On motion by Alderman Blume and second by Schallawitz, bids are
to be advertised for water main on Birch Street, S. A. No. 162, bids to be
in July 20, 1953 meeting.
Adjournment. The motion was made by Alderman Hansen and seconded
by Schallawitz to adjourn. The motion was voted upon by acclamation whereupon
the Mayor declared the motion carried and the meeting regularly adjourned.

CHAMBERS MONDAY, JULY 20, 1953,
AT 8:00 P. M.
LC) Call, to Order. The meeting was called to order by Mayor Kenneth G.
Mayer who presided with Alderman Hansen Schubert, Wolf, Tures Schallawitz,
•-r Jacobs, Behrel, Harm, Auck, Dahl, Blume, Davis and McKay responding to roll call.
Approval of Minutes. The motion was made by AldermanSchallawitz and
seconded by Behrel to approve the minutes of July 6, 1953. The motion was voted
upon by acclamation whereupon the Mayor declared the motion carried.
Reports of City Attorney. The City Clerk read the following reports:

Honorable Mayor and City Council, City of Des Plaines, Des Plaines, Illinois
Gentlemen:
This is to advise you of the present status on the acquisition of the
land for Parking Lot No. 2. You will recall that this property on Prairie
Avenue could not be acquired by negotiation. and that some time ago we filed
a suit in the Circuit Court of Cook County to condemn the land.
During the spring, there were two traverses filed by opposing
lawyers to this condemnation action. Without attempting to get into technical
detail, a traverse, in substance, challenges our legal right to proceed with
a condemnation suit and requires us to prove every single step and condition
required for condemnation.
Because of delaying tactics of the opposing attorneys and because of
the crowded conditions of Judge Normoyle's calendar, it took ten separate
appearances running from April 9th through July 8th to get the traverses set
for hearing and then heard and argued.
On July 8th, Judge Normoyle overruled the traverses deciding all
issues in favor of the City. Unfortunately, this does not conclude the
condemnation suit, but merely completes trial of legal issues. We must now
have a trial set before a jury to determine the value of the land.
Because of adjournment of the courts for summer vacation, I will not
be able to set this case for hearing before a jury until the fall.

Gentlemen:
This is to advise you of the current status of the suit against
Meyer Coal and Material Company seeking a mandatory injlton against this
company to halt operations of the ready -mix cement hopper nd accompanying
activities at the Meyer yard, because they are in violation of our zoning and
building ordinances:
This case was referred to Master -in -Chancery, last fall to take
evidence on the facts. Since that time we have had about 8 hearings before
the Master. Ori behalfof °.the .City, I have put •on 5 witnesses and have
introduced something'over 600 pages of evidence.
Two hearings were held in this matter this past leek before
Master -in -Chancery Sullivan in my attempt to conclude the City's proof
before the summer vacation. It turned out to be impossible to do, how-
ever, and the matter has now been continued until next. September, to be
taken up at that time when theattorneys for both sides are ready to
proceed. I will probably require another several hearings for introduction
of expert testimony as to real estate values and other things. After that,
the defendant has the opportunity to put on his witnesses and then we have
a rebuttal, if we choose to make it. I expect it will be the better part
of another year before the trial of this matter is completed.

. Alderman Dahl reported on County Zoning meeting in Des Plaines
City Hall, July 31, 1953, at 8:00 P.M. regarding property about mile
south of Higgins Road on Mannheim Road.
Alderman Harm reported that some of the business license had not
been paid and made the motion which was seconded by Jacobs that the names
be published in the local papers. Alderman McKay requeste a roll call.
The Mayor put the question and the Clerk called the roll with the
following result: Ayes: Alderman Hansen, Schubert, Wolf, Tures, Jacobs,
Behrel, harm, Auck, Dahl, Blume, Davis and McKay. Nays: Alderman
Schallawitz. The Mayor thereupon declared the motion carried.
Alderman Harm made the following report:
Packy's and National Tea Company
To the Mayor and City Council: regarding amending liqour ordinance.
Your Committee on Licenses has investigated the above and has met
with the above and finds that both requests are based on our increased
population since the establishment of Bulk Sales dealers license limits
and that the National Tea is only interested in bulk package sales of beer
for consumption off premises. The committee has examined present ordinances
and amendments and finds that limits imposed in 1941 are still the same.
Our population was then approximately 9 to 10 thousand and is now over
20 thousand. The cpntemplated locations will serve new outlying districts.
After due consideration we, your Committee on License and
Inspection, therefore recommend:
an amendment to present ordinance to provide an increase from three to four
in the limits with respect to Bulk -.Dealers Licenses and the creation of a
new Class B-2 classification under same heading permitting package sales
of beer only with a limit of one and with a fee.of.:$600.00

McKay to table the report The Mayor put the question

Alderman Tures reported that they have to purchase a new turbine for
Normal Well and that the Water Commissioner did not want to take the time to
advertise for bids 'The motion was made by Alderman Tures and seconded by Wolf
to purchase the turbine at the price of $1,360.00 from the Aurora Pump Company.
The Mayor put the question and the Clerk called the roll with the following
result: Ayes: Alderman Hansen, Schubert, Wolf, Tures, Schallawitz, Jacobs,
Behrel, Harm, Auck, Dahl, Blume, Davis and McKay. Nays: None. The Mayor
thereupon declared the motion carried.

Alderman Davis reported that the Council had turned down the insurance
regarding machinery and suggested it be investigated. The Mayor referred the
074 insurance to Finance and Water Committees.

Alderman Tures reported that Benjamin and Lang have been investigating
to see who were holding the 1934 Revenue Bonds a total of $65,000.00. The
motion was then made by Alderman Tures and seconded by Behrel to allow Benjamin
and Lang to negotiate regarding the purchase or exchanging of new bonds when
issued.
Alderman Dahl requested a report of the cause of water shortage in
reservoir. After considerable discussion the Mayor referred to the Water
Commission, Superintendent and City Engineer to check on the efficiency of
the employees at water plant.
Alderman Schubert reported on parking meters and parking time on Lee
Street from Prairie Avenue to Thacker Street. On motion by Alderman Schubert
and second, by Hansen the Council instructed the City Attorney to draft an
ordinance on meters and parking on Lee Street
On suggestion of Alderman Davis the Mayor referred to the Traffic
Commission the removal of meters and no parking on the east side of Lee
Street from Ellinwood Street south to alley.
Approval of Bills. Alderman Behrel presented the following proposed
resolution:
BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF DES PLAINES THAT THE
FOLLOWING BILLS ARE DUE AND PAYABLE
AND THAT THE MAYOR AND CITY CLERK
BE AND ARE HEREBY AUTHORIZED TO MAKE
PAYMENT FOR SAME.
(A schedule of bills placed before each Alderman and affixed to resolution and
on file with the City Clerk.)* Alderman Wolf requested that the bill of
Northwest Harley-Davidson for $64.95 be taken out for investigation and with
bill removed the Mayor put the question and the Clerk called the roll with
the following result: Ayes: Alderman Hansen, Schubert, Wolf, Tures,
Schallawitz, Jacobs, Behrel, Harm, Auck, Dahl, Blume, Davis and McKay.
Nays: None. The Mayor thereupon declared the motion carried.
The motion was made by Alderman Behrel and seconded by
Schallawitz to adopt the resolution.
Alderman Behrel 'reported that the gasoline bid which was approved in
1949 was to be for six months and suggested bids be on an annual basis.
Alderman Behrel then made the motion which was seconded by Jacobs to advertise
for bids to be returned for the August 3, 1953 meeting. The motion was voted
upon by acclamation whereupon the Mayor declared the motion carried.

State Highway Letter. The Clerk read the following letter:
July 15, 1953
Mr. Otto W. J. Henrich

Des Plaines, Illinois
Dear Sir:
I can now give you a partial reply to your letters of May 20 regarding
the. Councils request for speed reductions on several highways in your City.
Observations made on Wolf Road between Golf and Rand Roads showed
that 94 percent of the motorists were driving at or under the posted limit
of 30 M.P.H. We consider this excellent observance and feel that a
reduction to 25 MPH is warranted as 75 percent are operating at or under
this posting.
A survey was made on River Road between Howard and Touhy Avenue.
Here we found that only 51 percent were driving at or uncle;the 40 M.P.H.
posting. Until such time as observance is increased in tills area, we do
not feel that a reduction is warranted.
The final survey was made on Algonquin Road between Second Avenue
and Wolf Road. Our check showed that 72 percent of the motorists were driving
at or under 40 M.P.H. however we are willing to post a 35 P.P.H. limit in this
section and it will take a lot of enforcing by your police to obtain this
observance.
We will give you a report on conditions at Rand Road and Wolf just
as soon as our investigation has been completed.

On motion by Alderman Davis and second by Jacobs the Council approved that
the 25 mile per hour sign be taken down on Algonquin at Second Avenue.
The mayor referred the parking on both sides of Thacker Street
between Second and Third Avenues, also the parking on Thacker Street
between Pearson and Lee Streets on suggestions of Alderman Jacobs and Auck.

eement for annual maintenance of Street
. The Mayor referred
the agreement to the Street Commission and Engineer.
Herbert Volberding appointed as Police Patrolman. The Clerk informed
the Council Herbert Volberding was appointed police patrolman as of July 16, 1953..
Jannusch River Street Subdivision Plat. The Clerk reported he had a
plat approved by the Plan Commission. The Mayor referred the plat to the
Municipal Development Commission.
On motion by Alderman Tures and second by McKay the City Engineer
was instructed to prepare plans and specifications for water mains to Oakton
Gardens and Dexter Acres.
The Mayor reported that he met with some of the department officials
and it was suggested to divide the Street and Sanitation Committees into two
committees. On notion by Alderman Schubert and second by Schallawitz the
Council approved that the City Attorney draft an amending ¢rdinance changing
the Committees and the appointing of Alderman McKay,Chairman with Aldermen
Schubert and Schallawitz on. the Sanitation Committee.
On motion by Alderman Hansen and second by Blume the City Attorney
was instructed to draft a 30 day waiting period regarding Pale of taverns.
On motion by_Dahl and second by Jacobs the Council referred to the
Traffic commission the alley north of the circle in Cumberland which is from
Eighth Avenue to Cornell Avenue regarding making it a one 6y alley which
was suggested by Alderman Davis.

The item on purchase of purchase of turbine to change the wording to "did

motion was voted upon by acclamation whereupon the Mayor declared the motion

Reports of City Officials The Clerk submitted the reports of
Building Commissioner and City Clerk for July.
Alderman Dahl reported he was at City Hall to attend the County
Zoning hearing but found it had been posponed and the rezoning withdrawn.
But he had received no notice of posponement.
Approve Jannusch River Street Plat. Alderman Dahl reported that
the Municipal Development Committee found the Jannusch plat in order and
recommended the approval. The motion was made by Alderman Dahl and seconded
by Jacobs to concur in the recommendation. The Mayor put the question and
the Clerk called the roll with the following rusult: Ayes: Alderman Hansen,
Schubert, Wolf, Tures, Schallawitz, Jacobs, Behrel, Harm, Auck, Dahl, Blume,
Davis, and McKay. Nays: None. The Mayor thereupon declared the motion carried.
State agreement for Maintenance of City Streets Alderman Hansen
reported that the Street Committee had investigated the agreement. The
motion was made by Alderman Hansen and seconded by Dahl that the Mayor and
City Clerk be authorized to sign the agreement. The Mayor put the question
and the Clerk called the roll with the following result: Ayes: Alderman
Hansen, Schubert, Wolf, Tures, Schallawitz, Jacobs, Behrel, Harm, Auck,
Dahl, Blume, Davis and McKay. Nays: None. The Mayor thereupon declared
the motion carried.
Alderman Hansen reported that Council concur in the Traffic
Commission report Park Place and Jefferson Street and the suggestion of the
Fire Chief that there be no parking on the north side of Jefferson. Street
from Lee to Pearson Street. On motion by Alderman Hansen and second by
Schubert the council concurred in the recommendation and the City Attorney
instructed to draft an ordinance.
Alderman McKay reported he had confered with the Superintendent
of Public Works and City Clerk who have made some recommendations for the
Sanitation.Committee and would report further after a Committee meeting.
Alderman Blume reported that the sewer pumps on Algonquin Road
have proved inadequate to pump the sewerage from the garbage disposals in
the Ma:ailow Subdivision which is serious item but that they were investigating
to see what improvements are to be made.
