MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY
OF DES PLAINES, ILLINOIS, HELD
IN THE COUNCIL CHAMBERS, CIVIC
CENTER, MONDAY, September 15, 1975
CALL TO ORDER: The regular meeting of the City Council of the City of
Des Plaines was called to order at 8 P.M. by Mayor Herbert
H. Behrel in the City Council Chambers, Des Plaines Civic
Center.
ROLL CALL:
Roll Call indicated the following aldermen present:
Koplos, Olen, Bolek, Leer, Kisslinger, Birchfield, Erbach,
Kraves, Sarlo, Meyer, Abrams, Ward. Alderman Sullivan
arrived during Prayer. Absent were Aldermen Szabo,
Brannigan, and Seitz.
Also present were: Comptroller Assistant Raycraft, Police Captain Mensching,
Deputy Fire Chief Clark, Commissioner of Public Works Schwab, City Planner
Richardson, City Engineer Bowen, Building Commissioner Baldaccini,
Environmental Control Officer Lindahl, and City Attorney Hug.
PRAYER AND The meeting opened with prayer by Rev. James Jackson,
PLEDGE pastor of Christ Church, followed by the Pledge of Allegiance
to the flag.
DES PLAINES Alderman Bolek presented Sgt. Kenneth Fredricks with a
POLICE BOYS check in the amount of $400 representing surplus from the
CLUB Des Plaines City Officials Golf Outing for the Des Plaines
Police Boys Club.

Moved by Sarlo, seconded by Kisslinger, to approve the
Minutes of the regular meeting held September 2, 1975,
as published. Motion declared carried.
BILLS Moved by Bolek, seconded by Leer, to adopt the following
PAYABLE resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE
AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY
AUTHORIZED TO MAKE PAYMENT FOR SAME. Total, $346,947.05.

Autos two 1976 compact type automobiles, as stipulated in the
Public Works Department's specifications to Ridge Motors,Inc.
in the amount of $7,277.68 net. Upon roll call, the vote was:

HOSPITALIZATION Moved by Sarlo, seconded by Brannigan, to reconsider
INSURANCE motion to adopt the recommendation of Finance and Insurance
Committee to authorize Mayor and City Comptroller to imple-
ment the cancellation of Hospitalization Insurance for
employees with Blue Cross -Blue Shield and enter into contract
with Confederation Life Insurance for hospitalization
insurance and life insurance for city employees. The
Clerk submitted protest petitions signed by city employees
and read letter from Officers' Committee on Wages and
Benefits, Des Plaines Fire Department. Motion to reconsider
declared carried. Moved by Bolek, seconded by Meyer, to
table motion. Motion declared carried.

Moved by Abrams, seconded by Meyer, to adopt the recommenda-
tion of City- Code and Judiciary Committee to authorize
City Attorney to represent the City in a friendly suit
to be filed by owners of property located at Lee and Touhy
Avenue, owned by Walgreen Co. to sustain the validity
of the present C-2 zoning with restrictive covenants,
Walgreen Co. agreeing to reimburse the City for its expenses
in such litigation. Attorney Robert Pease, Real Estate
Department Manager of Walgreen Co. addressed the City
Council stating that Walgreen Co. would pay "out of pocket"
expenses, including court costs. Motion declared carried.
Moved by Abrams, seconded by Meyer, to adopt the recommenda-
tion of City Code and Judiciary Committee that no ordinance
be adopted to require residents to remove snow from side-
walks. Motion declared carried.
Moved by Abrams, seconded by Koplos, to adopt the recommenda-
tion of City Code and Judiciary Committee that the City
Attorney be authorized to file suit against the owner -
of two buildings, a commercial food store and a residence
at Elk Boulevard and Rand Road, to compel compliance with
City's zoning ordinance. Motion declared carried.
Moved by Erbach, seconded by Seitz, to adopt the recommenda-
tion of Police, Fire and Civil Defense, Streets and Traffic
and Finance and Insurance Committees to award the contract
for radio maintenance service to The Portable Clinic, Inc.
of Addison, I11. in the amount of $1,486.53 per month,
contract to include thirty day cancellation clause.
Upon roll call, the vote was:

Moved by Erbach, seconded by Sullivan, to adopt the recom-
mendation of Police and Finance and Insurance Committees
to award the contract for eight squad cars to Cass Ford, Inc.
of Des Plaines for a total price of $31,480.24. Upon roll
call, the vote was:

Moved by Erbach, seconded by Meyer, to adopt the recommenda-
tion of Police Committee to authorize $600 additional
cost for three MX -350 Portable Radios, approved by City
Council September 2, 1975, from Motorola Communications,
changing total from $4,005.00 to $4,605.00, waiving the
usual bid procedure, contract to include "equipment will
not be sold to any other customer at a lower price".

Moved by Kisslinger, seconded by Bolek, to adopt the
recommendation of License and Inspection Committee to
authorize City Attorney to draft necessary ordinance to
permit three years of use of taxicabs before retirement,
with safety checks at three month intervals and visual
general examination monthly during first five days of each
calendar month. Motion declared carried.
Moved by, Ward, seconded by Olen, to adopt the recommendation
of Struts and Traffic Committee to authorize City Attorney
to draft necessary ordinance for "No Right Turn between
7 A. M. and 9 A.M. and 4 P.M. to 6 P.M., except Saturdays,
Sundays and Holidays" for traffic eastbound on Vanburen
Avenue at Des Plaines Avenue, River Road. Motion declared
carried.
4 -way Stop Moved by Ward, seconded by Brannigan, to adopt the recommenda-

"No Thru Traffic" signs on Warrington Road, north of
Thacker Street for northbound traffic, City Attorney to

of Streets and Traffic Committee that traffic on LaSalle
Street yield to traffic on Bradley, City Attorney to draft

of Streets and Traffic Committee to recommend that Chicago
and Northwestern Railway Co. install similar walkway opening
with bell and flashing warning light to that of Park Ridge,
Edison Park, Norwood Park and Gladstone Park, directly
across from Depot leading to Ellinwood Street, and City
Attorney to take whatever necessary legal steps for public
hearing before Illinois Commerce Commission should C & NW
refuse to install. Motion declared carried.

"No Parking At Anytime" on the south side of Fifth Court
between Fourth and Fifth Avenues, City Attorney to draft

POLICE BLDG. Moved by Leer, seconded by Kisslinger, to adopt the recom-
FURNITURE mendation of Public Buildings, Grounds and Parking Lots
Committee to authorize the purchase of certain furniture
for the Police Building, per proposal dated August 25,
1975, from Henricksen & Co., Inc. in the amount of $9,781.98,
waiving usual bid procedure. Upon roll call,the vote was:

and 18th. Moved by Meyer, seconded by Ward, to amend the
motion to include also Building Commissioner Baldaccini.

permitting the city of beautify area located on property
south of 1704 Chestnut Street, lease agreement and project
subject to final approval by City Council. Motion declared

Alderman Bolek, Chairman, reported that the Finance and
Insurance Committee is continuing to study the possibility
of deferred compensation for city employees, meeting with
representatives of various companies offering said plan.
Moved by Leer, seconded by Bolek to adopt Resolution R-14-75
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DES PLAINES
AUTHORIZING SIGNATURE OF CONTRACT WITH FIRST NATIONAL BANK
OF DES PLAINES AS TRUSTEE UNDER TRUST NUMBER 51441306 FOR
PARKING SPACES IN THE DECK PARKING STRUCTURE. Upon roll
call, the vote was:
AYES: - 11 - Szabo, Olen, Bolek, Leer, Brannigan, Kisslinger,
Birchfield, Seitz, Abrams, Ward, Mayor

Counsel DiLeonardi to continue to defend the Appellate
Court decision in the City's favor in the suit against
Chicago and Northwestern Railway Co. re violation of noise
ordinance. Upon roll call, the vote was:

meeting of the City Council adjourn until Monday,
September 22, 1975, at 8 P.M. to consider the sale of
General Obligation Bonds and passage of necessary ordinance,
as well as any other matters of business before t - City
