MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY
OF DES PLAINES, HELD IN THE
COUNCIL CHAMBERS, CITY HALL,
MONDAY, November 5, 1973
CALL TO ORDER: The regular meeting of the City Council of the City of Des
Plaines was called to order at 8 P.M. by City Clerk Rohrbach.
ROLL CALL:
Roll Call indicated the following aldermen present:
Koplos, Szabo, Kehe, Olen, Bolek, Chase, Kisslinger, Hinde,
Birchfield, Erbach, Swanson, Sarlo, Meyer, Seitz, Abrams
Ward.
Also present were: Cityeasurer Mahon, City Comptroller Blietz, Police
Chief Hintz, Fire Chief et,'Building Commissioner Prickett, Assistant
City Engineer Perl, Commissioner of Public Works Schwab, Assistant
Commissioner of Public Works Schaeffer, Director of Planning and Zoning
Richardson, Environmental Officer Lindahl, City Attorney Bouril and
Corporation Counsel DiLeonardi.

Moved by Koplos, seconded by Olen, to nominate Alderman
Bolek to serve as Chairman Pro -Tem for this meeting.
Moved by Swanson, seconded by Seitz, to close nominations
for Chairman Pro -Tem and elect Alderman Bolek. Motion
declared carried.
PRAYER & The meeting opened with prayer by Rev. Fedder, followed
PLEDGE by the Pledge of Allegiance to the flag.

CITY OFFICIALS: Reports for the month of October_ of Planning and Zoning
Department, Building Department, Engineering Department,
Environmental. City Comptroller's report of 1972 Parking
Revenue Bond Construction Account, and report of. Water
Fund Report of Examination, Nine Months ended September
30, 1973.
INVESTMENT OF City Treasurer Mahon requested that City Attorney prepare
FUNDS a resolution designating the banks in which City should
invest funds..
POLICE CHIEF
FIRE CHIEF
Police Chief Hintz reported that the Department made eight
arrests involving marcotics in October and further that
they handled 24 calls involving criminal damage and
mischief on Halloween.
Fire Chief Corey expressed sincere appreciation to members
of City Council who attended retiring Fire Chief Haag's
retirement dinner. He further reported that the Department
received realistictraining in the burning of two large
buildings at Maryville Academy, and also attended training
session conducted by Northern Illinois Gas Co.
MORATORIUM Alderman Sarlo questioned Building Commissioner Prickett
MODULAR. TYPE re Modular Type Home Construction at Greco and Morse
HOME as to whether it meets the Building Code. Mr. Frank
CONSTRUCTION Tomascheski was granted permission to address the City
Council expressing disapproval of modular type home
construction. Following discussion, it was moved by Sarlo,
seconded by Meyer to declare a moratorium be held on
modular type of home construction and further to research
the building code re this type of construction. Upon roll
call, the vote was:
AYES: - 6 - Szabo, Chase, Birchfield, Sarlo, Meyer, Seitz.
NAYS: 10 - Koplos, Kehe, Olen, Bolek, Kisslinger, Hinde,
Erbach, Swanson, Abrams, Ward

BUILDING Referred to Building Control and Inspection Committee
CODE was Alderman Erbach's request for review of Building Code
re present standards to determine whether or not the
Code is satisfactory as far as modular home construction
is concerned.
CITY Assistant City Engineer Perl reported that Federal and
ENGINEER State EPA visited Maple and Thacker Street water plants
taking water samples as well as at miscellaneous locations
throughout the system.
COMMISSIONER OF Commissioner of Public Works Schwab reported that the fall
PUBLIC WORKS tree planting has begun and the leaf program continues on
schedule. Further reported that 2,000 stands and bags
are being delivered to another area, and salt is being
purchased from the State of Illinois at a cost of $11.17
per ton. Spreaders and plows are being prepared for
winter season.
LEGAL - Corporation Counsel reported that the Circuit Court ruled
VILLAGE OF against the City in the Village of Mt. Prospect annexation
MT. PROSPECT suit involving the 8 acre parcel of land known as the
"Dawnfresh property" on the south side of Dempster Street,
west of Elmhurst road.
CHICAGO & Corporation Counsel DiLeonardi reported that the court
NORTHWESTERN assessed a fine of $60 plus $20 court costs against
Chicago and Northwestern Railway Co. in suit for violation
of City's noise ordinance.

CROSSINGS
Corporation Counsel DiLeonardi reported that hearings are
being held before the Illinois Commerce Commission on
City's petition for improved signalization at Soo Line
Railroad crossings within the City.
CORPORATION Corporation Counsel DiLeonardi further reported that
COUNSEL an opinion in the MSD case is expected in the next several
weeks. Further reported that the trial in the Boeckenhauer
case is scheduled for November 8th.
LEGAL Corporation Counsel DiLeonardi reported that the court
FOREST HOSPITAL has continued the Forest Hospital case on alleged zoning
violations to allow them to cure certain violations and
arrangements are being made for joint inspection of buildings
involved.
REDEVELOPMENT Alderman Szabo's request for legislation requiring owners
R-5 District of buildings in the R-5 District to show proper placement
of tenants occupying buildings to be demolished prior to
redevelopment was referred to Building Control and Inspection
and City Code and Judiciary Committee.
LEGAL NON- Council requested that measures be taken to notify property
CONFORMING USE owners several times re discontinuance of non -conforming
use of property in accordance with amortization schedule
found in Zoning Ordinance of 1960 as amended.
CONFLICT OF Alderman Szabo's request for opinion as to whether or not
INTEREST he is violating the State Statutes Ethics Law by providing
-Aid. Szabo construction work for the general contractor who is building
an addition to the Library was referred to the City Code and
Judiciary Committee.
CITY ATTORNEY City Attorney Bouril reported on the seminars attended by
him in connectionwith the NIMLO conference and submitted
copies of various subjects to members of City Council,
and further reported that he presented various text amend-
ments before the Zoning Board of Appeals - letters to be
submitted later in this meeting.

The motion to adopt the recommendation of Municipal
Development Committee to approve Plat of Michael Reid
Resubdivision deferred at last meeting was brought to the
floor. Majority report and. Minority Report of Plan
Commission was read to City Council. Upon roll call, the
vote was:

tion of Building Grounds and Parking Lots Committee to
authorize the Mayor to finalize contracts to purchase
properties located at 760 Pearson, 766 Pearson, and
748 Pearson Street, and report to said committee for
further action, for completion of land acquisition to
construct Center Street Parking lot. Upon roll call, the
vote was:

Land Acquisition authorize the Mayor to finalize an exchange of properties
with Des Plaines Tomorrow Corporation on an equal basis
for installation of sewer and widening of Prairie Avenue,
in exchange for Center Street vacation area. Upon roll
call, the vote was:

Committee that the Mayor be authorized to negotiate with
Des Plaines Tomorrow Corporation and or their representative
to establish least cost for parking facilities and report
to City Council. Motion declared carried. Aldermen
Sarlo, Meyer, and Chase voting No.
Moved by Szabo, seconded by Koplos, to adopt the recommenda-
tion of Building Grounds and Parking Lots Committee to
approve Change Order awarding an additional amount of
$3,025.00 to Ewing Plumbing, Inc. to connect storm and
sanitary sewer for new Municipal Building at different
location from that previously specified. Upon roll call,
the vote was:

Moved by Kisslinger, seconded by Birchfield, to adopt the
FEES recommendation of Sanitation Committee that the City
continue to charge the same collection fee of $1.50 per
month to all households using the refuse disposal service.
In the event the Council desires to extend a special service
to our senior citizens, we recommend that it be in the form
of a program which all senior citizens in the City can
participate, regardless of type of dwelling in which they
reside. Motion declared carried. Aldermen Swanson and
Bolek voted No.0

Parking - Alderman Ward, Chairman of Streets, Traffic and Forestry
Des Plaines Ave.Committee reported that signs on either side of Des. Plaines
Brown St. area Avenue from Jefferson to Miner have been already: posted.
Further reported that said committee investigated complaint
re Brown Street speeding and dog litter near Menominee Park,
and will await 20 MPH state law and No Dog Walking signs
have been posted near the park by Department of Public
Works. No official action taken.

Parking" be allowed,on either side of Seymour Avenue between

on Seymour Avenue between Dorothy and Florian Drive, City
Attorney to draft necessary ordinance. Motion declared
carried.
Moved by Ward, seconded by Seitz, to adopt the recommenda-
tion of Streets, Traffic and Forestry Committee for
"No Parking between 8 a.m. and 6 p.m., except Saturdays,
Sundays and Holidays" on Luau between Third and Fourth
on the south side of the street, City Attorney to draft
necessary ordinance. Motion declared carried.
LINCOLN Moved by Ward, seconded by Olen, to adopt the recommendation
WHITE STOP SIGN that traffic on Lincoln stop for traffic on White Street,
of Streets, Traffic and Forestry Committee, City Attorney
to draft necessary ordinance. Motion declared carried.
STREET NAME PROposal of City Clerk Rohrbach to change name of Pine
CHANGE Pine Ct. Court to Pine Tree Court to avoid further confusion in
the area was referred to Streets, Traffic and Forestry
Committee.
HOWARD STREET Moved by Koplos, seconded by Kisslinger, to adopt the
STORM SEWER recommendation of Water and Sewer Committee to award the
EXTENSION contract for the Howard StreetzStorm Sewer Extension to
Vince DiVito of Bloomingdale, I11., in the amount of
$176,037.55, Alternates I and II of said contract to be
included in this contract and checks or bid bonds of
unsuccessful bidders to be returned. Upon roll call, the
vote was:

of occupancy be issued unless requirements for landscaping
have been met - City Attorney to draft necessary amendment

for nomination to the office of Commissioner of the

Building Commissioner Prickett's letter regarding certain
Building Code Amendments relating to the Electrical Code

Captain Blume's letter regarding installation of sidewalks

of certain law books as outlined by City Attorney Bouril
for the Law Library, at a cost not to exceed $3,600.00,
waiving the usual bid procedures. Upon roll call, the

Kisslinger, Hinde, Birchfield, Erbach, Swanson,
