MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY
OF DES PLAINES, ILLINOIS, HELD IN
THE COUNCIL CHAMBERS, CITY HALL,
MONDAY, APRIL 17, 1972
CALL TO ORDER: The regular meeting of the City Council of the City of Des
Plaines was called to order by Mayor Herbert H. Behrel at
8:05 P.M.
ROLL CALL:
Roll Call indicated the following aldermen present:
Koplos, Szabo, Kehe, Bolek, Chase, O'Brien, Kisslinger
Czubakowski, Erbach, Swanson, Thomas, Bonaguidi, Seitz,
Abrams. Absent were Sherwood and Michaels.
Also present were: City Comptroller Blietz, Police Chief Hintz, Fire Chief
Haag, Commissioner of P&blic Works Schwab, Assistant .City Engineer Perl,
Building Commissioner Prickett, City Attorney DiLeonardi and his assistant
Charles Hug.
The meeting opened with prayer by Rev. Ernest Grant, First Congregational
Church, followed by the Pledge of Allegiance to the Flag.
MINUTES:
Moved by Kehe, seconded by Swanson, to approve the Minutes
of the regular meeting of April 3, 1972, as published.
Correction: Page three, paragraph two, line 4, scratching
"23'6" and inserting "25"and scratching "240" and inserting
"200 sq. feet". Motion declared Carried.
REPORTS OF The following reports were ordered placed on file:
CITY OFFICIALS:Civil Defense first quarter; Department of Public Works,
March; Statement of Cash Receipts, January 1 to March 31;

Police Chief Hintz reported that the Cook County Sheriff's
Police apprehended and charged suspect with armed robbery
which will clear a number of cases throughout this area.
Further that striking employees at Berg Manufacturing Plant
have returned to work.
Fire Chief Haag reported on fire last Wednesday at 280
Beau Drive, causing estimated damage of $20,000.
City Engineer Bowen reported that the Buettner report
should be in the hands of City Council May lst. Also
reported on flooding problems in the Douglas Manor area,
and that his office will concentrate this next week
to arrive at a temporary solution.
TAX - New City Attorney DiLeonardi reported that Judge Cohen ruled
Motor Vehicles in favor of the County of Cook and against the City of
Des Plaines and several other municipalities in the matter
of the Tax on new motor vehicles passed recently under the
New Home Rule Provisions of the Constitution. Moved by
Bonaguidi, seconded by Seitz, to authorize the City Attorney
to proceed with appeal on behalf of the City of Des Plaines.
Alderman Michaels arrived at this time. Upon roll call,
the vote was:

EMPLOYEES City Attorney DiLeonardi reported on the status of employee
NEGOTIATIONS negotiations with Mecca and the Illinois Firefighters
Association, stating that the City is awaiting answers on
their last best offer, and he recommends that the Salary
Ordinance pertaining to these groups not be passed at this
meeting.

Commissioner of Public Works Schwab reported that his depart-
ment has completed the changing of alternate parking signs
throughout the City and has installed signs in accordance
with Ordinance T-14-72. Further that 80 cars were parked
today in Lot No. 5, (North School) compared to 215, due
to collection of 50 fee; however that all railroad parking
lots were completely full. He also reported on various
flooding problems throughout the City this weekend.
During first week of clean-up, thirty four loads were taken
to Sexton dumpsite.
Moved by Szabo, seconded by Koplos, to adopt the recommendation
of Public Building and Grounds and Parking Lots Committee
to award the contract for the installation of fence at
Fire Station #1 to the low bidder, Cowger Fence 0., in
the amount of $1,521.00. Upon roll call, the vote was:

Czubakowski, Erbach, Swanson, Thomas, Bonaguidi,
Seitz, Michaels, Mayor.

Moved by Szabo, seconded by Koplos, to adopt the recommenda-
tion of Public Buildings, Grounds and Parking Lots Committee
to authorize the purchase of 158 parking meters from the
Parking Revenue Replacement Account, from Duncan Co.,
for a total cost of $8,097.59. Upon roll call, the vote was:

Kisslinger, Czubakowski, Erbach, Swanson,

tion of Public Buildings, Grounds and Parking Lots Committee
to authorize the purchase of 81 meters for various locations
from Duncan Co., for a total cost of $4,151.25. Upon roll
call, the vote was:

Referred to Public Buildings, Grounds and Parking Lots
Committee was the proposal submitted by Midwest Concrete
Products Co. for a new municipal building.
Referred to City Attorney for legal opinion was Alderman
Kisslinger's request for information regarding the "turnkey"
method and whether or not it could be used in connection
with proposed new municipal building.
Moved by Seitz, seconded by Kehe, to adopt the recommendation
of Fire Committee to authorize Board of Police and Fire
Commission to certify eight men from the eligibility list
to serve as firefighters beginning May 22nd. Motion
declared carried.
Referred to Traffic Commission was Mrs. Young's request for
restrictive parking on Third Avenue.
Moved by O'Brien, seconded by Swanson, to adopt the recommenda-
tion of Streets, Traffic and Forestry Committee to award the
bid for one new tractor to the low bidder, P & W Industrial
Sales, Inc. in the amount of $10,875.00. Upon roll call /2/

Harding Ave. Signs on Harding Avenue from Laurel Avenue to Lee Street,
on an alternate yearly schedule, to begin on south side
this year, concurring with Streets, Traffic and Forestry
Committee recommendation. Motion declared Carried.
CENTER ST. Alderman O'Brien reported on the progress of Center Street
IMPROVEMENT improvement stating that minor changes are necessary in the
contract resulting in an increase of $20,431.75 but under
the estimate of cost. /j

The letter from OEA, Inc. regarding parking problems on
North Avenue was referred to Street, Traffic and Forestry
Committee.
Alderman Koplos's request for installation of necessary
signs on Jefferson instructing trucks making left turns
at the intersection of Jeffersonand Graceland Avenue to
use center lane was referred to Streets, Traffic and Forestry
Committee and Illinois State Highway Department.
The letter from Mr. and Mrs. Donald Meanger, submitted by
Alderman Bonaguidi and the petitions submitted by Alderman
Seitz, requesting sidewalks on the west side of Wolf Road
from Berkshire to Princeton was referred to the Streets,
Traffic and Forestry Committee and City Engineer.
Alderman Czubakowski's request for No Parking on Pratt
Avenue, both sides of street, between Mannheim Road easterly
to railroad was referred to Streets, Traffic and Forestry
committee.
Moved by Koplos, seconded by Abrams, to adopt the recommenda-
tion of Water and Sewer Committee to authorize the advertising
for bids for the drain tile at the Thacker Street Water
Softening Plant returnable Monday, April 24, 1972, at
3 P.M. Motion declared Carried.
Alderman Koplos reported that Water & Sewer Committee has
authorized Pioneer Title and Trust Co. to furnish names
and addresses of last known taxpayers of parcels of land
in the Farmers and Prairie Avenue Creek area at a cost of
$1.50 per parcel. He further reported that the committee
has reviewed the Joseph, Fox Lane storm sewer plans and
estimate of cost and plan to gather all proposed 1972
storm sewer projects for the year before going out for bid.
Alderman Koplos reported that Water & Sewer Committee had
recommended sometime previous to withhold the Rand Road
Watermain project until the Buettner report was received
and reviewed,and requested an explanation of the Mayor's
decision to advertise for bids for said watermain without
City Council's authorization. Mayor Behrel stated that
Joseph Lumber Co., will contribute $5,000 towards the cost
of said watermain and will annex certain lands to the City,
and Rand Pool & Patio will contribute $5,000 towards the
cost of the watermain project and further that tenants plan
to occupy new building June 1st and are in need of water.
Council recessed from 9:23 P.M. to 9:38 P.M., following
Mayor`:Sehrel's statement that the Buettner Co. stated that
the watermain project was warranted and would not affect
their survey.
Moved by Koplos, seconded by Abrams, to adopt the recommenda-
tion of Water and Sewer Committee to award the contract for
Rand Road Watermain, Contract No. 1, to the low bidder,
Rossetti Contracting Co., in the amount of $16,896.50,
subject to the annexation petition for the entire parcel
of land owned by Joseph Lumber Co. having been filed.
Moved by Bolek, seconded by Szabo, to defer action.
Referred to City Engineer and Commissioner of Public Works
was Alderman Szabo's request for investigation of blocked
over flow pipe on Holy Family Hospital property, Golf & River
Roads.
Moved by Erbach, seconded by Czubakowski, to adopt the
recommendation of Building Control and Inspection and
Beautification Committees to require the screening of
junk yards, construction yards, from public right-of-way
and residential property, and to authorize the drafting
of ordinance for further study by said committees. Motion
declared carried.

Referred to City Code and Judiciary Committee was Alderman
Szabo's request for review of present bid procedures and
code provisions re same.
Moved by Czubakowski, seconded by Erbach, to adopt the
recommendation of Beautification Committee to advertise for
bids returnable April 28th at 3 p.m. for necessary trees
and bushes to landscape the railroad right of way at the
downtown depot and from the S curve to Mt. Prospect Road.

Moved by Swanson, seconded by Erbach, that the City Council
adopt a resolution supporting Senate Bill 3342, entitled
Pollution the Noise Pollution Control Act of 1972, introduced by
Senators Muskie and Tunney. Motion declared carried.
Moved by Bonaguidi, seconded by Swanson, to adopt the
recommendation of Finance Committee to enter into an
agreement with Ernst and Ernst for the feasibility study
as outlined in their:proposal at a cost not to exceed
$8,500, including expenses. Upon roll call, the vote was:

Chapter 2 of Title VI of the City Code Having to Do with
Gambling by Adding Thereto a New Section to be Known as
Section 6-2-10 Providing that the Gambling Sections of
the Code Shall Not Apply to Participation in the Game of
Bingo.
Moved by Michaels, seconded by Erbach, to adopt a resolution
authorizing the execution of Agreement between City of
Des Plaines and William S. Deree for the use of certain
lands on the north side of Oakton Street, immediately
west of Soo Line right of way as a recycling center.

Resolution R-6-72 establishing fees for various Building
Permits, was referred to the Building Control and Inspection
Committee for study and to City Attorney for drafting of
ne;essary amendatory ordinances.
The Petition for Annexation of Commonwealth Edison trans-
mission right of way from a point north of Rand Road to
a point just south of Kensington Road was referred to the
City Attorney for drafting of necessary ordinances.
The request for subdivision known as Carcerino's Resubdivision
located on Elmira Avenue was referred to the Plan Commission.
Moved by Koplos, seconded by Szabo, to concur with Mayor
Behrel's reappointment of the following to the Electrical
Commission: Michael Danzi, Paul Whalen, Vernell Jacks,
George Wade, Frank Haag, and Robert Bowen, each for a one
year term to expire April 30, 1973. Motion declared carried.
Moved by Kehe, seconded by Seitz, to concur with Mayor Behrel's
reappointment of Rev. James Jackson and Robert Ranft for a
three year term to expire April 30, 1975. Motion declared
Carried.
Moved by O'Brien, seconded by Bolek, to concur with Mayor
Behrel's reappointment of Albert L. Gundelach and Earle
Stover to the Zoning Board of Appeals for a five year term
to expire April 30, 1977. Motion declared Carried.
Moved by Bonaguidi, seconded by Seitz, to concur with Mayor
Behrel's reappointment of Kenneth Holmes to the Architectural
Commission for a three year term to expire April 30, 1975.

Mayor Behrel's reappointment of Charles Bentley to the
Civil Service Commission for a three year term to expire
April 30, 1975. Motion declared carried.
Moved by Koplos, seconded by Bolek, to concur with Mayor
Behrel's reappointment of Robert Bruhn to the Board of
Fire and Police Commission for a•.three year term to expire
April 30, 1975. Motion declared carried.
Mayor Behrel read the letter from Mt. Prospect Park District
again requesting traffic signals at intersection of Algonquin
and Seymour.
The letter from Building Commissioner Prickett regarding
a text amendment to the Zoning Ordinance relating to
setbacks was referred to City Code and Judiciary Committee.
Moved by Swanson, seconded by Erbach, to accept the resigna-
tion of Mr. John T. Fankhauser as chairman and member of
Des Plaines Human Relations Commission. Motion declared
Carried.
Moved by Seitz, seconded by Erbach, to accept the resignation
of Mrs. Jean Branding as a member of Des Plaines Human
Relations Commission. Motion declared carried.
Mayor Behrel read the letter from Rev. Bruehl regarding
the activities of Des Plaines Human Relations Commission
and requesting guidance from the City as to future under-
takings, and requesting that members of Council submit
suggestions to his office.
Resolutions adopted by the Illinois Chapter of Municipal
Finance Officers Association objecting to Taxation of Local
Government Bonds, Promoting Home Rule in Illinois Municipalities
and in favor of the Continuation of Sales Tax Collections
for Food and Drugs,and Opposing the Extremely High Collection
Charges for Sales and Service Taxes by the State of Illinois
were referred to Finance Committee.
Moved by Bonaguidi, seconded by Erbach that the regular
meeting of the City Counci adjourn. Motion declarcarried.
