IN THE COUNCIL CHAMBERS, CITY
HALL, MONDAY, JUNE 21, 1971
CALL TO ORDER: The regular meeting of the City Council of the City of
Des Plaines was called to order by Mayor Herbert H. Behrel
at 8:04 P.M. The meeting opened with prayer by Father
Martin Farrell of St. Mary's Catholic Church, followed by
the Pledge of Allegiance to the flag.
I ROLL CALL: Roll Call indicated the following aldermen present:
Koplos, Szabo, Kehe, Sherwood, Bolek, Chase, O'Brien, Hinde,
Czubakowski, Swanson, Thomas, Bonaguidi, Abrams, Michaels.
Alderman Seitz arrived immediately after Pledge of
Allegiance to the flag. Absent was Alderman Erbach.

Also present were: Assistant City Comptroller Blicta, Police Captain Blume,
Fire Chief Haag, Building Commissioner Prickett, City Engineer Bowen,
Commissioner of Public Works Schwab, Assistant Commissioner of Public
Works Schaefer, City Treasurer Rateike, and City Attorney DiLeonardi

CITY OFFICIALS:
Fire Chief
Mr. Ralph Frese, Chairman, Mr. Ralph Nelson, Co -Chairman
and Mr. Jerry Dahl, Co-ordinator of Communications and
safety for the 14th annual Des Plaines River Canoe Marathon
held May 22nd, presented Mr. Robert Johler, Communications
Officer for Civil Defense, an award for services rendered
in connection with the marathon.
Moved by Swanson, seconded by Hinde, to approve the
Minutes of the regular meeting held June 7, 1971, as
published. Correction- Page two, paragraph two, changing
the word Superior to Supreme. Motion declared Carried.
Fire Chief Haag reported on the fire at Ace Hardware
on Lee Street, June 18th, and further reported on the
Auto Extradication and Rescue courses held June 19th and
20 sponsored by the University of Illinois held at the
Public Works Building.
City Attorney City Attorney DiLeonardi introduced his assistant, Charles
Hug to City Council stating that he would serve during
his absence while vacationing beginning July 3rd.
Metropolitan City Attorney DiLeonardi reported that the Metropolitan
Sanitary District's application for federal funds has
been approved by the Northeastern Illinois Planning
Commission. Alderman Abrams requested that the Mayor
contact NIPC expressing City Council's position in this
matter, as well as the Federal Environmental agencies
and Illinois Environmental Agencies.

Moved by Abrams, seconded by Michaels, to concur with
City Code and Judiciary Committee's recommendation to
authorize the City Attorney to file and prosecute an Appeal
in the Cities Service Oil Company vs City of Des Plaines
case - 69 L 15623. Upon roll call, the vote was:
AYES: - 15 - Koplos, Szabo, Kehe, Sherwood, Bolek, Chase,
O'Brien, Czubakowski, Swanson, Thomas,
Bonaguidi, Abrams, Michaels, Seitz, Mayor.
NAYS: 1 - Hinde

There being fifteen affirmative votes, Motion declared
Carried.
Commissioner of Public Works reported that the Addition
to the Public Works is substantially completed awaiting
final inspection by the Building Department. Further that
work is progressing on the Chicago and Northwestern right
of way Beautification program - Des Plaines Park District
contributing black dirt. Also reported on the stump
removal and removal of private Dutch Elm Diseased trees.'

Denver on Water Reclamation, Pollution, Underground Water
Storage and the use of plastic pipe.
Moved by Swanson, seconded by Hinde, to concur with
Municipal Development Committee's recommendation to obtain
an appraisal of Stewart Avenue from River Drive to the
River prior to vacation. Alderman Szabo gave a minority
report stating that he believed the property has a park
setting ideal to be used for recreational facilities such
as boating and further a storm sewer exists in the present
dedicated portion which is unimproved. Following discussion,
it was moved by Belek, seconded by Koplos to defer action
until next meeting.
Moved by Swanson, seconded by Ilrnde, to concur with
Municipal Development Committee's recommendation to
authorize the City Attorney to prepare the amendment to
the Zoning Ordinance for further consideration by the
Cou ncil, rezoning property located at 170 S. River Road,
Case 71-17-R to C-2 Commercial District. Motion declared.

Moved by Swanson, seconded by Hinde, to concur with
Municipal Development Committee's recommendation to
authorize the City Attorney to prepare the amendment to
the Zoning Ordinance for further consideration by the
Council, rezoning property located at 1001 Northwest
Highway - Case 71-16-R to C-2 Commercial District.
Motion declared Carried.
Moved by Swanson, seconded by Hinde, to concur with
Municipal Development Committee's recommendation to
authorize the City Attorney to prepare the amendment to
the Zoning Ordinance for further consideration by
the Council, rezoning property located at 165 North River
Road to M-2 Manufacturing District - Case71-19-R.
Motion declared Carried.
Moved by O'Brien, seconded by Czubakowski, to concur with
Streets and Traffic Committee's recommendation that the
West Side of Spruce Street from Oakton Street south to
the alley have No Parking At Any Time signs posted - City
Attorney to draft necessary amendment. Motion declared
Carried.
Moved by O'Brien, seconded by Koplos, to concur with Streets
and Traffic Committee's recommendation that "No Parking At
Any Time" signs be installed on both sides of Chicago
Avenue - City Attorney to draft necessary amendment.
Motion declared Carried.
Moved by O'Brien, seconded by Szabo, to concur with Streets
and Traffic Committee's recommendation that "No Parking
At Any Time" signs be installed on both sides of Western
Avenue from Northwest Highway to Harding Avenue - City
Attorney to draft necessary amendment. Motion declared
Carried.
Moved by O'Brien, seconded by Michaels, to concur with Streets
and Traffic Committee's recommendation for a two-way stoP
intersection - traffic on Norman Court to stop for traffic
on Marshall Drive - City Attorney to draft necessary
amendment. Motion declared Carried.
Moved by O'Brien, seconded by Hinde, to concur with Streets
and Traffic Committee's recommendation for "No Parking
Between 10 a.m. and 4 P.M., except Saturdays, Sundays, and
Holidays" on Frist Avenue - both sides from North Avenue
to Woodlawn Avenue - City Attorney to draft necessary (/
amendment. Motion declared Carried.

Moved by O'Brien, seconded by Bolek, to concur with Streets
and Traffic Committee's recommendation that request for
four way stop signs at the intersection of Margret & Walnut
be denied. Moved by Swanson, seconded by Bonaguidi, to
amend the motion by adding that said intersection become
a Yield intersection - traffic on Walnut to Yield to Traffic
on Margret. Motion to amend declared Carried. Motion
as amended declared Carried.

Moved by O'Brien, seconded by Windt, to concur with Streets
and Traffic Committee's recommendation that Stewart Avenue
not be vacated. Moved by Sherwood, seconded by Kehe, to
defer action until next meeting.
The letter from Mr. A. Dan Mesenbrink, Principal of Central
School requesting certain types of traffic controls on
Thacker Street in the area of Central School was referred
to the Streets and Traffic and Forestry Committee for study
and report.
Moved by Koplos, seconded by Thomas, to concur with Water
and Sewer Committee's recommendation to authorize M. P.
Schneller & Associates, Inc. to rehabilitate Well No. 4
in accordance with quotation in the amount of $11,394.00.
Upon roll call, the vote was:

O'Brien, Hinde, Czubakowski, Swanson, Thomas,

Moved by Koplos, seconded by Szabo, to concur with Water and
Sewer Committee's recommendation to authorize Rossetti -pp-41'r
Contracting Company, Inc. to complete Phase II,/of the
Weller Creek Improvement in accordance with bid received
in 1970 with the stipulation that payment be made after
September, 1971, in the amount of $17,308.50. Upon roll
call, the vote was:
AYES: - 16 - Koplos, Szao, Kehe, Sherwood, Bolek, Chase,
O'Brien, Hinde, Czubakowski, Swanson, Thomas,
Bonaguidi, Seitz, Abrams, Michaels, Mayor.

Moved by Koplos, seconded by Szabo, to authorize the City
Engineer to review with Water and Sewer Committee the
dredging of Farmers Creek - Cook Co. Creek No. 2, and
Prairie Avenue Creek within the corporate limits for
improved Storm drainage. Motion declared Carried.
Moved by Bonaguidi, seconded by Michaels, to concur with
Building Control and Inspection Committee's recommendation
to amend the Fence Ordinance in accordance with Building
Commissioner's recommendations - City Attorney to draft
necessary amendment. Motion declared Carried.
Moved by Kehe, seconded by Swanson, to adopt the resolution
commending the "Place For People" participants for their
fund raising drive during the week of June 12th thru June
19th. Motion declared Carried.
City Code and Judiciary Committee requested Mayor Behrel
to write the North Maine Fire Protection District to seek
their current views as to payment of monies due the City
for fire protection. v

Referred to the City Code and Judiciary Committee for study
and report was Alderman Sherwood's request for amendment
to City Code as follows: "Three consecfui:ive absences
with xcuse from Commission meetings be considered as
an automatic resignation and further that no elected or
appointed official of the City be allowed to serve as
a voting member of a Commission unless otherwise provided
by State Statute".
IIZONING Referred to the City Code and Judiciary and Building Control
R-6 District and Inspection Committee was Alderman Szabo's request for
a review and study of the amendment to the Zoning Ordinance
creating the R-6 District, as proposed by Rolf Campbell &
Associates and the consideration as to whether the City
should continue to retain Rolf Campbell & Associates as
a City Planner.

The request for a Beer and Wine Liquor License for Jo Jo's
Restaurant to be located at Dempster and Elmhurst was referred
to the License and Inspection Committee for study and report.
IORDINANCE Placed on First Reading was Ordinance T-9-71 providing for
T-9-71 No Parking on the west side of Lee Street between Howard
Lee St. Avenue and Touhy Avenue.

Real Estate
The Resolution adopted by the Village of Elmwood Park
relating to County of Cook's failure to issue Real Estate
Tax bills in sufficient time to allow payment of the First
Installment on or before May 1, 1971, was referred to the
City Code and Judiciary Committee for study and report.

SEWER Moved by Michaels, seconded by Abrams, to authorize the City
Dempster- Engineer to draft the necessary resolution approriating
Thacker St. $65,000 MFT funds for the over sizing of the storm sewer
in connection with the impFovement of Dempster -Thacker Street
from Elmhurst Road to Wolf Road by the State of Illinois.

SENIOR CITIZENS Following discussion, it was moved by Sherwood, seconded
HOUSING SITE by Kehe, to authorize Mayor Behrel to notify the Cook
County Housing Authority that the City has discontinued
negotiations with School District #62 for the purchase
of the former Thacker School site on the south side of
Thacker Street, just west of River Road. Motion was
declared lost.
Moved by Michaels, seconded by Czubakowski to authorize
Mayor Behrel to reopen negotiations with School District
#62 for the purchase of the former Thacker School site
to be used for Housing for the Elderly. Upon roll call
the vote was:
AYES: - 11 - Szabo, Bolek, Chase, O'Brien, Czubakowski,
Thomas, Bonaguidi, Seitz, Abrams, Michaels,
Mayor
NAYS: 5 - Koplos, Kehe, Sherwood, Hinde, Swanson

PRAIRIE AVENUE The proposed plans for the improvement of Prairie Avenue
IMPROVEMENT _in connection with Redevelopment of the downtown area
Redevelopment of Des Plaines were referred to the Streets and Traffic
and Public Building, Grounds and Parking Lots Committees
for study and report.
ADJOURNMENT: Moved by Szabo, seconded by Swanson, that the regular
meeting of the City Council adjourn. Motion declared
