City Attorney's report continued
I have filed my appearance for the City of Des Plaines and will
file an answer before:April 20th, and will do my best to uphold the ordinance.
I will report further developments to you.

Adopt Amendment to Zoning Ordinance (Herzog Wolf and Algonquin)
read for second reading the following proposed ordinance entitled:
AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE
CITY OF DES PLAINES, ILLINOIS
The motion was made by Alderman McKay and seconded by Behrel to adopt the
proposed ordinance. The Mayor put the question and the Clerk called the
roll with the following result: Ayes: Alderman Hansen, Davis, Wolf, Tures,
Behrel, Schallawitz, McKay, Morava, and Auck. Nays: None. The Mayor
thereupon dedlared the' motion carried.
Cook County Dept. of Public Health Letter: The Clerk read a letter
from the above Health Dept. that they have held meetings and are tying
to help the homeowners where the pits are being made on Church St. and East
River Road.
Alderman Davis reported about the traffic on Wolf Rd. in Cumberland
and suggested that the City request the State Department to relinquish
their maintenance of Wolf Rd. ffom Rand Rd. to Golf Rd. at Circle. The Mayor
refered the item to City Attorney and Engineer to investigate.

On motion by Alderman Morava and second by Hansen the application was refered
to the Zoning Board of Appeals sittion as a commission to call a hearing.
Alderman Davis reported to the partial blocking of Weller Creek
near Benjamin Electric due to excavating interceptor sewer. On motion
by Alderman Davis and second by Hansen the Clerk was instructed to write
the Sanitary District.
Alderman McKay read the following report:
March 23, 1953
I wish to direct the attention of the Council to the condition
of Weller Creek in the vicinity of the Cumberland Terrace Imhoff Tanks.
In recent conversation with Supt. of Public Works, Warnecke it was
our thought that the condition was not critical and Mr. Warnecke was sure
the Saintary District contractors would correct same before leaving the job,
We did agree however, in light of past experiences, a condition could arise
quickly that might cause local flooding.
At the spot where the new sewer goes under Weller Creek the water
was temporarily diverted during digging operations through two metal cuirerts.
After, when the stream was again permitted to find its way along the creek-
® bed the culverts were not removed not was a considerable amount of earth
and at this pont the creek is badly obstructed. A short distance downstream
ee there is another serious obstruction caused by a tree which was cut down
and allowed to fall into the creek.
No effort has been made to clear the creek in even a superficial
way, and it would not require much effort to clear it properly.
Following the mild winter we have just had it could easily happen
that we might have a very moist April, and rather than trust too much to
luck, perhaps it might be wise for us to press the Sanitary District to have
their contractors remedy this condition at onee, or even to have the Supt.
of Public Works do it and charge the expense to the contractors.

The Mayor instructed the City Engineer and Supt. Warnicke to contact the
contractors on interceptor and Commissioner Beer of Weller Creek Sanitary District.
Alderman McKay also suggested the Clerk write a letter to Sanitary
District about unfilled excavation of interception near Cumberland Station.
The Clerk reported about a County Rezoning Searing April 17 at
7:00 P.M. at Park Ridge City Hall regarding 12 acres at Vernon Avenue and
Dempster St. Alderman Behrel will attend.
St. Stephen's Holy Name regarding Carnival. The Clerk read the
following letter;

Dear Mr. Henrich:
The St. Stephens Holy Name Society wishes to petition the City of Des Plaines
to obtain approval to run a car raffel and carnival on Thursday, August 27
throught Sunday, August 30. The purpose of this car raffle and carnival is
to raise fnnnas to assist in paying for our new Church and school now under
construction on the property bordering Ash, Everett and Prospect Streets
in the City of Des Plaines.
We w6uld also appreciate at this time the City's approval to hold this '
carnival on one of the two following pieces of property:
1 - The south-east corner of Lee and Oakton Streets, this property
owned by Schorsh Builders. The owners will do their utmost to make this
property available to us for our carnival This is our first choice location

2 = The south -test corner of Prospect and Ash Streets which is
our parish property. For this location we ask permission to close Ash Street
bordering the parish property during the carnival hours.. This is not a through
street and there are no residences in thatblock. This is an alternate to our
first choice in the event that the Schorsh Builders are not able to make
their property available to us for some reason not known at this time.
We ask you for your acknowledgement of this petition as soon as
possible so that we can go ahead with our plans for this important affair.

A roval of Bills Alderman MacKay, Chairman of the Finance Committee
presented the following proposed resolution:
BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF DES PLAINES THAT THE
FOLLOWING BILLS ARE DUE AND PAYABLE
AND THAT THE MAYOR AND CITY CLERK
BE AND ARE HEREBY AUTHORIZED TO MAKE
PAYMENT FOR SAME.
(Schedule of bills placed before each Alderman and affixed to resolution
and on file with City Clerk.) The motion was made by Alderman McKay and
seconded by Wolf to adopt the resolution. The Mayor put the question and
the Clerk called the roll with the following result: Ayes: Alderman
Hansen, Davis, Wolf, Tures, Behrel, Schallawitz, McKay, Morava, and Auck.
Nays: None. The Mayor thereupon declared the motion carried.
Award Audit to Arthur Weiner Co. Alderman McKay reported on bid
of cost of audit for 1952 and continuous quarterly audit for 1953. The
motion was made by Alderman McKay and seconded by Behrel to award the audit
to Arthur Weiner Co. the lowest bid. The Mayor put -the question and the
Clerk called the roll with the following result: Ayes: Alderman Hansen,
Wolf, Tures, Behrel, Schallawitz, McKay, Morava, and Auck. Nays: Davis.
The Mayor thereupon declared the motion carried.
Alderman McKay reported about rubbis and garbage being dumped in
Chicago & Northwestern Railway yards near Cumberland Terrace. The Clerk
was instructed to write the Railway Company.
Alderman McKay inquired if an ordinance could be drafted regarded
garbage cans being left for several days on parkway. The City Attorney
said he would draft an ordinance. The Mayor suggested the newspapers have
an article about a clean city.
Alderman McKay reported about having a census taken due to
increase of population since 1950 so the City would receiveland increase
of Motor Fuel Tax. The Clerk was instructed to write the Commerce Dept.
Alderman McKay reported on Bennett excavating being a hazard and the City
Attorney will give an 'opinion next meeting of action to be taken.
Engineer Fletcher requested permission to advertise bids for a
12 inch water main from Well No. 3 to Algonquin Rd. the motion was made by
Alderman Auck and second by Behrel the request was granted.
Engineer Fletcher suggested the City pay the difference between
a 6 inch and 10 inch water main on Oakton St. about 500 feet east of Wolf
Road to be determined by bids. On motion by Alderman Tures and second by
Behrel the Council approved the suggestion.
Adjournment. The motion was made by Alderman Morava and second
by Hansen to adjourn. The motion was voted upon by acclamation whereupon
the Mayor declared the motion carried.
