MINUTES OF .THE REGULAR MEETING OF THE CITY
COUNCIL, DES PLAINES, ILLINOIS, HELD IN THE
COUNCIL CHAMBERS MONDAY, JANUARY 19, 1953
AT 8:00 P.M.
• Call to Order. The meeting was called to order by mayor Kenneth
G. Meyer who'presided with Alderman Hansen, Davis, Wolf, Tures, Schallawitz,
McKay, and Morava, responding to roll call.
Approval of Minutes The motion was made by Alderman Morava and
seconded by Hansen to approve the minutes of January 5, 1953. The motion
was voted upon by acclamation whereupon the Mayor declared the motion carried.
Official Reports. The Clerk submitted the report of Treasurer
L. Barrett for December and the annual report of Building Commissioner,
also a report from Nurse and Welfare Assn. for December.
Zoning Hoard recommend .to reject John Heinrich frquest for re-
zoning at 1284 Prairie Avenue. The Ulerk submitted the following report:

Your Zoning board of Appeals sitting as a Commission had referred to it the
application of Jacob Heinrich to rezone the following described real estate
from its present classification Residence Area A to Apartment Area B, to Wit:
Lot seventeen (17) in block two (2) in Des Plaines Manor
Tract No. one (1) a Subdivision of part of Section 17 and
20, Town 41 North Range 12, East of the Third Principal
Meridian according to Plat recorded July 14, 1911 as Docu-

1. That due notice to the' parties and to the`"publicof this proceeding
and of the public hearing therin was given as required by law and that the
Board has jurisdiction of the subject matter and of the parties.
2. That the Ir operty in question has'been used for some time as an apartment
building for two families in deliberate violation of the Zoning Law.
3. That there was one objector to the proposed amendment at the public
hearing.
4. That the property in question is in a single familyresidential neighborhood
•and that the highest and best use of the property is single family residential.
5. That the evidence presented Was not convincing as to the desirability
of reclassifying the property.
The Zoning Board of Appeals sitting as a Commission having Re Jacob Heinrich
heard and considered the evidence and being fully informed on the premises,
on a vote of four againdt a change and none for a change, recommends to the
Mayor and City Council that the proposed amendment to the Zoning Ordinance
hereinbefore described be rejected.

Heinrich !request for rezoning continued.
The Mayor refered the report to the Building and the Municipal Development
Committees.

The Clerk read a letter from Premier Rose Gardens and St. Patrick
Academy regarding the smoke from chimneys.
The Clerk read a letter from Hoyne Savings andlLoan Assn. stating
that they had 02,1:48.15 in escrow for the installationsiof water mains,
sewer systems, streets and sidewalks. I

The Clerk read a letter from the Division of Highways that the
plans for gates on 1the Soo Line Graceland crossing were approved.
The Clerk informed the Council he had received four copies of
resolutions adopted1 by the Illinois Commerce Commission on the four crossings
for gates approving the plans.
Adopt ofidinance on Fire Department Personal. The Clerk read for
second reading the following proposed ordinance entitled4
AN ORDINANCE TO AMEND SECTION 122 OF THE MUNICIPAL
CODE OF DES PLAINES OF 1928 AS AMENDED.
The motion was made; by Alderman Hansen and seconded by Schallawitz
to adopt the ordinance; The Mayor put the question and the Clerk
called the roll with the following result: Ayes: Alderman Hansen,
Davis, Wolf, Tures, Schallawitz, McKay, and Morava. Nays: None. The
Mayor thereupon declared the motion carried.
Adopt Ofdinance on Police Department Personal.

AN ORDINANCE AMENDING SECTION 3 OF AN ORDINANCE ESTABLISHING
THE DEPARTMENT OF POSICE FOR THE CITY OF DES PLAINES,
PASSED JANUARY 4, 1537, AS AMENDED.
The motion was madeby Alderman Schallawitz and secondedllby Hansen
to adopt the ordinance. The mayor put the question and the Clerk
called the roll with the following result: Ayes: Alderman Hansen,
Davis, Wolf, Tures,1Schallawitz, McKay, and Morava. Nays: None.
The Mayor thereuponldeclared the motion carried.
Adopt annexation ordinance of Herzog-Kunze N.E.I Corner
Oakton and Wolf Road. The Clerk read for second reading the following
proposed ordinance, entitled:
An ordinance annexing certain lands to the City of Des Plaines

The motion was madelby Alderman Schallawitz and seconded by Hansen to
adopt the ordinance. The Mayor put the question and the Clerk called
the roll with the following result: Ayes: Alderman Hansen, Davis, Wolf,
Tures, Schallawitz,'McKay, and Morava. Nays; None. The Mayor thereupon
declared the motion carried.
John H. Bouris safety Chairman. South School P.T.A. The
Clerk read the following letter:

Des Plaines, Illinois
Gentlemen:
At a recent South School P.T.A. board meeting, the problem
of the school children crossing Mannheim Road was discussed. The city
has furnished one adult guard who is stationed at Mannheim and Prospect.
Many of the children live on the Northeast side off Mannheim =clatter,
e ossing.at Mannheim; and Prospect, must cross ac ago across mannneim
at Ash or Spruce or whatever street they live on. There is no guard
at any of these streets.
The best solution to this problem, the board feels, would be
to have these children walg North to Oakton Street from school on Cora
ofrlllinois.Street, and then west on Oakton Street to their own streets
However, there are no sidewalks on the south side of Oakton Street
from Cora to Bittersweet, except in front of two stores. 'Consequently,
the children must walk in the street, greatly endangering their lives.

We, as a board, would like to know the exact proceedure to
compel these property owners to install sidewalks along this section
of Oakton Street and also several other section in the immediate
vicinity of the school, Must we have a petition drawn up, or does the
City Council handle such -matters?
We would appreciate your early attention to this matter.

The Mayor informed Mr. Gundelach and Mr. Bouris that the Council
could start proceedings for a special assessment if the,owners would
refuse to install sidewalks. The two men proM sed to.get'the names
of owners of the property and give the names'to the `City'Clerk.
The Clerk read two paragraphs regarding the information
service of the Illinois Municipal League.
CD Adopt resolution authorizing Special Election on City Manager
Plan. The Clerk read a resolution authorizing the City Clerk and other
officials to expend the necessary funds for the election and designated
the polling places in the respective wards. On motion by Alderman
Davis and seconded by McKay the resolution was adopted.
At the request of Alderman Davis the ''`ayor declared a recess.
After reconvening on motion by Alderman Davis and second by 'cKay the
Council concurred in the recommendation of the Zoning Board on the John
Heinrich rezoning application at 1284 Prairie Avenue.
Approval of Bills. Alderman McKay presented the following
proposed resolution:
BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DES PLAINES THAT THE FOLLOWING
BILLS ARE DUE AND PAYABLE AND THAT THE
MAYOR AND CITY CLERK BE AND ARE HEREBY
AUTHORIZED TO MAKE PAYMENT FOR SAME.
(Schedule of bills placed before each Alderman and affitted to resolution
and on file with City Clerk.) The motion was made by Alderman McKay
and seconded by Morava to adopt the resolution. The Mayor put the.
question and the Clerk called the roll with the following result:
Ayes: Alderman Hansen, Davis, Wolf, Tures, Schallawitz, McKay, and
Morava. Nays: None. The Mayor thereupon declared the motion carried.
Herzog's subdivision Plat Approved. The Clerk presented
Herzog's Subdivision Plat which had been approved. by the Plan Commission.
The motion was made by McKay and seconded by Schallawitz to approve the
plat. The Mayor put the question and the Clerk called the roll with
the following result: Ayes: Alderman Hansen, Davis, Wolf, Tures,
Schallawitz, McKay, and Morava. Nays: None. The Mayor thereupon
declared the motion carried.
The Mayor declared a recess for Council to discuss the agreement
of E. N. Fletcher and Alvord, Burdick andHowson. After reconvening
the motion was made by Alderman McKay and seconded by Schallawitz to
approve the agreement as corrected. The Mayor put the question and
the Clerk called the roll with the following result: Ayes: Alderman
Hansen, Davis, Wolf, Tures, Schallawitz, McKay, and Morava. Nays:
None. The Mayor thereupon declared the motion carried.
Engineer Fletcher requested that be be authorized to draft
plans and estimates for a complete street on Birch Street from Howard
to Welwyn avenue, by special assessment, On motion by Alderman Schallawitz
and second by Morava the council approved his request.
Adjournment: The motion was made by Alderman Davis and
seconded by Morava to adjourn. The motion was voted upondry acclamation
whereupon the Mayor declared the motion carried and the Council
regularly adjourned.
