01/04/19711 53 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, CITY HALL, MONDAY, JANUARY 4, 1971 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines was called to order by Mayor Herbert H. Behrel at 8:05 P.M. The meeting opened with prayer by Rev. Mark Bergman, Pastor of Trinity Lutheran Church, followed by the Pledge of Allegiance to the flag. ROLL CALL: Roll Call indicated the following aldermen present: Koplos, Szabo, Prickett, Sherwood, Bolek, O'Brien, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington. Absent was Alderman Leer, Michaels. Also present were: Police Chief Hintz, Fire Chief Haag, City Comptroller Blietz, City Engineer and Acting Building Commissioner Bowen, Commissioner of Public Works Schwab, Assistant Commissioner of Public Works Schaefer, and City Attorney DiLeonardi. There being a quorum present, the meeting was in order. MINUTES: Moved by Prickett, seconded by Thomas, that the Minutes of the regular meeting of December 21, 1970, be approved as published. Motion declared Carried. REPORTS OF The following reports were ordered placed on file: CITY Building Department, 1970; Building Department, December; OFFICIALS: Public Works Department, December; Health Department, December; City Comptroller's report on Source of Water in Gallons. Police Chief Police Chief Hintz reported that during the month of December there were 14 related narcotic cases. During the New Year Weekend, there were 25 accidents with 3 injuries. Further there were 4 arrests over the New Year Weekend of those driving under the influence of alcohol. There were 112 citations issued for vehicles parked illegally during snow removal. Further that the Solicitor's ordinance went into effect, January .1st. City City Engineer Bowen reported that Rossetti Contracting Co. Engineer started placing the storm sewer on Jarvis and Douglas today. City City Attorney DiLeonardi reported that the contracts to Attorney purchase real estate at 389 River Road had been prepared and were in hands of Mayor and City Clerk for execution. Kiwanis He reviewed with Council the pending suit before the Property Appellate Court with owners of the Kiwanis Property with relation to City's denial for water service. Following discussion, Council continues to authorize City Attorney to represent the City in said case. Tax City Attorney reported that the second tax injunction suit Injunction has been filed involving 28 parcels of City owned real estate. Lunar Oil Suit City Attorney DiLeonardi reported that the Appellate Court has ruled in favor of City of Des Plaines, reversing the trial court's decision, in the Lunar Oil Case. Commissioner Commissioner of Public Works reported on various watermain Public Works breaks during the holidays, three occurring today. Further there were 350 tons of salt used during recent holiday season. COMMITTEE Moved by Swanson, seconded by Prickett, to concur with REPORTS Municipal Development Committee's recommendation to approve Rita's Plat of Rita's Subdivision located at Stillwell and Craig Subdivision and authorize execution of same by Mayor and City Clerk. /7 Motion declared Carried. /64' ZONING CASE 70-38-R 1328 Webford FIRE STATION ARCHITECT RESOLUTION Construction on State Right of Way Insurance Special Welfare & Counseling BILLS PAYABLE ORDINANCE Z-22-70 1669 Rand 1/4/71 Page two 54 Moved by Swanson, seconded by Hinde, to authorize City Attorney to prepare necessary map amendment to the Zoning Ordinance for further consideration by the Council, in accordance with Zoning Board of Appeals recommendation in Case 70-38-R, property located at 1328 Webford Avenue. Upon roll call, the vote was: AYES: - 12 - Koplos, Prickett,'Sherwood, O'Brien, Hinde, Czubakowski, Wagner, Swanson, Bonaguidi, Seitz, Shillington, Mayor. NAYS: 3 - Szabo, Bolek, Thomas ABSENT: 2 - Leer, Michaels There being twelve affirmative votes, Motion declared Carried. Moved by Szabo, seconded by Hinde, to concur with Building and Grounds Committee's recommendation to authorize Building and Grounds Committee and Mayor Behrel to interview and engage an architect for the proposed new Fire Station #1. Upon roll call, the vote was: AYES: - 15 - Koplos, Szabo, Prickett, Sherwood, Bolek, O'Brien, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Mayor. o - None NAYS: ABSENT: 2 - Leer, Michaels There being fifteen affirmative votes, Motion declared Carried. Moved by Koplos, seconded by Wagner, to concur with Street: and Traffic Committee's recommendation to adopt Yearly Resolution for Permit Construction on State of Illinois Right of Way. Upon roll call, the vote was: AYES: - 15 - Koplos, Szabo, Prickett, Sherwood, Bolek, O'Brien, Hinde, Czubakowski, Wagner, Swanson. Thomas, Bonaguidi, Seitz, Shillington, Mayor. NAYS: 0 - None ABSENT: 2 - Leer, Michaels There being fifteen affirmative votes, Motion declared Carried. Chairman Bonaguidi reported that the Insurance Committee and City Comptroller Blietz met with the Insurance Brokers Association to review City's Workmens Compensation Insurance and found that during last year $10,000 was saved with the adoption of program last year whereby City maintains certain reserves, and recommends the City again proceed on the same basis - to be included in next year's budget. Chairman Sherwood reported that the Special Welfare and Counseling Committee, along with Sgt. Fredricks of the Police Department, had met with the executive director of Maine Township Mental Health to review City's program instituted during year of 1970. Moved by Prickett, seconded by Swanson, to adopt the following resolution: BE IT RESOLVED BY MAYOR AND CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME: Total $50,991.19. Upon roll call, the vote was: AYES: - 15 - Koplos, Szabo, Prickett, Sherwood, Bolek, O'Brien, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Mayor. Moved by Hinde, seconded by Shillington, to adopt Ordinance Z-22-70 rezoning property located at 1669 Rand Road to C-2 Commercial District. Moved by Prickett, seconded by Wagner, to waive First Reading of Ordinance M-1-71 amending Section 4 of. Ordinance M-19-70 by allowing the waiver of compensation to Trustees of the Des Plaines Mass Transit District. Motion declared Carried. Moved by Prickett, seconded by Seitz, to adopt Ordinance M-1-71. Moved by Thomas, seconded by Wagner, to waive First'Reading of Ordinance M-2-71 having to do_uwith Rules and Regulations of the Water Department. Motion declared Carried. Moved by Wagner, seconded by Hinde, to adopt Ordinance M-2-71. The tentative Plat of Pleasant Acres Subdivision along with letter from Plan Commission re same was referred to the Municipal Development Committee for study and report. The request of Jewel Companies, Inc. to sell packaged liquors at the Jewel Store located at 52 Northwest Highway was referred to the License Health and Inspection Committee for study and report. Moved by Prickett, seconded by Hinde, to authorize City Attorney to attend hearingon Cook Co. Zoning Docket #1898, if upon investigation property located on the northwest corner of Washington Street and Foster Lane is found to be within 12 miles of City Limits. Upon roll call, the vote was: AYES: - 13 - Koplos, Szabo, Prickett, Sherwood, Bolek, O'Brien, Hinde, Czubakowski, Swanson, Bonaguidi, Seitz, Shillington, Mayor NAYS: 2 - Wagner, Thomas ABSENT: 2 - Leer, Michaels There being thirteen affirmative votes, Motion declared Carried II APPOINTMENTS: Moved by Bonaguidi, seconded by Prickett, to concur with Mass Transit Mayor Behrel's appointment of the following to the Des Plaines District Mass Transit District Board: Mr. Rex Wilson, Chairman - term to expire January 1, 1975 Mr. Harry E.
