04/11/1955234 0 ADJOURNED MEETING OF THE CITY COUNCIL, DES PLAINES, ILLINOIS, HELD IN THE COUNCIL ROOM, CITY HALL, MONDAY, APRIL 11, 1955 AT 8:00 P.M. CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer who presided with Alderman Hansen, Schubert, Tures, Schallawitz, Harm, Behrel, Auck, Prickett, Dahl, Blume, McKay and Davis responding to roll call. LONSINGER PLAT APPROVED. The motion was made by Alderman Dahl and seconded by Hansen to approve the Lonsinger Subdivision, a plat of four lots, and that the Mayor and Clerk be authorized to sign same after fund for paving street is placed in escrow and a performance bond is received. The motion was voted upon by acclamation and the Mayor declared the motion carried. Alderman Wolf appeared at this time. BUTLER BROTHERS LETTERS. Alderman Dahl read the following two letters: Gentlemen: Delivered with this letter is Butler Brothers check in the amount of $5,000.00. This check is delivered in connection with the application by this Company for the annexation of approximately seventy acrea of land contiguous to the City of Des Plaines, a portion of which the company expects to use immediately for the construc- tion of a warehouse and office. The City Council has under consideration afpetition to rezone approximately one-half of this acreage (being the North one-half), lying Southwest of the inter- sdction of Oakton & Wolf Streets, and it is on this North one-half that Butler Brothers building will be constructed. It is estimated that the building and appurtenances will actually use a little over twelve acres. We have been informed that it is customary, under you Ordinances, to collect, upon annexation, a fee equivalent to $400.00 per acre for the land, which will actually be used upon annexation. We have, therefore, delivered our check in the amount of $5,000, which assumes the use as above specified. It is altogether possible that final plans, as approved by the City Engineer and our engineers, will require a sewer extension of some four or five thousand feet. It this is necessary, it will be undertaken without cost or expense to the City of Des Plaines. Edwin 0. Wack (Signed) Gentlemen: We have addressed a letter to you of even date and delivered thgrewith our check in the amount of $5,000.00, covering annexation fee in connection with the annexation of some seventy acrea lying to the Southwest of the intereection of Wolf & Oakton Streets, adjacent to the City of Des Plaines. The basis for this fee and our under- standing with respect thereto have been spelled out in that letter. In connection with the approximately thirty-five acres lying in the'South one-half of the seventy acre tract, which have not been rezoned at this time, we are willing to undertake as follows: If and when this additional thirty-five acre tract is put to use either by Butler Brothers or some subsequent owner and user, it is understood that upon hooking on to City of Des Plaines water and/or sewer lystems that such lands, as used, will be subject to a payment equal to $400.00 per acre; and Butler Brothers further agrees that if the land is resold, this obligation will be a con- dition of the sale. Wack (Signed) On motion by Alderman Dahl and seconded by Hansen the Council voted to place the letters and check on file in City Clerk's office until the annexation ordinance has been considered. Alderman Prickett reported the Building Permit Committee investigated the Building Permit Fee ordinance and they recommended that an amendment be drawn changing the ordinance as follows: A fee of .150.00 per dwelling plus $3.00 per $1,000 valu- ation. On motion by Alderman Prickett and seconded by Behrel the Council concurred in the report. 1 20'5 4-11-55 V. F. W. GRANTED PERMISSION TO HOLD CARNIVAL. The motion was made by Alderman Hansen and seconded by Tures to grant permission to the Veterans of Foreign Wars to hold their carnival at Maple and Oakton Streets. After discussion and after request of Alderman Blume that the people be allowed to speak voicing their objections which was objected to by Alderman Harm, the Mayor put the question and the Clerk called the roll with the following result: Ayes: Alderman Hansen, Wolf, Tures, Schalla- witz, Behrel, Harm, Auck, Prickett,&Dahl. Nays: Aldermen Schubert, Blume, Davis and McKay. The Mayor declared the motion carried. On motion by Alderman Davis and seconded by Hansen the Attorney is to be instructed to draft anj.ordinance for paid on call firemen. BUTLER BROTHERS REZONING LOT 16 BLOCK 4 IN HOMELAND ACRES. The Clerk read the Zoning Boards recommendation to zone Lot 16, Blobk 4, Homeland Acres (Northwest corner Oakton and Wolf Road) to Commercial. Alderman Schallawitz made the motion to table same. Motion was lost for want of a second. The motion was made by Alderman Schubert and seconded by Behrel to concur in the recommendation. The Mayor put the question and the Clerk called the roll with the following result: Ayes: Alderman Hansen, Schubert, Wolf, Tures, Behrel, Harm, Auck, Prickett, Dahl, Blume and Davis. Nays: Alderman L7 Schallawitz,and McKay. The Mayor declared the motion carried. O FIRST READING ZONING ORDINANCE ON LCT 16, BLOCK 4, HOMELAND ACRES. The Clerk read for first reading the zoning ordinance on Lot 16, Block 4, Homeland Acres. The Mayor Q ordered the ordinance placed on file for second reading. BUTLER BROTHERS ZONING. The Clerk read the Zoning Board recommendation to zone the Southwest corner of Oakton and Wolf Roads to Commercial. Alderman Schallawitz's motion to table the report was lost for want of a second. The motion was made by Alderman Behrel and seconded by Auck to concur in the report. The Mayor put the question and the Clerk called the roll with the following result: Ayes: Alderman Hansen, Schubert, 'Wolf, Tures, Behrel, Harm, Auck, Prickett, Dahl, Blume, and Davis. Nays: Alderman Schallawitz and McKay. The Mayor declared the motion carried. FIRST READING OF ZONING ORDINANCE BUTLER BROTHERS. The Clerk read for first reading the zoning ordinance the southwest corner Oakton and Wolf Road. The Mayor ordered the ordinance placed on file for second reading. BUTLER BROTHERS ZONING WOLF AND HOWARD. The Clerk read the Zoning Board recommendation rejecting the zoning of Butler Brothers on the northwest corner of Howard and Wolf Road. On motion by Alderman Dahl and seconded by Behrel the Council concurred in the report. 1 FIRST READING ORDINANCE TO ANNEX THE LAND INVOLVED IN ABOVE REZONING REPORTS. The Clerk informed the Council he had petitions for annexation of above land in above zoning reports. The Clerk then read for first reading the annexation ordinance. The Mayor ordered the ordinance placed on file for second reading. ADJOURNMENT. The motion was made by Alderman Hansen and seconded by Harm to adjourn.
