MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY
OF DES PLAINES, HELD IN THE
COUNCIL CHAMBERS, CITY HALL,
TUESDAY, JANUARY 2, 1973
CALL TO ORDER: The regular meeting of the City Council of the City of
Des Plaines was called to order by Mayor Herbert H. Behrel
at 8:00 P.M. The meeting opened with prayer by Rev. Keith
Davis, pastor of the Church of the Master, followed by
the Pledge of Allegiance to the flag.
ROLL CALL:
Roll Call indicated the following aldermen present;
Koplos, Szabo, Kehe, Sherwood, Bolek, Chase, Kisslinger,
Hinde, Czubakowski, Erbach, Swanson, Thomas, Bonaguidi,
Abrams, Michaels. Absent was Alderman Seitz.
Also present were: City Comptroller Blietz, Police Chief Hintz, Fire Chief
Haag, Building Commissioner Prickett, City Engineer Bowen, Assistant
Commissioner of Public Works Schaffer, City Planner Richardson, Sanitarian
Martin, Environmental Officer Lindahl, Attorney Hug, and City Attorney
DiLeonardi.
MINUTES:
Moved by Sherwood, seconded by Kehe, to approve the
Minutes of the regular meeting held December 18, 1972, as
published. Motion declared carried.
REPORTS OF Placed on file were the following reports: Monthly Report
CITY for December and Annual Report, 1972 - Building Department;
OFFICIALS: Monthly Report of Public Works Department for December;
Report of Health Department for December; Engineering
Department Monthly Report, December; Report of Examination
of Water Fund for nine months ended September 30, 1972.
BLUE CROSS- City Comptroller Blietz reported that a letter has been
BLUE SHIELD received from Blue Cross -Blue Shield indicating rates
for Blue Cross will remain the same but rates for Blue
Shield have been increased - Written report to be submitted
to City Council.
NWDS Moved by Bonaguidi, seconded by Swanson, to adopt recommenda-
Key Punch tion of City Comptroller Blietz to lease an IBM Type 129
Machine Data Recorder for key punching at a cost of $180 per month.

POLICE CHIEF Police Chief reported that the Police Department handled
10 cases during December involving narcotics or drugs.
Further that during Holiday Weekend - Dec. 22 to 25, there
were 26 accident cases and during New Year Holiday weekend,
the Department handled 21 accident cases. He further
reported that two deaths occurred at 7:45 a.m. this morning
resulting from traffic accident at River Road and Gregory.
FIRE CHIEF Fire Chief Haag reported that the fire retardant program
was a success and that the Department dipped approximately
400 trees.
COMMISSIONER Commissioner (Assistant) of Public Works Schaffer reported
OF PUBLIC the Department answered 12 sewer back up calls during
WORKS Saturday morning rainfall, and the Street Department
filled chuckhole where washouts occurred.
FENCING Estimate of cost for the fencing of recycling center
Recycling on motion of Chase, seconded by Czubakowski, was referred
Center to the Environmental Controls Committee. Motion declared
carried.

City City Attorney DiLeonardi reported that the Angel Town
Attorney Nursery case being handled by Attorney D. Rose has been
set for hearing of our motion for judgment on January 4th;
however do not expect court to rule on January 4th.
SCIENTIFIC City Attorney DiLeonardi reported that the Appellate Court
MACHINERY filed its opinion in the Scientific Machinery Movers case
MOVERS and reversed the trial court decision. Moved by Koplos,
Suit seconded by Sherwood, to retain City Attorney DiLeonardi
to continue the aforementioned case in the trial court

COMMITTEE Moved by Kehe, seconded by Sherwood, to adopt the recommenda-

Elk Grove Grove Fire Protection District for the year 1973, for the
Rural Fire sum of $18,123.00 to serve those areas in the District
Protection lying east of Route 83 and north of the Northwest Tollway,
District and to authorize execution thereof. Upon roll call, the
Contract vote was:

Moved by Kehe, seconded by Sherwood, to adopt the recommenda-
tion of Fire Committee to deny offer to purchase one
ambulance from Oehler's Funeral Home owners. Motion
declared carried.
FLAMBEE Moved byKehe, seconded by Sherwood, to adopt the recommenda-
LIQUIDS tion of Fire Committee to authorize City Attorney to draft
Ordinance amendment to Title Seven, Chapter 2, Articles 1 through 47,
relating to Flammible Liquids for further consideration by
City Council. Motion declared carried.
CIVIC CENTER Moved by Szabo, seconded by Hinde, to adopt the recommenda-
COMPLEX tion of Public Buildings Grounds and Parking Lots Committee
to authorize Mayor Behrel to seek proposal from Benjamin
& Lang for financial consulting in connection with General
Obligation Bonds to finance Phase I & II of the proposed
Civic Center Complex. Upon roll call, the vote was:
AYES: - 16 - Koplos, Szabo, Kehe, Sherwood, Bolek, Chase,
Kisslinger, Hinde, Czubakowski, Erbach, Swanson,
Thomas, Bonaguidi, Abrams, Michaels, Mayor.

OFFICE SPACE Moved by Szabo, seconded by Hinde, to authorize Mayor and
RENTAL City Comptroller to negotiate for office space to relocate
City Offices presently housed in the 1426 Miner Street
building. Motion declared carried.
LIQUOR LICENSE Moved by Bolek, seconded by Chase, to adopt the recommendation
Brat House of License and Inspection Committee to deny request of Brat
International House International for Class A Liquor License. Motion
declared carried.
FOOD Referred to the License and Inspection Committee was the
SERVICES licensing of certain grocery stores, service.. stations,
etc. who sell small food items in addition to prepared A/
sandwiches and carry -out food items.

STREETS, Mayor Behrel referred the following items to Streets,
TRAFFIC & Traffic & Forestry Committee:
FORESTRY 1. Request from Mr. Joseph Stucker to reduce number of

WATER Moved by Koplos, seconded by Szabo, to adopt the recommenda-

Church & Lyman Avenue at double the regular rate charged to the
Lyman residents - all expenses and fees incurred to be paid
by Shorewood Builders, Inc. - agreement to terminate on
June 30, 1973, and subject to the consent by City of
Chicago under City's Water Contract. Upon roll call, the

3. Permission granted for water service to this property
for single family use only.
All subject to consent by the City of Chicago under
City's Water Contract.

Oakton St. Dempsey and Associates be authorized to make the necessary
soil borings for the proposed Oakton Street Storm Water
Reservoir Improvement on Oakton Street at a cost not
to exceed $650.00. Upon roll call, the vote was:

Moved by Koplos, seconded by Szabo, to adopt the recommenda-
tion of Water and Sewer Committee to authorize the firm of
Edgebrook Construction Corp. of Highland Park to clear and
remove the debris from Farmer's Creek from Dempster Street
north to Emerson Street and Prairie Creek from_ Lyman. Avenue
east to Potter Road at a cost not to exceed $14,700, waiving
the advertising for .bid procedure. Following discussion,

to include the provision to advertise for bids. Motion
declared carried. Further amended on motion by Koplos,

OFFICE OF
MAYOR
Moved by Abrams, seconded by Michaels, to adopt the
recommendation of City Code and Judiciary Committee that
the City Attorney be authorized to prepare an appropriate
ordinance creating the Office of Mayor as a part time
position and creating the position of administrative
assistant to be selected by the Mayor with the consent of
City Council. Upon roll call, the vote was:
AYES: - 6 - Szabo, Bolek, Chase, Bonaguidi, Abrams, Michaels
NAYS: 9 - Koplos, Kehe, Sherwood, Kisslinger, Hinde,

ENVIRONMENTAL Moved by Michaels, seconded by Sherwood, to adopt the
CONTROL recommendation of Environmental Controls Committee to
HANDBOOK print an Environmental Control Handbook at a cost not to
exceed $700. Moved by Swanson, seconded' by Hinde, to
amend said booklet by deleting "Refuse Junk Mail". Motion
declared carried. Committee agreed to delete "Place
bricks in the flush tank of your toilet" from said booklet.

Relations Commission and authorize Mayor Behrel to write

Behrel's reappointment of Mr. George Olen, Mrs. Lynn
Edinoff, and Mr. George Olen as Chairman for the year 1973
to the Des Plaines Human Relations Commission, terms to
expire December 31, 1975. Motion declared carried.

RESIGNATION Moved by Bonaguidi, seconded by Szabo, to accept the
Zoning Bd. resignation of Mr. E. M. Roschke from Des Plaines Zoning
of Appeals Board of Appeals, effective January 1, 1973, and authorize
Mayor Behrel to write letter of commendation. Motion
declared carried.
APPOINTMENT Election by paper ballot declared Mr. Dale R. Fahnestock
Zoning Bd. appointed to the Des Plaines Zoning Board of Appeals to
of Appeals fill the unexpired term of Mr. E. M. Roschke, expiring
April 30, 1974.
AIR POLLUTION The pamphlet published by the Environmental Protection
Control Agency of the federal government re proposed standards for
