The Mayor ordered the ordinance placed on file for second reading. FIRST READING JOE DIV ITO ANNEXATION ORDINANCE. The Clerk read for first reading the Divito annexation ordinance of part of Lot 4 in Kruse's'Subdivision. The Mayor ordered the ordinance placed on file for second reading. II Superintendent Warnicke informed the Council that the pump on heating system at garage had to be replaced and the cost would be $105.00. The motion was then made by Alderman Davis and seconded by Schallawitz to allow Superintendent Warnicke to purchase pump at a cost of $105.00. The Mayor put the question and the Clerk called the roll with the following result: Ayes: Alderman Hansen, Schubert, Tures, Schallawitz, Behrel, Harm, Prickett, Blume, Davis and McKay. H City Clerk by Tures to adjourn. the motion carried. ich MINUTES OF THE REGULAR MEETING OF THE CITY COUNC'IL, DES PLAINES, ILLINOIS, HELD IN THE COUNCIL ROOM, CITY HALL, NOVEMBER 1, 1954. AT 8:00 P.M. CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer who presided with Alderman Hansen, Schubert, Wolf, Tures, Schallawitz, Behrel, Harm, Auck, Dahl, Blume, Davis and McKay responding to roll call. Alderman Prickgtt was absent. APPROVAL OF MINUTES. The motion was made by Alderman Auck and sconded by Hansen to approve the minutes of October 18, 1954. The motion was voted upon by acclamation and the Mayor declared the motion carried. OFFICIAL REPORTS. The Clerk submitted his report of receipts and disbursements for the first nine months of 1954 and the Building Commissioner's rIport for October. City Engineer Fletcher recommended the City Attorney draw up a contract for the purchase of certain lands to straighten Graceland Avenue at First Avenue. The Mayor instructed the attorney to draft the contract. Alderman Dahl reported that the rezoning application of Mr. Burgess on Golf and Mt. Prospect Road was being held up due to the boundary resolution with Mt. Prospect. On motion by Alderman Dahl and seconded by Schubert the City Attorney was instructed to draft a new resolution specifying the boundary lines. On motion by Alderman Dahl and seconded by Auck the Council voted to refer a revised light industrial zoning ordinance to the Zoning Board of Appeals sitting as a Commission to call a hearing. APPROVE HERZOG FIFTH ADDITION SUBDIVISION. On motion by Alderman Dahl and seconded by Wolf the Council approved the plat of Herzog's Fifth Addition and authorized the Mayor and Clerk to sign the plat. DENY APPLICATION OF ANNEXATION OF TWO LOTS ON CEDAR STREET NEAR TOUHY. Alderman Dahl reported that the Municipal Development Committee recommended to deny the annexation of two lots on Cedar Street north of Touhy. On motion by Alderman Dahl and seconded by Behrel the report was concurred in. Attorney to draft ordinance annexation of Seeger's property on Northwest Highway and Mt. Prospect Road. Alderman Dahl reported the following: We, your Committee on Municipal Development recommenc that the territory be annexed subject to conditions hereinafter stated and that the attorney be instructed to draw the proper ordinance for Council consideration. The con ition upon which this recommendation is made is that the petitioners present evidence to the, Council before the ordinance is considered4 that there has been deposited in escrow $17,800 to be paid to the Board of Education District 62 at the rate of $100 per lot as sold. After discussion the Mayor put the question and the Clerk called the roll with the following result: Ayes: Alderman Hansen, Schubert, Tures, Schallawitz, Behrel, Harm, Auck, Dahl, Davis. Nays: Alderman Wolf, Blume, and McKay. The Mayor declared the motion carried. Alderman Behrel reported he attended the Couty rezoning meeting in City Hall and filed objection for the City according to Council vote at the October 18, 1954 meeting, on the rezoning application on Touhy near Cedar Street. The Mayor instructed the Clerk write letters to the Couty Clerk, with copies to Popjoy and A. A. Levisohn, attorney for petitioning rezoning. Alderman Behrel reported that the rezoning on Milwaukee Avenue was outside the City jurisdiction but thought there would not be any objection. SIDEWALK ORDINANCE TO BE CORRECTED. On motion by Alderman Hansen and seconded by Schubert the Council instructed the City Attorney to correct the sidewalk ordinance. ARCHITECT CONTRACT FOR FIRE STATION. Alderman Davis reported about architect contract for Mr. Chamales for new fire station. On motion by Alderman Davis and seconded by LCD Hansen the Council approved that the Mayor and Clerk sign the architect contract with c Mr. Chamales with a fee of six per cent when approved by City Attorney and placed on 1.0 file in City Clerk's office seven days. d Alderman Behrel reported a school patrol woman had been placed at Center and Algonquin. APPROVAL OF BILLS. Alderman Behrel presented the following resolution of bills with a total of $3,148.83: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE I)UE AND PAYABLE AND THAT THE MAYOR AND CITY CIERK BE AND HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. The Clerk was instructed to send a copy of letter to the Izaak Walton League. ADOPT REZONING ORDINANCE AT -1167 ALGONQUIN ROAD. The Clerk read for second reading a rezoning ordinance on land at 1167 Algonquin Road from Residential to Commercial. The motion was made by Alderman Tures and seconded by Schallawitz to adopt the ordinance. The Mayor put the question and the Clerk called the roll with the following result: Ayes: Alderman Hansen, Schubert, Wolf, Tures, Schallawitz, Behrel, Harm, Auck, Dahl, Blume, Davis and McKay. Nays: None. The Mayor declared the motion carried. ADOPT ORDINANCE INCREASING WATER DEPOSITS TO $10,00 AND CHANGING THE DISCOUNT TO A PENALTY ON WATER BILLS. The Clerk read for second reading the following proposed ordinance entitled: AN ORDINANCE TO AMEND CHAPTER 30 RELATING TO WATER, OF THE MUNICIPAL CODE OF THE CITY OF DES .PLAINES AS HERETOFORE AMENDED The motion was made by Alderman Tures and seconded by Schallawitz to adopt the ordinance. Nays: None. The Mayor declared the motion carried. FIRST READING ORDINANCE TO CHANGE WARRINGTON ROAD TO CAMBRIDGE ROAD IN CUMBERLAND. The Clerk read for first reading the ordinance to change Warrington Road to Cambridge f% Road in Cumberland. The Mayor instructed the Clerk to place the ordinance on file for second reading. SANITARY DISTRICT SEWER PERMIT NO. 1954 -151. The Clerk informed the Council he had a Sewer Permit from Sanitary District for sewer extension in Herzog's Fourth Addition. On motion by Alderman Hansen and seconded by Davis the Mayor and Clerk were authorized to sign the permit. STATE HIGHWAY PERMIT NO. 10-12468. The Clerk informed the Council he had a permit from State Highway Department to construct a street at entrance on Oakton at Fifth Avenue. On motion by Alderman Behrel and seoonded by Blume the Mayor and Clerk were authorized to sign the permit. REQUEST FOR PERMISSION FOR PORTABIE FLASHER ON ALGONQUIN ROAD AND FIFTH AVENUE. The Clerk read the following letter: Dear Mayor Meyer: At the request of some fifty parents of the Algonquin Parent Teacher Associa- tion study group, I am writing to you for an answer to a question. The question is this: Is it'legal and permissable for a portable flasher light to be used on Algonquin Road as an assist to the crossing guard employed by our city at Fifth Avenue and Algonquin Road?. If they are permitted to do so, these parents propose to purchase a portable flasher and store it at the school when not in use. The Clerk read two letters from the State Director of Health about permits for the Air View Trailer Coach Park on Rt. 2 Box 520 and Rand Manor Trailer Park. The City Attorney is to check if the City can protest ori Trailer Park permits and the Clerk was instructed to write to the Director that the City Council is objecting to the Parks. Alderman Schubert requested the Street Committee investigate regarding water on sidewalk on north side of Miner Street at General Box Company. On motion by Alderman McKay and seconded by Schubert the City Attorney was instructed to draft an ordinance prohibiting septic tanks, if legal. On request of Alderman Auck the City Clerk was instructed to write to Mr. Tuthill requesting a traffic count at Lee and Thacker for traffic lights or four-way stop. SHAGBARK LAKE MANOR. The Clerk informed the Council he had a plat of Shagbark Lake Manor which was approved by the Plan Commission. The Mayor referred the plat to the Municipal Development Committee. CANVASS BALLOTS ON OCTOBER 23. 1954 ELECTION ON FIRE STATION ETC. On motion by Alderman Schallawitz and seconded by Behrel the Council approves} that the ballots for the October 23, 1954 election on fire station, etc., be canIassed and that the Mayor appoint a committee for that purpose. The Mayor appointed Alderman Schubert, Wolf and Davis. The Mayor declared a recess for the canvass and informed the Municipal Development Committee to study the Shagbark Lake Manor plat during the recess. After the Council reconvened the motion was made by Alderman Davis and seconded by Schubert be it resolved that the results of the special election held on October 23, 1954, shall be and they are hereby declared to be as follows: 11-1-54 CANVASS BALLOTS ON FIRE STATION ELECTION (Cont'dl) Shall bonds in the amount of $77.000 be issued by the City of Des Plaines, Cook County, Illinois for the purpose of paying the cost of acquiring the land and construction of a new Fire Station Building on the South side of the City, maturing ser- YES 919 ially $8,000 on December 1st of each of the years of 1957 to 1965 inclusive and $5,000 on December lst,1966 bearing inter- NO 49 est from date of issuance at a rate of interest not to exceed 3 per annum. Alderman Dahl reported that the Municipal Development Committee decided to call a meeting for next Monday on the Shagbark Lake Manor Plat. Mr. Berry told the Council they intended to start to install water mains the next day. On motion by Alderman Tures and seconded by Schallawitz the Council recessed again to study the plat. Attorney Howard informed the Council that the Supreme Court had ruled that. it is discriminatory to adopt such an ordinance for one area. The motion was withdrawn by Alderman Dahl. ADJOURNMENT.
