08/03/1970338 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, CITY HALL, MONDAY, August 3, 1970 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines was called to order by Mayor Herbert H. Behrel at 8:00 P.M. The meeting opened with prayer by Rev. James Jackson, Associate Pastor of Christ Evangelical and Reformed Church followed by the Pledge of Allegiance to the flag. III ROLL CALL: Roll Call indicated the following aldermen present: Koplos, Szabo, Sherwood, Bolek, Hinde, Czubakowski, Wagner, Swanson, Thomas, Seitz, Shillington, Michaels. Also present were: Police Chief Hintz, Fire Chief Haag, City Comptroller Blietz, City Engineer Bowen, Assistant Commissioner of Public Works Schaefer, Building Commissioner Schuepfer, and City Attorney DiLeonardi There being a quorum present, the meeting was in order. MINUTES: APPOINTMENT Morgan O'Brien 4th Ward Alderman It was moved by Alderman Hinde, seconded by Alderman Swanson that the Minutes of the regular meeting held July 20, 1970 be approved as published. Motion declared Carried. It was moved by Alderman Hinde, seconded by Alderman Sherwood, to concur with Mayor Behrel's appointment of Mr. Morgan O'Brien to fill vacancy created by the death of Alderman Reuel Figard as Fourth Ward Alderman until the next regular election. Upon roll call the vote was: AYES: - 13 - Alderman Koplos, Szabo, Sherwood,--Bolek, Hinde, Czubakowski, Wagner, Swanson, Thomas, Seitz, Shillington, Michaels, Mayor. NAYS: - :0 - None ABSENT: 3 - Alderman Leer, Prickett, Bonaguidi. There being thirteen affirmative votes, Motion declared Carried. Newly appointed Alderman O'Brien was then duly sworn in and seated as 4th Ward Alderman. REPORTS OF The following reports were ordered to be placed on file: CITY OFFICIALS: Monthly reports for July of the following Departments; Public Works, and Building Department. APPOINTMENT City Clerk Rohrbach reported to City Council that Mrs. DEPUTY CLERK Marilyn Trost has been appointed as Deputy Clerk effective August 3, 1970, and is authorized to execute her signature on all documents, inc, ding certificates, as follows: ilyn Trost, Deputy Clerk INSPECTIONS Building Commissioner Schuepfer reported that±.the Fire C-4 District Department, Health Department, and Building Department are conducting investigations of buildings located within the C-4 Zoning District in conformance with Resolution R-10-70. STORM SEWER 8th Ward ISTORM SEWER SECTION 21 City Engineer Bowen read report submitted by him to City Council regarding recommendations to solve Storm Sewer Drainage in the 8th Ward. Following this report, it was moved by Alderman Shillington, seconded by Alderman Hinde, to concur with City Engineer's recommendation to authorize Rock Road Construction Company to oversize proposed sewers in South Park, Mount Prospect Park District, at a total cost of $8,854.00.1 Upon roll call, the vote was: AYES: - 14 - Alderman Koplos, Szabo, Sherwood, Bolek, O'Brien, Czubakowksi, Wagner, Swanson, Thomas, Seitz, Shillington, Michaels, Mayor. NAYS: 0 - None ABSENT: 3 - Alderman Leer, Prickett, Bonaguidi. There being fourteen affirmative votes, Motion declared /% Carried. //0'1 OAKTON ST. BYPASS SEWER TRAFFIC Lee & Touhy 8/3/70 339 Page two It was moved by Alderman Shillington, seconded by Alderman Michaels, to concur with City Engineer's recommendations to authorize Engineering Department to prepare plans and specifications for Bypass Sewer in Oakton Street west of Mt. Prospect Road and advertise for bids, at an estimated cost of $13,800. Motion declared Carried. Copies of the Traffic Report at the intersection at Lee and Touhy prepared by Engineering Department were submitted to City Council by Engineer Bowen. SPEED LIMIT It was moved by Alderman Bolek, seconded by Alderman Koplos, WOLF RD. to adopt a resolution urging that the speed limit to be Resolution posted by the County Highway Department on newly constructed Wolf Road from Touhy Avenue to Golf Road not exceed 30 m.p.h. Motion declared Carried. ZONING SUIT Rand -Wolf City Attorney DiLeonardi reviewed Final Judgment Order in the Rand -Wolf Zoning Case, copies of which were submitted to all members of City Council. It was moved by Alderman Seitz, seconded by Alderman Shillington, to authorize City Attorney DiLeonardi to proceed with an appeal of of judge's decision in said case. Upon roll call, the vote was: AYES: - 14 - Alderman Koplos, Szabo, Sherwood, Bolek, O'Brien, Hinde, Czubakowski, Wagner, Swanson, Thomas, Seitz, Shillington, Michaels, Mayor. NAYS: 0 - None ABSENT: 3 - Alderman Prickett, Leer, Bonaguidi There being fourteen affirmative votes, Motion declared Carried. IICOMMITTEE It was moved by Alderman Swanson, seconded by Alderman REPORTS Wagner, to concur with Municipal Development Committee's Zoning recommendation to authorize City Attorney to draft Variations necessary amendment to Zoning Ordinance and prepare Petition to Zoning Board for Public Hearing to provide that the Building Commissioner be authorized to grant building permits on subdivided lots approved by City Council where a variation exists on lot frontage within 10% of require- ment and where lot contains the required square foot area. Motion declared Carried. 1 SUBDIVISION It was moved by Alderman Swanson, seconded by Alderman REGULATIONS Hinde, to authorize City Attorney to draft necessary amendment to the ordinance in accordance with Municipal Development Committee's recommendation to require that all changes or rearrangement in the boundary or division of -property or public thoroughfare be subdivided; providing for submission of 8 copies tentative plat, one copy of which to be submitted to all public utilities; City Engineer to conduct inspections; allow letter of deposit in escrow account in lieu of performance bond for public improvements; add the stipulation that if final plat is not recorded within a period of six months following final approval by Council, it be declared null and void; and add Section having to do with Subdivision fees to be adopted by resolution of the Council. Further to authorize City Attorney to prepare Resolution re subdivision fees as recommended by Municipal Development Committee. Motion declared Carried. STOP SIGNS It was moved by Alderman Koplos, seconded by Alderman ASHLAND & Sherwood, to concur with Streets and Traffic Committee's CORA recommendation to authorize City Attorney to draft necessary ordinance that westbound traffic on Ashland Avenue stop for traffic on Cora Street. Motion declared Carried. Touhy 8/3/70 Page three 340 It was moved by Alderman Koplos, seconded by Alderman Sherwood, to concur with Streets and Traffic Committee's recommendation to authorize City Attorney to draft ordinance for two way stop sign for traffic on Ashland to stop for traffic on Center Street, east and west bound. Motion declared Carried. It was moved by Alderman Koplos, seconded by Alderman Michaels, to authorize City Attorney to draft ordinance to require northbound traffic on Susan to stop for traffic on Jill Court. Motion declared Carried. It.was moved by Alderman Koplos, seconded by Alderman Wagner, to concur with Streets and Traffic and Finance Committees' recommendation to award the bid for the 1970 truck and aerial platform and crane to the only bidder, Elliott Manufacturing Co., for a total amount of $18,657.00. It was moved by Alderman Bolek, seconded by Alderman Michaels, to defer action on said report. It was moved by Alderman Swanson, seconded by Alderman Sherwood, to adopt the following resolution: BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME: $113,297.44. Upon roll call the vote was: AYES: - 14 NAYS: ABSENT: - Alderman Koplos, Szabo, Sherwood, Bolek, O'Brien, Hinde, Czubakowski, Wagner, Swanson. Thomas, Seitz, Shillington, Michaels, Mayor. 0 - None 3 - Alderman Prickett, Leer, Bonaguidi There being fourteen affirmative votes, Motion declared Carried. It was moved by Alderman Wagner, seconded by Alderman Thomas, to adopt Ordinance M-14-70, relating to disputes Between the City of Des Plaines and its Employees Concerning Employment within Limits of the City's Power and Discretion; To Prohibit Strikes and Work Stoppages by Public Employees and Provide Disciplinary Action in Connection Therewith; To Provide for the Adjustment of Grievances; to Create a Public Employees Labor Relations Board and Define its Powers and Duties. It was moved by Alderman Sherwood, seconded by Alderman Swanson, to` table Ordinance M-14-70 to provide sufficient time for study of amendment to be proposed by Alderman Sherwood. Motion declared Carried. Alderman Wagner voted No. It was moved by Alderman Swanson, seconded by Alderman Thomas, to adopt Ordinance Z-15-70 rezoning property located at 999 E. Touhy Avenue and providing for Special Use Planned Unit Development. It was moved by Alderman Bolek, seconded by Alderman Szabo, to amend the ordinance that the building proposed would not exceed 45 feet in height, page eight. Alderman Szabo, Bolek and Seitz spoke for this amendment as they believed it would set a precedence and further that the downtown development would suffer, if buildings on the areas surrounding downtown exceed 45 feet in height. Amendment was declared lost. Upon roll call on Ordinance Z-15-70, the vote was: AYES: - 11 - Alderman Koplos, Sherwood, O'Brien, Hinde, Czubakowski, Wagner, Swanson, Thomas, Shillington, Michaels, Mayor. NAYS: 3 - Alderman Szabo, Bolek, Seitz ABSENT: 3 - Alderman Prickett, Leer, Bonaguidi There being eleven affirmative votes, Motion declared Carried. 8/3/70 341 Page four ORDINANCE Placed on First Reading was Ordinance A-4-70 providing A-4-70 for the annexation of properties north and south of Catholic Central Road and east of Wolf Road known as the Catholic Cemeteries Cemeteries Property. Property ORDINANCE It was moved by Alderman Czubakowski, seconded by Alderman Z-16-70 Wagner, to waive First Reading of Ordinance Z-16-70 1400 E.Touhy correcting the legal description and commonly known as location of Ordinance Z-13-70, which rezoned property located at 1400 E. Touhy Avenue to C-2 Commercial District. It was movedby Alderman Czubakowski, seconded by Alderman Sherwood to adopt Ordinance Z-16-70. Upon roll call, the vote was: AYES: - 13 - Alderman Koplos, Sherwood', Bolek, O'Brien Hinde, Czubakowski, Wagner, Swanson, Thomas, Seitz, Shillington, Michaels, Mayor. NAYS: 1 - Alderman Szabo ABSENT: 3 - Alderman Prickett, Leer, Bonaguidi There being thirteen affirmative votes, Motion declared Carried. DEDICATION The Plat of Dedication of 33' to extend Pleasant Lane Pleasant Lane approved by Plan Commission was referred to the Municipal Development Committee for study and report. RESOLUTION It was moved by Alderman Wagner, seconded by Alderman License Hinde, to adopt a resolution authorizing Mayor and City Agreement Clerk to execute License No. 18998 covering a cast iron Soo -Line" pipe line extending on and across Railroad Company property on Central Road. Upon roll call, the vote was: AYES: - 14 - Alderman Koplos, Szabo, Sherwood, Bolek O'Brien, Hinde, Czubakowski, Wagner, Swanson, Thomas, Seitz, Shillington, Michaels, Mayor. NAYS: 0 - None ABSENT: 3 - Alderman Prickett, Leer, Bonaguidi There being fourteen affirmative votes, Motion declared Carried. APPOINTMENT It was moved by Alderman Szabo, seconded by Alderman Koplos, LIBRARY BD. to concur with Mayor Behrel's appointment of Mr. Mason E. North, 442 Alles Street, to the Library Board to fill vacancy of Mr. Santiago, term to expire June 30, 1971. Motion declared Carried. PETITION Alderman Seitz submitted a petition from residents on Yale Court Yale Court regarding parking restrictions on Yale Court. Alderman Seitz requested a moratorium on issuing tickets for violations to allow Streets and Traffic Committee to study possibility of 3 hour parking 10 a.m. to 6 p.m. and further for Police Department to conduct survey to determine if parked cars are those of commutters. Matter referred to Streets and Traffic Committee and Police Department for study. LOAD LIMIT WHITE ST. Alderman Sherwood's-request that,Streets and Traffic Committee reconsider load limit signs on White Street from Oakton to Ashland was referred to said committee. SUBDIVISION J. S. Adams Company request for Subdivision on Golf Road Golf Road was referred to the Plan Commission. SUBDIVISION The request of Mrs. Vera M. Smith for subdivision of 2122 Spruce- lot located at 2122 Sprucewood was referred to the Plan wood Commission. ADJOURNMENT: It was moved by Alderman Shillington, seconded by Alderman Szabo, that the regular meeting of the City Cou cil adjourn.
