(CONT' D. ) Personally, I think the first project on this plan should be the widening of Thacker Street and the construction of a storm sewer starting from River Road and thus pro- ceeding westerly. How far the first stage of this improvement can go depends upon the gas ax monies that are available for this purpose. Algonquin Road is in a bad state of repairs and needs widening and im- proving. I know there is opposition to widening Algonquin Road, but I do believe that once Algonquin Road was widened and improved, the property owners would realize that their property would be increased in value thereby. We have strong hopes of having State Highway #62 re-routed to Oakton Street and thus remove some of the traffic from Algonquin Rohl. Same progress otos made during 1953 toward eliminating or reducing the traffic hazard on Northwest Highway at the Belt Line Viaduct and I hope something more constructive can be accomplished on this question in 1954. The many problems which face us and which will be of ultimate benefit to the City twill require shore time on the part of each Alderman on the various matters assigned to them.fof study and report, for it is only by strong, collective operations that these important projedts can come to a final conclusion for the benefit of the City. In conclusion, it is my opinion that we can be proud of what has been accomplished during the past year, and if we can complete the projects on our schedule for 1954, you will have rendered a valuable service to the citizens of Des Plaines. The meeting was called to order by Mayor Kenneth G. Meyer who presided with Alderman Hansen, Schubert, Wolf, Tures, Schallawitz,,Behrel, Harm, Auck, Prickett, Dahl, Blume, Davis and McKay. APPROVAL OF MINUTES. The motion was made by Alderman Auck and seconded by Behrel to approve the minutes of January. 4, 1954. Alderman Auck requested to include the amount of Benjamin Electric Fire Contract of $1,000.00 per year and Protective Coating Corporation Fire Contract of .002 of the total value of the property determined by fire insurance value. Alderman McKay requested to include "on judgement of awards" on purchase of parking lots. Alderman Wolf requested that the following item be included: '"The Mayor appointed Alder Jacobs to investigate the Library regarding their appropriations." The motion was then voted upon by acclama- tion whereupon the Mayor declared the motion carried. 1 121 1-18-54 OFFICIAL REPORTS. The Clerk submitted the reports of Treasurer, City Clerk, Acting Building Commissioner, and the Nurse and Welfare Association for December 1953. Also the annual reports of Marshall Kolze and Marshall Wigham. The Clerk read the report of Marshall Kolze regarding the condition of property in the rear of Jordan Mfg. Company and suggestion that the cyclone fence be removed in order that fire trucks would be able to drive through. The Mayor referred the matter to the Bublic Building Committee with power to act. The. Clerk read the following report of City Attorney: Honorable Mayor and City Council City of Des Plaines Des Plaines, Illinois Gentlemen: January 18, 1954 Some time ago I was requested by the Council to draft an ordinance forbid- ding issuance of a business license to any person who did not have a building in which 1.0 to locate to sell merchandise. The idea was to prohibit the sale of merchandise either CD from a truck, automobile or from vacant commercial property. L7 It is my earnest and sincere opinion this is an invalid and illegal ordinance. No City has the right to prohibit conduct of a lawful business for the sole reason it is not carried on in a building. Peddling, and similar occupation, can be regulated and licensed, but I do not believe they can be prohibited. If it is still your desire that we risk the charge of illegality, I will proceed to draft the best ordinance that I can under the circumstances. Knocke, Chairman of the Plan Commission, regarding the renaming of Cumberland Parkway and Warrington Road in Cumberland. The Mayor requested the Street Committee to meet with the Plan Commission January 28, 1954. The Clerk read a letter from E. Knocke, Chairman of the Plan Commission recommending that the City Council notify the Park District regarding the Herzog Subdivision No. 3, having Lots 15 and 16 in Block 4 set aside as a park and recreational site. The Clerk was instructed to write to the Park District on motion by Alderman Dahl and seconded by Schubert. ZONING BOARD RECOMMENDATION TO REZONMAT 21 W. GOLF RD. The Clerk read the report of Zoning Board of Appeals recommending the rezoning of lot a 21 W. Golf Road to Commercial. The motion was made by Alderman Dahl and seconded by Schubert to concur in the report and the City Attorney draft an ordinance. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. Alderman Dahl reported on two county zoning notices and said the Committee found no objections. Alderman Dahl reported on Bell Telephone franchize. On motion by Alderman Dahl and seconded by McKay the Council voted to allow the Municipal Development Committee to negotiate for a franchise for a term of five years. Alderman Wolf requested the Attorney to draw up a lease with Engineering Appliance Company for the land in rear of Jordan Mfg. Company for $100.00 per year. Alderman Harm, Chairman of the License Committee, reported the following: The license committee met on Wednesday, Jan. 6, to consider request of Bersal's Dining Room, who were represented by Mr. F. E. Passarelli. The Mayor and nine Aldermen were present. After due consideration the license committee recommends: The creation of a new classifidation to permit the sale of alcoholic beverages to patrons while being served meals by restaurants which have no counter or counter stools and which have a serving capacity of 75 or more at tables. Limitation of one to this classification and annual fee to be $800.00. Alderman Hansen reported that some of the sidewalks had been constructed on Algonquin Road in Minilow Subdivision. The Mayor referred the "Fire Department Creation" to the Fire Protection Committee. On motion by Alderman Schubert and seconded by Hansen the Parking Meter Committee was given authority to install six (6) one hour meters on north side of Pr&irie Avenue east of Pearson. Alderman Behrel reported the following on request of H. Thal for Quit Claim Deed for all four lots 8,9,10 and 11 on payment of $100.00 each for lots 8,9 and 10 or a total of $300.00. On motion by Alderman Behrel and seconded by Blume the report was concurred in. APPROVAL OF BILLS. Alderman Behrel presented the following proposed resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILIS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND HEREBY AUTHORIZED TO MAKE PAY- MENT FOR SAME. (A schedule of bills placed before each Alderman and affixed to resolution and one file with the City Clerk.) The motion was made by Alderman Behrel and seconded by Schubert to adopt the resolution. Alderman Wolf requested two bills of Tower Oil Company, $89.76 and Des Plaines Tire and Battery Service, $20.95 be withdrawn. The Mayor put the question and the Clerk called the roll with the following result: Ayes: Alderman Hansen, Schubert, Wolf, Tures, Schallawitz, Behrel, Harm, Auck, Prickett, Dahl, Blume, Davis and McKay. Henrich City Clerk Des Plaines, Illinois Dear Mr. henrich: In response to the resolution of the City Council of Des Plaines, dated December 21, 1953, relating to the abandonment of parking lanes along Lee Street, SBI Route 46 (U.S. 8oute 45), which was forwarded to this office by Mr. J. P. Tuthill, District Engineer, Chicago, the action described below has been taken. Effective January 15, 1954, the Sate of Illinois, Department of Public Works and Buildings, Division of Highways, releases to the City of Des .Plaines, Illinois, for the purpose of maintenance and traffic control the following des- cribed portions of Lee Street in said City, to wit: "A six-foot section including curbs, gutter, gutter inlets, and all appurtenances which may have been constructed or are being maintained by the State of Illinois, and which are located along the curbs as aforesaid, between the northerly line of Thacker Street and the southerly line of Prairie Avenue in the City of Des Plaines, Illinois, County of Cook, and State of Illinois." Rosenstone Director January 6, 1954 To the Mayor and City Council of the City of Des Plaines Des Plaines, Illinois Gentlemen: 123 In compliance with the Ordinance relating to the Upper Des Plaines Intercepting Dever, Contracts Nos. 11-A and 11-B, dated December 11, 1952, under Section Three (3) thereof, The Sanitary District of Chicago is hereby notifying the City of Des Plaines that the Intercepting Sewer is now completed and the area served by the Pumping Station is now connected into the aforesaid Intercepting Sewer. In consequence thereof, the Sanitary District ceased operating said Pumping Station on December 31, 1953, and hereby notifies the City of Des Plaines that it is yielding and delivering to said City of Des Plaines for its use and operation thereafter the Pumping Station, manhole, and sewer structures adjacent to and northwest of the Pumping Station, and the equip- ment therein, the stone roadway, the cyclone fence around the site of the Unit Tank, and the landscaping, as it exists; all as specified in said Section Three (3) and as subject IIIto the conditions of Section Four (4) of said Ordinance. The Clerk read for first reading the following proposed ordinance entitled: AN ORDINANCE authOritiiig and providing for the issue of $61,000 Refunding Water Revenue Bonds of the City of Des Plaines, Cook County, Illinois, prescribing all the details of said bonds, and providing for the collection, segregation and distribution of the revenue of the waterworks system of said City for the purpose of paying the cost of the operation and maintenance thereof, and paying the prin- cipal and interest of said Refunding Water Revenue Bonds. The motion was made by Alderman Wolf and seconded by Auck that the ordinance be placed on file for public inspection in the office of the City Clerk fo a period of not less than seven days. Alderman Auck read a report of Mrs. Elsie Willer, Health Inspector, regarding wells and septic tanks in Oakton Gardens. Alderman Harm reported about a building having been moved to First and Walter Avenues and requested an investigation be made. The Mayor referred the item to the' Building Permit Committee. Alderman Dahl asked permission for a member of the National Guard to speak regarding the Governor's order which would eliminate the Guard in Des Plaines. On motion by Alderman Wolf and seconded by Hansen the Council voted that the Mayor write the Governor asking him to give further consideration in regard to withdrawing the National Guard from Des Plaines.
