12/16/196868 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL ROOM, CITY HALL, MONDAY, DECEMBER 16, 1968 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines was called to order by Mayor Pro Tem Prickett at 8:05 P.M. The meeting opened with a prayer by Rev. Bruehl of the First Methodist Church, followed by the pledge of allegiance to the flag. ROLL CALL: Roll Call indicated the following aldermen present: Rateike, Prickett, Wright, Bolek, Leer, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Shillington, Michaels. Absent were Aldermen Szabo, Bonaguidi, Seitz. Also present were: City Comptroller Blietz, Police Chief Hintz, Building Commissioner Schuepfer, Assistant Commissioner of Public 'Forks Schwab, City Engineer Fletcher, Fire Chief Arndt, and City Attorney DiLeonardi. There being a quorum present, the meeting was in order. MAYOR*PRO-TEM: It was moved by Alderman Figard,,, seconded by Alderman Rateike, to appoint Alderman Prickett Mayor Pro -Tem for this meeting, in Mayor'Behrel's absence. Motion declared Carried. MINUTES: It was moved by Alderman Figard, seconded by Alderman Shillington, to approved the Minutes of the regular meeting of December 2, 1968, as published. Motion declared Carried. REPORTS OF Placed on file were the following reports: City Comp - CITY OFFICIALS: troller's report of 1964 Water Construction Account. Howard St. Sewer City Engineer Fletcher reported that the Howard Street Sewer construction is almost completed. Metropolitan City Attorney DiLeonardi reported that Judge Lupe entered Sanitary the Judgment Order and Decree in the Metropolitan Sanitary District District of Greater Chicago case December 12, 1968, which declares that the Metropolitan Sanitary District is subject to the zoning authority of the City and said District cannot proceed without obtaining zoning authority and further that a Writ of Injunction be issued restraining from constructing a plant on said property without first obtaining the zoning authority. S.A. #190_ City Attorney reported on the progress in the court on Special Assessment #190, Orchard Place Improvement, stating there remains approximately 35 parcels left on which a decision on the "benefit" should be reached sometime this week. COMMITTEE It was moved by Alderman Swanson, seconded by Alderman REPORTS: Wagner, to concur with Municipal Development Committee's 2499 S. Wolf Rd.recommendation to concur with Zoning Board's decision to ZONING 68-76-R grant rezoning of property located at*2499 S. Wolf Rd. to M-2 Manufacturing upon annexation and authorize the City Attorney to draft the necessary ordinances - Case #68-76-R. Motion declared Carried. 'ZONING 68-73-R It was moved by Alderman Swanson, seconded by Alderman Perry & Lee Hinde, to concur with Des Plaines Zoning Board of Appeals in Case #68-73-R, to rezone property 90' west of the northwest corner of Perry & Lee to C-2 Commercial and delete subject property from R-5 District - City Attorney to draft the necessary ordinances. Motion declared Carried. Alderman Szabo arrived at this time - 8:30 P.M. 1 1 ZONING: Service Stations Service Station Building Permits Abandon- ment WOLF'S SUBDIVISION ZONING 68 -62 -RV 2700 River Road ZONING 68-65-R 389 River 12/16/68 69 Page two It was moved by Alderman Swanson, seconded by Alderman Shill- ington to concur with Municipal Development Committee's recommendation to authorize the City Attorney to petition the Zoning Board for a text amendment to the 'Zoning Ordinance, deleting Gasoline Filling Stations from the permitted uses in the C-2 Commercial District and add same to "Special Uses" catagory. Motion declared Carried. It was moved by Alderman Swanson, seconded by Alderman Shill- ington, to direct the Building Commissioner not to issue any building permits for new gasoline service stations in the C-2 Commercial District, pending the passage of the Zoning Ordinance which will allow said stations as Special Uses only. Motion declared Carried. It to of to was moved by Alderman Bolek,/seconded by Alderman Hinde, authorize the City Attorney to petition the Zoning Board Appeals for a text amendment deleting that section having do with abandonment of use. Motion declared Carried. It was moved by Alderman Swanson, seconded by Alderman Thomas, to approve Plat of Wolf's Subdivision, located on Westfield Lane, and to authorize the Mayor and City Clerk to execute same. Motion declared Carried. It was moved by Alderman Swanson, seconded by Alderman Thomas, to concur with Municipal Development Committee's recommendation that Council concur with Des Plaines Zoning Board of Appeals in Case 68 -62 -RV, property located at 2700 River Road, to grant rezoning, contingent upon submission of a 50' utility easement on the west side of River Road and the City Attorney be authorized to draft the necessary ordinance. Motion declared Carried. It was moved by Alderman Swanson, seconded by Alderman Thomas, to concur with Municipal Development Committee's recommendation to concur with Des Plaines Zoning Board of Appeals in Case #68-65-R and deny rezoning petition on property located at 389 River Road. Motion declared Carried. Alderman Bonaguidi arrived at this time - 8:50 p.m. FIRE DEPT. Air Pacs It was moved by Alderman Rateike, seconded by Alderman Shill- ington to concur with Fire Committee's recommendation to purchase new Air Pac for the Fire Department at a total cost of $446.00. Upon roll call, the vote was: AYES: - 15 - Alderman Rateike, Szabo, Prickett, Wright, Bolek, Leer, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Shillington, Michaels. CITY HALL It was moved by Alderman Shillington, seconded by Alderman Court Room Bolek, to concur with Building and Grounds and Finance Committee's recommendation to refurbish the second floor of the Municipal Building for use by the court, in an amount of $4,609.75. Upon roll call, the vote was: AYES: - 15 - Alderman Rateike, Szabo, Prickett, Wright, Bolek, Leer, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Shillington, Michaels. NAYS: 0 - None ABSENT: 1 - Alderman Seitz There being fifteen affirmative votes, Motion declared Carried. LIQUOR LICENSE Rescinded SALT It was moved by Alderman Szabo, seconded by Alderman Leer, to reduce the number of Class A liquor licenses by one and rescind the license issued to River Rand Bowl, and to authorize the City Attorney to draft the necessary ordinance. Motion declared Carried. It was moved by Alderman Leer, seconded by Alderman Wright, to concur with Streets and Traffic Committee and Parking Lots Committte's recommendations to certify all four comparable Calcium Chloride Quotations Good Ave. One -Way Alley - Graceland & Lee Committee Meeting Tree Purchase Committee Meeting BILLS PAYABLE: 12/16/68 70 Page three bidders, Cargill, Inc., Diamond Crystal Salt Co., Hardy Salt Co., and Morton Salt Co. at a cost of $12.80 per ton, and issue purchase order to the company having best available supply of salt at the time needed. It was moved by Alderman Leer, seconded by Alderman Hinde, to concur with Streets and Traffic Committee's recommendation that stop signs be erected at each side of the alley where First National Bank traffic exits and the City Attorney be authorized to draft the necessary ordinance. It was moved by Alderman Szabo, seconded by Alderman Bonaguidi to defer action until next meeting on Committee report. Alderman Szabo, Chairman, announced a meeting of the Building Control and Inspection Committee for 7:30 P.M., January 2nd. It was moved by Alderman Leer, seconded by Alderman Figard, to concur with Elm Tree Disease Committee's recommendation to purchase 1000trees from Boyd Nursery Co. of McMinnville, Tennessee, 12" by 1 3/4" B & B 18" at a cost of $12.50 per tree. It was moved by Alderman Swanson, seconded by Alderman Rateike, to adopt the following resolution: BE IT RESOLVED BY TIIE CITY COUNCIL OF THE CITY OF DES PLAINES. THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THE MAYOR AND CITY CLERK ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME: $521,864.04. It was moved by Alderman Rateike, seconded by Alderman Shill- ington, to concur with Fire Committee's recommendation to renew the contract with North Maine Fire Protection District from January 1, 1969, for a period not to exceed one year, terminating December 31, 1969, or upon completion of their facilities. Upon roll call, the vote was: AYES: - 15 - Alderman Rateike, Szabo, Prickett, Wright, Bolek, Leer, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Shillington, Michaels. It was moved by Alderman Rateike, seconded by Alderman Shill- ington, to concur with Fire Committee's recommendation to grant permission to North Maine Fire Protection District to install a direct communications line between the City's headquarters and their station, to be maintained by the District, without financial responsibility to the City... same to remain in operation until the need for the line no longer remains. Motion declared Carried. It was moved by Alderman Rateike, seconded by Alderman Figard, to concur with Fire Committee's recommendation that the City use the equipment and manpower of the North Maine Fire Pro- tection District, at the discretion of the Fire Chief, for training and fire fighting use. The salaries and maintenance of their equipment will be paid by the District. Insurance Certificates will be supplied by them as necessary and Comp- troller Blietz was authorized to notify the City's insurance carrier. Motion declared Carried. The Clerk read the letters received from Des Plaines Pro- fessional Fire Fighters Association and the Des Plaines Patrolmens Association, and Ken E. Tiernan, spokesman for the Public Works Department Employees re proposed salary increases. Said letters were placed on file. ORDINANCE M-1-69 Appropriation Following second reading, it was moved by Alderman Swanson, seconded by Alderman Shillington, to adopt Ordinance M-1-69, the appropriation ordinance. It was moved by Alderman Swanson, seconded by Alderman Wagner, to amend Ordinance M-1-69 as follows: "Article XVIII - It is hereby provided that any funds remaining on hand shall be construed with and classi- fied with the miscellaneous revenue anticipated during the coming year and covered by the appropriation from such miscellaneous revenue." Upon roll call for the amendment, the vote was: AYES: - 15 - Alderman Rateike, Szabo, Prickett, Wright, Bolek, Leer, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Shillington, Michaels NAYS: 0 - None ABSENT - 1 - Alderman Seitz There being fifteen affirmative votes, Amendment declared carried. After discussion, Motion to adopt Ordinance M-1-69 was withdrawn and Ordinance M-1-69 remains on First Reading. Z=44468 Perry & Lee 12/16/68 72 Page five Following second reading, it was moved by Alderman Swanson, seconded by Alderman Shillington, to adopt Ordinance M-2-69, the Salary Ordinance. It was moved by Alderman Figard, seconded by Alderman Shillington, to amend Ordinance M-2-69, to provide for a 6% increase rather than a 2% increase and make all men second and third in -command in both the Police Department and Fire Department comparable in salary amounts. After dis- cussion, motion to amend was withdrawn. Motion to adopt was withdrawn and Ordinance M-2-69 remains on First Reading. It was moved by Alderman Swanson, seconded by Alderman Wagner, to adopt a Resolution authorizing expenditures until the 1969 Appropriation Ordinance is Adopted. Motion declared Carried. Discussed at length was an amendment proposed by Alderman Czubakowski to Ordinance M-1-69 increasing the General Corporate by $20,000 for promotion of Historical Research, Preservation of Historical Documents, Structures, Works of Art and other objects having special Community or Aesthetic Interest or Value. No action taken. It was moved by Alderman Figard, seconded by Alderman Hinde, to waive First Reading of Ordinance M-40-68, providing fof the transfer of sums of money within departments. Motion declared Carried. It was moved by Alderman Swanson, seconded by Alderman Rateike, to adopt Ordinance M-40-68. The letters from Des Plaines Zoning Board of Appeals regarding the following cases were referred to the Municipal Development Committee for study and report: Cases 68-67-A and 68-68-A - Text Amendments (Office Bldgs.) MFT It was moved by Alderman Swanson, seconded by Alderman Leer, RESOLUTION to adopt MFT Resolution appropriating $35,000 MFT Funds for Maintenance the purpose of maintaining streets and highways under the applicable provisions of the Illinois Highway Code from January 1, 1968 to December 31, 1969. Motion declared Carried. It was moved by Alderman Shillington, seconded by Alderman Swanson, to adopt the resolution honoring Rev. John H. .Draisma, Pastor of the First Christian Reformed Church, who has received a call to Holland, Michigan. Motion declared Carried. The request of Attorney David Addis, representing property owners, for a lot division south of the southeast corner of Elmhurst and Algonquin Roads, was referred to the Plan Commission for study and report. Traffic Referred to the Traffic Commission and Streets and Traffic Perry & Lee Committee, was the study of a traffic pattern prior to construction of building at the northwest corner of Perry and Lee. TrafficReferred to the Streets and Traffic Committee was Alderman Lige._ Cpbakowski's request for a traffic light at the intersection Ellinwood & of Graceland and Ellinwood. Grace and o Lots - The subject of variation granted by Des Plaines Zoning Board of "'Sunset & Stillwel two lots into three lots was discussed. It was moved by Alderman Appeals to owners of lots at Sunset and Stillwell, to divide Bolek, seconded by Alderman Szabo, to instruct the Building Commissioner not to issue a building permit on these parcels of property, and to authorize the City Attorney to petition the Zoning Board to reconsider the matter. Upon roll call, the vote was: AYES: 5 - Alderman Szabo, Bolek, Leer, Wagner, Shillington NAYS: 19 - Alderman Rateike, Prickett, Wright, Eigard, Hinde, Czubakowski, Swanson, Thomas, Michaels ABSTAIN: 1 - Alderman Bonaguidi ABSENT: 1 - Alderman Seitz There being nine negative votes, Motion declared Lott. Motion declared Carried. Alderman Leer, Chairman, set a meeting of the Streets and Traffic Committee for 8 P.M., January 2nd.
