MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY
OF DES PLAINES, ILLINOIS, HELD IN
THE COUNCIL CHAMBERS, CITY HALL,
MONDAY, FEBRUARY 7, 1972
CALL TO ORDER: The regular meeting of the City Council of the City of Des
Plaines was called to order by Mayor Herbert H. Behrel at
8:05 P/M. The meeting opened with prayer by Rev. Father
Peckenpaugh of St. Martin's Episcopal Church, followed by
Pledge of Allegiance to the flag.
III ROLL CALL:
Roll Call indicated the following aldermen present:
Koplos, Kehe, Sherwood, Bolek, O'Brien, Kisslinger,
Czubakowski, Erbach, Swanson, Thomas, Bonaguidi, Seitz,
Abrams, Michaels. Absent were Szabo, and Chase.
Also present were: City Comptroller Blietz, Police Chief Hintz, Fire Chief
Haag, Building Commissioner Prickett, Commissioner of Public Works Schwab,
J. Edgren from City Engineer's office, City Treasurer Rateike, Deputy Clerk
Trost, Charles Hug, and City Attorney DiLeonardi.
There being a quorum present, the meeting was ih order.
MINUTES:
Moved by Kehe, seconded by Swanson, to approve the Minutes
of the regular meeting held January 17, 1972, as published.
Correction, Page one paragraph relating to City Engineer's
report changing March 15th to March 8th. Page four,
paragraph one changing AYES to 13, scratching Bolek from
roll call vote, and showing Bolek as abstaining. Following
corrections, motion declared Carried.
REPORTS OF The following reports were ordered placed on file:
CITY OFFICIALS: Annual Report, Police Department; Annual Report, Fire Dept.;
Building Commissioner, January; Health Department, January;
Public Works Department, January; Engineering Department,
January; City Treasurer's report on Firemen's Pension
Fund and Policemen's Pension Fund.
POLICE CHIEF Police Chief Hintz reported that the Police Department had
Chief Hintz handled 11 narcotic cases in January - 11 arrests involving
persons 14 to 38 years of age, nine overdose cases. Also
reported on robberies at Burchard Cleaners, Prairie Avenue
and Jupiter Cleaners at Lee & Walnut. He further reported
the change in uniforms to be worn by Police Department.
CHIEF HAAG: Fire Chief Haag reported on fire at Elmhurst and Golf Roads
Fire Chief at 7:50 this morning with estimated damage of $100,000.
CITY ATTORNEY: City Attorney DiLeonardi reported that the City was successful
in the Julson case involving recapture agreements. He also
reported that no oral argument was presented in the Zeliga
case and that the Tomascek case on Busse Highway has been
continued until early April. The Boeckenhauer property
zoning case is set for February 14th.
TEXT AMENDMENT 'The City Attorney submitted copies of the proposed Parking
Zoning Ord. Revenue Bond Ordinance to City Council stating that it was
necessary to file petition for Zoning Text Amendment re
Municipal Parking Facilities in any zoning district. Moved
by Swanson, seconded by Bonaguidi, to ratify the filing of
said petition. Moved by Koplos, seconded by Bolek, that
text amendment be amended to read that Municipal Parking
Facilities be allowed in any district provided that sites
are contiguous or bounded by properties zoned for commercial
purposes. Motion to amend declared Carried. Motion as
amended declared Carried.
HOME RULE
Tax Pre-empt
provision
Alderman Bolek's request for review of Home Rule provision
having to do with pre-empting certain taxes invoked by
Cook County Board of Commissioners within the City limits
was referred to the Finance Committee and City Attorney for
drafting of necessary pre-empting ordinance.

Commissioner of Public Works Schwab reported that sewer main
repairs have been completed at Craig Manor Life Station.
Further reported that 88 tons of salt were used January 28th
and 82 tons used February 2nd during snow falls. Further
reported that 16 parkway trees were damaged by a motorist,
who has not been apprehended to date.
Moved by Thomas, seconded by Bonaguidi to concur with Police
Committee's recommendation to approve the expenditure of
$2,394.00 ($1,344.00 Federally reimbursed) to permit Lt.
Mike Clark to attend the F. B. I. National Academy,
commencing in March and ending in June, 1972. Upon roll call,
the vote was:

FIRE PROTECTION Moved by Seitz, seconded by Kehe, to authorize the execution
DISTRICT of agreement between Park Ridge Manor Fire Protection District
Park Ridge and City of Des Plaines for fire protection services at
Manor a rate of $4,000 per year from January 1, 1972 to December
31, 1972. Moved by Bonaguidi, seconded by Swanson, to
defer action until next regular meeting.

Committee announced that Skyway Enterprises has withdrawn

request of National Tea Company. Motion declared Carried.

Alderman Bonaguidi requested that a Committee of a Whole
meeting be held to re-evaluate the City's position with
respect to the granting of liquor licenses.
Moved by O'Brien, seconded by Kehe, to adopt the recommendation
of Streets and Traffic and Forestry Committee to award the
bid for one new portable welder for the Public Works Department
to Benster-Welding Supply Co. in the amount of $1,427.79.
Upon roll call,the vote was:

Moved by Erbach, seconded by Thomas, to adopt the recommendatio
of Building Control and Inspection Committee to authorize
City Attorney to draft necessary text amendment for petition
to Zoning Board of Appeals , Section 9D.4 to stipulate bond
required only above a $1500 estimated cost of building or
improvements. Motion declared Carried.
Moved by Erbach, seconded by Thomas, to concur with recommenda-
tion of Building Control and Inspection to grant:.request of
Patrick Rambler for a sign 144 sq. ft. to be located at
1500 Rand Road. Motion declared Carried.
Moved by Erbach, seconded by Thomas, to adopt the recommenda-
tion of Building Control and Inspection Committee to grant
sign request of Cass Ford, 750 E. Northwest Highway for
sign twenty feet in height, 140 --square feet upon removal
of existing "Used Car" sign. Motion declared Carried.

ORDINANCE Moved by Michaels, seconded by Abrams, to adopt the recommenda-
M-35-71 tion of Environmental Controls Committee to amend Ordinance
Phosphate M-35-71 by deleting paragraphs d, e, and f, from Section
Content 1, under Definitions; deleting the paragraph entitled
Limitations and further authorize the redrafting of said
ordinance to be known as M-10-72. Motion declared Carried.
Council recessed from 9:15 P.M. to 9:23 P.M.
IRESOLUTION The motion to adopt Health and Welfare Committee's recommenda-
R-2-72 tion to adopt Resolution R-2-72 Establishing a Special Des
Des Plaines Plaines Housing Commission and Providing for Its Composition,
Housing Purpose and Duration was brought to the floor.
Commission Alderman Sherwood withdrew his motion and Alderman Kehe
withdrew the second. Moved by Michaels, seconded by
Czubakowski to adopt Resolution R-2-72. Moved by Michaels,
seconded by Abrams, to amend said Resolution by adding to
Section 2 the following: "and 4) whether there is a need
within the City of Des Plaines for low and moderate income
housing to serve the residents of Des Plaines."

Placed on First Reading was Ordinance M-9-72 Authorizing and
Providing for the issue of %825,000 Motor Vehicle Parking
System Revenue Bonds of the City of Des. Plaines, Cook County,
Illinois, for the purpose of refunding and refinancing the
outstanding Parking Rev nue Bonds, Series of 1957, and
defraying the cost of improving and extending the motor
vehicle parking facilities of said City, prescribing all
the details of said bonds, providing for the charging of
rates and fees for the use of such facilities, and the
collection, segregation and distribution of the revenues
of such motor vehicle parking facilities for. the purpose
of paying the cost of operation and maintenance thereof,
and paying the principal of and interest upon such Motor
Vehicle Parking System Revenue Bonds.
Plat of Chris O'Toole's Subdivision located at Webster Lane
and Everett and letter of recommendation from Plan Commission
was referred to the Municipal Development Committee for
study and report.
Moved by Swanson, seconded by Thomas, to approve Plat of
Dedication of Seegers Road, east of Wolf Road and to
authorize execution thereof. Motion declared Carried.
Letters from Mr. James R. Kosterman, Jr. and Jachimek
Builders, Inc. regarding proposed New Municipal Building
were referred to the Public Buildings, Grounds and Parking
Lots Committee.
The request of Northwest Opportunity Center for funds to
be included in City's 1972 Appropriation was referred to
the Finance Committee.
The request of First United Methodist Church to place a
sign near the Community Special Events sign was referred to
the Building Control and Inspection Committee for study
and report.
City Engineer's Estimate of Cost and preliminary plans for
the installation of storm sewers in Joseph Avenue, Morse
Avenue and Fox Lane area was referred to the Water and Sewer
Committee.
The proposed draft of certain text amendments in the R-5
District prepared by Rolf C. Campbell and Associates was
referred to the Municipal Development Committee.
Building Commissioner's letter requesting deletion of certain
regulations within the City Code relating to non -conforming
signs was referred to the Building Control and Inspection
Committee
City Clerk's recommendation for code amendment relating
to requirement of proof of age for persons over 65 purchasing
vehicle stickers was referred to City Code and Judiciary
Committee.
Following the report of City Attorney DiLeonardi regarding
certain property owners failing to disconnect storm sewers
from combined sanitary and storm sewers and connect to storm
sewers in the area north of Touhy Avenue, just east of
Mannheim Road, it was moved by Bonaguidi, seconded by
Czubakowski, to authorize City Attorney to file necessary
suits requiring said owners to comply with ordinance.

Lawrence R. Behrel's appointment of Mr. Lawrence R. Thome to the Youth
Thome Commission to fill vacancy, term to expire April 30, 1972.

FENCES OR Alderman Seitz's recommendation that the City require fences
SCREENING or screening to hide junk yards, construction yards, etc.
Junk Yards and the storing of junk automobiles in front of existing
storage facilities was referred to the Building Control and
Inspection Committee and Beautification Committees for
study and report.
ELECTRONIC Alk'erman Michaels' request that the City install an electronic
VOTING SYSTEM voting system in the new municipal building was referred to
the Public Buildings, Grounds and Parking Lots Committee
for study and report.
NEXT MEETING
Moved by Bonaguidi, seconded by Seitz, that the next regular
meeting of the City Council be held on Monday, February 21,
1972, Motion declared Carried.
RAILROAD AVE. Moved by Swanson, seconded by Bolek, to change the name of
TO GRECO AVE. Railroad Avenue, lying south of Touhy Avenue, to Greco
Avenue in memory of Pat Greco. Motion declared carried.

Alderman Swanson's request for reduction of speed limit on
Touhy Avenue in the area of Iroquois Jr. High School and
for the installation of "20 m.p.h. when school children
are present" signs was referred to Mayor Behrel to contact
State Highway Department.
FENCE Alderman Swanson's request for an amendment to the fence
ORDINANCE ordinance allowing chain link fences four feet in height
to extend beyond the building line was referred to the
Building Control and Inspection Committee.
