MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY
OF DES PLAINES, ILLINOIS, HELD IN
THE COUNCIL CHAMBERS, CITY HALL,
MONDAY, MAY 1, 1972
CALL TO ORDER: The regular meeting of the City Council of the City of Des
Plaines was called to order by Mayor Herbert H. Behrel at
8:00 P.M.
ROLL CALL:
Roll Call indicated the following aldermen present:
Koplos, Szabo, Kehe, Sherwood, Chase, O'Brien, Kisslinger,
Czubakowski, Erbach, Swanson, Thomas, Bonaguidi, Seitz,
Abrams. Absent were Aldermen Bolek and Michaels
Also present were: City Comptroller Blietz, Police Chief Hintz, Deputy Fire
Chief Corey, Commissioner of Public Works Schwab, City Engineer Bowen,
Assistant City Engineer Perl, Building Inspector Trost, City Treasurer
Rateike, City Attorney DiLeonardi and his assistant Charles Hug, and
Deputy Clerk Trost.
The meeting opened with prayer by Rev. Fedder of Immanuel Lutheran Church,
followed by the Pledge of Allegiance to the flag.
MINUTES:
Moved by O'Brien, seconded by Bonaguidi, to approve the
Minutes of the regular meeting held April 17, 1972, as
published. Motion declared Carried.
Alderman Michaels arrived at this time
REPORTS OF Placed on file were the following reports: Fire Department
CITY OFFICIALS: Quarterly report; Health Department, April; Engineering
Department, April; Public Works Department, April; Building
Department, April; Report of Examination, Water Fund for
three months ended March 31, 1972.
City City Comptroller Blietz reported that the assessed valuation
Comptroller for the City of Des Plaines has increased to over $316,000,000.
He further reported that the City's tax rate increased
and that the County Treasurer is remitting tax collections.
Police Police Chief Hintz reported that the Foster Avenue police
Chief apprehended a suspect which has cleared up the armed robbery
case at Kentucky Fried Chicken, Elmhurst Road. He also
reported on various narcotic cases resulting in two arrests,
and five overdose cases.
Deputy Fire Deputy Fire Chief Corey reported that Des Plaines Fire
Chief Department is participating in Fire Service Recognition
Week at Randhurst Shopping Center.
City City Engineer Bowen submitted to City Council the Hydraulic
Engineer Analysis report prepared by Buettner. He reported that the
1972 Street Maintenance will begin May 18th, and submitted
schedule to press and City Officials. In connection with
Dempster -Thacker Street improvement by Cook County, the
contractors were contacted regarding use of certain streets
within Szywala Subdivision and requested to gain access
along the railroad right of way.
PETERSON - City Attorney DiLeonardi reported that Court denied Petition
FIREMEN's for Certificate of Importance in the Peterson VS City of
PENSION FUND Des Plaines case, and the next step is to appear in the
trial court with petition that Mr. Peterson accept or
reject the City's offer to return to work.
EMPLOYEES City Attorney DiLeonardi reported that no agreements have

Public Works Department and the Illinois Fireman's Association
representing employees in the Fire Department and that
meetings have been scheduled within the next two weeks. )1)

City Attorney reported that Health and Fire Departments have
been in contact with his office re Angel Town Nursery School,
reportedly operating a day care center at 2329 Birch Street,
in a Single Family Residence District, for which City has
denied permit. Moved by Sherwood, seconded by Thomas, to
authorize Attorney Jack Siegel to represent the City as
legal counsel to prosecute owners of Angel Town Nursery
School. Upon roll call, the vote was:

Commissioner Commissioner of Public Works Schwab reported that the contractors
of Public for Dempster -Thacker Street were contacted over the weekend
Works and have assured the City a tank truck will be available on
weekends in addition to during the week for dust control
during construction. He further reported that 300 trees
have arrived and are being planted by the Forestry Department.
Also reported that the recycling station work has begun and
should be completed in two weeks.

Moved by Seitz, seconded by Kehe, to adopt the report of
Fire Committee in connection with the alleged gasoline leak
at the residence of Mr. Burton Kosmen, 679 Des Plaines Avenue
Des Plaines, Illinois, as follows:
"Your Committee on Fire has investigated the above and found
the following:
1. The Fire Department submitted to this committee, Mr.
Kosmen, and other interested parties, a report totaling 155
pages (including exhibits) concerning the suspected gasoline
Des Plaines Avenue.
2. Based on that report, we find the Fire Department of the City of Des
Plaines did respond promptly to the initial complaint of Mr. Burton Kosmen,
and did respond promptly to all subsequent complaints or requests of Mr.
Kosmen.
3. Based on that report, we also find that the Fire Department of the City
of Des Plaines did cause several tests to be conducted on the gasoline
storage tanks at 679 Des Plaines Avenue, including below and above -ground
tests on the exposed tanks; that the Fire Department of the City of
Des Plaines did also require tests on the gasoline storage tanks of
the three other service stations in the immediate area; and that all

tanks were found to be free of leaks, except one that may have been
damaged in the testing process.
4. Based on that report, we further find that tests taken in the basement
of the Kosmen residence at no time indicated any danger of explosion or
any other danger to the occupants.
5. We further note that the City of Des Plaines has paid to indipendent
testing agencies the sum of $1,008.00 and that the City has expended in
terms of man hours a minimum of an additional estimated $2,000.00 in its
investigation of this suspected leak.
6. Mr. Kosmen, in his appearance at the Fire Committee meeting held
April 24, 1972, presented no information not already included in the
report of the Bureau of Fire Prevention of the Fire Department of the
City of Des Plaines, and refused to present or discuss the new item of
"evidence" he claimed to have in. his possession.
7..Mr. Kosmen, at that same meeting, also agreed that he has not
accepted the offer of the Fire Department to introduce "No Flash" into
his sump. "No Flash" is a chemical that will render any possible petrolewm
product in Mr. Kosmen's sump nonflammable.
8. We have further determined that the Bureau of Fire Prevention
monitors on a regular basis the separator installed at 697 Des Plaines
Avenue, and does test and will test the sump in the basement of the
Kosmen residence on a regular, and on a request, basis.
9. A Deputy State Fire Marshall in attendance at the committee meeting,
and present at several on-site tests, stated his complete satisfaction
with the performance of our Fire Department and with the validity of
all tests utilized.
Therefore, it is the conclusion of the Fire Committee:
1. That the Bureau of Fire Prevention in particular and the Fire Department
of the City of Des Plaines in general, has always acted in accordance
with State Statutes and City ordinances;
2. That the Bureau has exhibited and extended full cooperation with all
other governmental agencies involved, and that no other governmental
agency involved has indicated any negligence or lack of competence
on the part of the Fire Department of the City of Des Plaines.
We, your Committee on Fire therefore recommend:
That the Fire Department of the City of Des Plaines be commended for its
performance in this matter and that no further action be taken at this
time." Motion declared Carried.

Municipal of Public Buildings, Grounds and Parking Lots Committee to
Building authorize Holmes and Fox to prepare preliminary plans for
the proposed new municipal building, at a cost not to exceed
$20,000 to be shared equally with Smith-Pipenhagen, and
to authorize execution of agreement to prepare said plans.

street improvement to be assessed against the properties

to authorize the placement of sidewalks on the east side of

by Short -Form Special Tax method, City Engineer to draw
specifications and City Attorney to draft necessary ordinance.

bids for lane transition on Lee Street, adjacent to the K -Mart
Parking Lot and south of Mannheim Road, at an estimated cost
of $700, at the same time bids are received for the North
School Parking Lot Improvement. Upon roll call, the vote was:

tion of Water and Sewer Committee to award the bontract for
the Pipe Drain Replacement at Thacker Street Water Plant
to Rossetti Contracting Co., in the amount of $2,600.00

ORDINANCE Moved by Erbach, seconded by Thomas, to adopt the recommenda-
M-4-72 tion of Building Control and Inspection Committee to rewrite
Fence Ordinance M-4-72 as per Building Commissioner's recommendations
with the addition that where used, barbed wire must be
above six foot level above ground, and barbed wire not to
extend beyond property line - for further consideration

N.O.I.S.E. Aldermen Michaels and Swanson gave a report on the NOISE
Symposium held in Atlanta, Ga., stating they were happy
Des Plaines is a member of this organization.

The letter from County of Cook Department of Highways re
improvement of Campground Road, Algonquin Road to Northwest

City Engineer's report re blocked overflow pipe at Holy
Family Hospital was submitted and placed on file, stating
Public Works Departmetn will cut a drainage swale from the
elevated tank south to Golf Road in the existing easement.

Moved by Swanson, seconded by Czubakowski, to authorize City
Clerk to proceed with computerizing voter registration cards,
as outlined in letter, at an estimated cost of $1,784.00.
Upon roll call, the vote was:
AYES: - 16 - Koplos, Szabo, Kehe, Sherwood, Chase, O'Brien,
Kisslinger, Czubakowski, Erbach, Swanson, Thomas,
Bonaguidi, Seitz, Abrams, Michaels, Mayor.
NAYS: 0 - None
ABSENT: 1 - Bolek
Motion declared carried.
The letter from Cully Auction Co. re request for sign variation
was referred to Building Control and Inspection Committee for
study and report.
Moved by Chase, seconded by Koplos, to adopt a resolution
inviting the Oakton College Board to select Des Plaines as
the site of Oakton College campus and encouraging the Board
to seriously consider the property near Wolf and Central
Roads. Motion declared carried.
ADJOURNMENT: Moved by Sherwood, seconded by Bonaguidi, that the regular
