CALL TO ORDER: The regular meeting of the City Council of the City of
Des Plaines was called to order at 8:05 P.M. by Jr. Mayor
Jeff Dennis, introduced by Mayor Herbert H. Behrel.
ROLL CALL: Roll Call indicated the following aldermen present:
Koplos, Szabo, Kehe, Olen, Bolek, Chase, Kisslinger,
Hinde, Birchfield, Erbach, Swanson, Sarlo, Meyer, Abrams,
Ward. Absent was Alderman Seitz
Also present were: City Treasurer Mahon, City Comptroller Blietz, Police
Chief Hintz, Fire. Chief Corey, Building Commissioner Baldaccini, City
Engineer Bowen, Assistant City Engineer Perl, Director of Planning and
Zoning Richardson, Health Director Branding, Environmental Control Officer
Lindahl, Sanitarian Martin, Civil Defense Director Arthur, Attorney Hug,
City Attorney Bouril, and Deputy Clerk Trost, and Commissioner of Public
Works Schwab.

1 MINUTES:
The meeting opened with Prayer read by City Clerk Rohrbach,
followed by Pledge of Allegiance to the flag.
Jr. Mayor Dennis thanked the City Officials of the City
of Des Plaines and the members of the Optimist Club for
Jr. City Official Week events on behalc of all Juniors
who participated stating that the TWA tour was very
Interesting, the opportunity to view a civil trial most
enlightening and the highlight was the trip to Springfield,
Illinois. In closing he said "We are indeed very proud
to be residents of the City of Des Plaines, Illinois.

REPORTS OF Jr. City Clerk Kathy Nickels stated that Report of Health
CITY OFFICIALS: Department for October, 1973, and Comptroller's report of
Appr'.'priation of Expenditures January 1, 1973 to October
31, 1973 were placed on file.
CITY CLERK Jr. City Clerk Kathy Nickels reported that for the past
year, Mayor Behrel and the City Clerk have been meeting
with Government Department of Maine West High School to
develop an internship program for interested students.
Ten students will spend the entire day with various
Department Heads on Tuesday, December 11, 1973, in a
Pilot Program with an eye toward future development of
an intern program for high school students.
CITY TREAS. City Treasurer Mahon reported $4,923,409.39 total cash
and investments on hand. •

CITY City Comptroller Blietz reported that he has been
COMPTROLLER requested to serve the Commission of Inter -Government
Cooperation Special Study on Local Government accounting
Committee in an advisory capacity.
Jr. CITY Jr. City Comptroller Jim T'Tortorelli placed copy of
COMPTROLLER Statement of Cash Receipts for January 1, 1973 to October
31, 1973 on desks of Council members which shows total
cash receipts to date of $9,298,395 as compared to budget
estimate of $9,277,161. The City's share of State Income
Tax and Sales Tax is over Budget estimate at October 31st
and 98% of the Real Estate Tax has been collected.

CHIEF
Police Chief Hintz introduced Jr. Police Captain Kathy
Miller and reported since November 15th there were three
armed robberies in the City. Further that the Police
Department held their annual inspection.
Fire Chief Corey introduced Mark Brodie, Jr. Fire Chief
and Dave Mozdren, Jr. Deputy Fire Chief who reported that
ambulance calls continue to lead all service calls.
Further reported on three recent fire calls.
BUILDING Building Commissioner Baldaccini thanked the City Council
COMMISSIONER for the opportunity to serve the. City of Des Plaines
RETIRED Moved by Koplos, seconded by Olen, to adopt a resolution
BUILDING commending Mr. Alfred J. Prickett for his more than
COMMISSIONER twenty-five years of service to the City of Des Plaines
Prickett as alderman and Building Commissioner. Motion declared
carried.
CITY City Engineer Bowen introduced Jr. City Engineer Betty
ENGINEER Lou Evans and Jr. Assistant City Engineer Doug Merkel
who reported that the Engineering Department has prepared
six annexation plats for City Council's perusal and that
crews are working on River Road between Ashland and
Oakwood. Further that bids for the Oakton Street.Retention
Basin will be received Wednesday. Further that work on
Farmers Creek and Prairie Avenue Creek is 85% completed.
COMMISSIONER Commissioner of Public Works Schwab introduced Jr. Assistant
OF PUBLIC Commissioner of Public Works Brian Olfield who reported
WORKS as follows:
The Sanitation Department has delivered about 2,000 stands
and bags up to date. Also, our leaf program is still on schedule. We
have about 2,000 yards of leaf compost which will be given away free to
any Des Plaines resident. A large container will be placed in front of
the Public Works building for persons wishing compost for their flower
or garden beds. In our Street Department, street repairs are continuing
as weather permits. All the MFT street repairs for 1974 have been submitter
to the Ynijii.leering Department. The Water and Sewer Department received
one call this weekend, at the Camelot Restaurant on Elmhurst Road; the
complaint was a sewer backup. The Forestry Department has completed
planting 350 replacement _gees and also trees for the Beautification
Program were planted on Oakton Street. We are still waiting for deliveries
of our new trucks from various companies. Our latest report was that
deliveries could be expected in January or February of '74. There are
two employees that are retiring, Mr. Hank Schmidt of our Street Department
who intends to retire the early part of January or February of 1974, an
employee of 21 years, and also Mr. Daniel Flynn, who is retiring after
20 years service in the Sewer Department, on December 14, 1973.

RAND & Alderman Koplos's request for left turn signals or longer
BALLARD signalization during rush hour at the interoection of Rand
Signals and Ballard Roads was referred to Commissioner of Public
Works for processing.
ANNEXATION Corporation Counsel representative Charles Hug reviewed
Elmhurst & history of proceedings to annex certain parcels of land
Algonquin in the area of Elmhurst and Algonquin Road, stating that •
this morning he appeared in court and the court dismissed
City's petition calling for a referendum, and as soon as
he got out of court, he was served with a request for
Temporary Restraining Order No. 73CH7106, as was served
on Mayor, City Clerk and. all aldermen later today.
He reported that the Court denied Mt. Prospect's request
for temporary restraining order on all parcels recited
in Ordinances. A-7-73 and A-8-73, with the exception of
of parcel described as follows:
"Lot 7, of Elmhurst Algonquin Industrial Park -Unit
No. 2 A subdivision of the southeast 1/4 of Section
23, Township 41 North, Range 11, all in Cook County,
Illinois,"
On. said parcel, the Temporary Restraining order was issued
by the court as a previous voluntary petition for
annexation is before the Village of Mt. Prospect, filed
by the owners of subject property. Copy of above-
mentioned order submitted to all members of City Council.
CITY City Attorney Bouril reported that Suit has been filed
ATTORNEY against City No. 73L16687, by William L. Kunkel & Co.
and Michael Reid Builders and Development, Inc., in the
1296 Whi€:;omb Avenue Zoning Variation case. Moved by
Szabo, seconded by Birchfield, to authorize City Attorney
Bouril to defend the City in the above mentioned suit.

City Attorney Bouril further reported that statutory
requirements require a certification or notice be sent
to all banks holding City Funds following passage of
Resolution R-21-73. He also discussed various cases
heard before the courts today.
DIRECTOR OF Director of Zoning and Planning Richardson introduced
ZONING AND Jr. City Director Georgann Carlson who reported that Mr.
PLANNING Richardson attended the meeting to discuss Cook Co. Zoning
Ordinance. Further requested that Ordinance Z-27-73
be held on First Reading to allow for certain housekeeping
amendments to be made by City Attorney and himself
Alderman Seitz arrived at this time.
Council recessed from 8:55 P.M. to 9:20 P.M. to discuss the annexation
of property recited in Ordinances A-7-73 and A-8-73.
ORDINANCE Moved by Abrams, seconded by Ward, to amend Ordinance
A-8-73 A-8-73, by deleting the following from Section 1 thereof:
West of "Also Lot 7 of Elmhurst Algonquin Industrial Park - Unit
Elmhurst Rd. No. 2, A Subdivision in the Southeast 1/4 of Section 23,
Township 41, Range 11 all in Cook County, Illinois."
to comply with the order entered this afternoon No.
73 CH 7106 in which the City was enjoined from annexing
that certain land wherein a voluntary annexation petition
had been filed with the Village of Mt. Prospect.

Environmental Officer Lindahl introduced Jr. Environmental
Officer Anthony Pondel stating that they took readings
on airplane noise today.
Civil Defense Director Arthur introduced Jr.. Civil Defense
Officer Geraldine K. Crouse, who reported that the City
of Des Plaines has received reim;hursement for Fourth
Quarter Personnel and Administration Programs, in the
amount of $485.62 and for training aid equipment,
in the amount of $290:00 from the Federal Government.
Alderman Swanson introduced Jr. Alderman Debra A. Johnson
who made the following report. "Your Committee on Municipal
Development recommends to concur with Zoning Board of
Appeals in Case 73-59-R - property located at .1300 to 1328
Prairie Avenue to deny petition to rezone to R-5 District."

Alderman Kehe introduced Jr. Alderman Carol Schatz, who
set a meeting of Police Committee for 8 P.M., Nov. 26th.
Alderman Seitz introduced Jr. Alderman Madonna Strykow:ki
who reported that Park Ridge Manor Fire Protection District
will be provided fire protection services by the City
of Park Ridje beginning January 1, 1974. Also reported
on the progress of collections from North Maine Fire
Protection District and that the Committee will report
on the paramedic program December 3rd.
Alderman Szabo introduced Jr. Alderman Cathy Greene,
who reported that the contractors have begun excavation
for the new Municipal Building.
Alderman Bolek introduced Cathy Ann Braunz who announced
a meeting of the License and Inspection Committee for
7:30 P.M., November 26th.
Alderman Kisslinger introuced Jr. Alderman Michael Longo
who announced No Report of the Sanitation Committee.
Alderman Ward introduce=-? Jr. Alderman Randy Yaffee who
made the following report: "Your Committee on Streets,
Traffic and Forestry recommends that the contract for
mft Section 100 -TL -CS - Traffic Signals at Rand and
Third, be awarded to Meade Electric Company, in the
amount of $3,605.70, and checks or bonds of unsuccessful
bidders be returned" Moved by Ward, seconded by Seitz
to adopt recommendation of said committee. Upon roll

Alderman Chase introduced Jr. Alderman John Svoboda, who
announced that City Council is invited to a wedding
Wednesday, November 28th of two mannikins at the Historical
Society Museum. Further that gravel parking lot on the
north side of the Library is opened to patrons and addition
to the Library should be completed by January 1st.
Alderman Sarlo introduced Jr. Ald. Jody L. Levitan who
announced that the Youth Activity Committee had no report.

CENTERS who made the following report of the City Code and
Judiciary Committee: "Your Committee on City Code and
Judiciary recommends that City Attorney present Text
Amendment to the Zoning Ordinance re Day Care Centers
as outlined by Director of Planning and Zoning to the
ZoningBoard of Appeals." Moved by Abrams, seconded by

LANDSCAPING Alderman Meyer introduced Jr. Alderman Keither R. Haug,
BUILDINGS who reported as follows: "Your Committee on Civil Defense
and Beaztification recommends amending the Building Code
to control and promote beautification of new commercial
and industrial developments, relating to building
permit requirements to require two copies of detailed
landscaping drawings be submitted to the Building Depart-
ment at the time of application for Building permits,
to be reviewed by the Architectural Commission for
approval. Plans also to be approved by the Building
Commissioner prior to issuance of building permit.
Single family and two family detached dwellings are
exempt from these requirements. Also to propose an
amendment to the building code with reference to occupancy
permit, (a) No certificate of occupancy shall be issued
for the occupancy of any building unless building has
been construction in compliance with the provisions
of approved lancscaping drawings, but if in the decision
of Building Commissioner that the season of the year
prevents compliance with landscape improvements at the
time of occupancy, a percentage of the cash bond, or
equivalent, be withheld by the City until compliance
with provisions of the regulations concerning the
landscape improvements are performed. The time limit
for performance of landscape improvements shall not be
longer than six months from the date of occupancy of
the building." Moved by Meyer, seconded by Sarlo to
adopt above recommendation for submission to Civil
Defense and Bea-tification'and Building Control and
Inspection Committee upon drafting by City Attorney,
for further review. Motion declared carried.

CONTROLS who reported on the meeting of NOISE held at O'Hare
Inn and announced meeting of the Environmental Commission
for November 28th at 8 p.m.
SPECIAL__Alderman Olen introduced Jr. Alderman Terry Quinn, who

worked with the various departments on the budget and
plans a Committee As a Whole Meeting at a later date.
