OF THE CITY COUNCIL OF THE CITY
OF DES PLAINES, ILLINOIS, HELD
IN THE COUNCIL CHAMBERS, CITY HALL
MONDAY, February 3, 1975
CALL TO ORDER: The regular meeting of the City Council of the City of
Des Plaines was called to order by Mayor Herbert H. Behrel
at 8:00 P.M.
ROLL CALL:
Roll Call indicated the following aldermen present: Koplos,
Szabo, Kehe, Olen, Bolek, Chase, Kisslinger, Hinde, Birchfield,
Erbach, Swanson, Sarlo, Meyer, Seitz, Abrams, Ward
Also present were: City Treasurer Mahon, City Comptroller Blietz, Police
Chief Hintz, Fire Chief Corey, Building Commissioner Baldaccini, City
Engineer Bowen, Commissioner of Public Works Schwab, Assistant Commissioner
of Public Works Schaeffer, Planner Richardson, Environmental Officer Lindahl,
Assistant Comptroller Raycraft, Corporation Counsel DiLeonardi, Deputy Fire
Chief Wolf, and City Attorney Hug.

The meeting opened with prayer by Rev. Kenneth Wobbe, pastor
of United Church of Christ, followed by the Pledge of
Allegiance to the flag.
Moved by Meyer, seconded by Sarlo, to approve the Minutes
of the regular meeting held January 20, 1975, as published.
Correction: Page two, paragraph five, line five, strike
word "facility" and insert "existing facilities". Motion
declared carried.
Moved by Seitz, seconded by Sarlo, to adopt a resolution
expressing sympathy to the family of His Honor, Robert S.
Juckett, who served as Fourth District Representative in
the General Assembly of the State of Illinois and who
passed away February 2, 1975. Motion declared carried.
Moved by Hinde, seconded by Koplos, to adopt Resolution
R-1-75, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DES PLAINES, ILLINOIS, AUTHORIZING THE PAYMENT OF NOT TO
EXCEED $300,000.00 FROM THE GENERAL CORPORATE FUND FOR
CONSTRUCTION COSTS OF THE WATERWORKS SYSTEM. Upon roll
call, the vote was:

Kisslinger, Hinde, Birchfield, Erbach, Swanson,
Sarlo, Meyer, Seitz, Abrams, Ward, Mayor

Moved by Hinde, seconded by Swanson, to adopt the following
resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE
AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY
AUTHORIZED TO MAKE PAYMENT FOR SAME: Total, $378,895.41.
Upon roll call, the vote was:

Moved by Szabo, seconded by Koplos, to concur with recommenda-
tion of Buildings Grounds and Parking Lots Committee to
approve change orders in connection with construction of
the New City Hall Building, increasing the contract with
Wigdahl Electric Company in the amount of $3,776.22 and
increasing the contract with William Adams Engineers, Inc.
in the amount of $7,675.00 Upon roll call, the vote was:

Kisslinger, Hinde, Birchfield, Erbach, Swanson,
Sarlo, Meyer, Seitz, Abrams, Ward, Mayor

DEMOLITION Moved by Szabo, seconded by Hinde, to adopt the recommendation
Pearson St. of Public Buildings, Grounds and Parking Lots Committee to
Bldgs. advertise for bids returnable at 3 p.m., February 27, 1975,
Parking Lot for demolition of buildings at 750-752-754, 760, and 766
Pearson Street, to construct Parking Lot. Motion declared
carried.
LEASE Moved by Szabo, seconded by Hinde, to adopt the recommendation
MUNICIPAL of Public Buildings Grounds and Parking Lots Committee
BUILDING to lease approximately 835 sq. feet of space on the fourth
Cong. floor of the new municipal building to Congressman Mikva
Mikva at a rental of $500 per month until January 3, 1977, and to
authorize Mayor and City Clerk to execute the lease to be
drawn by City Attorney. Moved by Kisslinger, seconded by
Hinde, to amend the motion to authorize City Attorney to
include in the lease agreement that said leased office .
space not be used as a campaign headquarters. Motion to
amend declared carried. Upon roll call, the vote on the
motion as amended was:

FINANCIAL of Water and Sewer Committee to approve the Statement of
CONDITION Financial Condition of Water System for the fiscal year
WATER SYS. ending December 31, 1974. Upon roll call, the vote was:

Bonds OF WATER SYSTEM AND AUTHORIZING ADVERTISING FOR BIDS
RETURNABLE FEBRUARY 18, 1975 FOR PROPOSED $2,850,000 WATER
REVENUE BOND ISSUE. Upon roll call, the vote was:

WOODLAND AVE. Moved by Ward, seconded by Sarlo, to adopt the recommendation
PARKING of Streets and Traffic Committee to authorize "Parallel
Parking Only" on Woodland Avenue" and to repeal Ordinance
T-28-74, City Attorney to draft necessary ordinances.
Motion declared carried.
MAYOR
Moved by Abrams, seconded by Kehe, to adopt the recommendation
of City Code and Judiciary Committee to authorize City
Attorney to prepare a draft ordinance for further review
by said committee designating a first and second deputy mayor
to act as mayor in an emergency and that such deputy mayors
be designated on an automatic rotation basis so that each
alderman will serve at some time during the year as deputy
mayor. Motion declared carried.
LUCILLE Moved by Swanson, seconded by Erbach, to adopt the recommenda-
DONOVAN tion of Municipal Development Committee to approve Plat of
RESUB. Lucille Donovan Resubdivision, located at approx. 2200
Sprucewood Avenue, and authorize execution thereof by Mayor
and City Clerk. Motion declared carried.

Moved by Abrams, seconded by Hinde, to adopt the recommendation
of City Code and Judiciary and Finance and Insurance
Committees to agree to settlement of a Workmen's Compensation
claim on Patrolman Ronald Robinson, in the amount of $1,253.95.
Upon roll call, the vote was:

Moved by Erbach, seconded by Birchfield, to adopt Ordinance
M-6-75, AN ORDINANCE AMENDING TITLE IX OF THE DES PLAINES
CITY CODE BY ADDING THERETO A NEW CHAPTER REGULATING PRIVATE
PARKING FACILITIES WHICH SERVE 25 DWELLING UNITS OR MORE,
COMMERCIAL USES OR INDUSTRIAL USES BY ESTABLISHING REGULATIONS
THEREFOR AND PROVIDING A PROCEDURE FOR COLLECTION OF THE
AMOUNT DUE AND FOR A LIEN. Moved by Kisslinger, seconded
by Szabo to amend Ordinance M-6-75, Page 4, section 9-17-4
last sentence as follows: "If the plans are not in compliance
with the standards, the City Engineer may suggest design
changes to the owner or his agent to permit their redesign
so that there'is compliance." Motion to amend declared
carried. Upon roll call on Ordinance M-6-75, as amended
the vote was:

r,City Corporation Counsel DiLeonardi reported that Summons
on the Metropolitan Sanitary District was served Friday in
the most recent suit filed by City. Moved by Koplos, seconded
by Bolek, to authorize Mayor to respond to letter from
Metropolitan Sanitary District requesting permission to
install certain tunnel connections that the matter is in
litigation and that the City Council has taken no action
in the matter. Motion declared carried.
Corporation Counsel DiLeonardi reported that the Illinois
Supreme court affirmed the Appellate Court in the Grobman
case and ruled in favor of the City.
Alderman Abrams reported that City Code and Judiciary
Committee has directed Attorney Hug to research recent
opinions by the courts in the matter of Sale of Meat after
6 p.m. and that the Committee will continue to study the
matter.
Moved by Swanson, seconded by Hinde, to waive First Reading
and place on passage Ordinance T-3-75, AN ORDINANCE AMENDING
SECTION 10-7-3 OF THE CITY CODE HAVING TO DO WITH STOP
STREETS BY ADDING THERETO THE INTERSECTION OF PROSPECT
AVENUE AND WHITE STREET AS A TWO-WAY STOP .INTERSECTION.
Motion declared carried. Moved by Swanson, seconded by
Sarlo to adopt Ordinance T-3-75. Upon roll call, the vote
was:

Kisslinger, Hinde, Birchfield, Erbach, Swanson,

Letters from Plan Commission and Zoning Board of Appeals
re Case 75 -3 -SU, 249 South River Road, were placed on file
awaiting final letter from Zoning Board of Appeals.
Letter from Mayor Behrel recommending the hiring of an
Aide or Administrative Assistant to the Mayor was referred
to City Code and Judiciary Committee.
Moved by Szabo, seconded by Koplos, to authorize hiring an
appraiser to appraise property at the end of Mill Street
and River Street for proposed connection between River Street
and Mill Street, 20 feet in width. Upon roll call, the vote
was:
