Zoning Board Recommendation The Clerk read the following recommendation: February 14, 1953 Mayor and City Council, City of Des Plaines, Illinois Gentlemen: Recent hearings before the Zoning Board of Appeals have indicated a deed for Commercial and Apartment Zones. The Zoning Board of Appeals has had considerable difficulty in meeting this need and at the same time trying to protect the rights of adjacent property owners, who usually have single family residences. Accordingly, after considerable discussion, it was agreed to recommend to the Council the following: 1. A Comprehensive City Plan should be prepared by City Planning Engineers with provisions for the following: . a. Adequate shopping areas at convenient distances from residential sections. b. Apartment areas acting as "buffer zones" between commer- cial areas and single family areas. c. Light industrial areas in location which are unsuitable - fpr commercial or residential, for example, as.l5uffer zones near railroad yards. d. Off -the -street parking to be required in all zoning classifications as is now done in the Zoning Plan for Kankakee, Illinois. e. Recreational areas as an integral part of large subdivisions. f. Future school sites as the city expands. 2. The City should continue to enforce the Zoning Law by vigorous prosecution•of Zoning Violators: Citizens should be encouraged to report zoning violations and to make complaints as it isitheir property values which will suffer when the zoning laws are disregarded, 2/16/3 3. Re -hearings on petitions should not be encouraged since the Zoning Board of Appeals is not legally required to re -hear a petition nor to reconsider a decision previously rendered. If a re -hearing is requested, new evidence should be furnished as a basis for the request for a re -hearing. It is our belief that our City Officials are doing a good job, however, with the present rapid gorwth of the city and consequent "growing pains" it appears necessary that we employ expert advice to reduce the problem of residences in undesirable locations, and the inadequacy -of other types of zoning. Respectfully yours, ZONING BOARD OF APPEALS OF THE CITY OF DES PLAINES Fred K. Howe, Chairman Alvah H. James James J. Carroll W. H. McConnell CD By Albert L. Gundelach Secretary ott Copies: Des Plaines Suburban Times Des Plaines Journal The Mayor requested that the Clerk issue a copy of the recommendation to the Plan Commission and Aldermen. Zonins Board reject Swift Properties, Inc. rezoning application The Clerk read the follwoing recommendation: February 13, 1953 Mayor and City Council City of Des Plaines, Illinois Gentlemen: Your Zoning Board of Appeals, sitting as a•commission, had referred to it the application of Swift Properties, Inc., to rezone from Residence Area District A to Multiple -Family Dwelling the propefty at the Northeast corner of Third Avenue and Algonquin Road, legally described as follows: Lots 17,18,and 19, in Block 23, All in Homerican Villas, being a Subdivision of the West Half (-) of the Northwest Quarter (i) of Section 20 (except the Easterly 503 feet measured at right angles to, the East line thereof) also the East Half (*) of the Northwest Quarter (i) of Section 19, (except the West 173 feet thereof) Town 41, North, Range 12, East of the Third Principal Meridian, as per plat recorded November 10, 1927, as Document No. 9839446 in Cook County, Illinois. Northeast corner of Third Avenue and Algonquin Road. advises as follows: 1. That due notice to the parties and to the public of this proceed- ing and of the p ublic hearing therein was given as required by law and that the Board has jurisdiction of the subject matter and of the parties. 2. That the petitioner wishes to utilize the property inuestion for.the construction of an apartment building with twelve 4i roan apartments 3. That the property is entirely surrounded by single family residences and therefore any rezoning would be "spot zoning". Under such circumstances, a variation would be a possible alternative. 4. That the construction of'an apartment building would have a detrimental effect on the property values of the adjacent residences. 17 18 2/16/53 5. That the petitioner made no provision for parking for the residents of the proposed apartment building and that therefore a problem might arise in regard to parking. 6. That the highest and best use of the property in question is single family residential. The Zoning Board of Appeals, acting as a Commission, having heard and considered the evidence and being fully informed on the matter, on a vote of four for the rejection and none against, recommends to the Mayor and City Council that the proposed amendment to the Zoning Ordinance hereinbefore described be rejected. Respectfully submitted, ZONING BOARD OF APPEALS OF THE CITY OF DES PLAINES, SITTING AS A COMMISSION James J. Carroll Fred K. Howe Alvah H. James W. H. McConnell by Albert L. Gundelach Se cr tary On motion by Alderman Davis and second by Auck the Council concurred in the recommendation Herzog=Kvnze remaring-spladgeation. The Clerk read the following recommendation: February 12, 1953 Mayor and City Council City of Des Plaines, Illinois Gentlemen: Your Zoning Board of Appeals, acting as a Commission, had referred to it the application of the Herzog Construction Company to rezone from Residential A. to Commercial C the property at the Southeast corner of Algonquin and Wolf Roads, legally described as follows: The Northerly Two Hundred Sixty and 25/100 (260.25) feet of the West Half '(W)) of the Northeast Quarter (NE4) of the Southeast Quarter (SE+) of Section Nineteen (19), Township Forty0ne (41) North, Range Twelve (12) East of the Third Principal ileridian, situated in the City of Des Plaines, in the County of Cook in the State of Illinois, located on the Southeast corner of Algonquinland Wolf Roads. advises as follows: 1. That due notice to the parties and to the public of this proceed- ing and of the public hearing herein was given as required by law and that the board has jurisdiction of the subject matter and of the parties. j 2. That the petitioner wishes to construct three commercial buildings with four stores to each building and plans to provide three square feet of parking area or more to each one square foot of area occupied by buildings. I 3. That there were twelve objectors to the proposed rezoning at the second public hearing. 4. That there is a great need for a commercial district in this area due to the influx of over one thousand families at this time and no provision having been made for a corresponding increase in commer- cial property. 5. That the Southwest corner of Algonquin and Wolf Roads now has a farmers stand on County property with unrestricted zoning. 2/16/53 6. That the Northwest corner of Algonquin and Wolf Roads is zoned Commercial and has a gas station on it in operation. 7. That the property in question is at the intersection of two arterial highways and is theutype generally considered suitable for commercial zoning. 8. That adequate off—the—street parking should be provided by any commercial activity and it is contemplated that parking will be provided in this case. 9. That the property to the East will be utilized by the proposed Algonquin School and will be relatively unaffected by the proposed rezoning. 10. That the corner of Algonquin and Wolf Roads is unsuitable for residential use. 11. That a hearing on the same subject matter was held on November 28, 1952 and that it was then recommended by this Board that the proposed amendment be granted, and that since that time there have been no changes nor new evidence which would warrant a change of that recommendation. 12. That the highest and best use for the co mer of Algonquin `and ct Wolf Roads is Commercial and that the corner is unsuitable for other purposes. 13. That the evidence presented was convincing as to the disirability of reclassifying the petitioners property into a•CamamerciaL District.
