02/16/1970265 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, CITY HALL, MONDAY, FEBRUARY 16, 1970 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines was called to order by Mayor Herbert H. Behrel at 8:10 P.M. The meeting opened with prayer by Rev. Ernest Grant of the First Congregational Church, followed by the Pledge of Allegiance to the flag. ROLL CALL: Roll Call indicated the following aldermen present: Alderman Koplos, Prickett, Sherwood, Bolek, Leer, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels. Also present were: Administrative Assistant R. Carlsen, City Comptroller Blietz, Police Chief Hintz, Fire Chief Haag, City Engineer Bowen, Commissioner of Public Works Schwab, and City Attorney DiLeonardi There being a quorum present, the meeting was in order. MINUTES: It was moved by Alderman Prickett, seconded by Alderman Koplos, that the Minutes of the regular meeting of February 2, 1970, be approved as published. Motion declared Carried. REPORTS OF The following reports were submitted and placed on file: CITY OFFICIALS Division of Public Works Staff Meeting; City Engineer's report of 1970 Street Program; Annual Report, Des Plaines Historical Society; Annual Report, Police Department; Annual Report, Fire Department; Annual Report, Mayor Herbert H. Behrel. Police Chief Police Chief Hintz reported on a hit -run accident and also reported that it was necessary to hire a second prosecutor for this morning's traffic cases Fire Chief City Engineer City Engineer appointed to Bldg.Control & Inspection Committee City Atty. I Commissioner Public Works REPORTS OF COMMITTEES Zoning Case 69 -68 -SU 955 Elmhurst Alderman Szabo Fire Chief Haag reported on two fires; Kelly's Springfield Tire Company and residence on Westgate Road, Feb. 10th. City Engineer Bowen reported that a report is forthcoming from his office with regard to the flooding problems in the Eighth Ward. He also gave a progress report on the fencing of Weller Creek and Well No. 3. It was moved by Alderman Wagner, seconded by Alderman Thomas to appoint City Engineer Robert Bowen to the Building Control and Inspection Committee, effective immediately. Motion declared Carried. City Attorney DiLeonardi reported on the progress of cases in court as follows; Trial of Rand -Wolf Zoning Case to begin February 18th; Motion for Summary Judgment filed in Spindler Tree Case; No decision rendered in Mt. Prospect Annexation case to date; Zalegia zoning case set for trial March 23; Brief in Metropolitan Sanitary District case due February 28th. Commissioner of Public Works Schwab reported that the questionairres regarding the plastic bag system have been sent to those participating residents. Further that the patching up work on streets is in the process. It was moved by Alderman Swanson, seconded by Alderman Shillington, to concur with Municipal Development Committee's recommendation to deny petition for Special Use of property located at 955 S. Elmhurst Road for Gasoline Service Station as accessory use to car -wash, as Ordinance Z-17-66 prohibits the sale or storage of gasoline on subject property. Council TREES Purchase 2/16/70 266 Page two It was moved by Alderman Thomas, seconded by Alderman Sherwood, to concur with Police and Finance Committee's recommendation to award the bid for the leasing of eleven squad cars to Sondag Chevrolet, Inc. at a cost of $359.00 per car which includes $100 Deductible Collision Insurance and air conditioning. Upon roll call, the vote was: AYES: - 17 - Alderman Koplos, Szabo, Prickett, Sherwood, Bolek, Leer, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. It was moved by Alderman Thomas, seconded by Alderman Bonaguidi, to concur with Police Committee's recommendation to purchase two additional radios for squad cars, at an approximate cost of $650.00 per radio from Motorola, Inc. Upon roll call, the vote was: AYES: - 17 - Alderman Koplos, Szabo, Prickett, Sherwood, Bolek, Leer, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mpyor. Alderman Figard's request for removal of No Parking signs on the north side of Prairie Avenue west of First Avenue in front of Com mercial Development was referred to the Streets and Traffic Committee for study and report. Alderman Czubakowski's request for "No Parking Between Signs" in front of St. Stephen's church on Prospect Avenue was referred to the Streets and Traffic Committee for study and report. Alderman Sherwood�'s request for removal of No Parking signs on the ��aeet side of Deane Street (along Soo -Line Railroad) between Algonquin and Van Buren was referred to the Streets and Traffic and Traffic Commission for study and report. It was moved by Alderman Figard, seconded by Alderman Thomas, to concur with Water Committee's recommendation to deny the request of Des Paines Park District for reduced water rates. Motion declared Carried. It was moved by Alderman Wagner, seconded by Alderman Koplos, to concur with Building Control and Inspection Committee's recommendation to approve the sign request of Rand & Patio Pool, located at 1313 Rand Road. Motion declared Carried. recessed from 8:48 p.m. to 9:08 P.M. at request of Forestry Committee It was moved by Alderman Leer, seconded by Alderman Sherwood, to concur with Forestry Committee's recommendation to purchase 500 Red Maples and 500 Norway Maples at a cost of $15 per tree from MATTTures Sons Nursery. OF TRUSTEES LEGAL OPINION SOCIAL SECURITY WATER POLLUTION DES PLAINES HOUSING AUTHORITY BILLS PAYABLE ZONING APPLICATION FEES ORDINANCE A-2-70 Kiwanis Property 2/16/79 267 Page three It was moved by Alderman Leer, seconded by Alderman Sherwood, to concur with the Forestry Committee's recommendation to advertise for bids returnable March 23, 1970, for the tree trimming, tree removal and stump removal for the coming season. Motion declared Carried. It was moved by Alderman Michaels, seconded by Alderman Prickett, to authorize the City Attorney to file a friendly action against the Firemen's Pension Board in order that the court may interpret the laws involved in a recent decision made by Board of Trustees involving children of a deceased fireman, and safeguard the City's position in view of the fact that public monies are involved. Upon roll call, the vote was: AYES; - 17 - Alderman Koplos, Szabo, Prickett, Sherwood, Bolek, Leer, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. Referred to the City Attorney was a request for a legal opinion regarding Social Security benefits available to dependent children as well as benefits available to retiring personnel in police and fire departments. Alderman Szabo's request for investigation of possible water pollution in Des Plaines River from Dempster to Golf Road was referred to Public Works Department. Alderman Szabo's request for a study of the feasibility of creating a Des Plaines Housing Authority was referred to the Special Senior Citizen's Housing Committee. It was moved by Alderman Prickett, seconded by Alderman Shillington, to adopt the following resolution: BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME: $69,871.76. Upon roll call, the vote was: AYES: - 17 - Alderman Koplos, Szabo, Prickett, Sherwood, Bolek, Leer, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. It was moved by Alderman Prickett, seconded by Alderman Wagner, to concur with Building Control and Inspection and Finance Committees' recommendation to authorize the City Attorney to draft the necessary resolution for consideration by the Council to implement the suggested increases in Zoning Application Fees as submitted by City Clerk Rohrbach. Motion declared Carried. Following second reading, it was moved by Alderman Swanson, seconded by Alderman Hinde, to adopt Ordinance A-2-70, annexing involuntarily the property commonly known as the Kiwanis property located at Woodland and Grove Avenues. After considerable discussion and review of the entire matter by City Attorney DiLeonardi, it was moved by Alderman Szabo, seconded by Alderman Koplos, to table Ordinance A-2-70. Motion declared Carried. It was moved by Alderman Swanson, seconded by Alderman Seitz, to adopt Ordinance T-3-70. It was moved by Alderman Shillington, seconded by Alderman Michaels, to waive First Reading of Ordinance T-4-70, providing for 4 -way stop signs at the intersection of Beau Drive and Millers Road. Motion declared Carried. It was moved by Alderman Shillington, seconded by Alderman Michaels, to adopt Ordinance T-4-70. Upon roll call, the vote was: AYES: - 17 - Alderman Koplos, Szabo, Prickett, Sherwood, Bolek, Leer, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. Placed on First Reading was Ordinance T-5-70 providing for No Parking from 9:00 a.m. to 5:00 p.m., except Sundays and Holidays on the north side of Seegers Road to Wieboldt Avenue. Placed on First Reading was Ordinance T-6-70 providing for No Parking on the east side of White Street from Oakton Street south to the alley. Placed on First Reading was Ordinance T-7-70 providing for No Parking on Dale Street and Railroad Avenue south of Touhy Avenue. It was moved by Alderman Figard, seconded by Alderman Sherwood, to authorize the Mayor and City Clerk to execute License Agreement between Chicago and Northwestern Railway Company and City with reference to improvement of O'Hare Prospect Venture Subdivision. Motion declared Carried. NATIONAL It was moved by Alderman Bonaguidi, seconded by Alderman LEAGUE OF Figard, to authorize Mayor Behrel to attend the CITIES Congressional -City Conference of the National League of Washington Cities in Washington, D. C. March 8-10. Upon roll call, the vote was: AYES: - 17 - Alderman Koplos, Szabo, Prickett, Sherwood, Bolek, Leer, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. LEGAL Alderman Prickett requested that the City Attorney submit OPINION a legal opinion regarding the Zoning Board's authority Zona g to grant variations of less than 90% of square foot Variations area of the lot, particularly in cases where lots have been platted and approved prior to adoption of Zoning Ordinance of 1960. NORTHWEST It was moved by Alderman Seitz, seconded by Alderman Koplos, SUBURBAN that City Council oppose by Resolution the location of FREEWAY the Northwest Suburban Freeway anywhere within the limits of the City of Des Plaines. Motion declared Carried. NATURAL GAS Alderman Bolek's.suggestion that City Vehicles be adapted FOR CITY to use Natural Gas to reduce Air Pollution was referred to VEHICLES the Air and Water Pollution Committee for study and report. ADJOURNMENT It was moved by Alderman Prickett, seconded by Alderman Sherwood, that the regular meeting of the City Council adjourn.
