MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL, DES PLAINES,
ILLINOIS, HELD IN THE COUNCIL •
ROCM, CITY HALL, APRIL 18, 1955,
AT 8:00 P.M.
CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer who presided
with Alderman Hansen, Schubert, Wolf, Schallawitz, Behrel, Harm, Auck, Prickett, Dahl,
Blume, Davis and McKay responding to roll call.
APPROVAL OF MINUTES. The motion was made by Alderman Auck and seconded by Blume to
approve the minutes of April 4 and the adjourned meeting of Aril 11, 1955. The
motion was voted upon by acclamation and the Mayor declared the motion carried.
OFFICIAL REPORTS. The Clerk submitted the report of Chief of Police Wigham for 1954
of list of complaints and arrests.
Alderman Behrel reported of attending County zoning hearing at Mt. Prospect.
That in a new subdivision storm water would drain into Weller Creek. On motion by
Alderman Behrel and seconded by McKay the Clark was instructed to write a letter
protesting. It was then decided the Mayor make a phone call to the Mt. Prospect
Village Hall. On motion by Alderman Behrel and seconded by Dahl the Clerk'was
instructed to write a letter of protest to the County Zoning Board regarding the
rezoning to Commercial for a service station on the southwest corner of Algonquin
and Mt. Prospect Roads including the objection of septic tank.
Alderman Dahl reported of County Zoning hearing in City Hall, April 29,
and Alderman Behrel is to attend.
APPROVE PETERSON'S SUBDIVISION. Alderman Dahl made the motion iahich was seconded by
Prickett that the Mayor and Clerk be authorized to sign the Peterson Plat after
deposit of sufficient funds in escrow for street,sidewaik, water and sewer improve-
ments, or the deposit of a performance bond to cover said improvements or after
completion of these improvements. The motion was voted upon br acclamation and the
Mayor declared the motion carried.
PETITION TO ANNEX SOUTHWEST CORNER IEE & HOWARD DEFERRED TO NEW COUNCIL. On motion
by Alderman Dahl and seconded by Auck the Lee and Howard Streets annexation was
deferred for new Council.
FIRECCOMMISSIONERS TO CERTIFY A NEW FIREMAN. On motion by Alderman Davis and seconded
by Auck the Council instructed the Police and Fire Commissioners to certify another
fireman to fill vacancy due to David Wolf being called to military service. •
Alderman Tures appeared at this time.
BIDS TO BE ADVERTISED FOR EXCAVATING AND CONCRETE WORK ON NEW FIRE STATION. On motion
by Alderman Davis and seconded by Auck the Council approved that bids be advertised
to be returned at the May 16, 1955 meeting for excavating and concrete work on new
fire station.
CONTRACT WITH SISTERS OF THE HOLY FAMILY OF NAZARETH FOR EXTENSION OF WATER SERVICE.
The contract for extension of water service having been on file in City Clerk's office
seven days, the motion was made by Alderman McKay and seconded by Behrel that the
Mayor and Clerk be authorized to execute same. The Mayor put the question and the
Clerk called the roll with the following result: Ayes: Alderman Hansen, Schubert,
Wolf,Tures, Schallawitz, Behrel, Harm, Auck, Prickett, Dahl, Blume, Davis and McKay.
Nays: None. The Mayor declared the motion carried.
APPROVAL OF BILLS. Total $53,603.86. Alderman Behrel presented the following
resolution:
BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF DES PLAINES, THAT
THE FOLLOWING BILLS ARE DUE AND
PAYABLE AND THAT THE MAYOR AND
CITY CLERK BE AND HEREBY AUTHOR=
IZED TO MAKE PAYMENT FOR SAME.
(A schedule of bills placed before each Alderman and affixed to resolution and on
file with City Clerk.) The motion was made by Alderman Behrel and seconded by Blume
to adopt the resolution. The Mayor put the question and the Clerk called the roll
with the following result: Ayes: Alderman Hansen, Schubert, 'Wolf, Tures, Schallawitz,
Behrel, Harm, Auck,Prickett,Dahl, Blume,Davis and McKay. Nays: None. The Mayor
declared the motion carried.

Alderman Dahl presented copies of a City Manager ordinance to the Council
and at his request the Mayor referred same to the Council as a Committee of the Whole.
CITY TREASURER'S LETTER ON SPECIAL ASSESSMENT REFUND. The Clerk read the following
letter:
Gentlemen:
RE: Petition of Wm. G. Kraemer for a refund of Special Assessment payment.
Kindly authorize the City Treasurer to re-imburse Wm. G. Kraemer for double
payment of Special Assessment 99, Installments 1 thru 10 inclusive, amounting to
$361.03, paid to this office March 14, 1955 in error.
This Special Assessment was paid in 10 yearly installments from April 30,
1926 thru Dec. 18, 1934, when it was due.
When these payments were re -instated by a Court Order of June 30, 1932,
this part of Special Assessment 99 was transferred to another book. However the
payments were not transferred but left open. For that reason, this man's property
asp was listed twice, once as paid, the second time as not paid. The payments should
have been transferred at the time the records were changed in 1932. As this
of happened before the present administration, there is nothing to do but refund
et Mr. Kraemer his second payments and stamp both books in the City Treasurer's office

paid so the error cannot happen again.

The motion was made by Alderman Behrel and seconded by Schubert to approve the
refund. The Mayor put the question and the Clerk called the roll with the follow-
ing result: Ayes: Alderman Hansen, Schubert, Wolf, Tures, Schallawitz, Behrel, Harm,
Auck, Prickett, Dahl, Blume, Davis and McKay. Nays: None. The Mayor declared the
motion carried.
HERZOG REZONING ORDINANCE NORTHWEST CORNER WOLF AND SEEGERS ROADS. The Clerk read
for second reading the rezoning ordinance of Herzog at Northwest corner Wolf and
Seegers Roads. The motion was made by Alderman McKay and seconded by Hansen to adopt
the ordinance. After it was found the ordinance did not include the entire property
the motion and second were withdrawn. On motion by Alderman Wolf and seconded by
Behrel the Attorney was instructed to draft a new ordinance to include all the
property.
COUNCIL VOTE NOT TO ADOPT ORDINANCE ON REZONING LOT 16, IN BLOCK 4,HOMELAND ACRES.
The Clerk read for secondcreading the ordinance to rezone to Commercial Lot 16,
Block 4, Homeland Acres. The motion was made by Alderman Dahl and seconded by Auck
to adopt the ordinance. The motion was then made by Alderman Schallawitz and second-
ed by Wolf to table the ordinance. The Mayor put the question and the Clerk called
the roll with the following result: Ayes: Alderman Wolf: Nays: Alderman Hansen,
Schubert, Tures, Behrel, Harm, Auck, Prickett, Dahl, Blume, Davis and McKay. The
Mayor declared the motion lost. The Mayor then put the question on the previous
motion and the Clerk called the roll with the following result: Ayes: Alderman
Tures, Harm and Davis. Nays: Alderman Hansen, Schubert, Wolf, Schallawitz, Behrel,
Auck, Prickett, Dahl, Blume and McKay. The Mayor declared the motion lost.

ADOPT ORDINANCE REZONING 35 ACRES SOUTH OF OAKTON STREP;T FROM WOLF ROAD TO BELTLINE
RAILROAD. The Clerk read for second reading the ordinance to rezone land for Butler
Brothers. The motion was made by Alderman Behrel and seconded by Prickett to adopt i4,116 -
the ordinance. The Mayor put the question and the Clerk called the roll with the
following result: Ayes: Alderman Hansen, Schubert, Wolf, Tures, Behrel, Harm, Auck,
Prickett, Dahl, Blume, Davis and McKay. Nays: Alderman Schallawitz„ The Mayor
declared the motion carried.
ADOPT ANNEXATION OF BUTLER BROTHERS PROPERTY. The Clerk read for second reading the
annexation ordinance of Butler Brothers property (Oakton to Howard Street, Wolf Road
to Belt Line Railroad and Lot 16 in Homeland Acres.) The motion was made by Alderman
Auck and seconded by Prickett toadopt the ordinance. The Mayor put the question and
the Clerk called the roll with the following result: Ayes: Alderman Hansen, Schubert,
Tures, Behrel,Harm, Auck, Prickett, Dahl, Blume, Davis and McKay. Nays: Alderman
Wolf and Schallawitz. The Mayor declared the motion carried.

FIRST READING ORDINANCE ENACTING THE FIRST FIVE CHAPTERS OF T CITY CODE. The
Clerk read for first reading the ordinance on the first five chapters of the City
Code. The Mayor ordered the ordinance placed on file for second reading.
PLAN COMMISSION LETTER ON EDGEBROOK PLACE. The Clerk read the
Plan Commission:
Gentlemen:

RE: ASHLAND AVENUE TO EDGEBROOK PLACE
Your PLAN COMMISSION recommends that Ashland Avenue, from the west edge of -
the forest preserve to Rand Road be changed to Edgebrook Place. The reason for this
change is that the new subdivision ""Edgebrook" has one street which enters into the
subdivision which is called Edgebrook Place.
We feel it would cause confusion to have this short section of Ashland Avenue
as it does not connect with the original Ashland Avenue.

FIRST READING OF ORDINANCE ON CITY PLAN. The Clerk read for first reading the
ordinance on City Plan. The motion was made by Alderman Schubert and seconded by
Wolf the ordinance be referred to Municipal Development Committee for further study.
The motion was made by Alderman Dahl to amend the motion which was seconded by
Prickett to refer to the Council as a Committee of the Whole. The Mayor put the
question and the Clerk called the roll with the following result: byes: Alderman
Hansen, Wolf, Schallawitz, Auck, Prickett, Dahl and McKay. Nays: Alderman Schubert,
Tures, Behrel, Harm, Blume and Davis. The Mayor declared the motion carried. The
Mayor then put the question on the previous motion and the Clerk called the roll with
the following result: Ayes: Alderman Hansen, Schubert, Wolf, Tures, Schallawitz,
Behrel, Harm, Auck, Prickett, Dahl, Blume, Davis and McKay. Nays: None. The Mayor
declared the motion carried.
G. W. LINDSTROM LETTER REQUEST FOR WATER FOR SUBDIVISION. The Clerk read a letter
requesting the City to furnish water to a subdivision east of Maine High School. The
Mayor'referred the letter to the Water Committee.
PLAT OF EDGEBROOK SUBDIVISION. The Clerk submitted a plat which had been approved by
the Plan Commission. The motion was made by Alderman Davis and seconded by Prickett to
approve the plat. After discussion on septic tanks the motion and second were with-
drawn. The plat to be held over for next meeting.
The Clerk reported of complaints of parking of oil truck and other trucks on
Cora Street near Oakwood Avenue. The Mayor referred the item to Chief of Police.
The Mayor also referred to the Chief of Police, on request of Alderman Schubert and
Blume, about use of residence for sale of dwellings at Miner and Mason Lane, also
1516 Lincoln Avenue.
The Council, on motion by Alderman Prickett and seconded by Behrel, voted to
commend Alderman Dahl for his services as a member of the City Council. The Mayor
thanked Alderman Dahl for his cooperation and work on the committees. The Mayor
requested the Clerk to record his aye vote.
ALDERMAN DAHL'S RESIGNATION. Alderman Dahl read the following:
Gentlemen:
It is with deep regret that I hereby submit my resignation
of the City of Des Plaines.
from the City Council
I am purchasing a new home at 1070 Margret Avenue, which is in the Third Ward,
and am in the process.of moving into this home from my present home in the Sixth Ward
at 2094 Cedar Street. I expect to be moved completely by May 1, so please consider
this resignation effective as of that date.

I earnestly urge the Council to declare a vacancy in the Sixth Ward as soon as
possible and to expedite steps to fill that vacancy so the residents of the Ward
may have full representation. I suggest that the steps necessary to fill the vacancy
be taken quickly so that a special election in the Ward can be held in conjunction
with the first general referendum.
I am sincerely sorry to relinquish my post as alderman f or I have enjoyed
associating with you and working with you on the many problems that have confronted
us. I feel confident that you as City Officials will continue in the future to
maintain the high standards of government that we strived for together in the past,
and I want to wish all of you success and good luck.

CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer with Alder-
man Schubert, Hansen, Wolf, Tures, Schallawitz, Behrel, Prickett, Auck, Blume,
McKay and Davis responding to roll call. Alderman Harm was absent.
APPROVAL OF MINUTES. The motion was made by Alderman Auck and seconded by Hansen to
approve the minutes of April 18, 1955. The motion was voted upon by acclamation and
the Mayor declared the motion carried.
OFFICIAL REPORTS. The Clerk submitted the report of Building Commissioner Rieck for
April.
APPROVE EDGEBROOK PLAT. Alderman Prickett reported the Edgebrook Plat had been
referred to the Municipal Development Committee and the Committee recommended approval
of plat. The motion was made by Alderman Prickett and seconded by Behrel to approve
the plat and the Mayor and City Clerk be authorized to execute same after a deposit
or. performance bond is placed in escrow. The Mayor put the question and the Clerk
called the roll with the following result: Ayes: Alderman Hansen, Schubert, Wolf,
Tures, Schallawitz, Behrel, Prickett, Auck, Blume, McKay and Davis. Nays: None.
The Mayor declared the motion carried.
ALDERMAN BEHRE L ON COUNTY ZONING. Alderman Behrel reported on three County Zoning
hearings. Alderman Behrel recommended that the Council should object to a rezoning
from Farming to Business for stores and extension of a traler park on Scott Street
south of Central Avenue. On motion by Alderman Behrel and seconded by Schubert the
Council approved that the Clerk write a letter protesting this rezoning.
Alderman Auck, Chairman of the Police Committee, said he wished to thank the
Police Department for their fine cooperation during his term of office.
Alderman Blume, Chairman of the Sewer Committee, reported his Committee had met
with the new and old aldermen to inform them of what had been done to date in regard
the flood relief sewer.
