OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, HELD IN THE COUNCIL CHAMBERS, CITY HALL, MONDAY, December 3, 1973 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines was called to order at 8:10 P.M. by City Clerk Rohrbach. ROLL CALL: doll Call indicated the following aldermen present: Koplos, Szabo, Kehe, Olen, Bolek, Chase, Kisslinger, Birchfield, Erbach, Swanson, Sarlo, Meyer, Seitz, Abrams, Ward. Absent was Alderman Hinde Also present were: City Treasurer Mahon, City Comptroller Blietz, Police Chief Hintz, Fire Chief Corey, Building Commissioner Baldaccini, City Engineer Bowen, Environmental Control Officer Lindahl, Commissioner of Public Works Schwab, Assistant Commissioner of Public Works Schaeffer, Corporation Counsel DiLeonardi, and Oity Attorney Bouril. PRAYER & PLEDGE The meeting opened with prayer by Pastor James Bouman, of Immanuel Lutheran Church, followed by the Pledge of Allegiance to the flag. 4-7.ayor Pro -Tem Moved by Olen, seconded by Koplos, to nominate Alderman Abrams Mayor Pro -Tem until December 13, 1973. Moved by Sarlo, seconded by Meyer, to nominate Alderman Swanson Mayor Pro -Tem. Moved by Meyer, seconded by Sarlo, to nominate Alderman Chase Mayor Pro -Tem. Moved by Kehe, seconded by Seitz, to clDse nominations. Motion declared carried. Moved by Seitz, seconded by Meyer, that votes for Mayor Pro -Tem be cast by secret ballot. Motion declared carried. Alderman Abrams, having received nine votes, was declared elected Mayor Pro -Tem to serve until December 13, 1973, durinh the absence of Mayor Behrel. MAYOR PRO -TEM Code revisions regarding selection of Mayor Pro-Tem.and CHAIRMAN Chairman Pro -Tem, as well as the manner in which a Mayor PRO -TEM Pro -Tem ca:=ts his vote was referred to City Code and Judiciary Committee. MINUTES: Moved by Kehe, seconded by Meyer, to approve the Minutes of the regular meeting held November 19, 1973, as publ.shed. Motion declared carried. REPORTS OF The following monthly reports were ordered placed on file: CITY OFFICIALS: Department of Planning and Zoning; Engineering Department; Health Department; Environmental Report; Building Department. Also, Division of Public Works Staff Meeting. BIDS - Tree City Clerk Rohrbach announced that bids would be received Trimming, December 14th at 3 p.m. for Tree Trimming and Tree Removal, Removal speci;`ications to be drawn by Commissioner of Public Works. CITY TREAS. City Treasurer Mahon submitted Treasurer's report of cash and investment balances. CITY COMPT. City Comptroller Blietz reported that the firm of Benjamin and Lang have completed their study of City's water rates and will present their report at Committee as a Whole meeting, December 10th at 8 P.M. CHIEF OF Police Chief Hlntz reported that during the month of November POLICE there were five arrests involving narcotics,,,eight cases of overdose. Also reported that three male subjects who committed armed robbery of certain food stores have been apprehended. Further that a number of juveniles have been apprehended in connection with vandalism to property. Further reported that Police vehicles are purchasing gasolinE at retail prices from the Clark Station, Rand Road. f G 95 12/3/73 Page two GASOLINE Fire Chief, Police Chief, Civil Defense Director, and USAGE Commissioner of Public Works were requested to determine SURVEY number of gallons of gasoline required -for use in respective departments, availability of supply during weekends in event of emergency, and report at next Council meeting. FIRE CHIEF Fire Chief Corey reported that nine of the Certified Medical Technicians have volunteered to take refresher course at Luthern General Hospital to be eligible for the Paramedic program. BUILDING Building Commissioner Baldaccini reportedthat the building COMMISSIONER at Greco and Morse has structurally passed the Building Department standards and is being rewired. The dry wall is being replaced and plumbing and services should be completed by the end of this week. He further reported that during the week calls were received regarding work being done within the Terrsal Park area, and that work on the outside of the buildings has been stopped until plans are presented for review prior to Building Permit being issued. He also reported that two revisions were required for the new City Hall Building due to station wall existing next to Svoboda building and the other due to shortage of steel. CITY CORP. Corporation Counsel DiLeonardi reported that the court COUNSEL has granted City's motion to dismiss the complaint filed by John Nitz in connection with Certificate of Occupancy. He further reported that the court denied motion of Chicago and Northwestern Railroad to vacate previous order, and now C& NW RR has thirty days from today to file an appeal. ANNEXATION Corporation Counsel DiLeonardi reported that the court Village of enjoined the City from annexing that parcel for which a Mt. Prospect petition had been filed with Village of Mt. Prospect, lying on the west side of Elmhurst Road, south of Algonquin Road, and in the same suit, the court sustained the City's action to annex remaining parcels. Since the annexation of subject parcel by the Village of Mt. Prospect, said Village proceeded to annex adjacent 12 acre parcel, already a subject of action by the City. Moved by Ward, seconded by Seitz, to authorize Corporation Counsel DiLeonardi to investigate recent annexation by the Village of Mt. Prospect described above. Motion declared carried. LEGAL' SUIT Corporation Counsel DiLeonardi reported that Westbank Corp- WESTBANK CORP. oration has abandoned their request for variation of set back requirements on Prairie Avenue and that the case was dismissed with predijuce by the court. MSD SUIT Corporation Counsel DiLeonardi reported that notice has been received that the decision in the MSD case will be filed tomorrow. 1738 Rand Rd. Alderman Kopios requested Corporation Counsel to review Court Decree in the 1738 Rand Road case, to determine if present use of property violates the spirit of court order. CITY ATTY. City Attorney Bouril reported that he has filed an appearance in the Wm. Kunkel & Co, Michael Reid Builders case and will begin preparing the case. COOK CO. Following review of memo submitted by City Attorney Bouril ZONING DOCKET on hearing of Cook Co. Zoning Docket #2393, it was moved 2393 by Kopios, seconded by Szabo, to authorize and direct City Attorney to file an objection to Cook County Zoning Docket #2393. City Attorney Bouxil further reported that traffic court Continued has been light the last two Mondays, and further that five youths were sentenced to one year of supervision following arrest for attempting to engage automobiles outside the Police Department. Further reported he would be attending a hearing before the EPA re requirements for EPA permit prior to construction. STADIUM Alderman Sarlo's request for study of the impact the proposec Village of stadium to be constructed by the Village of Rosemont near Rosemont O'Hare Airport, relating to traffic, parking, flood plain area, pollution, etc. was referred to Environmental Officer to provide preliminary report to City Council& St. & Traffic. Moved by Sarlo, seconded by Swanson, to adopt a resolution directing the FAA to study the possible involvement of the proposed stadium with the landing pattern on 22R, and report their study to the City Council. Motion declared carried. COMMITTEE Moved by Kehe, seconded by Swanson, to adopt the recommenda- REPORTS: tion of Police Committee to award the contract for VTR, Equipment Camera and Accessories to Centre Video Center, in the Police Dept. amount of $1,839.00. Moved by Olen, seconded by Meyer to defer action. FIRE DEPT. Following report of Fire_ Committee, copies submitted to Paramedic all members of City Council, regarding Paramedic Service Program for the City of Des Plaines, it was moved by Seitz, seconded by Olen, to adopt the recommendation of the Fire Committee that the Mayor direct the Fire Chief to provide paramedic service to the citizens of Des Plaines and to initiate such service as soon as possible. Motion declared carried. DEMOLITION Moved by Szabo, seconded by Koplos, to adopt the recommenda- Buildings tion of Buildings, Grounds and Parking Lots Committee to Center St. advertise for bids returnable December 14, 1973, at 3 P.M. for the Demolition of four buildings on Center Street, owned by the City of Des Plaines, City Engineer to draw necessary specifications. Motion declared carried. LICENSE AND Alderman Bolek, Chairman of License and Inspection Committee INSPECTION reported that said committee met and recommends increasing taxi -cab rates, as set forth in Ordinance M-47-73. Further reported that the License and Inspection Committee recommends increases in certain business license fees as set forth in Ordinance M-49-73, and are studying the possibility of implementing a license fee for commercial and industry based on square footage. LEFT -TURN Alderman Ward, Chairman of Streets Traffic and Forestry Lee & Park reported that said committee recommends no action be taken Place at this tim-e on the Chamber of Commerce request to provide for left turn intersection at Lee and Park Place to allow entry into Park Place Parking Lot. Item referred back to said Committee for further study. LEFT -TURN Alderman Chase's request for left turn signals at the Wolf & intersection of Wolf and Oakton Streets, was referred to Oakton Streets, Traffic and Forestry Committee and Traffic Commission and City Engineer to submit request to Cook Co. Seymour 12/3/73 97 Page four Alderman Koplos's request for four-way left turn signals at the intersection of Dempster and Potter was referred to Traffic Commission, Streets, Traffic and Forestry Committee and City Engineer to request permission from State of Illinois. Moved by Erbach, seconded by Kisslinger, to adopt the recommendation of the Majority of Building Control and Inspection Committee to amend the City Code re signs to allow digital time and temperature signs limited to one per parcel of property, with a maximum of two faces no more than twenty feet above the adjacent street grade, City Attorney to draft the necessary ordinance. Alderman Szabo submitted a Minority report, stating that no need has been shown as to the desireability of such sign or signs and tend to attract the attention of motorists. Further if this City is going to pursue the beautification of our city, he stated he can envision many businesses installing these instruments to gain attention and therefore recommends denial of above proposal. Following report of Health and Welfare Committee, copies submitted to members of City Council, it was moved by Olen, seconded by Birchfield, to adopt the recommendation of said committee to establish a Des Plaines Housing Commission, with seven members to be recommended by the Mayor and approved by City Council with amount to be budgeted to cover expenses to include but not be. limited to secretarial service and publication fees, if necessary. City Attorney to draft the necessary ordinance for further consideration, showing members of said Commission to be similar to Special Housing Commission. Motion declared carried. Alderman Koplos's request for review of agenda matters before the City Council reaching the members of City Council as late as night of meeting, and amending the Code making it mandatory that items to be considered by City Council be in hands of City Council prior to meeting, was referred to City Code and Judiciary Committee.
