MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY
.OF DES PLAINES, ILLINOIS, HELD
IN THE COUNCIL CHAMBERS, CITY
HALL, MONDAY, MARCH 15, 1971
CALL TO ORDER: The regular meeting of the City Council of the City of
Des Plaines was called to order by Mayor Herbert H. Behrel
at 8 P.M. The meeting opened with prayer by Rev. Ernest
Grant, pastor of the First Congregational Church, followed
by the Pledge of Allegiance to the flag.
ROLL CALL: Roll Call indicated the following aldermen present:
Koplos, Szabo, Sherwood, Bolek, Leer, O'Brien, Hinde,
Czubakowski, Swanson, Thomas, Shillington. Alderman
Wagner arrived immediately thereafter. Alderman Seitz
and Alderman Michaels arrived after approval of Minutes.
Absent was Alderman Bonaguidi.
Also present were: Police Chief Hintz, Fire Chief Haag, City Comptroller
Blietz, City Engineer Bowen, Commissioner of Public Works Schwab, Assistant
Commissioner of Public Works Schaefer, Building Commissioner Prickett,
and City Attorney DiLeonardi.
There being a quorum present, the meeting was in order.
MINUTES:
Moved by Shillington, seconded by Szabo, to approve the
Minutes of the regular meeting held March 1, 1971, as
published. Correction on Page two, para. 2 - should be
"Permistit, Paramust, New Jersey" not Hershey Sparling
Co. Correction on Page four, paragraph 6, adding thereto
the following: "Resolution to be mailed to members of
the Senate and House of Representatives and Northwest
Municipal Conference". Following correction, Motion to
approve declared Carried.
:REPORTS OF Placed on file were the report of the Engineering Department
CITY OFFICIALS: for February, and the Annual Report of Mayor Herbert H.
Behrel
ANNUAL City Comptroller Blietz reviewed with Council, the Annual
FINANCIAL RPT. Financial Report for the year 1970.
Police Chief
Police Chief reported on the recent burg;2r•lary attempt
at 652 Graceland Avenue, and further that the Court this
morning issued sizeable fines for individuals who have
failed to pay for parking meter tickets. He further
reported that 155 abandonded vehicles would be crushed
March 16th, for which the City would receive a renumeration
of $5 per vehicle.
City City Attorney DiLeonardi reported that the brief and
Attorney abstract in the Moehling Zoning Case at Rand and Wolf Roads
was filed last week, copies of same submitted to Council
at this meeting. Further reported that the fact-finding
process in the collective bargaining with CCPA begins
Thursday.. The Cities Service zoning case at Ballard and
Potter will be heard before Judge Egan on April 26.
North Maine Following discussion, it was moved by Koplos, seconded by
Fire Protection Szabo, to institute necessary legal proceedings to collect
District past due monies pe'r contract, in the amount of $61,000
from the North Maine Fire Protection District. Moved by
Bolek, seconded by Sherwood, to amend the motion to
institute legal action at the expiration of a sixty day
period if no satisfactory schedule for payment is developed.
Motion to amend declared Carried. Upon roll call, the
vote on the motion as amended was:

Hinde, Czubakowski, Wagner, Swanson, Thomas,
Seitz, Shillington, Michaels, Mayer.

COMMITTEE REPORTS:
Kenroy's Moved by Swanson, seconded by Hinde, to concur with Munici-
Resubdivision pal Development Committee's recommendation to approve the
Plat of Kenroy's Resubdivision, located within 1i miles
of City Limits on Malmo Road, and authorize execution of
same by Mayor and City Clerk. Motion declared Carried.

pal Development Committee's recommendation to approve the
Plat of Boelke's Subdivision located at Harvey and Wolf
Roads and authorize execution of same by Mayor and City
Clerk. Motion declared Carried.
Moved by Hinde, seconded by Thomas, to concur with Fire
Committee's recommendation to authorize Board of Police and
Fire Commission to certify six men from the eligibility
list for firemen, effective April 5, 1971. Motion declared
Carried.
Moved by Hinde, seconded by Szabo, to authorize the Building
and Grounds Committee, Mayor and City Clerk to extend the
bid opening date of March 29, 1971, for bids for the new
Fire Station, should it be found necessary to add an
addendum. Motion declared Carried.
The report of the Police Department re parking along the
north side of Perry Street, between Graceland and Lee,
was referred to the Traffic Commission for study and report.
The problem of long waiting periods for southbound traffic
turning onto Wolf Road from Golf Road during morning rush
hour, was referred to the Police Department for study and
report.
Alderman Michaels' request and letter from Mayor Behrel
re two-way stop signs to be installed at the intersection
of Norman Court and Marshall Drive was referred to the
Traffic Commission for study and report.
Alderman Leer, Chairman of the Streets and Traffic Committeg,
set the date of March 29th at 8 p.m. for a Public Hearing
with persons executing petition opposing widening of
Center Street.
WATER Moved by Thomas, seconded by O'Brien, to concur with Water
Bacteriological Committee's recommendation to authorize the City Engineer
Testing Lab to order new equipment and labor to complete the Water
Bacteriological Testing Labratory on items costs less
than $1,000 and advertising for bid those items exceeding
$1,000 in cost - approximate total cost $6,650.43.
Upon roll call, the vote was:

Hinde, Czubakowski, Wagner, Swanson, Thomas,

Moved by Thomas, seconded by Michaels, to concur with Water
Committee's recommendation to engage the firm of Pete
Schneller & Associates to pull the motor and pump at Well
#4 for inspection, at an estimated cost of $5,000.
Upon roll call, the vote was:

Hinde, Czubakowski, Wagner, Swanson, Thomas,

Moved by Szabo, seconded by Leer, to concur with Sewer
Committee's recommendation to advertise for bids for the
cleaning of 1,000 catch basins, returnable March 29th
at 3 p.m. Motion declared Carried.
AIR & WATER Alderman Michaels reported that the Air and Water Pollution
POLLUTION Committee is continuing to study the ordinance passed in
Progress Denver re excessive emmission from automobiles, use of
detergents, and recycling of paper.
Senior Mayor Behrel reported that a communication has been
Citizen received from Cook Co. Housing Authority stating that
Housing HUD has allocated $50,000 to said authority for the
Des Plaines Senior Citizen Housing project for preliminary
studies and site location.
BILLS Moved by Swanson, seconded by Hinde, to adopt the following
PAYABLE: resolution: BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE
DUE AND PAYABLE AND THE MAYOR AND CITY CLERK BE AND ARE
HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. Total,
$136,754.70. Upon roll call, the vote was:
AYES: - 15 - Koplos, Szabo, Sherwood, Bolek, Leer, O'Brien,
Hinde, Czubakowski, Wagner, Swanson, Thomas,
Seitz, Shillington, Michaels, Mayor.

City Code
Committee
Moved by Shillington, seconded by Koplos, to concur with
report of City Code Committee, regarding meeting held on
March llth with Mr. Rolf Campbell, on the proposed text
amendment to the Zoning Ordinance of 1960 relating to
Commercial District Classifications, stating -that therls
neeting:was held and the item further to be discussed
at a meeting to be held March 18,1971. Also discussed
by Alderman Szabo was the R-5 classifications with suggestions
for a text amendment. Motion declared Carried.
TEXT Moved by Szabo, seconded by Shillington, to authorize the
AMENDMENT City Attorney to draft the necessary text amendment to the
R-5 District Zoning Ordinance of 1960, requiring that all buildings
in the R-5 District be constructed on a lot having a
100 foot frontage or more, and contain.±ng at least
12,500 square feet. Motion declared Carried.
MORATORIUM Moved by Szabo, seconded by Shillington, to declare a
R-5 District moratorim on the issuance of building permits to applicants
where property is located in the -5 District, where the
lot contains less than 100 foot frontage or 12,500 square
feet, pending the outcome of aforementioned text amendment.
Motion declared Carried.
RESOLUTION Moved by Koplos, seconded by Shillington, to adopt Resolution
R-1-71 R-1-71 allowing for encroachment at 1622 Algonquin Road.

M-6-71 of Ordinance M-6-71 calling for regular election April 20,

Election by Sherwood, to adopt Ordinance M-6-71. Upon roll call,

Placed on First Reading was Ordinance M-8-71 Declaring it
to Be Unlawful and a Nuisance to Leave An Inoperable Motor
Vehicle on Public or Private Property.
Following the announcement by City Clerk Rohrbach, stating
no bids were received for the sale of the Water Tank and
Tower located in Northwestern Park, it was moved by Hinde,
seconded by Wagner, €o advertise for bids for removal
of same, returnable April 12th at 3 P.M., City Engineer
to write necessary specifications. Motion declared Carried.
The request of_,.V. E. Grand Realtor to review the improvement
of Stewart Avenue from River Street east to the river in
connection with improvement of lots on the north side
thereof was referred to Municipal Development and Streets
and Traffic Committees for study and report.
Moved by Sherwood, seconded by Michaels, that City of Des
Plaines again decline membership in the Council of
Governments of Cook County. Motion declared Carried.
Following the reading of the letter from State of Illinois
Department of Public Works and Buildings, Bureau of
Traffic, regarding certain costs to install traffic signaling
equipment to serve emergency vehicles at the new Fire
Station to be located on River Road, it was moved by Leer,
seconded by Thomas, to make application to the State of
Illinois to use Motor Fuel Tax Funds for payment thereof.
Motion declared Carried.
Alderman Shillington reported on a meeting held March llth
with residents of the Eighth Ward and a Trustee from the
Metropolitan Sanitary District, Mr. Janecki, and Mr. Robert
Barbolini. At this meeting Mr. Janecki reported that he
was not aware that the City of Des Plaines wanted the
Sewage Treatment Plant at another location, and should that
have been the case, it was only necessary that someone
communicate with him. It was moved by Shillington, seconded
by Koplos, to authorize Mayor Behrel to communicate with
the Metropolitan Sanitary District Board of Trustees, the
City's position regarding the proposed location of the
Sewage Treatment Plant, reminding Mr. Janecki that members
of the City Council and Mayor Behrel met personally with
him and several Trustees prior to the purchase of the parcel
of land at Oakton and Elmhurst Road, at the site location
and at the office of Mr. Vinton Bacon. Motion declared
Carried.
Moved by Michaels, seconded by Shillington, to authorize
City Clerk to redistrict the City for a more equitable
distribution of population within the wards immediately
following the regular election, April 20, 1971.

Alderman Seitz's request for a study of the possibility
that traffic on Luau yield to traffic on Fourth Avenue
was referred to the Traffic Commission for study and
report.
Mayor Behrel reported that he received a letter from the
National League of Cities, naming him a member of the
Standing Policies Committee of said league for 1971.
Moved by Sherwood, seconded by Michaels, that the regular
meeting of the City Council adjourn. Motion declared
