12/02/1968CALL TO ORDER: read by Clerk ROLL CALL: 63 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL ROOM, CITY HALL, MONDAY, DECEMBER 2, 1968 The regular meeting of the City Council of the City of Des Plaines was called to order by Mayor Herbert H. Behrel at 8:05 P.M. The meeting opened with a prayer Rohrbach, followed by the pledge of allegiance to the flag. Roll Call indicated the following aldermen present: Rateike, Prickett, Wright, Leer, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Shillington. Absent were Alderman Szabo, Bolek,Figard, Seitz, Michaels. Also present were: City Comptroller Blietz, Police Captain Blume,R. Carlson Building Commissioner Schuepfer, Assistant Commissioner of Public Works Schwab, Engineer Quigley Fletcher, and City Attorney Robert J. DiLeonardi There being a quorum.present,.,the meeting was, in order. MINUTES: It was moved by Alderman .Prickett, seconded by Alderman Rateike, that the Minutes of the regular meeting of November 18, 1968, be approved as published. Motion declared Carried. Alderman Bolek arrived at this time. REPORTS OF CITY OFFICIALS: Placed on file were the following reports: Health Depart- ment, November; Building Department, November. Legal City Attorney reported on the status of various legal Cases cases before the courts as follows: River -Rand Motel case has been filed and is still in preliminary pleading stages on the basis that the operation is violating building and fire ordinances. Two new suits have been filed for duplex units on Dover Drive and Dover Lane area..the Billy Joe Barr case remains before the courts...the first case is still pending. The operation is a rooming house operation and adequate parking spaces are not provided. The second case has been filed on the basis that more than the maximum number of persons occupy one apartment...the occupants egtoeed three non -related persons. Judge Lupe has rendered a decision in the City's favor requiring the Metropolitan Sanitary District to comply with the City's zoning ordinance and must apply to the City for use of property owned by them for a Sanitary Disposal Plant. He further reported that the court hearing for confirmation of.S.pecial Assessment #190 (Orchard Place Improvement) has been continued until tomorrow when he is hopeful to have those parcels on which no objections have been filed confirmed. The Circuit Court has entered a decree.in the Rand -Central Zoning case upholding the validity of single family zoning on said property. A letter has been written to the Chicago and Northwestern Railway and to Scientific Machinery Movers requesting that they comply with the City's ordinances regarding unsightly conditions along Northwest Highway. A reply has been received from Scientific Machinery Movers, in which they state they do not believe they are violating any ordinances and a suit will be filed against them. The Lunar Oil Case against Officer Ladendorf has been rescheduled for next week. ORDINANCE Hypodermic Needles Alderman Wright read an article from a newspaper in OysterBay, New York, regarding legislation governing the disposal of hypodermic needles used in doctor's offices. Referred to the City Attorney to explore legislation and contact of Health Board Chairman for advice and counsel. Dreyer It was moved by Alderman Swanson, seconded by Alderman Resubdivision Prickett, to concur with Municipal Development Committee's N.Shore &recommendation to approve the plat of Dreyer's Resubdivision Curtis , at North Shore Avenue and Curtis Street, and to authorize the Mayor and City Clerk to execute same upon the deposit of necessary bond or cash for improvements and trees. Motion declared Carried. Committee Alderman Swanson, Chairman, set a meeting of the Municipal D1 Meeting Development Committee for December 9th at 7:30 P.M. ,�(/ 1 Page two 64 Committee Alderman Shillington, Chairman, set a meeting of the Meeting_ Building and Grounds and Finance Committee for December 9th at 8:30 P.M. Sengstock Mayor Behrel reported that several contacts have been Property made with Mrs. Sengstock and Mr. Holdimaier regarding the purchase price of the property just east of the present Municipal Building. He stated that the appraised value of subject property approx. 18 months ago was $32,500 and that an offer of $42,500 was rejected. He further reported that Mrs. Sengstock's firm price is $50,000. It was mutually decided to reject the offer of $50,000 at this time. Alderman Seitz arrived at this time. Progress. Alderman Bolek, Chairman, reported that the License, Report Health and Inspection Committee met with the three Cab Stands. Taxicab companies regarding the location of additional cab stands and that only one cab company is, interested at this time. Jack's Cab Co is researching the possibilities of locating said cab stands and will report findings to the committee at a later time. Refuse Alderman Swanson, Chairman, reported that the Sanitation Compaction Committee, along with Mayor Behrel witnessed the display Machine of the Refuse Compaction Machine, costing $300,000, on which Mayor Daley of Chicago pushed the starting switch, and stated they were very much impressed. Committee Alderman Leer, Chairman, set a meeting of the Streets and Meeting Traffic, to discuss the salt bids on which further information has been obtained regarding the use of rust inhibitor, for 8 P.M., Tuesday, December 10, 1968. Water Plant Alderman Thomas reported that the Water Committee met Equipment with representatives of the S.P.R. Services, Inc. Inspection and they recommend that Council award the contract for the inspection of water plant equipment at a cost not to exceed $2,000. It was moved by Alderman Prickett, seconded by Alderman Rateike, to defer action on said committee report until next meeting and requested that Attorney DiLeonardi review original contract for purchase of said equipment. Adv. for Bids It was moved by Alderman Wagner, seconded by Alderman S ORM SEWER Czubakowski, to advertise for bids for Section 14 of the Section 14 Storm Sewer Program, returnable December 30th at 10 a.m. Motion declared Carried. Committee Alderman Wright, Chairman, set a meeting of the Parking Meet ng Lots Committee, for December 10th, at 7:30 P.M. Elm Tree Disease Alderman Leer reported that Bishop's Tree Service for Progress Rept. a two week period has removed 35 diseased elms and put in 22i hours on emergency repairs. Further that Manhart Tree Service continues to trim trees in the Cumberland area. A map of diseased elm trees marked by zones has been prepared and trees will be removed by zones. Purchase ofI It was moved by Alderman Leer, seconded by Alderman Rateike, Trees to authorize the Commissioner of Public Works to obtain quotations for trees for the 1969 tree planting program, to be presented at the meeting of December 16th, and to conduct a survey of trees planted during the last few years to determine percentage of losses. Motion declared Carried. State Highway Mayor Behrel read a letter dated November 27th from the Dept. Trees State Highway Department in which certain nursery stock is being offered to the City for use on State Highways. Letter referred to Asst. Commissioner of Public Works for study. Civil Defense Alderman Czubakowski reported that the 200 bed disaster hospital has been lodged in City Buildings. ��' Insurance Historical Society_ 65 Page three It was moved by Alderman Bonaguidi, seconded by Alderman Seitz, to oonour with Insurance Committee's recommendation to make no change in Insurance Carriers at this time, thus rejecting the offer of Employees Mutual of Wassau. Motion declared Carried. Alderman Czubakowski, Chairman, reported that the Historical Society has been granted a lease on the Kinder property until 1971 for use as an historical museum and further information will be reported at the next meeting. BILIS It was moved by Alderman Prickett, seconded by Alderman PAYABLE: Swanson, to adopt the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THE MAYOR AND CITY CLERK ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME: $205,369.81. Following second reading, it was moved by Alderman Rateike, seconded by Alderman Wright, to adopt Ordinance T-26-68, providing for two-hour parking 9 a.m. to 5 p.m. daily, on the south side of Ashland Avenue from Lee Street east to the end of Commercial zone. Upon roll call, the vote was: AYES: - 15 - Alderman Rateike, Prickett, Wright, Bolek, Leer, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor NAYS: 0 - None ABSENT: 2 - Alderman Szabo, Figard There being fifteen affirmative votes, Motion declared Carried. Following second reading, it was moved by Alderman Swanson, seconded by Alderman Hinde, to adopt Ordinance Z-40-68, rezoning property located at 1228 Harding Avenue, presently owned by Do -All Co. to M-2 Manufacturing District. Upon roll call, the vote was: AYES: - 15 - Alderman Rateike, Prickett, Wright, Bolek, Leer, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. After discussion, it was moved by Alderman Prickett, seconded by Alderman Michaels to table Ordinance M-38-68. Upon roll call, the vote was: AYES: - 3 - Alderman Prickett, Leer, Michaels NAYS: - 11 - Alderman Rateike, Wright, Bolek, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington ABSENT: 2 - Alderman Szabo, Figard There being eleven negative votes, Motion declared lost. Upon roll call to adopt Ordinance M-38-68, the vote was: AYES: - 12 - Alderman Rateike, Wright, Bolek, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Mayor. NAYS: 3 - Alderman Prickett, Leer, Michaels ABSENT: 2 - Alderman Szabo, Figard There being twelve affirmative votes, Motion declared Carried and Ordinance M-38-68 was adopted. Placed on First Reading was Ordinance M-1-69, the Appropriation Ordinance for 1969. Placed on First Reading was Ordinance M-2-69, having to do with Position Classification and Compensation Plan. The letters from the Des Plaines Zoning Board of Appeals regarding the following cases were referred to the Municipal Development Committee for study and report: Cases 68-57-A, 68-58-A, 68-59-A, 68-60-A, 68-61-A, Text Amendments "R-5" and "C-4"; Case 68 -62 -RV; Case 68-65-R, 389 River Road. Following the submission of a copy of petitions signed by property owners in the immediate neighborhood, submitted by Alderman Wagner, it was moved by Alderman Wagner, seconded by Alderman Bolek, that Council concur with Des Plaines Zoning Board of Appeals in denying petition for rezoning in Case #68-63R, 2329 Westview Drive and Case #68-64R, 800 East Touhy Avenue. Motion declared Carried. The request for a resubdivision of a lot submitted by Mr. Joseph Pace was referred to the Plan Commission. The City Clerk read the invitation to an open house honoring Mrs. Ethel Hunting, retiriigg in December after serving as Assistant Librarian for twenty-two years, at the Library, Sunday, December 8th from 3 to 5 p.m. Mayor Behrel read the letter from Attorney LeVander re an offer to purchase the lot owned by the City located. on the east side of Maple Street at Lunt Avenue, for $6,000.00. It was moved by Alderman Shillington, seconded by Alderman Hinde, to secure an appraisal of subject property. Upon roll call, the vote was: AYES: - 15 - Alderman Rateike, Prickett, Wright, Bolek, Leer,Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor NAYS: 0 - None ABSENT: 2 - Alderman Szabo, Figard There being fifteen affirmative votes, Motion declared Carried. 1 1 67 Page five RESIGNATION It was moved by Alderman Prickett, seconded by Alderman Edw. J. Keller Shillington, to accept the resignation of Mr. Edward J. Keller as a member of the Traffic Commission and write a letter of commendation. Motion declared Carried. Maple St. The letter from Des Plaines Safety Council, Inc. regarding between Howard condition of Maple Street between Howard Street and the & Maple School northwest corner of the Maple School property was referred to the Traffic Commission and Streets and Traffic Committee for study and report. Alley - Referred to the Traffic Commission for study and report between `Lee & was the request of Alderman Bolek for stop signs at the Graceland First National Bank Drive -In exit into the alley between Lee and Graceland south of Prairie Avenue. Alley - Des Alderman Czubakowski's request for traffic relief in Plaines Trust the alley behind Des Plaines Trust and Savings was referred & Savin&s. to the Mayor to contact President of the Bank requesting that a post in the parking lot be removed for traffic flow. Product Mayor I3ehrel reported briefly on his meeting of today P1annin, with a representative of the Chicago and Northwestern Associates Railway and Product Planning Associates regarding a speed transit system between Des Plaines and O'Hare Airport.
