07/15/1968J-19-1 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS HELD IN THE COUNCIL ROOM, CITY HALL, MONDAY, JULY 15, 1968 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines was called to order by Mayor Herbert H. Behrel at 8:08 P.M. The meeting opened with a prayer read by City Clerk Rohrbach, followed by the pledge of allegiance to the flag. ROLL CALL: Roll Call indicated the following aldermen present: Szabo, Prickett, Wright, Bolek, Leer, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Shillington, Michaels. Present also were: Chief of Police Hintz, Fire Chief Arndt, Fire Captain Haag, Assistant Comptroller Carlson, Building Commissioner Schuepfer, Commissioner of Public Works Warnicke, City Engineer Fletcher, and City Attorney DiLeonardi. There being a quorum present, the meeting was in order. MINUTES: It was moved by Alderman Prickett, seconded by Alderman Wright, to approve the Minutes of the regular meeting of July 1, 1966, as published. Motion declared Carried. REPORTS OF CITY OFFICIALS: Police. Chief Mt. Prospect Annexation Petition North Mane Fire Pro- Tectlon-^ District Sidewalks COMMITTEE REPORTS: Amendment -5 District Placed on file were the following reports: Appropriation Expenditures - January to June 30, 1966; Fire Department Quarterly Report; Police Department Quarterly Report. Police Chief Hintz reported that at the end of a six month period, there were 1,108 traffic accidents, 206 injuries, and four deaths. Also that one family had been evicted from the premises and temporary quarters had been located - the belongings stored at the City Garage. City Attorney DiLeonardi reported that Mt. Prospect had filed a separate involuntary annexation petition in the courts similar to the one previously filed and that he filed objections in behalf of the City before July 6th and that September 16th had been set as the hearing date. It was moved by Alderman Shillington, seconded by Alderman Prickett to ratify the action taken in filing said objections: Upon roll call, the vote was: AYES: - 15 - Alderman Szabo, Prickett, Wright, Bolek, Leer, Figard, Hinde., Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Shillington, Michaels, Mayor. NAYS: - 0 - None ABSENT: 2 - Alderman Rateike, Seitz There being fifteen affirmative votes, Motion declared Carried. City Attorney DiLeonardi reported that the circuit court upheld the City's objections to the North Maine Fire Pro- tection District's suit and the property located at 110 North River Road remains subject to the Des Plaines Tax and will be disconnected from the North Maine Fire Pro- tection District. Commissioner of Public Works Warnicke reported that the sidewalk replacement program is completed to date and urged the press and City Council to inform property owners of the availability of the program. It was moved by Alderman Swanson, seconded by Alderman Prickett, to concur with Municipal Development Committee's recommendation that the City Attorney petition the Zoning Board of Appeals for a text amendment to the Zoning Ordinance in the R-5 District in accordance with the recommendations of Tec -Search, Inc. in the staff report dated June 3, 196d. Upon roll .call, the vote was: AYES: - 15 - Alderman Szabo, Prickett, Wright, Bolek, Leer, Figard, Hinds, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Shillington, Michaels, Mayor. NAYS: 0 - None ABSENT: 2 - Alderman Rateike, Seitz There being fifteen affirmative votes, Motion declared Carried. 4 ZONING CASE 68-36-R 2500 S. Des Plaines Plat of Dedication Sycamore St. Adelman & Brott - Third Addition Kelley's Subdivision Committee Mee ing Zoning Case 68-35-R 955 E. Rand Planned Unit Development Alderman J-19-2 Page two It was moved by Alderman Swanson, seconded by Alderman Prickett, to concur with Municipal Development Committee's recommendation to concur with the Zoning Board to grant rezoning of property located at 2500 S. Des Plaines Avenue to C-2 Commercial (Case 68-36-R) and authorize the City Attorney to prepare the amendment to the Zoning Ordinance for further consideration by the Council. Motion declared Carried. It was moved by Alderman Swanson, seconded by Alderman Prickett, to concur with Municipal Development Committee's recommendation that the Mayor and City Clerk be authorized to execute the Plat of Dedication of Sycamore Street. Motion declared Carried. It was moved by Alderman Swanson, seconded by Alderman Prickett, to concur.with Municipal Development Committee's recommendation that the Mayor and City Clerk be authorized to execute the Plat of Adelman and Brott, Third Addition, Subdivision, subject to the posting of cash or bond for necessary public improvements. Motion declared Carried. It was moved by Alderman Swanson, seconded by Alderman Thomas, to concur with Municipal Development Committee's recommendation to authorize the Mayor and City Clerk to execute Plat of Kelley's Subdivision. After discussion, it was moved by Alderman Szabo, seconded by Alderman Shillington, that the subdivider install sidewalks on the subject property and the motion be amended accordingly. It was moved by Alderman Shillington, seconded by Alderman Bonaguidi, to defer action until the next regular meeting on the aforementioned committee report. Alderman Swanson, Chairman, set a meeting of the Municipal Development Committee for 7:30 P.M., July 29th. It was moved by Alderman Swanson, seconded by Alderman Prickett, to concur with Municipal Development Committee's recommendation to concur with the Zoning Board to grant rezoning of property located at 955 E. Rand Road to C-2 Commercial (Case 68-35-R) and authorize the City Attorney to prepare the amendment to the Zoning Ordinance for further consideration by the Council. Motion declared Carried. It was moved by Alderman Prickett, seconded by Alderman Thomas, to concur with Municipal Development Committee's recommendation that the draft of the planned unit development ordinance be referred to the Plan Commission for study and report prior to the Zoning Board public hearing. Motion declared Carried. Rateike arrived at this time. Committee Meeting Double Frontage Lots - Improvements EQUIPMENT Radio -Police Alderman Shillington and Alderman Swanson set a meeting of the Building and Grounds and Sanitation Committees for 8:30 July 29th. The matter of public improvements on double frontage lots as pr©posed by Alderman Bonaguidi, was referred to the n,: -,m Building Control and Inspection Committee, Building Commissioner, and City Engineer for study and report. It was moved by Alderman Figard, seconded by Alderman Thomas, to concur with Police Committee's recommendation to authorize the City Comptroller to issue the purchase order to Motorola Co. for a radio unit for squad #6, in the amount of $813.00. Upon roll call, the vote was: AYES: - 16 - Alderman Rateike, Szabo, Prickett, Wright, Bolek, Leer, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Shillington, Michaels, Mayor. NAYS: 0 - None ABSENT: - 1 - Alderman Seitz There being sixteen affirmative votes, Motion declared LE, Carried, / Reopen Negotiations Acquisition of Property Committee Meeting Grant Drive & Hoffman Webster Lane Committee Ming Lime Tank Improvements Committee Meeting STORM SEWER Section 15 7/15/68 3� Page three It was moved by Alderman Prickett, seconded by Alderman Bonaguidi, to authorize the Mayor and City Attorney to reopen negotiations for the acquisition of the two properties east of the present Municipal Building. It was moved by Alderman Rateike, seconded by Alderman Shillington, to amend the motion to include any other properties in the immediate area of the Municipal Building. Motion declared Carried. Motion as amended declared Carried. Alderman Swanson, Chairman, set a meeting of the Sanitation Committee for July 29th at 8:30 P.M. At the request of Alderman Leer, referred to the Traffic Commission and Police Department for study and report were the following: the intersection of Hoffman and East Grant Drive and West Grant Drive for possible traffic control signs and excessive speeds on Webster Lane between Oakton and Forest Avenues. Alderman Leer, Chairman, set a meeting of the Streets and Traffic Committee for July 24th at 8 PIM. It was moved by Alderman Tigard, seconded by Alderman Hinde, to concur with Water Committee's recommendation to advertise for bids returnable August 12th at 10 a.m. for the improvements of the lime tank - City Engineer to draw the specifications. Motion declared Carried. Alderman Figard, Chairman, set a meeting of the Water Committee for 7 P.M., July 29th. It was moved by Alderman Bonaguidi, seconded by Alderman Shillington, to concur with sewer Committee's recommendation to advertise for bids returnable August 12, 1968, at 10 a.m. for Section #15 of the Storm Sewer program. Motion declared Carried. STORM SEWER City Clerk Rohrbach read the motion on which action was Section #11 deferred at the last regular meeting regarding Section 11 Elmhurst Rd. of the Storm Sewer Program. After considerable discussion, and a ten-minute recess of the Council, Alderman'Bonaguidi asked for leave to withdraw his motion. Mayor Behrel stated that inasmuch as the motion had been stated and was now before the Council, it was necessary to obtain the consent of the Council to withdraw the motion. The vote on consent to withdraw was: AYES: - 16 - Alderman Rateike, Szabo, Prickett, Wright, Bolek, Leer, Figa ,d, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Shillington, Michaels, Mayor. NAYS: 0 - None ABSENT: 1 - Alderman Seitz There being sixteen affirmative votes, Motion was declared Carried; Section #11 It was moved by Alderman Bonaguidi, seconded by Alderman Contract Shillington, to proceed with the fulfillment of the contract for Section 11 of the Storm Sewer program, in- cluding the installation of the storm sewer on the east side of Elmhurst Road (Route 83). Upon roll call, the vote was: AYES: - 16 NAYS: 0 ABSENT: 1 There being Carried. - Alderman Rateike, Szabo, Prickett, Wright, Bolek, Leer, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Shilling - ton, Michaels, Mayor. - None - Alderman Seitz sixteen affirmative votes, Motion was declared • Page four 7/15/68 4 RESOLUTION It was moved by Alderman Bolek, seconded by Alderman Sanitary, Prickett, to pass a resolution, copies of which to be District forwarded to all trustees of the Metropolitan Sanitary Disposal District, expressing the City Council's view of the Plant district's decision not to locate a sludge plant on the south and southwest side of Cook County, and requesting a re-evaluation of their decision to locate a disposal plant within the corporate limits of the City - the City Attorney to draft the necessary resolution. Motion declared Carried. Committee Alderman Szabo, Chairman, set a meeting of the Building Meeting Control and Inspection Committee for July 23rd at 8 P.M. Approve Sign It was moved by Alderman Szabo, seconded by Alderman Wagner, Request to concur with Building Control and Inspection Committee's Cave Inn recommendation to approve the sign request of the Cave Restaurant Inn Restaurant at 2733 Mannheim Road, and authorize the Building Commissioner to issue the necessary permit. Motion declared Carried. Advertise for Bids - Trees It was moved by Alderman Leer, seconded by Alderman Prickett, to concur with Elm TreeDisease Committee's recommendation to reject the un -opened bid and re -advertise for bids on (1) tree removal (2) stump removal and (3) tree trimming and forester service and emergency service, returnable July 29, 1968 at 10 a.m., each to be bid separately or as one unit - specifications to be drawn by the Commissioner of Public Works and approved by the City Attorney. Motion declared Carried. ZONING It was moved by Alderman Michaels, seconded by Alderman ORDINANCE Shillington, to authorize the City Attorney to petition Commercial the Zoning Board of Appeals for a public hearing for a Districts text amendment to the Commercial Districts in accordance wnft4 City Code Committee's revisions of said amendment as recommended by Tec -Search, Inc. in their staff report dated May 20, 1968. Motion declared Carried. BILLS PAYABLE: It was moved by Alderman Prickett, seconded by Alderman Swanson, to adopt the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THE MAYOR AND CITY CLERK ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME: Total $119,440.35. Code Amendment It was moved by Alderman Prickett, seconded by Alderman Tax Rate Rateike, to concur with Finance Committee's recommendation Limits to amend the City Code as follows and authorize the City Attorney to draft the necessary ordinance: Add to the code, a Street and Bridge Tax rate - .10; Change Public Library Fund from .10 to .12; Change' Fire Protection Fund from .0690 to .20. It was moved by Alderman Figard, seconded by Alderman Michaels, after second reading, to adopt Ordinance M-26-68, vacating a portion of Ashland Avenue, Farrell Avenue, a Public Alley located between portions of Ashland Avenue and Farrell Avenue. Placed on First Reading was Ordinance T-11-68 having to do with changing of one way streets, south of Thacker and north of Algonquin Road. The North Maine Fire Protection District contract was referred to the Fire Committee for study and report. Alderman Rateike, Chairman, set a meeting of the Fire Committee for 8:30 July 24th. The petitions for Annexation from Commonwealth Edison Company and the Chicago and Northwestern Railway for property located on Rand Road were referred to the City Attorney for the drafting of the necessary ordinances. The letter from the Des Plaines Zoning Board of Appeals re Case 68-38-A, regarding a text amendment having to do with the Parking of Trucks and Trailers was read and placed on file. Referred to the Traffic Commission was the suggested control of traffic at the entrances to the alley north of Miner Street, between Pearson and Lee, to be marked for "entrance only". Alderman Michaels questioned the possibility of setting up an engineering department for the City and including same in next year's appropriation. The subject was discussed briefly - no action taken. It was moved by Alderman Shillington, seconded by Alderman Rateike, that the regular meeting of the City Counci adjourn. Motion declared.
