06/02/1975316 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, CIVIC CENTER, MONDAY, June 2, 1975 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines was called to order by Mayor Herbert H. Behrel at 8:03 P.M. ROLL CALL: Roll Call indicated the following aldermen present: Koplos, Szabo, Sullivan, Olen, Bolek, Leer, Brannigan, Kisslinger, Birchfield, Erbach, Kraves, Sarlo, Meyer, Seitz, Abrams, Ward, Mayor Also present were: City Treasurer Mahon, City Comptroller Blietz, Police Chief Hintz, Fire Chief Corey, Deputy Fire Chief Wolf, Building Commissioner Baldaccini, City Engineer Bowen, Commissioner of Public Works Schwab, Planner Richardson, Police Captain Mensching, Environmental Control Officer Lindahl, Museum Director Welch, Police Lt. Clark, and City Attorney Hug. PRAYER AND The meeting opened with prayer by Rev. James Bouman, pastor PLEDGE of Immanuel Lutheran Church, followed by the Pledge of Allegiance to the flag. MINUTES: Moved by Sarlo, seconded by Seitz, to approve the Minutes of the regular meeting held May 19, 1975, as published. Correction: Page four, last paragraph, add "Motion declared Carried". Following correction, motion declared carried. PETITIONS Students from Stevenson School Pupils Enrichment Program "Save The presented petitions to either join with federal and state Rand Mill" offices to obtain funds to purchase the Rand Mill and the site on which it stands and to have the site declared a historical land mark or to purchase just the Mill, renovate it and move it to another site on city or park district property such as Rand or Spiegler Park. Said petitions were referred to the Historical Landmark Commission. BILLS Moved by Bolek, seconded by Sarlo, to delete from the PAYABLE Register of Bills Voucher No. 117,312, in the amount of $31.85 and Voucher No. 117,256 in the amount of $799.50. Motion declared carried. Moved by Bolek, seconded by Sarlo, to adopt the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME: Total, $137,312.52. ORDINANCE Moved by Bolek, seconded by Kisslinger, to adopt the M-18-75 recommendation of Finance Committee to suspend the rules Industrial of City Council and place Ordinance M-18-75 AN ORDINANCE Rev. Bonds AGREEING TO ISSUE INDUSTRIAL DEVELOPMENT REVENUE BONDS Dry Storage (DRY STORAGE CORPORATION PROJECT) on passage, waiving Co. First Reading. Motion declared carried. Moved by Bolek, seconded by Kisslinger to amend Ordinance M-18-75, changing $3,100,000 to $1,000,000 wherever it appears in the ordinance and agreement. Motion declared carried. Moved by Bolek, seconded by Kisslinger, to adopt Ordinance M-18-75, as amended. Upon roll call, the vote was: AYES: - 17 - Koplos, Szabo, Sullivan, Olen, Bolek, Leer, Brannigan, Kisslinger, Birchfield, Erbach, Kraves, Sarlo, Meyer, Seitz, Abrams, Ward, Mayor NAYS: 0 - None ABSENT: 0 - None Motion declared carried. SPECIAL Moved by Koplos, seconded by Abrams, to adopt the recommenda- FLOOD tion that the Special Flood Control Commission not be formed CONTROL at this time - recommendation of Water and Sewer Committee. COMMISSION Motion declared carried. WATER Moved by Koplos, seconded by Seitz, to adopt the recommendation SECURITY of Water and Sewer Committee that the City Attorney be DEPOSITS authorized to prepare the necessary ordinances to eliminate the water security deposits, and also that all commercial users of $1200 or more of water annually, be billed on a monthly basis. Motion declared carried. DISPLAY OF Moved by Abrams, seconded by Olen, to adopt the recommendation MAGAZINES of City Code and Judiciary Committee that the City Attorney AND be authorized to prepare an ordinance restricting the display NEWSPAPERS of magazines and newspapers having on their cover a sub- stantial depiction of nudity particularly where young children may be exposed to such magazines and newspapers and specifically to restrict the display of such magazines in such a way that substantially only the title of such magazinw or newspaper may be displayed and that City Attorney present such proposed ordinance to the Committee prior to submitting such ordinance to City Council. Motion declared carried. PIGEONS Moved by Abrams, seconded by Meyer, to adopt the recommendation of City Code and Judiciary Committee that no change in the City Code permitting the keeping of fowl such as pigeons with the City be made. Following discussion, moved by Leer, seconded by Sullivan to defer action. WOODALLS Moved by Szabo, seconded by Erbach, to adopt the recommenda- Subdivision tion of Municipal Development Committee to approve Plat of Elmira Ave. Woodall's Subdivision located at 2244 Elmira Avenue, with order that Plat not be recorded until garage has been removed from subject property. Motion declared carried. ZONING CASE Moved by Szabo, seconded by Birchfield, to adopt the recom- 75-20-V mendation of Municipal Development Committee to concur 2500 Lee St. with Zoning Board of Appeals in Case 75-20-V, 2500 Lee Street, and to authorize City Attorney to draft necessary ordinance for further consideration by City Council. Motion declared carried. ZONING CASE 75 -17 -SU 20 W. Golf Moved by Szabo, seconded by Kisslinger, to adopt the recom- mendation of Municipal Development Committee to concur with Zoning Board of Appeals in Case 75 -17 -SU, 20 W. Golf Road, and to authorize City Attorney to draft necessary ordinance for further consideration by City Council Motion declared carried. DEDICATION Moved by Leer, seconded by Seitz, to adopt the recommendation DES PLAINES of Public Buildings, Grounds and Parking Lots Committee CIVIC CENTER that July 13, 1975, be designated as the date for Dedication Ceremonies and that the Mayor be authorized to extend the City's invitation to various dignitaries. Motion declared carried. Alderman Birchfield voted No. Moved by Szabo, seconded by Leer, to retain the bid bonds or checks of two low bidders for carpeting and return all other bid bonds or checks for bids originally received for carpeting. Motion declared carried. Moved by Kraves, seconded by Birchfield, to adopt the recom- mendation of Environmental Control Committee to approve proposed bylaws of the Northwest Environmental Council. Moved by Kraves, seconded by Birchfield, to adopt the recom- mendation of Environmental Controls Committee to authorize the installation of one 275 gallon storage tank for recycled fuel oil to be buried in compliance with all City Codes. Placed on First Reading was Ordinance T-12-75, AN ORDINANCE AMENDING SECTION 10-7-3 OF THE CITY CODE HAVING TO DO WITH STOP STREETS BY ADDING THERETO THE INTERSECTION OF EARL AVENUE AND FOREST AVENUE AS A TWO-WAY STOP INTERSECTION. Moved by Bolek, seconded by Leer, to waive First Reading of Ordinance M-23-75, and place on passage, AN ORDINANCE AGREEING TO ISSUE INDUSTRIAL DEVELOPMENT REVENUE BONDS (YMCA OF METROPOLITAN CHICAGO PROJECT). Conference to allow Mayor Behrek, Alderman Abrams, and Environmental Officer Lindahl to attend. Commendation to Fire Department Captain Richard Arthur was read to the City Council as follows, received from the Des Plaines River Annual Canoe Marathon: "For your service to your community in providing emergency assistance during the 18th Annual Des Plaines River Canoe Marathon, this certificate of appreciation is gratefully offered. It is only through people like you who willingly volunteer their time and personal resources that emergency aid organizations can exist and perform their needed functions. You may be sure your efforts are greatly appreciated."
