12/07/1970MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, CITY HALL, MONDAY, DECEMBER 7, 1970 CALL TO ORDER: The regular meeting of the City Council was called to ROLL CALL: order by City Clerk Rohrbach, in the absence of Mayor Herbert H. Behrel at 8 P.M. Moved by Sherwood, seconded by Bonaguidi, to appoint Alderman Prickett as Mayor Pro -Tem for this meeting. Motion declared Carried. The meeting opened with Prayer by Rev. Lloyd Wolters of the First Christian Reformed Church, followed by the Pledge of Allegiance to the flag. Roll Call indicated the following aldermen present: Koplos, Prickett, Sherwood, Bolek, Leer, O'Brien, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington. Alderman Michaels arrived at 8:07 P.M. after Roll Call. Absent was Alderman Szabo. Also present were: Police Chief Hintz, Fire Chief Haag, City Comptroller Blietz, City Engineer and Acting Building Commissioner Bowen, Commissioner of Public Works Schwab, Assistant Commissioner of Public Works Schaefer, and City Attorney DiLeonardi. There being a quorum present, the meeting was in order. MINUTES: Moved by Shillington, seconded by Koplos, that the Minutes of the regular meeting held November 16, 1970 and the REPORTS OF CITY Special Meeting held November 23, 1970, be approved as OFFICIALS: published. Motion declared Carried. Police Chief Fire Chief Police Chief Hintz reported on certain power failures on the west side of Des Plaines which contributed to certain traffic tie-ups. Fire Chief Haag reported that 204 registrants from the State of Illinois participated in the Leadership Seminar held in Des Plaines. Acting Bldg. Acting Building Commissioner reported that a temporary Commissioner building permit for footings and foundations had been issued to the Greek Orthodox Church and further he expressed appreciation to the City Council for the appointment of Acting Building Commissioner. Columbia Ave. City Engineer Bowen reported that he has completed Storm the sketches and estimate of cost for the solution of Drainage storm drainage problem on Columbia. Avenue, as requested by Alderman Hinde. Said study was referred to the Streets and Traffic Committee for study and report. City City Attorney DiLeonardi reported that the suit has been Attorney filed in the matter of existing sub -standard structures on the property at 626 Birchwood. Further that a decision in the Metropolitan Sanitary District case is expected within the next few weeks. REPORTS ON The following reports were ordered placed on file: FILE Health Department, November; Building Department, November; Public Works Department, November; Engineering Department, November, and Statement of Cash Receipts, thru November 30. COMMITTEE Moved by Swanson, seconded by Hinde, to concur with REPORTS: Municipal Development Committee's recommendation to concur Zoning Case with Zoning Board's decision in Case 70-39-R to rezone 70-39-R property located at 1669 Rand Road to C-2 Commercial 1669 Rand District, and authorize City Attorney to draft map amendment to the Zoning Ordinance for further consideration by the Council. Motion declared Carried. SUBDIVISION Moved by Swanson, seconded by Hinde, to approve Plat Wm. L. Kunkel of Wm. L. Kunkel Subdivision, formerly Farrell Park Subdivision and authorize execution by Mayor and City Clerk. Motion declared Carried. 12/7/70 Page two 42 SUBDIVISION Moved by Swanson, seconded by Hinde, to concur with Stade's Municipal Development Committee's recommendation to 2133 Douglas approve Plat of Stade's Resubdivision - located at 2133 Douglas Avenue, and authorize execution by Mayor and City Clerk after signatures of City Treasurer and City Engineer have been affixed thereon. Motion declared Carried. MFT RESOLUTION Moved by Leer, seconded by Hinde, to adopt Supplemental Wieboldt Ave. Resolution appropriating $2,000 additiona1-funds for Section 82CS Section 82CS - the improvement of Wieboldt Avenue, concurring with Streets and Traffic Committee's recommendation. Upon roll call, the vote was: AYES: - 15 - Koplos, Prickett, Sherwood, Bolek, Leer, O'Brien, Hinde, Czubakowski, Wagner, Swanson, Bonaguidi, Seitz, Shillington, Michaels NAYS: 0 - None ABSENT: 1 - Alderman Szabo There being fifteen affirmative votes, Motion declared Carried. 2 -Way Stop Upon withdrawal of motion to install two way stop signs Signs - at the intersection of Dover Drive and Marshall Lane, Dover & the matter was referred to the Traffic Commission for Marshall further study and report. TRAFFIC - Cumberland School Stop Signs Westview & Jarvis Referred to the Streets and Traffic Committee was the City Engineer's reporton traffic at Cumberland School. Alderman Czubakowski's request for stop signs at the intersection of Westview Drive and Jarvis St. was referred to the Streets and Traffic Committee and Traffic Commission for study and report. THACKER ST. Following discussion by Alderman Bolek regarding the TRAFFIC STUDY Traffic Study conducted by Sgt. Walters staff on Thacker Street, the matter was referred to the Traffic Commission for further study. WATERMAIN Moved by Thomas, seconded by Wagner, to concur with Water Contract #2 and Finance Committee's recommendation to award the bid for Watermain Improvements - Contract #2 to the lowest base bidder, Bari Sewer and Water Contractor, Inc., in the amount of $40,402.00 and authorize the negotiation of a contract in accordance with bid with Bari Sewer and Water Contractor, Inc., at a cost not to exdeed the amount of bid submitted for Alternates A, B, and C, upon com- pletion of necessary easement agreements - bid bonds and checks of unsuccessful bidders to be returned. Upon roll call, the vote was: AYES: - 15 - Koplos, Prickett, Sherwood, Bolek, Leer, O'Brien, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels NAYS: 0 - None ABSENT: 1 - Alderman Szabo There being fifteen affirmative votes, Motion declared Carried. OAKTON ST. Moved by Bonaguidi, seconded by Shillington, to concur RELIEF STORM with Sewer and Finance Committees' recommendation to SEWER award the bid for the Oakton Street Relief Storm Sewer to the law bidder, Mike DiPaolo, Inc. in the amount of $17,085.00 with provision that no payment be made until all waivers from suppliers are received - bid checks or bonds to be returned to unsuccessful bidders. Youth Alderman Sherwood, Chairman of Youth Activity Committee Activity made the following Progress Report of said Committee: A meeting was held November 10th with Special Welfare and Counseling Committee and a representative from the "Place For People" drop -in -center. At this meeting a copy of their by-laws, a copy of non-profit charter, and a copy of liability insurance, as well as documenta- tion of financial status was requested but to date not received. A legal opinion was requested at this time regarding the use of City Funds for a drop' -in -center administered by a Private Organization.. BILLS. PAYABLE RESOLUTION R-19-70 Zoning Fees Moved by Swanson, seconded by Hinde, to adopt the following resolution: BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME: Total $477,773.01. Voucher #1854 withdrawn prior to submission to Council. RESOLUTION Moved by Hinde, seconded by Sherwood, to adopt Resolution R-20-70 R-20-70, supporting the proposed 1970 Constitution for Con -Con the State of Illinois being submitted to the Voters of Illinois December 15, 1970. Placed on First Reading was Ordinance T-47-70 prohibiting parking Along the South Side of Everett Street between Ash and Mannheim. Placed on First Reading was Ordinance T-48-70 providing for a Three -Way Stop sign intersection at Village Court and Drake Lane. Placed on First Reading was Ordinance T-49-70 requiring Pinehurst Traffic to Yield to Traffic on Drake Lane. Placed on First Reading was Ordinance M-24-70 changing the name of First Avenue from Soo Line Railroad Tracks to Walnut Street to "Graceland Avenue". Placed on First Reading was Ordinance M-25-70 allowing the use of Plastic or Paper Bags as Garbage Receptacles. Moved by Wagner, seconded by Czubakowski, to waive First Reading of Ordinance M-26-70 amending Ordinance M-11-70 providing for the Construction of Sidewalks along the North and South Side of Northshore Avenue from Curtis Street to Eisenhower Drive, on the North Side of Nimitz Drive from Curtis Street to Scott Street, and on the East and West Side of Eisenhower Drive from Nimitz Drive to Northshore Avenue. Motion declared Carried. Moved by Wagner, seconded by Czubakowski, to adopt Ordinance M-26-70. ORDINANCE Placed on First Reading was Ordinance M-27-70 Authorizing M-27-70 and Directing the Execution of Mutual Aid Agreement for Fire Protection Fire Protection Between the City of Des Plaines and Mutual Aid Participating Municipalities. Referred to the Judiciary and Fire Committees for study and report. MECCA Election Placed on file was the Certification of Election Results Results whereby Public Works Department employees chose M.E.C.C.A. to be exclusive representative of employees - Election held November 10, 1970. PUBLIC HEARING Sexton - Des Plaines River Crossing COOK CO. ZONING DOCKETS Notice of Public Hearing to be held December 9, 1970 at West Park Field House by Division of Waterways re Sexton installation of temporary crossing over Des Plaines River was read to Council. Moved by Bonaguidi, seconded by Wagner, to authorize City Engineer and City Attorney to attend said Hearing. Motion declared Carried. MILLERS ROAD Improvement Mft Funds Cook Co. Zoning Dockets #1871 and #1874 were presented to Council. No Action. The request owners and subdividers of property located at Mt. Prospect and Millers Road, Rauschenberg & Biasiello that the City improve Millers Road with MFT Funds, west of Mt. Prospect Road, was referred to the Streets and /1 Traffic Committee for study and report. 12/7/70 45 Page five SUBDIVISION The request of Reliable Construction Co. to subdivide 927 Warrington one lot into two at 927 Warrington Road was referred to the Plan Commission for preliminary approval prior to Zoning Hearing on Variation. RESUBDIVISION The request for approval of Plat of Rita's Resubdivision Rita's located at Stillwell & Craig submitted by Kunkle Real Estate Co. was referred to the Plan Commission for study and report. COOK CO. The request of Cook County Office of Economic Opportunity, OFFICE OF Inc. that the City of Des Plaines appropriate $641.90 ECONOMIC as a 10%% share of total cost of operating Operation OPPORTUNITY Nutrition Program in this area was referred to the Special Welfare and Counseling Committee for study and report. Speed Limit The request of Alderman Hinde for reduction of speed Mt. Prospect limit on Mt. Prospect Road between Golf Road and Thacker Road Street was referred to the Streets and Traffic Committee and Traffic Commission for study and report.
