01/19/1970254 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, CITY HALL, MONDAY, JANUARY 19, 1970 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines was called to order by Mayor Herbert H. Behrel at 8:07 P.M. The meeting opened with a prayer by Rev. James Jackson, Pastor of Christ E & R Church, followed by the pledge of allegiance to the flag. ROLL CALL: Roll Call indicated the following aldermen present: Koplos, Szabo, Prickett, Sherwood, Bolek, Leer, Figard, Hinde, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels. Absent was Alderman Czubakowski Presentalso were: City Police Chief Hintz, Fire Chief Haag, !commissioner of Public Works Schwab, Building Commissioner Schuepfer, City Comptroller Blietz, City Engineer Bowen, and City Attorney DiLeonardi. There being a quorum present, the. meeting was in order. MINUTES: It was moved by Alderman Prickett, seconded by Alderman Sherwood, to approve the Minutes of the regular meeting of January 5, 1970, as published. Correction was made on Page one changing the name Warnicke to Schwab. Motion declared Carried. REPORTS OF The progress report of Commissioner of Public Works CITY Schwab was placed on file. OFFICIALS: City Comptroller Blietz submitted a report on Summary of Pension Statutes Police Chief reported that the Department would move to its new quarters Wednesday and the Annual report will be submitted in February Fire Chief reported on the fire fought Sunday morning at a building on Miner Street. The Council commended the fire department for the fine fire -fighting confining it to the one building. City City Attorney DiLeonardi reported that the court will Attorney issue its decision in the Mt. Prospect Annexation case on January 27th. ZONING City Attorney DiLeonardi reported that a Public Hearing 1584 Rand Rd. before the Zoning Board of Appeals had been held on March 28, 1967 - Case 67-12-A - on petitioner's request to rezone property located at 1584 Rand Road. The recommendation of the Zoning Board was to rezone Lots 6, 7, 8, 10, 11 and 12 in Block 3 of River -Rand Road Subdivision; however the recommendation of the Municipal Development Committee, concurred by the Council, was to rezone only Lots 10, 11, and 12 in Block 3 of River -Rand Road Subdivision. In error, just the opposite lots 6, 7, and 8 were rezoned with the adoption of Ordinance Z-24-67 September 18, 1967. Upon recommendation of the City Attorney, it was moved by Alderman Prickett, seconded by Alderman Swanson, that the City petition the Zoning Board to seek rezoning of Lots 6, 7, and 8 back to R-2 Single Family Residence District and zone Lots 10, 11, and 12 to C-2 Commercial District. Motion declared Carried. ZONING City Attorney DiLeonardi reviewed the history of Zoning 70-1-SU/V Case 70-1-SU/V - 1061 Lee Street, stating that the Variation 1061 Lee St. granted by the Zoning Board of Appeals to reduce square foot area to an 18,162 square -foot area exceeds their authority of granting a 10% variation if the proposed use of property is for automobile laundry and gasoline service station, wherein the square foot requirement would be 25,000 square foot area. After discussion, it was moved by Alderman Koplos, seconded by Alderman Sherwood to authorize the City Attorney to write the Zoning Board of Appeals regarding the granting of variation as aforementioned. Motion declared Carried. ORDINANCE M-3-70 Salary Ordinance It was moved by Alderman Sherwood, seconded by Alderman Koplos, to waive First Reading of Ordinance M-3-70, the Salary Ordinance. Upon roll call, the vote was: AYES: - 14 - Alderman Koplos, Szabo, Prickett, Sherwood, Leer, Figard, Hinde, Wagner, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. NAYS: 2 - Alderman Bolek, Swanson ABSENT: 1 - Alderman Czubakowski There being fourteen affirmative votes, Motion declared Carried. It was moved by Alderman Sherwood, seconded by Alderman Koplos, to adopt Ordinance M-3-70. Upon roll call, the vote was: AYES; - 13 - Alderman Koplos, Szabo, Prickett, Sherwood, Leer, Figard, Hinde, Wagner, Thomas, Bonaguidi, Seitz, Shillington, Mayor. NAYS'3 - 3 - Alderman Bolek, Swanson, Michaels ABSENT: 1 - Alderman Czubakowski There being thirteen affirmative votes, Motion declared Carried. HOSPITALIZATION It was moved by Alderman Bonaguidi, seconded by Alderman INSURANCE Wagner, that the City pay the premium for the employee's Dependent dependent coverage of hospitalization insurance - Blue Coverage Shield and Blue Cross. It was moved by Alderman Bolek, seconded by Alderman Szabo, to amend the motion that the City pay only 50% of the dependent coverage this year. Motion to amend declared lost. Upon roll call, the vote on the original motion wasa AYES: - 12 - Alderman Koplos, Prickett, Sherwood, Leer, Figard, Hinde, Wagner, Thomas, Bonaguidi, Seitz, Shillington, Mayor. NAYS: 4 - Alderman Szabo, Bolek, Swanson, Michaels ABSENT: 1 - Alderman Czubakowski There being twelve affirmative votes, Motion declared Carried. ZONING CASE It was moved by Alderman Swanson, seconded by Alderman 69-57-R Hinde, to concur with Municipal Development Committee's 1001 E. recommendation to concur with Zoning Board's recommendation Northwest in Case 69-57-R and authorize the City Attorney to draft Highway the re -zoning ordinance for further consideration by the Council. Motion declared Carried. Alderman Shillington left the meeting at this time. WATER It was moved by Alderman Figard, seconded by Alderman Joseph Hinde, to concur with Water Committee's recommendation Lumber Co. to deny the request of Jose-hy Lumber Company for water service to property on Rand Road without annexation. Motion declared Carried. EQUIPMENT It -was moved by Alderman Bonaguidi, seconded by Alderman PUBLIC WORKS Figard, to concur with Sewer Committee's recommendation to award the bid for the Portable Trash Pump to the low bidder, Lakeland Equipment Co., Inc., for a net price of $1,929.00. Upon roll call, the vote was: ayes; - 15 - Alderman Koplos, Szabo, Prickett, Sherwood, Bolek, Leer, Figard, Hinde, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Michaels, Mayor. Motion declared. It was moved by Alderman Wagner, seconded by Alderman Thomas, to concur with Building Control and Inspection Committee's recommendation to approve the sign request of Tops Big Boy Restaurant at 1505 Elmhurst Road. Motion declared Carried. It was moved by Alderman Michaels, seconded by Alderman Sherwood to concur with Judiciary Committee's recommenda- tion to settle claim of Double M Realty Company for expenses incurred in connection with proposed acquisition of city property located at Sunset & Stillwell. Alderman Szabo reported that the Building and Grounds Committee does not concur with Judiciary Committee's recommenda- tion. It was moved by Alderman Hinde, seconded by Alderman Figard, to amend the motion to settle for $505.00. It was moved by Alderman Bonaguidi, seconded by Alderman Prickett, that Council enroll with Midland Casualty Company in the Self -Insurance of Workmen's Compensation as reported at the meeting of January 5, 1970. It was moved by Alderman Prickett, seconded by Alderman Swanson to adopt the following resolution: BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME: $149,230.35. It was moved by Alderman Leer, seconded by Alderman Szabo, to withhold Warrant #10,219, in the amount of $416.25. It was moved by Alderman Koplos, seconded by Alderman Szabo, to withhold Warrants #202 and 204, totaling $8,022.46. New Total $140,791.64. ORDINANCE It was moved by Alderman Sherwood, seconded by Alderman M-2-70 Bolek, to adopt Ordinance M-2-70 increasing Class A Liquor Liquor Licenses by one and decreasing Class E Liquor Licenses Licenses by one. Upon roll call, the vote was: AYES: - 15 - Alderman Koplos, Szabo, Prickett, Sherwood, Bolek, Leer, Figard, Hinde, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Michaels, Mayor. ORDINANCE It was moved by Alderman Prickett, seconded by Alderman M-4-70 Figard, to waive First Reading of Ordinance M-4-70 having Water Rate to do with Water Rates and Water Deposits. Motion declared Increase Carried. It was moved by Alderman Figard, seconded by Alderman Prickett, to adopt Ordinance M-4-70. Upon roll call, the vote was: AYES: - 15 - Alderman Koplos, Szabo, Prickett, Sherwood, Bolek, Leer, Figard, Hinde, Wagner, Swanson, Thoma$, Bonaguidi, Seitz, Michaels, Mayor. Motion declared Carried. It was Z-15-69 moved by Alderman Prickett, seconded by Alderman Swanson to adopt Ordinance Z-2-70. Hinde, to authorize City Attorney DiLeonardi to attend RATE INCREASE Hearing before the Illinois Commerce Commission on Central Telephone Company of Illinois's request for general increase in telephone rates applicable to all exchanges of the company (55384). Upon roll call, the vote was: AYES: - 12 - Alderman Koplos, Szabo, Prickett, Sherwood, Bolek, Leer, Figard, Hinde, Wagner, Swanson, Seitz, Mayor. Morse & Scott Commissioner of Public Works was instructed to install stop signs at the intersection of Morse & Scott Streets, Morse to stop for Scott, and City Attorney to draft necessary amendatory ordinance. PLAQUE It was moved by Alderman Bonaguidi, seconded by Alderman E.N.Fletcher Figard, to authorize Mayor Behrel to secure suitable plague for presentation to E. N. Fletcher, retiring City Engineer.
