07/20/1970333 MINUTES OF PRE -ANNEXATION HEARING - held in the Council Chambers, City Hall, at 7:30 P.M., July 20, 1970 Mayor Herbert H. Behrel opened the Pre -Annexation Hearing on a proposed written pre -annexation agreement between the City of Des Plaines and the Catholic Bishop of Chicago at 7:40 P.M. The Clerk read the Legal Notice as published June 25, 1970 and City Attorney DiLeonardi reviewed terms of the proposed agreement on file in office of City Clerk, copies of same submitted to each member of the City Council, having to do with annexation of certain real estate lying north of the City's present corporate boundaries. Alderman Szabo questioned the zoning on subject property if annexed to which City Attorney answered R-2 single family district. Alderman Bolek questioned the status of subject property with regards to tax assessment and if leased by Catholic Bishop of Chicago for purposes other than use by Maryville Academy would it be assessed for taxes, to which City Attorney DiLeonardi answered this decision is made in the Tax Assessor's office. All members of the Council reviewed the Plat of Annexation at this time. Alderman Szabo questioned whether or not a supply of water ,would be furnished to buildings outside the city limits. At this point, Mayor Behrel asked if there were any interested parties who wish to speak in favor or not in favor to which he received no reply. The hearing was declared closed and the matter taken under advisement. MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, CITY HALL, MONDAY, July 20, 1970 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines was called to order by Mayor Herbert H. Behrel at 8:10 P.M. The meeting opened with prayer by Rev. Keith A. Davis, Church of the Master United Church of Christ, followed by the Pledge of Allegiance to the Flag. ROLL CALL: Roll Call indicated the following aldermen present: Aldermen Koplos, Szabo, Prickett, Sherwood, Bolek, Leer, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Michaels. Absent was Aldermen Hinde and Shillington Also present were: Police Captain Mensching, Fire Chief, Haag, Adminis- trative Assistant Carlsen, City Engineer Bowen, Building Commissioner Schuepfer, and City Attorney DiLeonardi. There being a quorum present, the meeting was in order. MINUTES: It was moved by Alderman Prickett, seconded by Alderman Sherwood, to approve the Minutes of the regular meeting of July 6, 1970 and the Adjourned Meeting of July 13, 1970, as published. Motion declared Carried. REPORTS OF The Clerk submitted the quarterly reports of the Police CITY OFFICIALS Department and Fire Department which were ordered placed on file. Police Police Captain Mensching reviewed the quarterly report Captain submitted to Council pointing to the 36% increase in Part I crimes over last year for the same period. Building Building Commissioner Schuepfer reported that a short - Commissioner form complaint had been filed today against owner of property on Oakton Street for failure to tap in to sewer due to faulty septic system. He further reported that inspections were made today by Lt. Arthur of Fire Prevention Bureau and Sanitarian Lucille Weideman in accordance with provisions of court decree in the Rio -Rand Motel case and in their opinion the buildings do not comply with City's ordinances - written reports to be submitted to City Attorney and members of City Council. City Engineer City Attorney LEASE AGREEMENT BANTAM BOOKS Cumberland Parking Lot LIQUOR LICENSE Royal Court Inn 7/20/70 334 Page two City Engineer Bowen reported that Rock Road Construction Company is installing curb - approximately 2300 feet per day on Wolf Road. He further reported that Well #6 was vandelized over the weekend with no damage to controls. City Attorney reported that a hearing has been scheduled before the Board of Police and Fire Commissioners for tomorrow evening, July 21st, in connection with Fireman William Fox. He further reported that he will represent the Board of Police and Fire Commissioners and suggests that Attorney Donald Rose be retained to represent the City Council at this hearing. It was moved by Alderman Prickett, seconded by Alderman Bonaguidi, to retain Attorney Donald Rose to represent Council at said hearing. Upon roll call, the vote was: AYES: - 14 - Alderman Koplos, Szabo, Prickett, Sherwood, Bolek, Leer, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Michaels. NAYS: 0 - None ABSENT: 2 - Alderman Hinde, Shillington There being fourteen affirmative votes, Motion declared Carried. City Attorney DiLeonardi reviewed with City Council the provisions of the Lease Agreement between Bantam Books, Inc and the City of Des Plaines in connectbn with the improvement and expansion of Cumberland. Parking Lot. It was moved by Alderman Prickett, seconded by Alderman Bonaguidi, to adopt a resolution authorizing Mayor and City Clerk to execute Lease Agreement between Bantam Books Inc. and the City of Des Plaines aforementioned. Upon roll call, the vote was: AYES: - 14 - Alderman Koplos, Szabo, Prickett, Sherwood, Bolek, Leer, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Michaels. NAYS: 0 - None ABSENT: 2 - Alderman Hinde, Shillington There being fourteen affirmative votes, Motion declared Carried. The request of owners, George Samatas and William Dimas of the Royal Court Limited for a liquor license to operate a lounge on new premises on Oakton Street just east of Lift Parts Road was referred to the License, Health and Inspection Committee for study and report. Council recessed from 8:35 P.M. to 8:52 P.M. EQUIPMENT Public Works 4 new trucks It was moved by Alderman Leer, seconded by Alderman Wagner, to concur with Streets and Traffic Committee's recommenda- tion to reject all bids for the four pick up trucks and readvertise for 1971 models, returnable August 10, 1970. Motion declared Carried. Alderman Shillington arrived at this time - 8:55 P.M. SPEED LIMIT 20 m.p.h. Seegers Rd. It was moved by Alderman Leer, seconded by Alderman Koplos, to post 20 m.ph speed limit signs on Seegers Road from Wieboldt gate north and west to Golf Road and authorize City Attorney to draft necessary ordinance. Motion declared Carried. Harvey & The request of Alderman Leer to study parking problems Seegers Rd. at the T intersection of Harvey Avenue and Seegers road particularly on the bend of the street was referred to the Police Department and Traffic Commission for study and report. It was moved by Alderman Thomas, seconded by Alderman Swanson, to concur with Water and Finance Committee's recommendation to award the bid for the 1970 heavy duty step van to the low bidder, Oakton International, Inc. in the amount of $4,630.74. Upon roll call, the vote was: AYES: -.14 — Alderman Koplos, Szabo, Prickett, Sherwood, , Leer, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. NAYS: 1 - Alderman Bolek ABSENT: 1 - Alderman Hinde There being fourteenaffirmative votes, Motion declared Carried. Upon roll call, the vote was: AYES: - 15 - Alderman Koplos, Szabo, Prickett, Sherwood, Bolek, Leer, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. WATERMAIN It was moved by Alderman Thomas, seconded by Alderman Szabo, Central Road to concur with Water and Finance Committee's recommendation to award the bid for the Watermain on Central Road to serve Maryville Academy to the low bidder, Joe B. Divito & Co., in the amount of $25,772.00, and return checks and or bonds of the unsuccessful bidders - contract not to be executed until annexation papers are in order. Upon roll call, the vote was: AYES: - 15 - Alderman Koplos, Szabo, Prickett, Sherwood, Bolek, Leer, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. SPeRM-WATER Alderman Bonaguidi, Chairman of the Sewer Committee, Fargo Ave. reported that said committee had reviewed petition sub- mitted by Alderman Thomas regarding drainage problem on Fargo Avenue and states that Public Works department will install two additional inlets in middle of the block. DISASTER SERVICE American Red Cross It was moved by Alderman Czubakowski, seconded by Alderman Shillington, to concur with Civil Defense Committee's recommendation to authorize Mayor to execute Statement of Understanding between Disaster Service, Mid -American Chapter of the American Red Cross and City of Des Plaines. Motion declared Carried. WEED CONTROL It was moved by Alderman Czubakowski, seconded by Alderman ORDINANCE Shillington, to concur with Beautification Committee's recommendation to amend the City's Weed Control Ordinance to declare certain weeds exceeding eight inches in height a nuisance, to require owner to remove twice a year, BILLS PAYABLE ORDINANCE M-13-70 Abandoned Motor Vehicles ORDINANCE M-14-70 Labor Relations ORDINANCE Z-15-70 999 E. It was moved by Alderman Prickett, seconded by Alderman Swanson, to adopt the following resolution: BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME: $104,248.91 (Withholding Voucher #340 in theamount of $193.19 from payment). Placed on First Reading was Ordinance M-14-70, relating to disputes between the City of Des Plaines and its employees concerning the terms and conditions of employment within limits of the City's power and discretion; To Prohibit strikes and work stoppages by public employees and provide disciplinary action in connection therewith; to provide for the adjustment of grievances; to create a public employees labor relations board and define its powers and duties. Placed on First Reading was Ordinance Z-15-70, rezoning certain property and authorizing a Special Use in the Nature of a Planned Unit Development on a portion thereof as set forth in Zoning Case 70-13-SU/PD, property located at 999 E. Touhy Avenue. The Plat of Subdivision of the Academy of St. Patrick located on northern tract of land owned by said Academy was referred to the Plan Commission for study and report. The letter from North Maine Fire Protection District notifying the City of their intention to file a petition in the Circuit Court to prevent disconnection of territory set forth in Pre -Annexation Agreement before the Council this evening owned by Catholic Bishop of Chicago was referred to the Municip.l Development Committee and City Attorney. It was moved by Alderman Prickett, seconded by Alderman Szabo, to accept the resignation of Mr. C. Santiago from the Library Board and authorize Mayor Behrel to write letter of commendation. Motion declared Carried. /01/ 1 1 UNITED MOTOR COACH 7/20/70 Page five 337 Mayor Behrel reported that City Comptroller Blietz had met with the auditor and Mr. Shuleman of United Motor Coach Company and will submit written report upon return from vacation. Further that in conversation with Mayor Blase of Niles, a meeting of Mayors from cities and villages served by United Motor Coach Company will be planned for the near future to discuss request for funds. STOP SIGN Alderman Seitz's request for stop signs to stop traffic Alley behind entering Broadway and Yale Court from alley behind Fahey Fahey Medical Medical Center was referred to the Traffic Commission Broadway and Streets and Traffic Committee for study and report. N.O.I.S.E. It was moved by Alderman Swanson, seconded by Alderman Wagner, to include in 1971's appropriation the sum of $2,000, representing the City's dues to N.O.I.S.E., and authorize the M :tyor to contact Mr. Castle of the City's intent to participate in this organization. Upon roll call, the vote was: AYES: - 13 - Alderman Koplos, Prickett, Sherwood, Bolek, Leer, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Shillington, Michaels, Mayor.
