06/15/19701 1 317 MINUTES OF THE REGULAR MEETING MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, CITY HALL, MONDAY, June 15, 1970 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines was called to order by Mayor Herbert H. Behrel at 8:10 P.M. The meeting opened with prayer by Rev. Ernest Grant, pastor of the First Congregational Church, followed by the Pledge of Allegiance to the Flag. ROLL CALL: Roll Call indicated the following aldermen present: Koplos, Szabo, Prickett, Sherwood, Bolek, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels. Absent was Alderman Leer Also present were: Police Chief Hintz, Fire Chief Haag, City Comptroller Blietz, City Engineer Bowen, Building Commissioner Schuepfer, and City Attorney DiLeonardi. There being a quorum present, the meeting was in order. MINUTES: It was moved by Alderman Prickett, seconded by Alderman Figard, that the Minutes of the regular meeting of June 1, 1970, be approved as published. Motion declared Carried. REPORTS OF The following reports were ordered to be placed on file: CITY OFFICIALS:Statement of Cash Receipts to May 31, 1970; Monthly report of Engineering Department, May, 1970; Building Department for month of May, 1970. City City Comptroller reported that sales tax receipts and Comptroller state income tax have been slow in their receipt. Upon investigation at the Department of Revenue, Springfield, he found that the department in the process of switching to new form of data processing and holds a considerable amount of tax money due municipalities. He will continue to urge the department to release these funds, making adjustments at a later date. Chief of Police Chief Hintz reported on a second traffic fatality. Police at the intersection of Touhy and Lee due to malfunctioning traffic signals. Fire Chief Fire Chief Haag reported that fire personnel will be trained in the area of First Aid at Holy Family Hospital enrolling in the Northwest Suburban Council program recently accomplished, Sidewalk City Engineer Bowen reported that Just Construction Company, Replacement towhom the contract for Sidewalk replacement was awarded, Program has failed to date to contact his office regarding work orders issued on or about May 1st, and he recommends that a ten day notice be sent to Just Construction Company to commence work and failing to do so, the contract be awarded the next low bidder, Mr. E. Russell. It was moved by Alderman Prickett, seconded by Alderman Hinde, to authorize the City Engineer to send a ten day notice to Just Construction Company and if work is not commenced by the date specified, the contract for sidewalk replacement be awarded to E. Touhy Ave. POLICE EQUIPMENT Servi-Car 6/15/70 318 Page two City Engineer Bowen reported that the UOP - Metropolitan Sanitary District violation had been abated. Further that he-tand the City Attorney met with Mr. Francis of the Metropolitan Sanitary District to discuss the LaSalle Street cross -connection but arrived at no solution to the problems. He also reported on the water consumption and the progress at the wells. Further reported that a letter was received by Fletcher Engineering Company from Commonwealth Edison Co. expressing their desire to install a sidewalk on Elmhurst Road across their right of ways. He further reported that he has requested the County Highway Department to eliminate the median strip on Wolf Road at Wieboldt Avenue, but to date no reply to second letter. City Engineer Bowen reported that the City of Chicago will test samples taken from three locations of water supply and plans are under study for installation of our labortory for testing of water. City Attorney DiLeonardi reported that last Wednesday, June 10th, the City proceeded to complete the Rand -Wolf Zoning Case and Concluded our evidence June 17th wit_h additional witnesses and closing arguments - will report decision as soon as possible. He further reported that the Metropolitan Sanitary District has filed a petition for rehearing before Appellate Court re Sewage Treatment Plant location. Following the City Attorney's report that a suit had been filed against the City and A.F.C.O. Products, Inc. in connection with sanitary sewer connections, it was moved by Alderman Prickett, seconded by Alderman Bonaguidi, to authorize City Attorney DiLeonardi to defend the City in said Suit. Upon roll call, the vote was: AYES: - 17 - Alderman Koplos, Szabo, Prickett, Sherwood, Bolek, Leer, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. City Attorney DiLeonardi reported that the covenants on the property located at 1400 E. Touhy Avenue have been received and reviewed by him and recommends that the zoning ordinance as prepared be placed on First Reading at this meeting. It was moved by Alderman Swanson, seconded by Alderman Czubakowski, to concur with Municipal Development Committee's recommendation to authorize the City Attorney to draft the necessary amendment to the Zoning Ordinance for further consideration by the Council in Case 70-16-R - 1400 E. Touhy Avenue. Motion declared Carried. It was moved by Alderman Michaels, seconded by Alderman Sherwood, to return unopened bid for Police Servi-Car, and readvertise in August. Motion withdrawn. It was moved by Alderman Koplos, seconded by Alderman Szabo, to open only bid received. Bid received from Villa Park Harley-Davidson Sales, Inc. for 1971 model at net cost of $2,100.00. It was moved by Alderman Hinde, seconded by Alderman Michaels, to reject the bid inasmuch as it does not meet specifications. It was moved by Alderman Figard, seconded by Alderman Sherwood, to authorize the City Attorney to review the file and if necessary file suit against Mr. Agrillo. Commissioner of Public Werks Schwab reported that during Special Clean Up Month 170 loads were dumped costing $1,784.00. Further that branch pickup from June 1st thru June 5th cost $1,505.38. In the same four day period trees were inspected and 230 trees found to have Dutch Elm Tree Disease. 63 calls have been received regarding cottony maple scale. It was moved by Alderman Swanson, seconded by Alderman Hinde, to concur with Municipal Development Committee's recommendation to authorize the City Attorney to prepare the amendment to the Zoning Ordinance in accordance with recommendations of Zoning Board of Appeals in Case 70-13-SU/PD - property located at 999 E. Touhy Avenue. Motion declared Carried. It was moved by Alderman Swanson, seconded by Alderman Hinde, to concur with Municipal Development Committee's recommenda- tion to authorize Mayor and City Clerk to execute Plats of Dedication of Thacker Street. It was moved by Alderman Swanson, seconded by Alderman Figard, to concur with Municipal Development Committee's recommenda- tion to authorize the City Attorney to prepare the Annexation and rezoning ordinances in accordance with Zoning Board's recommendation in Case 70 -19 -RA - property located at 2700 S. Mt. Prospect Road. Motion declared Carried. It was moved by Alderman Leer, seconded by Alderman Koplos, to concur with Streets and Traffic Committee's recommendation to advertise for bids for the resurfacing of Graceland Ave; Thacker Street to First Avenue and First Avenue, Graceland to Walnut Avenue; widening and resurfacing of Ida Street, Perry to Jefferson and Prairie Avenue, Laurel to Soo Line Railroad - MFT Section 90CS. Alderman Leer set a meeting with bank officials, Traffic Commission, Police Chief, Aldermen of the Ward to discuss ingress and egress to bank facility on the corner of Perry and Lee Street - June 22nd at 10 a.m. at the site. At the request of Streets and Traffic Committee, the matter of Maple Street Traffic flow was referred to City Engineer Bowen for further study and report. The letter addressed to Alderman Leer regarding the changing of present two-hour parking zone on the west side of Nuclear Drive to an all day parking zone was referred to the Traffic Commission, Fire Chief and Police Chief for study and report. The letter from City Engineer Bowen regarding the improve- ment of Prairie Avenue between Lyman and Potter was referred to the Streets and Traffic Committee for study and report. It was moved by Alderman Leer, seconded by Alderman Wagner, to concur with Streets and Traffic Committee's recommendation to change the name of State:Street, just north of Rand Road, west of River Road to Sakas Drive and authorize City Attorney to draft necessary ordinance. Motion declared Carried. Alderman Szabo voted No. It was moved by Alderman Figard, seconded by Alderman Bona- guidi, to concur with Water Committee's recommendation to authorize City Engineer to draw plans and specifications and upon completion advertise for bids for an extension of the ten inch watermain on Central Road to serve Maryville Academy. Motion declared Carried. Water Committee Chairman, Alderman Figard, reported that said Committee met with Mr. Ipsen of Nelson Marine Sales at 955 Rand Road, regarding request for water line and fire hydrant and advised Mr. Ipsen the extension of water line should be installed at his expense. Sewer Committee Chairman, Alderman Bonaguidi, reported that a meeting was held regarding the 8th ward flooding problem with Mr. Schaeffer, Commissioner Schwab, and City Engineer Bowen, and a report should be available within the next thirty days. It was moved by Alderman Wagner, seconded by Alderman Swanson, to concur with Building Control and Inspection Committee's recommendation to approve the sign request of Allen's Store on Lee Street for a sign 20' high, 9 x 7 main sign and over all sign 9'10" x 14'. Motion declared Carried. It was moved by Alderman Koplos, seconded by Alderman Wagner, to concur with Parking Lots Committee's recommendation to purchase one Zenith Instro-Met Industrial Cleaning Machine from Duncan Industries, Inc. for a total cost not to exceed $500.00. The possible expansion of Fire Station #1 facilities on the recently acquired sites east of the present building was referred to the Building and Grounds and Fire Committees and Fire Chief for study and report. U.S.Post Office Mass Trans- portation PETITION Fargo Ave. Storm Water PETITION 8th Ave. Parking Mayor Behrel reported to Council that on his recent trip to Washington, he met with various Illinois legislators regarding the relocation of the U. S. Postal Facility site, and expressed hopefulness that it may be accomplished. He further reported on the meeting regarding revenue sharing from the Federal Government and on Mass Transportation Funding. He also reported on the recent studies to adopt a Federal Housing Code. The petition submitted by Alderman Thomas, signed by residents on Fargo Avenue relating to storm water drainage was referred to the Sewer Committee for study and report. The petition submitted by Alderman Seitz, signed by residents on North Eighth Avenue requesting No Parking on the west side of EighthAvenue and Slow School Zone signs was referred to the Streets and Traffic Committee for study and report. 1 1 WATER REQUEST Citizens Utility Co.
