CALL TO ORDER: The regular meeting of the City Council of the City of
Des Plaines was called to order at 8:07 P.M. by Mayor Herbert
H. Behrel.

PLEDGE
MINUTES:
The meeting opened with prayer by. Rev. James Jackson, pastor
of Christ Church, followed by the Pledge of Allegiance to the
flag.
Moved by Kehe, seconded by Swanson, to approve the Minutes
of the regular meeting held December 3, 1973, as published.
City Attorney offered correction to Paragraph. two, Page.
three scratching "sentenced to one .year of supervision
following arrest for attempting to engage automobiles outside
the Police Department," and inserting, "given supervision
for one year for an_alle.ged disturbance of the peace".
Building Commissioner corrected Page two, Paragraph.2,
changing word "station" to "foundation". Following corrections
motion declared carried.
IREPORTS:` OFCity Comptroller's Statement_...of._Cash. Receipts_ from January.
CITY OFFICIALS:1, 1973 to November -30, 1973, and report of 1972 Parking

Police Chief Hintz reported there 'were two deaths resulting
from auto -train accident.,._ December_. 9th . _ Further rep.orted.
that $1,013 was realized__from auction of bicycles and mis-
cellaneous items. Further reported that the Police Department
has secured three. additional.. sources of gasoline_ supply
for regular use and two_sources will serve the City in the
event of an emergency. The Police Department used 7,318
gallons of gasoline during November.
Fire Chief Corey reported_ that_Standard_Oil_Bulk Station
will furnish gasoline upon three hour notice in the event
of emergency.
Building Commissioner Baldaccini_reported that a field survey
is necessary to complete_the requested report of non -conforming
signs and should be completed during month of January or
February.
Commissioner of Public:Works reported _that the grand total
for snow removal, including removal__of..damaged trees,
from December 13th to December -16th -was $24,105.60.
Commissioner of Public Works-Schwab's request for ordinance
prohibiting all nite parking in the City's parking lots
during snow removal period was -referred to Buildings Grounds
and Parking Lots Committee.
Corporation Counsel DiLeonardi_.re.po.rted_.that when suit was
filed against Forest Hos..pital._reuse of several buildings.
on the north and south side of Rand Road for more than single
family use, the violation existed but recent investigation
shows that all buildings are in compliance with exception of
one which is currently being investigated for Corporation
Counsel's use in court proceedings December 27th.

Corporation Counsel further. reported that .the Church of
Three Crosses Zoning suit, N. E. Corner of Oakton and.Wolf,
goes to trial January 24th, and the Boechenhauer .case. will
be heard December 19th. The case pending against. Angel. Town
being handled by Attorney Ro.s.e..has .been continued until
January 16th. The Chicago .and Northwestern Railroad today
paid the fine registered in the noise case.

Corporation Counsel DiLeonardi reported:that the Appellate
Court ruled in favor of.the City -in the Metropolitan Sanitary
District case and Friday the MSD filed a petition for re-
hearing.
City Attorney Bouril submitted report concerning. Public
Hearing held by the Federal_.Environmental_Protection Control
Agency and the State -Environmental Protection Control Agency
December 3, 1973.
Moved by Swanson, seconded by Szabo, to.author.ize.City. Attorney
to prepare a text amendment:to Zoning Or.dinance_of_1960, as
amended and _submit_for public.. hearing to require_ a. period
of one year between filing. petitions for_rezoning on the same
parcel of property, and identical request. Motion declared
carried.
Motion to adopt recommendation_.of . Police. and Finance Committees
to award the bid for VTR, Camera and Accessories to. the lowest
bidder, Center Video Center in the amount of $1,839.00 was
brought to the floor. Upon roll call, the vote was:

Mayor Behrel reported that the Park Ridge Manor Fire Protection
District has informed _the_City that payment of las.t_install-
ment is forthcoming and further that the City of Park Ridge
will provide fire protection beginning January 1, 1974, at
which time the contract with City of Des Plaines expires.

of Streets, Traffic_and Forestry._ Committee to_adopt adopt the
recommendations of Engineering.Department for the installa-
tion of signs drawing attention to Park.: Place Parking .Lot.,
and not to allow a left. turn into Park Place.from Lee Street,

Alderman Ward, Chairma n of Streets and Traffic_ Committee
reviewed flow of traffic in. and out of proposed Cougar
Stadium in Rosemont and stated that said committee will
continue to study the impact of the:proposed stadium.
Study of the proposed -stadium and its impact on air pollution
was referred to the Environmental -Control Committee.

Moved by Abrams, seconded by Kehe, to concur with the report
of City Code and Judiciary. Committee that Alderman Szabo's
activities do not constitute a violation of the State Statutes
pertaining to an unlaw ful interest in contracts, namely
Chapter 103, Sec. 3 or Chapter 2.4, Section 3-14-4. Both of,
these statutes essentially require involvement with a contract
of the municipality. In the present instance the construction
contract involved was not with the City but rather with the
Des Plaines Library Board of Directors. Under the Local
Library Act, Chapter 81, Sec. 4-7, the Board has..exclusive
power to let construction contracts_and to spend_.lib.rary. funds.
Accordingly under such Act once the city approved in general
the proposed addition and method of financing, the a±ty
Council (aside from an annual appropriation ordinance) had ®,

no further control over the construction. contract for such
addition. Moreover, the contract-.of.the Board was.not directly
with Mr. Szabo but rather. through a'subcontract with Slezak
Construction Company. In this respect, there were approximate-
ly 12 to 15 general contractors bidding_upon the contract.
Each general contractor in turn had .several masonary sub-
contractors. submitting_.bids.. to them. Thus. as..many as. 20 to
30 masonary contractors were submittingr_bida and.furthermore
the names of these masonary subcontractors. were. not known to
the Board in reviewing the bids of the general contractors.
For the above reasons the relationship. of Mr. Szabo, as a
City Alderman, to the contract was too remote to.b e regarded
as a violation of.the above-mentioned State. Statutes. Letter
from Board of Directors of Des Plaines Public Library
indicates that there was no conflict of interest.

tion of City Code.and Judiciary Commi.ttee_that the City
Attorney be authorized to retain.Ancel, Glink, Diamond
and Murphy to ack as prosecutor in the matter before the
Civil Service Commi.ssion_involving a Public Works employee.
Council recessed from 10:35 to 10:43 to dis.cuss..above matter
in Executive Session. Following executive session,. motion
changed that City Attorney be authorized to retain responsible
counsel to act as pros.ecutor in above mentioned case.
