MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY
OF DES PLAINES, ILLINOIS, HELD IN
THE COUNCIL CHAMBERS, CITY HALL,
MONDAY, MARCH 6, 1972
CALL TO ORDER: The regular meeting of the City Council of the City of Des
Plaines was called to order by City Clerk Rohrbach, at
8:05 P.M.
ROLL CALL:
Roll Call indicated the following aldermen present:
Koplos, Szabo, Kehe, Sherwood, Bolek, Chase, O'Brien,
Kisslinger, Czubakowski, Erbach, Swanson, Thomas, Bonaguidi,
Seitz, Michaels. Absent was Alderman Abrams
MAYOR Moved by Seitz, seconded by Kisslinger, to nominate Alderman
PRO -TEM Bonaguidi as Mayor Pro -Tem. Moved by Thomas, seconded by
Czubakowski to nominate Alderman Swanson as Mayor Pro -Tem.
Moved by Szabo, seconded by Koplos to close nominations
for Mayor Pro Tem. Motion carried. By secret ballot,
Alderman Bonaguidi was elected to be Mayor Pro -Tem for
this evening's meeting.
The meeting opened with prayer by RRv. Wobbe of Christ E & R Church,
followed by the Pledge of Allegiance to the flag.
Also present were: City Comptroller Blietz, Police Captain Mensching, Fire
Chief Haag, Commissioner of Public Works Schwab, Assistant Commissioner of
Public Works Schaefer, City Engineer Bowen, City Treasurer Rateike,
Deputy Clerk Trost, City Attorney DiLeonardi and his assistant C. Hug.
MINUTES:
Moved by Kehe, seconded by Swanson, to approve the Minutes
of the regular meeting held February 22, 1972, as
published. Correction: Page two, paragraph nine, item
4. changing words both side to"west of". Following
correction, motion declared Carried.
REPORTS OF The following reports were ordered placed on file:
CITY OFFICIALS: Health Department, February; Public Works Department,
February; Engineering Department, February. Building Dept.,
February.
Police Police Captain Mensching reported there were 12 narcotics
Captain and drug related cases handled by the Police Department
during February, resulting in seven arrests. Further, they
investigated seven overdose cases - five female and two
male.
Fire
Chief
Fire Chief Haag reported on the progress being made by
the Fire Department in investigating the complaint of
leaking gasoline at the Citgo Service Station on River
Road, near the residence of Mr. Burton Kosmen, 709 S.
Des Plaines Avenue,
DEMOLITION City Attorney reported that the Building Department and
350 E. Touhy Fire Prevention Bureau reports that the building located
at 350 E. Touhy Avenue is a safety and fire hazard.
Moved by Swanson, seconded by ERbach, to authorize and
direct the City Attorney to file the necessary legal
action to remove the unsafe building located at 350 E.
Touhy Avenue. Upon roll call, the vote was:

SZELIGA CASE
City Attorney reported that the Appellate Court upheld the
City in the Szeliga Case and affirmed the trial court
decision in the City's favor

AMENDMENT City Attorney reported that a provision which under some
Billboards certain circumstances might be construed to permit billboards
remains in the City Code - Title IV, Chapter 5. Moved
by Michaels, seconded by Kehe, to authorize and direct
City Attorney to draft necessary amendment to delete any
reference to billboards in our ordinance. Motion declared
Carried.
RESOLUTION The written legal opinion of City Attorney regarding
R-2-72 - Resolution R-2-72 - (Des Plaines Housing Commission) was
Legal Opinion referred to.the Health and Welfare Committee for study and
report.

Moved by Koplos, seconded by Michaels, to grant permission
to Bertin Kosman, 709 S. Des Plaines Avenue, to address
City Council. He stated that gasoline is being pumped
by his sump pump at his residence and asked that the City
Council give the matter immediate attention as he believes
the gasoline is leaking from the Citgo Service Station
adjoining his property. The remarks of Mr. Kosman typed
from tape, the letters addressed to Mayor Behrel, and
the files of Fire Department were referred to the Fire
Committee for thorough review.
PARKING City Attorney discussed the Parking Revenue Bond Issue
REVENUE BOND ordinance M-15-72 and submitted to Council letters from
ISSUE Benjamin & Lang and the First National Bank. Alderman
Bolek questioned the use of General Obligation Bonds...
said matter discussed by Mr. Benjamin and City Attorney.
ANNUAL City Comptroller Blietz submitted to City Council the
FINANCIAL Annual Financial Report, reviewing highlights of the report
REPORT with City Council. Alderman Kehe commended City Comptroller
for the fine financial report again this year.
COMMITTEE Moved by Swanson, seconded by Michaels, to adopt the recommend -
REPORTS: ation of Municipal Development Committee to concur with
Zoning Case Zoning Board of Appeals in Case 72-7-R, to deny rezoning
72-7-R of property located at Golf and Beau Drive. Motion declared
Carried.

Moved by Swanson, seconded by Szabo, to adopt the recom-
mendation of Municipal Development Committee to concur
with Zoning Board of Appeals in Case 72-10-R, to deny
rezoning of property at 1561 Sherman Place. Motion
declared Carried.
FIRE Alderman Seitz reviewed the progress of Fire Committee
PROTECTION concerning the contract with Park Ridge Manor Fire Protection
Park Ridge District, stating that another meeting of Trustees has been
Manor held, wherein said district was notified of the City's
intent to discontinue fire protection and urging the
district to contract with North Maine Fire Protection District
for fire protection or annex to the City of Park Ridge,
no later than De -ember 31st of next year.

tion of License and Inspection Committee to deny the request
for Class B. Liquor License of Koutavas Enterprises, Inc.
to be located at 1651 Rand Road. Motion declared Carried.
LIQUOR LICENSE Referred to the License and Inspection Committee was
Class E. Alderman Bolek's request for review of Code provisions
for Class E liquor licenses particularly the one year
requirement.,,

J. S. Adams Co. and City to recapture certain improvement
costs for sewer from owners of parcels of land on Golf Road.

Moved by Erbach, seconded by Thomas, to adopt the recommenda-
tion of Building Control and Inspection Committee to
permit First United Methodist Church to place their sign
in a location convenient to motorists at the Graceland-
Miner intersection - exact location to be determined by
mutual agreement between the Mayor and representatives
of the First United Mehtodist Church. Motion declared
Carried.
Moved by Erbach, seconded by Thomas, to adopt the recommenda-
tion of Building Control and Inspection Committee to
authorize Building Commission to issue a permit for fence
at 41 W. Lance Drive, with the following restrictions:
1. Height of the fence not to exceed five feet
2. Fence must be constructed to provide a minimum of 70%
open "see-through" space whereever it projects beyond
the building lines
3. The fence may not be constructed beyond the property
line along Victoria Road or beyond the building line
along Lance Drive.

Moved by Erbach, seconded by Thomas, to adopt the recommenda-
tion of Building Control and Inspection Committee to
authorize City Attorney to draft the necessary amendment
to Section 6-7-1 of the City Code to allow the fencing of
corner lots as follows:
1. Fence may be constructed to the lot line along the
long side of the lot, but may not be constructed beyond
the building line on the short front side of the lot.
2. Where a fence is built beyond the building line, it
must be constructed to provide at least 70% open "see -Through"
area of uniform distribution, and may not exceed five feet
in height.

BEAUTIFICA- Alderman Czubakowski made a progress report of the
TION Beautification Committee stating that the spring clean-
up begins April 10, ending May 15; screening of junk yards
and construction yards is being studied; landscaping of
C&NW right -of way along Northwest Highway under study;
Soo -Line Railroad Beautification lease in progress;
Downtown landscaping plans under study and Committee
urges strict enforcement of illegal signs in the City.
RESOLUTION Moved by Michaels, seconded by Czubakowski, to amend
R-2-72 Resolution R-2-72 , Section 2, as follows:
"The purpose of the Commission shall be to study and
report to the Mayor and City Council on the following
issues: 4 to what extent does sub -standard housing (and
including sub -standard housing occupied by low and
moderate income persons) exist in the City of Des Plaines,
and to determine its causes and long-range solutions;
2) what additional sites, if any, should be selected for
future Senior Citizens' Housing; and 3) whether the City
should establish its own local housing authority."

the issue of $825,-00 Motor Vehicle Parking System Revenue
Bonds of the City of Des Plaines, Cook County, Illinois,
for the prupose of refunding and refinancing the outstanding
Parking Revenue Bonds, Series of 1957, and defraying the
cost of improving and extending the motor vehicle parking
facilities of said City, prescribing all the details of
said bonds, providing for the charging of rates and fees
for the use of such facilities, and the collection,
segregation and distribution of the revenues of such motor
vehicle parking facilities for the purpose of paying the
cost of operation and maintenance thereof, and paying the
principal of and interest upon such Motor Vehicle Parking
System Revenue Bonds. Upon roll call, the vote was:

T-12-72 Section 10-9-6 of the City Code Having to do with Vehicle
Vehicle License Plates, by Providing that Windshield Stickers
Licenses Have to be Placed on the Lower Right -Hand Corner of the
Windshield and by Deleting the Provision that Vehicles
Need Not Attach License Except When in Use.

Alderman Bolek's suggestion that all meetings, including
Committee Meetings, be held on Monday evenings, was

4 -WAY STOP Referred to Traffic Commission and Streets and Traffic
SIGNS Committee was Alderman ERbach's request for a four-way
Pratt & stop sign at Pratt & Eisenhower.

Referred to the Traffic Commission was Alderman Erbach's
YIELD SIGNS request for study of stop sign intersections, particularly
two-way stop signs, with possibility of use of Yield Signs.
RECAPTURE Referred to Water and Sewer Committee was Alderman Koplos's
AGREEMENTS request for setting guidelines for future recapture
agreements.
TRIANGLE SIGN Moved by Swanson, seconded by O'Brien, to approve the
SUIT settlement of the Triangle Sign case, as suggested by City
Attorney DiLeonardi, to allow billboard in question to
remain standing for a, period of twenty-four months, at
which time Triangle Sign Co. will remove same.
