10/02/1972, 419 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, HELD IN THE COUNCIL CHAMBERS, CITY HALL, MONDAY, OCTOBER 2, 1972 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines was called to order by City Clerk Rohrbach at 8:05 P.M. The meeting opened with prayer by Rev. Ernest Grant of The First Congregational Church followed by the Pledge of Allegiance to the flag. ROLL CALL: Roll Call indicated the following aldermen present: Koplos, Szabo, Kehe, Sherwood, Bolek, Chase, Kisslinger, Hinde, Czubakowski, Erbach, Swanson, Thomas, Bonaguidi, Seitz, Abrams, Michaels. Also present were: City Comptroller Blietz, Police Chief Hintz, Fire Chief Haag, Building Commissioner Prickett, Commissioner of Public Works Schwab, Assistant Commissioner of Public Works Schaeffer, City Planner Richardson, City Attorney DiLeonardi and his assistant C. Hug, City Engineer Bowen, Assistant Engineer Perl, Environmental Officer Lindahl, and City Treasurer Rateike. MAYOR Moved by Bonaguidi, seconded by Szabo, to nominate Alderman PRO -TEM Bolek Mayor Pro -Tem for this meeting. Moved by Thomas, seconded by Bonaguidi, that nominations be closed. Upon roll call, the vote was: AYES: - 10 - Koplos, Szabo, Sherwood, Chase, Erbach, Swanson, Thomas, Bonaguidi, Seitz, Michaels NAYS: 5 - Kehe, Kisslinger, Hinde, Czubakowski, Abrams ABSTAIN: 1 - Bolek Motion declared carried. DES PLAINES Alderman Bolek presented to Police Chief Hintz a check in POLICE BOYS the amount of $350.00 for the Des Plaines Police Boys Club, CLUB representing proceeds of the Des Plaines City Officials Golf Outing. MINUTES Moved by Chase, seconded by Kehe, to approve the Minutes of the regular meeting held September 18, 1972, as published. Correction, Page five, paragraph ORDINANCE M-37-72, Section 1, to read as follows: "3. Set -back Line. No Ground Sign shall be constructed closer than five feet from any property line. Where a public sidewalk is constructed over any property line, the set- back shall be five feet from the sidewalk." Correction: Page four, Paragraph CITY PROPERTY Library, adding "825 Graceland Avenue" to line four. Motion declared carried. REPORTS OF The following reports were ordered placed on file= CITY OFFICIALS:City Treasurer's Statement of Illinois State Income Tax Collected 1971 and 1972; City Treasurer's Statement of Sales Tax collected - 6 Months 1972; Monthly Reports for September of the following Departments: Engineering, Health, Public Works, and Building. GASOLINE City Clerk Rohrbach announced that bids for gasoline for BIDS City Vehicles will be received October 18, 1972. CLAIM Following report of City Comptroller Blietz of offer of SETTLEMENT settlement of claim from Insurance Co. representing George Schuman R. Schuman for knocked down street light and pole, the matter was referred to City Code and Judiciary Committee and City Attorney for review and report. POLICE Police Chief Hintz reported that during September 16 to 27 CHIEF four armed robberies occurred in small grocery stores through- out the City. Further that the Department handled ten cases involving narcotics during the month of September, five of which were overdose. hw� FIRE CHIEF SEWER PROBLEMS First Federal Ins. Co. Properties SWIMMING POOL ORDINANCE CITY ENGINEER WATER TESTING LABORATORY FLOODING INFORMATION BOOKLET REPORTS OF COMMITTEES: Zoning Case 72-50-R SUBDIVISION Tim O'Toole CITY ATTORNEY 10/2/72 420 Page two Fire Chief Haag reported on the fire at church located at 1480 Oakton Street, Friday evening, estimating damage at $8,000 to the building and $7,000 to the contents - cause not determined. Further announced that Fire Prevention Week begins Sunday, October 8th with Open House at all Fire Stations from 1:30 P.M. to 5 P.M. Building Commissioner Prickett reported that the City is not receiving the cooperation needed from First Federal Insurance Co., owners of property in the Fargo, Chestnut, Mannheim area to correct sump pumps installed spewing raw sewage onto public ways. Matter referred to City Attorney and Water and Sewer Committee. Building Commissioner Prickett reported that he is at a loss as to how the Building Department will implement the provisions of the recently enacted Swimming Pool Ordinance, unless the City purchases the necessary equipment And is willing to hire personnel with expertise. Further that no schedule of fees has been established. Matter referred to Finance and Building Control and Inspection Committee. City Engineer Bowen reported that the Center Street Improve- ment is progressing nicely and surfacing should be completed by October 20 or before. He further reported that Mayor Behrel received a letter from State of Illinois Waterways re Higgins -Willow Creek re bridge ownership and meetings will be scheduled with Mayor Stephens of Rosemont next week. He further reported that all property owners in the Industrial Park north of Touhy, between Mannheim and Maple have in- stalled separate sanitary sewers and the Public Works Department have scheduled the changeover at Howard & Maple. Booklets prepared by Skokie Flood Commission were submitted to members of City Council. City Engineer Bowen reported that the Des Plaines Water Testing Laboratory has been fully certified by the State of Illinois, one of very few in the State, and the City's Lab will be used by the State of Illinois to be shown to others as an example. Alderman Abrams request that the City of Des Plaines prepare a Flooding Information Booklet, similar to the Village of Skokie, or other available booklets from municipalities was referred to Water and Sewer Committee. Moved by Swanson, seconded by Hinde, to adopt the recommenda- tion of Municipal Development Committee to deny petition to rezone property located at 1125 Walter Avenue, recited in Zoning Case 72-50-R. Motion declared carried. Moved by Swanson, seconded by Thomas, to adopt the recommenda- tion of Municipal Development Committee to approve the Plat of Tim O'Toole Subdivision, located on Sprucewood Avenue, and authorize execution thereof. Motion declared carried. City Attorney reported the following: Illinois Supreme Court has allowed motion of Richard Peterson to review decision of Circuit Court and Appellate Court, in the matter re Board of Trustees of Firemen's Pension Fund to deny Disability Pension. The last two parcels of land to be acquired by the City for Center St. Parking lot are now in hand - a contract for Scott Patterson parcel and Hunsinger parcel subject to petition to condemn. Legal opinion from Chapman & Cutler should be received sometime this week at which time bonds will be signed. Moved by Hinde, seconded by Erbach, to adopt the recommenda- tion of Streets, Traffic and Forestry Committee that Stop Signs for east and west bound Howard Street Traffic at Webster Lane be removed and "Caution Howard Street Does Not Stop" signs be installed for North and South bound traffic on Webster Lane where it meets Howard. SENIOR Letter received from Housing Authority of County of Cook CITIZENS enclosing resolution of said authority approving City's HOUSING Resolution R-9-72, establishing a preference for occupancy in the subject elderly Senior Citzen's Housing Project was placed on file. OAKTON Moved by Sherwood, seconded by Chase, to appoint Mr. John COMMUNITY Means as the City's representative to the ad hoc advisory COLLEGE subcommittee of Oakton Community College to provide an Site objective and independent review of the site search activities Committee of the Board of Trustees. Motion declared carried. In the event Mr. Means does not accept appointment, City Planner Richardson was requested to attend meeting as City's representative until representative is appointed. SIDEWALKS Captain W. Blume's letter re crossing guard to serve Thacker- Terrace School between Wolf and Mt. Prospect Road, on Dempster Thacker Street, recommending installation of sidewalks on the south side of Thacker Street, and Alderman Abrams request for sidewalks on the north side of Thacker Street from Marshall Drive to Elmhurst Road, was referred to Streets, Traffic and Forestry Committee for review and report. CONSTRUCTION The letter from Rep. Schlickman requesting that City adopt BAN a resolution establishing a ban on all construction within Flooding the corporate limits until a comprehensive area -wide plan for flood control is arrived at and implementation is secured was referred to Building Control and Inspection Committee and Water and Sewer Committee.
