08/17/1970#343 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, CITY HALL, MONDAY, AUGUST 17, 1970. CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines was called to order by Mayor Herbert H. Behrel at 8:05 P.M. The meeting opened with prayer by Rev. Keith A. Davis, Pastor, Church of the Master, United Church of Christ, followed by the Pledge of. Allegiance to the flag. ROLL CALL: Roll Call indicated the following aldermen present: Koplos, Szabo, Sherwood, Leer, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels. Absent were Aldermen Prickett, Bolek and O'Brien. Also present were: Police Chief Hintz, Fire Deputy Corey, City Comptroller Blietz, Assistant Commissioner of Public Works Schaefer, Building Commissioner Schuepfer and City Attorney DiLeonardi. There being a quorum present, the meeting was in order. MINUTES: RESOLUTION It was moved by Alderman Hinde, seconded by Alderman Swanson that the Minutes of the regular meeting held August 3, 1970 be approved as written. Motion declared Carried. Due to the fire at Jeco Industries on. Redeker Road August 15, 1970, it was moved by Alderman Szabo, seconded by Alderman Shillington to adopt a Resolution proposed by Mayor Behrel to allow Alderman Bolek to conduct his business in the vacated Sears Farm Store on Pearson Street for a period of ninety days. Motion declared Carried. REPORTS OF The following reports were ordered to be placed on CITY OFFICIALS: file: July reports for Finance and Engineering Departments. Mayor Behrel Mayor Behrel plans to call a meeting with neighboring villages to discuss United Motor Coach request for municipal funds. Police Chief Police Chief Hintz reported of a recent meeting with Board of Fire and Police Commissioners stating that twenty-six applicants tooka written test and an eligibility list will be posted early September. Fire Depute Fire Deputy Corey reported that the fire at Jeco Industries on Redeker Road, Saturday, August 15, 1970, was served by the North Maine Fire Protection District and upon call from the Chief of North Maine, Des Plaines Fire Department assisted. Building Building Commissioner Schuepfer reported that prosecution Commissioner was dismissed against property owner on Oakton Street. Sewer was installed as requested by City of Des Plaines. He further requested a legal opinion from City Attorney DiLeonardi regarding another sewer problem. City Attorney City Attorney DiLeonardi made reference to memorandum. to the City Council having to do with text amendment to the Zoning ordinance, making post offices special uses. He further reported that the Metropolitan Sanitary District filed brief in court and that the Roy Egan condemnation suit trial was set for November 5, 1970. Progress report was also made on the Rio -Rand suit. Post Offices Special Uses Police Dept. Servi-Car 344 Page two 8/17/70 It was moved by Alderman Swanson, seconded by Alderman Sherwood to authorize City Attorney petition the Zoning Board for a public hearing for a text amendment which would eliminate post offices as permitted uses and allow them as special uses only. Motion declared Carried. It was moved by Alderman Thomas, seconded by Alderman Bonaguidi that the one bid received August 10, 1970 for Police Department Servi-Car be opened by Deputy Clerk and read before Council. Motion declared Carried. It was moved by Alderman Thomas, seconded by Alderman Bonaguidi that the bid for the Servi-Car be awarded Villa Park Harley-Davidson Sales, Inc. in the amount of $2,100.00 net. Upon roll call the vote was: AYES: - 14 - Aldermen Koplos, Szabo, Sherwood, Leer, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. NAYS: - 0 - None ABSENT: 3 - Aldermen Prickett, Bolek, O'Brien. There being fourteen affirmative votes, Motion declared Carried. Elk Grove Fire Progress report was made by Alderman Hinde stating Protection that Elk Grove Fire Protection fees are now $6,000.00 and by next year may be as high as $9,000.00. Expansion of Fire Station No. 1 It was moved by Alderman Szabo, seconded by Alderman Wagner that the City employ Holmes and Fox Architects to study feasibility of enlarging Fire Station No. 1, cost not to exceed $500.00. Upon roll call, the vote was: AYES: - 14 - Aldermen Koplos, Szabo, Sherwood, Leer, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. NAYS: - 0 - None ABSENT: 3 - Aldermen Prickett, Bolek, O'Brien. There being fourteen affirmative votes, Motion declared Carried. Referred to Building and Grounds Committee and Streets and Traffic Committee was letter from Des Plaines Redevelopment Association, Inc. No Left Turn It was moved by Alderman Leer, seconded by Alderman Seegers & Harvey Koplos to ratify action for No Left Turn sign at Seegers Road and Harvey Avenue and authorize City Attorney draft necessary amendment to ordinance. Motion declared Carried. Stop Signs It was moved by Alderman Leer, seconded by Alderman Grove and Hill Wagner to concur with Streets and Traffic Committee's recommendation that a three-way stop sign be posted at the intersection of Grove and Hills Avenues and authorize City Attorney draft necessary ordinance. Motion declared Carried. Stop Signs It was moved by Alderman Leer, seconded by Alderman Springfield and Michaels to concur with Streets and Traffic Committee's Pennsylvania recommendation that a three-way stop sign be posted at Springfield .and Pennsylvania Avenues and authorize City Attorney draft necessary amendment to ordinance. Motion declared Carried. Stop Signs Marshall and Cordial Dr. Load Limit White Street 345 Page three 8/17/70 It was moved by Alderman Leer, seconded by Alderman Michaels to concur with Streets and Traffic Committee's recommendation that three-way stop signs be posted at Marshall and Cordial Drive, and authorize City Attorney draft necessary ordinance. Motion declared Carried. It was moved by Alderman Leer, seconded by Alderman Wagner to concur with Streets and Traffic Committee's recommendation that a three -ton load limit sign be posted on White Street from Oakton to Ashland Avenue, and authorize City Attorney to draft necessary ordinance. Motion declared Carried. Air Compressor It was moved by Alderman Leer, seconded by Alderman Koplos to concur with Streets and Traffic Committee's recommenda- tion that the bid for the Air Compressor for the Public Works Department be awarded to Baker Equipment Company, low bidder meeting all specifications, in the amount of $4,338.00, and that bid checks and/or bonds be returned to the unsuccessful bidders. Upon roll call, the vote was AYES: - 14 - Aldermen Koplos, Szabo, Sherwood, Leer, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. 0 - None. Pick -Up Trucks It was moved by Alderman Leer, seconded by Alderman Wagner to concur with Streets and Traffic Committee's recommenda- tion that the bid for four new 1971 four-wheel pick-up trucks be awarded to the low bidder meeting all specifications, Gilmore International, Inc. in the amount of $15,986.00 and that bid checks and/or bonds be returned to the unsuccessful bidders. Upon roll call, the vote was: AYES: - 14 - Aldermen Koplos, Szabo, Sherwood, Leer, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. NAYS: - 0 - None. Truck and It was moved by Alderman Leer, seconded by Alderman Wagner Aerial Platform to concur with Streets and Traffic Committee's recommenda- and Crane tion that the bid for a new 1970 truck and aerial platform and crane be awarded to the low bidder meeting all specifications, Elliott Manufacturing Company of Omaha, Nebraska in the amount of $18,657.00. Upon roll call, the vote was: AYES: - 13 - Aldermen Koplos, Sherwood, Leer, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. NAYS: - 1 - Alderman Szabo. Benjamin and Lang Parking Study Referred to the Parking Lots Committee was letter from Benjamin and Lang with reference to parking system, throughout City. O'Hare Noise Abatement Forestry Sidewalks - Nimitz and North Shore Civil Defense Insurance City Employees Beautification Special Historical Society Bills Payable 346 Page four 8/17/70 It was moved by Alderman Michaels, seconded by Alderman Sherwood to concur with Judiciary and Air and Water Pollution Committees that the City of Des Plaines not enter into law suit filed by Park Ridge and other surrounding municipalities regarding the O'Hare Noise Abatement. City will continue to investigate the possibility of their own law suit against the Airport Authority and will continue to be involved in the N.O.I.S.E. program. Motion declared Carried. Alderman Leer reported that Tower Tree Experts had removed 103 diseased elm trees during the period of July 6 thru August 7, 1970. He further stated that City would be purchasing new trees for planting this fall. It was moved by Alderman Leer, seconded by Alderman Wagner to reject all bids for the sidewalks on Nimitz Drive and North Shore Avenue and readvertise for bids returnable Monday, August 31, 1970 at 3:00 P.M. in the City Clerk's office. Motion declared Carried. Alderman Czubakowski reported that City of Des Plaines is co-host:ng'.iwith Mt. Prospect and Arlington Heights in the Illinois Civil Defense Council. Luncheon will be held at Arlington Park Towers at 12:00 noon, Saturday, September 19, 1970 and all City officials are welcome,. ; Referred to the Insurance Committee was letter from John Hancock Insurance Company re group insurance for City employees;for study and report. - Progress report was made by Alderman Czubakowski as to the cutting of weeds and grading of Chicago and North Western Railroad right-of-way in connection with the City's Beautification Program. It was moved by Alderman Czubakowski, seconded by Alderman Hinde to concur with Special Historical Society Committee to appoint Miss Mary V. Wright as coordinator for the Historical Society effective September 1, 1970. Upon roll call, the vote was: AYES: - 14 - Aldermen Koplos, Szabo, Sherwood, Leer, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. NAYS: - 0 - None. Ordinance It was moved by Alderman Sherwood, seconded by M-14-70 Alderman Shillington to remove Ordinance M-14-70 from Labor the Table having to do with City employee labor Relations relations. Upon roll call, the vote was: AYES: - 13 - Aldermen Koplos, Sherwood, Leer, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. NAYS: - 1 - Alderman Szabo. It was moved by Alderman Sherwood, seconded by Alderman Michaels, to Amend Ordinance M-14-70 by adding thereto the following language to be known as Section 5 (e): The City may elect to cease or refuse to recognize or negotiate with and may terminate any existing agreement with any group, association or individual representing such groups or associations where any of the above have been convicted of violating any Federal laws, laws of the State of Illinois, or ordinances of the City of Des Plaines, providing that the conviction of any such individual is related to his activities on behalf of such groups or association. Upon roll call, the vote was: AYES: - 13 - Aldermen Koplos, Sherwood, Leer, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. NAYS: - 1 - Alderman Szabo. Ordinance Placed on first reading was Ordinance T-30-70, prohibiting T-30-70 parking along the west side of Lee Street for a distance of 150 feet south from the intersection of Lee Street and Perry Street. It was moved by Alderman Shillington, seconded by Alderman Hinde, to adopt resolution R-12-70 urging speed limits be posted by the Cook County :.Highway Department on Wolf Road from Touhy Avenue to Golf Road not to exceed 30 mph. Upon roll call, the vote was: AYES: - 14 - Aldermen Koplos, Szabo, Sherwood, Leer, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Setiz, Shillington, Michaels, Mayor. The Petition for Annexation for the Kiwanis property located at Woodland and Grove Avenues, was referred to the Municipal Development Committee for study and report. The Plat of Subdivision for the Academy of St. Patrick was referred to the Municipal Development Committee for study and report. The letter from the Plan Commission and Des Plaines Zoning Board of Appeals with reference to the zoning report made by Tec -Search, was ordered to be placed on file. The letter from the Zoning Board of Appeals with reference to variations on properties with 50 -ft. frontage lotsfwas referred to the Municipal Development Committee for study and report. Referred to the Plan Commission was lot division for property located at 2203 S. Wolf Road. Referred to the Plan Commission was lot division for property located at 2812 Curtis Street. No action was taken by Council with reference to hearing to be held August 21, 1970 at 10:00 A. M., Illinois Commerce Commission, 160 N. LaSalle Street, Chicago, Illinois, Northern Illinois Gas Company's application for authority to try to obtain supplies of gas in service territory and to place gas supply adjustment rider in company's rate schedules. Letter from Cook County Highway Department states that plans for the Wieboldt Avenue drive area have been adjusted to provide for a 130 -ft. median opening to facilitate turning movements. Letter from State Highway Department with reference to traffic sign -located on the northwest corner of Northwest Highway and Graceland Avenue, states that curb lane is a mandatory right lane and according to the 1969 Illinois Vehicle Code, right turns on Red are only permitted at "T" intersections. 351 Page nine 8/17/70 Liquor License The request of Mr. Nicholas A. Vangel for liquor license to operate banquet facilities at 783 Lee Street was referred to License, Health and. Inspection Committee for study and report. Leahy Circle Paving The request of Alderman Shillington for paving Leahy Circle between Kathleen Drive on the south and Millers Road on the north, was referred to City Engineer Bowen for study and report.
