MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY
OF DES PLAINES,..ILLINOIS, HELD
IN THE COUNCIL CHAMBERS, CITY HALL,
MONDAY, APRIL 5, 1971.
The regular meeting of the City Council of the City
of Des Plaines was called to order by Mayor Herbert H.
Behrel at 8:05 P.M. The meeting opened with prayer
by Mayor Behrel, followed by the Pledge of Allegiance
to the flag.
Roll call indicated the following. aldermen present:
Koplos, Szabo, Sherwood, Bolek, Leer, O'Brien, Hinde,
Czubakowski, Wagner, Swanson, Thomas, Seitz, Shillington,
Michaels. Absent was Alderman Bonaguidi.
Also present were: Police Chief Hintz, Deputy Fire Chief Corey, City
Comptroller Blietz, City Treasurer Rateike, City Engineer Bowen,
Commissioner of Public Works Schwab, Assistant Commissioner of Public
Works Schaefer, Building Commissioner Prickett, and City Attorney
DiLeonardi.
There being a quorum present, the meeting was in order.

REPORT OF CITY
OFFICIALS:
Moved by Alderman Sherwood, seconded by Alderman Hinde,
to approve the Minutes of the regular meeting held
March 15, 1971, as published. Motion to approve
declared Carried.
Moved by Alderman Hinde, seconded by Alderman Koplos,
to approve the Minutes of the Special Meeting held
Friday, March 26, 1971, as published. Motion to
approve declared Carried.
Placed on file were the following reports for March:
Building Department, Health Department, Public Works
Department, Engineering Department, and Statement of
Cash Receipts from January 1, 1971 to February 28, 1971,
Office of the Comptroller.
CITY COMPTROLLER: Comptroller Blietz reported that the group insurance
for the City of Des Plaines went from $0.73 per
thousand in 1970 to $0.65 per thousand per month in
1971, saving the City approximately $1,000.00.
POLICE CHIEF:
Deputy City Clerk notified Council of two bids received
late for Catch Basin Cleaning and it was authorized by
Council to return said bids.
Police Chief Hintz reported that the Illinois Law
Enforcement Commission granted request for police
squad cars 50% off if radios were ordered within the
next few days. Also at 836 Center Street there was
an armed robbery and warrant would be issued on
April 6, 1971. Part of traffic survey was completed
on Center Street as to volume and turning movements
and Police Department will complete survey on Cora
Street this week. Fourteen narcotic cases were
reported, five of which were over doses.
Two women have started as operators on Police Department
Communication's Center; third woman scheduled to start
April 19, 1971. Alderman Wagner asked Chief on possible
rise of vandalism in Orchard Place area and it was
noted that vandalism was on rise in all nothern suburbs.
DEPUTY FIRE CHIEF: Deputy Fire Chief Corey reported on Fire Convention
held in Kansas City, Missouri with 3,000 participants.
Also four new firemen were sworn in by Deputy City
Clerk on Monday, April 5, 1971.
BUILDING COMMISSIONER:
Pollution Control Building Department inspectors are reporting
pollution violations with respect to City of Des
Plaines antipollution ordinance; citations will be
issued if deemed necessary.

Building Commissioner Prickett requested clarification
from Attorney DiLeonardi and City Council to continue
to accept R-5 plans even though under 100 -ft. frontage
lots. City Attorney DiLeonardi agreed that plans
could be accepted, but no permits issued.
City Engineer Bowen reported on progress at Well #2 -
Schneller was taking camera shots to determine
shale layers; also mercury content measured was well
within satisfactory limits.
The Cook County Highway Department is taking bids
for the widening of Oakton Street between Lee Street
and Mt. Prospect Road for four lanes.
As to sidewalk replacement program for 1971, as soon
as weather permits, Cumberland school sidewalk and
"S" curve on Prairie Avenue would commence.
CITY ATTORNEY: City Attorney DiLeonardi reported that the Illinois
Metropolitan Supreme Court rejected a final City request for
Sanitary District a rehearing of the high court's ruling, stating
that the Metropolitan Sanitary District does not
have to obey the City's zoning laws and can proceed
with construction. Moved by Alderman Shillington,
seconded by Alderman Michaels, to retain City
Attorney DiLeonardi to further research action that
should be taken by the City of Des Plaines in con-
tinuing its fight against location of MSD plant at
Oakton Street and Elmhurst Road.
Upon roll call, the vote was:

Roy Egan
Progress report was made with reference to Lunar Oil
Company that petition was filed to appeal to Illinois
Supreme Court.
Court ordered in the condemnation suit that Roy Egan
vs. City of Des Plaines, $160,000.00 is the value
of taking 3-3/4 acres east of and adjacent to
City garage property.
Legal Suit - Moved by Alderman Koplos,seconded by Alderman
North Maine Fire Wagner to retain City Attorney DiLeonardi to defend
Protection District City in legal action. Upon roll call, the vote was:

Mayor Behrel reported that he met with Attorney
Jacobs of MECCA to discuss the City's position
in the collective bargaining for Public Work's
employees.
Referred to Attorney DiLeonardi was request of
Alderman Szabo, to research letter from Dodge
News reports with reference to cost of underground
and aboveground wires being the same.

BEAUTIFICATION: Alderman Czubakowski announced that the third annual
Spring Cleanup Program for the City of Des Plaines will
begin April 19, 1971 for five-week program.
TREES: Alderman Leer reported that first shipment of trees for
Spring planting have been received; Commissioner of
Public Works Schwab stated that planting and grading
will commence on the Chicago & Northwestern right-of-way
as soon as Commonwealth Edison has completed wiring.

to concur with Mayor Behrel's reappointment of Dr.
John McMahon to the. Board of Health, term to expire

Moved by Alderman Wagner, seconded by Alderman Sherwood,
to concur with Mayor Behrel's recommendation to reappoint
Mr. Walton Newton to the Civil Service Commission,
term to expire April 30, 1974. Motion declared Carried.
Moved by Alderman Sherwood, seconded by Alderman Thomas,
to concur with Mayor Behrel's reappointments of
Rev. Donald Hughes and Mr. Warren Bell as members of
the Youth Commission, terms to expire April 30, 1974.

Moved by Alderman Shillington, seconded by Alderman
Sherwood, to concur with Mayor Behrel's recommendation
to appoint Alderman Lois Czubakowski as United Nations
Chairman. Motion declared Carried.
Letter from Attorney Wilhelm F. Levander regarding
North Maine Fire Protection District Contract was
submitted to all members of Council.
Mayor Behrel reported that the City of Des Plaines
Comprehensive Planning documents as prepared by
Rolf C. Campbell and Associates, in connection with
the 701 Program, have been submitted to the Department
of Local Government Affairs, State of Illinois.
Moved by Alderman Wagner, seconded by Alderman
Czubakowski, to concur with Alderman Wagner's request
for a three-way stop sign at the intersection of
Dale and Estes Avenues, and authorize City Attorney
to draft necessary ordinance. Motion declared Carried.
