MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY
OF DES PLAINES, HELD IN THE
COUNCIL CHAMBERS, CITY HALL,
MONDAY, DECEMBER 4, 1972
CALL TO ORDER: The regular meeting of the City Council was called to order
by Mayor Herbert H. Behrel at 8:05 P.M. The meeting opened
with prayer by Rev. Philip Gronbach, pastor of Trinity
Lutheran Church, followed by the Pledge of Allegiance to
the flag.
ROLL CALL:
Roll Call indicated the following aldermen present:
Koplos, Szabo, Kehe, Sherwood, Bolek, Chase, Kisslinger,
Hinde, Czubakowski, Erbach, Swanson, Thomas, Bonaguidi,
Seitz, Abrams. Absent was Alderman Michaels
Also present were: City Comptroller Blietz, Police Chief Hinte7 Fire Chief
Haag, Building Commissioner Prickett, City Engineer Bowen, Commissioner of
Public Works Schwab, City Planner Richardson, Sanitarian Martin, City
Treasurer Rateike, Police Captain Blume, Attorney Hug, and City Attorney
DiLeonardi.
MINUTES:
Moved by Sherwood, seconded by Kehe, to approve the Minutes
of the regular meeting held November 20, 1972, as published.
Motion declared carried.
REPORTS OF The following reports were ordered placed on file:

Public Works Department, Health Department, Building
Department; City Comptroller's report on 1972 Parking
Revenue Bond Construction Account.

City Clerk Rohrbach reported that all precinct boundaries
within wards have been drawn and voter registration cards
pulled and filed within precincts. Maps and Redistricting
Ordinance will be submitted at next regular meeting.
Police Chief Hintz reported on traffic accident November
25th at Rand and Wolf, resulting in one fatality and six
injuries. Also a traffic accident on November 26th at
Mt. Prospect Road and Roxbury, resulting in one fatality
and three injuries. December 1 an auto was hit by Soo
Line train at, Frontage Road. December 2nd. Police Auction
proceeds were $1,219.00, and the City received approximately
$18,000 refund from Federal Government for Police Training.
Further that Officer Neil is attending classes at the
National Association for the Deaf.
Fire Chief Haag reperted that the Fire Department's annual
program of dipping Christmas trees will continue thru
December 24 at Station #1, seven days per week from 2 to
5 p.m. and 7 to 9 p.m.
Alderman Szabo questioned the Building Commissioner re
the material used in the building being constructed at
Laurel and Washington for which a building permit was
issued stating his opposition to the dry -block concrete
block and recited certain documentation of said new material
from publications received from Masonry Association and
others. It was moved by Szabo, seconded by Koplos, following
discussion that the building be stopped at this point
until further tests are made on the new construction
material. Following Alderman Erbach's report re Committee's
review of plans submitted and signed by a structural
engineer, Motion was withdrawn. Moved by Sherwood,
seconded by kin -de'► ; to authorize Building Control and
Inspection Committee to hire an independent structural
engineer to review the new construction material and submit
a report to City Council. Upon roll call, the vote was:

Moved by Swanson, seconded by Hinde, to adopt the recommenda-
tion of Municipal Development and Zoning Board of Appeals
to deny petition to rezone property located at 1375 Elmhurst
Road to C-2 Commercial District - Case No. 72-55-R.
Motion declared carried.
Moved by Swanson, seconded by Thomas, to adopt the recommenda-
tion of Municipal. Development Committee to grant variation
as recited in Case 72-54-V - property located at 1264
Campbell, and authorize City Attorney to draft the necessary
ordinance. Motion declared carried.
Alderman Hinde reported that report of Lt. Scheskie and
Officer Neil submitted to City Council a report on proposed
"bike routes" to be reported by Committee at next regular
meeting. He further reported that the Committee continues
to study the elimination of certain crossing guard locations.
Following discussion re the installation of sidewalks on
the west side of Wolf Road and the letter from property
owner, I. Moehling, it was moved by Hinde, seconded by
Bonaguidi, that the City install a temporary gravel walk
on the east side of Wolf Road from Central or Berkshire
to Rand Road. Upon roll call, the vote was:
AYES: - 16 - Koplos, Kehe, Sherwood, Bolek, Chase, Kisslinger,
Hinde, Czubakowski, Erbach, Swanson, Thomas,
Bonaguidi, Seitz, Abrams, Michaels, Mayor.
NAYS: 1 - Szabo

Motion declared carried.
Alderman Chase's request for Traffic Light at the intersection
of Walnut and First Avenue, as recited in letter from.
Keith Bachtell, was referred to Traffic Commission and
Streets and Traffic Committee for study and report. Also
to Police Department for survey of alleged "non -stopping"
vehicles.
Alderman Kehe's request for traffic on Lincoln to yield to
traffic on Maple Street was referred to Streets, Traffic
and Forestry Committee for study and report.
Moved by Erbach, seconded by Swanson, to adopt the recommend-
ation of Building Control and Inspection Committee to
authorize City Attorney to draft the necessary ordinance
to amend the City Code to provide that all front yard
fences which are authorized by the code, be restricted to
a maximum height of 31 feet, and where two or more dwelling
units are joined by a common wall, such fences shall be
uniform in height, material, type and design for each
structure or building. Motion declared carried.
Moved by Chase, seconded by Bolek, to adopt the recommenda-
tion of Library and Historical Society Committee that the
Mayor appoint a Special Bicentennial Committee charged
with responsibility of recommending to the Mayor and City
Council a Des Plaines Bicentennial Commission together
with recommendation as to the membership and purpose of
such a commission and further that the Special Bicentennial
Committee be comprised of the present three members of
the Library and Historical Society Committee plus Mr.
James Williams and Mr. David Wolf. Motion declared carried.

Moved by Koplos, seconded by Erbach, to concur with Mayor
Behrel's appointment of the following to the Special
Bicentennial Committee: Aldermen, Chase, Erbach, Seitz,
Mr. James Williams and Mr. David Wolf. Motion declared
carried.
Alderman Chase reported that the grounds surrounding the
City's Recycling Center were filled with flying papers
and broken glass - matter referred to Commissioner of
Public Works for estimate of fencing and possible
supervision on weekends.
Moved by Bonaguidi, seconded by Hinde, to adopt the
recommendation of Finance and Insurance Committee to
take no action on the proposal of Aetna Life and Casualty
Co. for Deferred Compensation Plan for employees at this
time. Motion declared carried.
Moved by Bonaguidi, seconded by Swanson, to adopt the
recommendation of Finance and Insurance Committee to approve
a settlement of $7,500 for Robert Schaffer, fireman for
the City of Des Plaines, and to authorize Bronson,
Dennehy, Ulseth, Inc., our insurance managers, to instruct
the firm of Kane, Doy & Harrington to proceed to effect
the settlement. Upon roll call, the vote was:

ARE DUE AND PAYABLE AND THE MAYOR AND. CITY CLERK BE AND
ARE HEREBY AUTHORIZED TO.MAKE PAYMENT FOR SAME: Voucher
Nos. 5302 in the amount of $4,701.65 and Voucher No.
114 in the amount of $41,993.90 withheld making new total
$67,783.53. Upon roll call, the vote was:

Placed on First Reading was Ordinance T-38-72 Amending
Schedule I of Section 10-5-4 of the City Code by Prohibiting
Parking Along the South Side of Rawls Road, 66 Feet East of
111 East Rawls Road West Driveway.
Placed'on First Reading was Ordinance T-39-72 Amending
Section 10-5-5 (G) Having to Do With Parking During Certain
Hours on Oak Street From Brown Street to Harding Avenue.
The letter from residents residing in the Thacker House
Condominium expressing dissatisfaction with the proposed
Thacker Street Overpass was referred to Streets, Traffic
and Forestry Committee.
The letter from State Department of Transportation re
Pedestrian Crossing Signals at Wolf Road and Stone Avenue
was referred to Streets and Traffic and Forestry Committee.
The Plat of Fulle's Subdivision located on Stratford Road
was referred to the Plan Commission.
The Plat of River=Golf Subdivision located on the west
side of River Road, just north of Holy Family Hospital
property was referred to the Plan Commission:.
The Petitions for Annexation received from property owners
at 714 W. Oakton Street and 716 W. Oakton Street were
referred to City Attorney for the drafting of necessary
ordinance.
Moved by Koplos, seconded by Bonaguidi, to grant request
of property owners, Mr. and Mrs. Herbert Oehlerking at
716 W. Oakton Street, and Mr. and Mrs. Roy Eanos at 714
W. Oakton Street to tap on to Watermain at their expense,
upon the issuance of the necessary permit, and prior to
annexation. Motion declared carried.
Placed on First Reading was Ordinance M-57-72 Amending
Section 5-34-10 of the City Code by Increasing the Number
of Class A Liquor Licenses by Two.
Moved by Koplos, seconded by Michaels, to authorize City
Attorney to draft necessary ordinance repealing Ordinance
M-12-72 Providing for a Tax on the Retail Sale of New
Motor Vehicles - motion followed City Attorney's report
of Supreme Court Opinion. Motion declared carried.
Moved by Koplos, seconded by Bolek, to authorize City
Attorney to draft necessary ordinance repealing Ordinance
M-14-72 Providing for a Privilege Tax on Certain Mobile
Homes. Motion declared carried.
The letter from Dr. Ferraiolo offering for sale the building
located at 1585 Ellinwood Street, was referred to Public
Building and Grounds and Parking Lots Committee.
Mayor Behrel made a report on his attendance at the annual
conference of the National League of Cities stating he served
on the Resolutions Committee, and subjects relating to
Catv, Revenue Sharing, Grants and others were discussed.
Further that he is now a member of the Board of Directors
Advisory Council.
Referred to City Attorney and City Code and. Judiciary
Committee was the matter of Smith & Pipenhagen's responsi-
bility to submit payment to the City for preliminary plans
for the proposed Civic Center complex.
