10/21/1968CALL TO ORDER: Donald Hughes allegiance to ROLL CALL: 40 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL ROOM, CITY HALL, MONDAY, OCTOBER 21, 1968 The regular meeting of the City Council of the City of Des Plaines was called to order by Mayor Herbert H. Behrel, at 8:05 P.M. The.meeting opened with a prayer by Rev. of St. Stephens Catholic Church, followed by the pledge of the flag. Roll Call indicated the following aldermen present: Rateike, Szabo, Prickett, Wright, Bolek, Leer, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Shillington. Absent were Aldermen Seitz and Michaels. Also present were: City Comptroller Blietz, Chief of Police Hintz, Fire Chief Arndt, Building Commissioner Schuepfer, Commissioner of Public Works Warnicke, City Engineer Fletcher, and City Attorney Robert J. DiLeonardi. There being a quorum present, the meeting was in order. MINUTES: It was moved by Alderman Prickett, seconded by Alderman Rateike, that.the,Minutes of the regular meeting of October 7, 19681 be approved as published., A correction was made on Page two, Paragraph, "Fire Hose Adapters", purchased from Dalton Bi*Lateral Hose Co:'instead of Great Lakes Fire Equipment. After correction, Motion.to_approve was declared carried. REPORTS OF Placed on file were the following reports: Appropriation CITY OFFICIALS: Expenditures - January 1 to September 30; Fire Department Quarterly Report. ZONING - Ra5 City Attorney,DiLeonardi reported that. Attorney M..Tuttle, District - Maly. representing property owners, had written him regarding . Amendment the map amendment to the Zoning Ordinance in the R-5 District, stating that the property located at the north - :east corner of 'Lee & Perry is zoned C-2 Commercial along It* frontage on ,Lee Street but that the legal description of the map amendment for the R=5"District bisects the property leaving a portion zoned,A4 _ an apparent error in the map amendment. It was moved by. Alderman Ra-teike, seconded byAlderman Szabo, to authorize, the City - At'torney.to petition the ZonineBoard of Appeals to correct the map rezoning land in the R-5 District to eliminate the tract stated above. Motion declared Carried. Alderman Michaels arrived at 8:18 P.M. MSD Brief City Attorney.DiLeonardi submitted copies of the Brief & Argument and Argument in the Metropolitan Sanitary District of Greater,,;Chicago case, filed with Judge Lupe .of the Circuit Court,'0etober 21, 1968. Rand -Central City"Attorney.DiLeonardi reported on the results of the Zoning Case Rand -Central Zoning case heard this mornings sta=ting that a judgement has been ruled in favor of surrounding property owners, and hopefully a judgement will be entered in favor of the City to keep the'property single family residence district.' Alderman Seitz arrived at this time - 8:22 P.M. City Attorney DiLeonardi reported that Emmanuel Lutheran Church has filed various objections to the Lee Street Lighting by Special Assessment 4189, stating that the property is used for school and church purposes, which was found to be invalid. He further reported that the trial on these objects has been set for sometime next week. NIMLO Conference It was moved by Alderman Shillington, seconded by Alderman Hinde, to authorize the expenditures of City Attorney DiLeonardi to attend the NIMLO conference in Kansas City, November 10th thru 14th for registration, transportation, and hotel fees. Motion declared Carried. Alderman Figard, Chairman, set a meeting of the Police Committee for 7:30.P.M., October 24. It was moved by Alderman Rateike, seconded by.Al.derman Shillington, to concur with Fire Committee's recommendation to advertise for bids.returnable 10 a.m., November 4th, for the coating of steel and caulking of the Fire Drill Tower at Fire Station #3 on Thacker Street - Fire Chief to draft necessary specifications. Motion declared Carried. Alderman Rateike, Chairman, set a meeting of the Fire Committee for 7:30, November 4th. It was moved by Alderman Shillington, seconded by Alderman Hinde, to concur with Building and Grounds and Finance Committee's recommendation to reject all bids received for the Old City Garage property located on Miner Street and retain subject property until the time a decision can be reached. for acquisition of sites for a new Municipal Building and new Fire Station.- possiblyrenting the site in the meantime. After considerable discussion, it was moved by Alderman Bolek, seconded by Alderman Rateike, to defer action on said committee report until next meeting. Alderman Rateike requested that a quotation for demolition of buildings on the property be obtained. It was moved by Alderman Shillington, seconded by Alderman Swanson, to concur with Building and Grounds and 'Finance Committee's recommendation not to consider the purchase of a.voting device for registering votes of Council members at this time. Motion declared Carried. Alderman Michaels and Thomas voted No. Alderman Shillington, Chairman, set a meeting of the Building and Grounds Committee for 8:30 P.M., October 24th. Alderman Bolek reported that the City Code, Judiciary and License Health and Inspection Committees met with Department Heads regarding Amendments to the Violation Citation Ordinance, and.do not have a final recommendation for submission to Council.at this time. Itrwas decided at this meeting to use the short -form method submitted by City Attorney DiLeonardi and the City Attorney will designate someone from his office to give the Department Heads more guidance trying to obtainordinance compliance before court action. It was moved by IAlderman Bolek, seconded by Alderman Bonaguidi, to concur.with.License Health and Inspection Committee's recommendation to reduce the number of Class "A" liquor licenses by one and revoke the license issued to the owners of Bersal's at 1414 Oakton Street January 1, 1968 further to authorize the City Attorney to draft the necessary amendment to the ordinance. After considerable discussion, it w#s moved by Alderman Szabo to defer action for two weeks at which time Alderman Bolek withdrew his motion. It was moved by Alderman Bolek, seconded by Alderman Hinde, to concur with License, Health and Inspection Committee's recommendation to reduce the Class "E" liquor licenses by one and to authorize the City Attorney to draft the necessary amendment, as the license originally issued to the Colonial Room at the DeVille Motel is no longer being used. Motion declared Carried. It was moved by Alderman Bolek, seconded by Alderman Hinde, to concur with License Health and Inspection Committee's recommendation to deny the liquor license request of Norwood Pizza Inn .Inc., Elmhurst Road, south.of Bonanza Steak House. Motion declared Carried. It was moved by Alderman Bolek, seconded by Alderman Shill- ington, to concur with License Health and Inspection Committee',s recommendation to grant a Class F - Beer Only liquor license to the Brown Bottle owners, represented by Prudential Realty Company, and authorize the City Attorney to draft the necessary amendment to the ordinance to be held on Firot Reading until the building permit has been issued for the building to be located at Wolf Rd. and Touhy Avenue. Motion declared Carried. It was moved by Alderman Leer, seconded by Alderman Hinde, to concur with Streets and Traffic Committee's recommendation to install 4 -way stop signs at the intersection of Maple and Riverview and authorize the City Attorney todraft the necessary ordinance. It was moved by Alderman Leer, seconded by Alderman Rateike, to concur with Streets and Traffic Committee and Traffio Commission's recommendation that no action be taken at this time for traffic controls at the intersection of Bussee Highway and Dempster Street. It was moved by Alderman Leer, seconded by Alderman Hinde, to concur with Streets and Traffic Committees recommendation to concur with the Traffio Commission, that no action be taken at this time for a stop sign at the intersection of Fifth Avenue and Algonquin Road. It was moved by Alderman Leer, seconded by Alderman Shillington, to concur with Streets and Traffic Committee's recommendation that traffic on Westmere should yield to Little Path and authorize the City Attorney to draft the necessary amendment. Referred to the Public Works Department was Alderman Wagner's request for a survey of street lighting of the newly annexed Douglas Manor and Anderson Subdivision, south of Howard Street. Alderman Figard, Chairman, set a meeting of the Water Committee for 8:30 P.M., October 24th. Alderman Bonaguidi, Chairman, set a meeting of the Sewer and Finance Committees, City Attorney and City Engineer for 7:30 P.M., October 23. Alderman Bonaguidi, Chairman, set a meeting of the Insurance Committee for 8:30 P.M., October 23rd. It was moved by Alderman Szabo, seconded by Alderman Rateike, to concur with Building Control and Inspection Committee's recommendation to grant the request of Ladendorf Motors to install an 8' height stockade fence at the rear property line of the Commercially zoned property at the southeast corner of Rand and Mt.Prospect Roads. It was moved by Alderman Szabo, seconded by Alderman Shillington to concur with Building Control and Inspection Committee's recommendation to deny the request of Standard Oil Company for a new standard emblem to be enlarged atop present car wash sign. It was moved by Alderman Szabo, seconded by Alderman Swanson, to concur with Building Control and Inspection Committee's recommendation to grant the request of Forest Hospital to install a suspended cast iron soil pipe as a pilot model as per plans submitted, with a view towards including same in the City's Building Code. Motion declared Carried. �' 00 It was moved by Alderman Szabo, seconded by Alderman Prickett, to concur with Building Control and Inspection Committee's recommendation to approve the sign request of Henry Drive Inn, at the northeast corner of Higgins and Mannheim, for a sign 23'feet in height. It was moved by Alderman Szabo, seconded by Alderman Thomas, to concur with Building Control and Indpection Committee's recommendation to grant the request of Central Telephone Company to install a 100' guide tower Mobile Service Antenna at 767 Pearson Street. After discussion, it was moved by Alderman Bolek, seconded by Alderman Shillington, to defer action on the Committee report until next meeting. The City Attorney was requested to review the franchise agreement. A4dergam Szabo, Chairman, set a meeting of the Building Control and Inspection Committee for 7:30 P.M., October 29th. It was moved by Alderman Leer, seconded by Alderman Shillington, to concur with Elm Tree Disease and Finance Committee's recommendation to authorize a supplemental appropriation of $35,000 to cover tree work in the Forestry Department for the balance of 1968 and authorize the City Attorney to draft the necessary ordinance. Motion declared Carried. 10/21/68 44 Page five Tree Alderman Leer, Chairman, Elm Tree Disease Committee, reported Survey as follows: "The survey which began June 1st, is 99 9/10% Report complete as to what losses the City has incurred through the year. 669 diseased elm trees, of which 274 have been removed. As of this date 395 diseased elm trees remain, both public and private. 72 trees were removed because of storm damage. 520 trees have been trimmed. Due to storm damage and emergencies, 608 trees were repaired. 2500 inspections were made. The Committee feels that the tree removals were lagging somewhat and requests that all the remaining 395 trees be removed, that is the trees on public property, be removed by December 31st and that tree trimming continue. Due to the fact that there were no changes in the cost, we have given approval for Manhart to do some of the tree -trimming and will start in the Cumberland area Monday. Also the Committee would like to have a feasibility study made by the Assistant Commissioner of Public. Works along with the Commissioner to determine if we can use part of the Public Works property to plant trees for the City's use." It was further suggested that this program of tree planting include other city properties where possible. It was moved by Alderman Prickett, seconded by Alderman Rateike, to authorize the expenses ,of Mayor and Mrs. Behrel to attend the National League of Cities Conference. Following the reading of the letter from Dr. Ferraiolo, it was'_moved by Alderman Szabo, seconded by Alderman Rateike, to authorize the City Attorney to take whatever steps are necessary to enforce zoning and nuisance ordinances., allegedly being violated by Scientific Machinery Movers on property fronting on Northwest Highway. Motion declared Carried. It was moved by Alderman Bonaguidi, seconded by Alderman Szabo, to authorize the City Attorney to institute a suit against the Chicago and Northwestern Railway Co. for littering of rightfi6f-way along Northwest Highway, west of Graceland Avenue, and research with the Railway Company the possibility of relocation of the siding tracks. Motion declared Carried. The letter from Commissioner of Public Works Wernicke, re the cleaning of sludge in the drying beds was referred to the Water Committee for study and report. The letter received from the State Highway Department regarding traffic signals at the intersection of Oakton and Lee Streets, as well as the resurfacing of River Road, was read by Mayor Behrel and plaoed on file. The engineering study of the relocation of Prairie Avenue, as recotthended by the Des Plaines Redevelopment Association, Inc. was brought to the Council's attention by Mayor Behrel. It was moved by Alderman Prickett, seconded by Alderman Bonaguidi, to authorize the City Engineer to initiate the engineering study of the relocation of Prairie Avenue.
