MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY
OF DES PLAINES, ILLINOIS, HELD
IN THE COUNCIL CHAMBERS, CITY
HALL, TUESDAY, OCTOBER 6, 1970
CALL TO ORDER: The regular meeting of the City Council of the City of
Des Plaines was called to order by Mayor Herbert H. Behrel
at 8:05 P.M. The meeting opened with prayer by Rev.
Michael Bielenda, Deacon of St. Stephen's Catholic
Church, followed by the Pledge of Allegiance to the flag.
ROLL CALL:
Roll Call indicated the following aldermen present:
Szabo, Prickett, Sherwood, Bolek, Hinde, Wagner, Swanson,
Thomas, Bonaguidi, Seitz, Shillington, Michaels,
Absent were Aldermen Koplos, Leer, O'Brien, Czubakowski
Present also were: Police Captain Mensching, Fire Chief Haag, City
Comptroller Blietz, Commissioner of Public Works Schwab, Building
Commissioner Schuepfer, City Engineer Bowen, and City Attorney DiLeonardi
There being a quorum present, the meeting was in order.
MINUTES:
Moved by Prickett, seconded by Hinde, that the Minutes
of the regular meeting held September 21, 1970, be
approved as published. Motion declared Carried.
REPORTS OF The following reports of City Officials were ordered
CITY OFFICIALS placed on file: Health Department for September, 1970;
Building Department for September, 1970; Public Works
Department for September, 1970.
Fire Chief
Fire Chief Haag reported on the exce=llent attendance at
the open houses held at the three fire stations Sunday.
Further reported on a fire at 650 Murray Lane and the
Fred Astaire Studio on September 29th.
Cook Co. = City Attorney submitted a written me'no regarding the
Zoning Dockets hearing on Cook County Zoning Dockets #1849 and #1850,
1849 & 1850 and reviewed same with Council. Moved by Szabo and
R-16-70 seconded by Shillington that City Council adopt a
resolution opposing the rezoning as set forth in Cook
County Zoning Dockets 1849 and 1850. Motion declared
Carried.
SCIENTIFIC City Attorney DiLeonardi reviewed the consent decree
MACHINERY between Scientific Machinery Movers, Inc. and the City of
MOVERS,INC. Des Plaines stating that the court denied Scientific
Machinery Movers, Inc. motion to vacate certain provisions
of said decree=;and that Scientific Machinery Movers, Inc.
has filed an appeal from said order. Moved by Szabo,
seconded by Michaels that City Attorney DiLeonardi repre-
sent City to defend said appeal. Upon roll call, the vote
was:
AYES: -13 - Szabo, Prickett, Sherwood, Bolek, Hinde,
Wagner, Swanson, Thomas, Bonaguidi, Seitz,
Shillington, Michaels, Mayor.
NAYS: 0 - None
ABSENT: 4 - Koplos, Leer, O'Brien, Czubakowski
There being thirteen affirmative votes, Motion declared
Carried.
DOOR TO DOOR Alderman Shillington questioned City Attorney DiLeonardi
SOLICITATION regarding draft of ordinance governing door to door
solicitation and submitted petition signed by eighth
ward residents requesting said ordinance. Draft of
ordinance as prepared by City Attorney DiLeonardi was
placed on First Reading and referred to Judiciary Committee
and City Attorney for further study and report.

COMMITTEE REPORTS:
ZONING CASE Moved by Swanson, seconded by Prickett, to concur with
70-30-R Municipal Development Committee's recommendation to grant
611 E. Golf Rd.rezoning of property located at 611 E. Golf Road to
C-1 Commercial District - Zoning Case 70-30-R and restrict
use for Parking Only. After discussion, motion was withdrawn.
Moved by Swanson, seconded by Prickett, to concur with Des
Plaines Zoning Board of Appeals in Case 70-30-R to deny
rezoning petition and recommend to Zoning Board of Appeals
the granting of variation for Parking Lot use Only in the
R-2 Single Family Residence District of parcel of property
legally described in Zoning Case 70-30-R - located at the
commonly known address of 611 E. Golf Road. Motion
declared Carried.

Moved by Swanson, seconded by Prickett, to concur with
Municipal Development Committee's recommendation;,to grant
petition to rezone property located at 815 W. Oakton Street
to C-2 Commercial District and authorize City Attorney to
prepare necessary map amendment to the Zoning Ordinance
for further consideration by the Council - Zoning Case
70-25-R. Motion declared Carried.
Moved by Swanson, seconded by Hinde, to concur with
Municipal Development Committee and Des Plaines Zoning
Board of Appeals recommendation to deny rezoning petition
in Case 70-26-R - property located at 1738 Rand Road.
Motion declared Carried.
Moved by Swanson, seconded by Hinde, to concur with
Municipal Development Committee's recommendation to grant
petition for rezoning of property located at 1200 Golf
Road - Zoning Case 70-29-R - and authorize the City
Attorney to draft the map amendment to the Zoning
Ordinance for further consideration by the Council.
Motion declared Carried.
Alderman Hinde, member of the License Health and Inspection
Committee, submitted the following Majority Report of
said Committee: "The majority of the License Health and
Inspection Committee recommends to City Council that
an ordinance be drawn to permit a new classification
for liquor licenses to permit a banquet facility only,
to allow liquor to be served to banquet participants
and not to general public and authorize City Attorney
to draft necessary amendment to the ordinance allowing
such classification of liquor license to be issued Mr.
Nicholas A. Vangel to operate at 783 Lee Street."
A Minority report was submitted by Alderman Bolek, Chairman
of License Health and Inspection Committee opposing the
issuance of above mentioned liquor license classification
on the basis of future redevelopment of the area. Moved
by Hinde, seconded by Thomas, to concur with Majority
Report of said Committee. Following discussion, moved
by Shillington, seconded by Szabo, to defer action until
next meeting.
Moved by Wagner, seconded by Prickett, to concur with
Streets and Traffic Committee's recommendation to authorize
City Engineer to draw specifications for the improvement
of alley leading from Municipal Building Parking Lot
eastward to Lee Street, and authorize City -Clerk to
advertise for bids returnable at the earliest date possible.
Motion declared Carried.
Alderman Sherwood submitted a petition signed by residents
in the 1400 block to 1600 block on Thacker Street regarding
proposed future improvements of said street - Petition
referred to the Streets and Traffic Committee for study

Alderman Hinde submitted petition signed by residents
on Thacker Street regarding proposed improvement of
Thacker Street, opposing same. Said petition was referred
to the Streets and Traffic Committee for study and report.
Alderman Shillington questioned progress of request for
traffic signals at the intersection of Marshall and
Algonquin stating that four accidents have occurred at
the intersection of Andrea and Algonquin in the past seven
days and suggested that if crossing light cannot be
installed perhaps a double yellow line down the center
of Algonquin from the intersection of Marshall and
Algonquin to Elmhurst Road would be permitted. Said
request referred to Mayor Behrel to communicate with
State Highway Department.
Moved by Bolek, seconded by Wagner, to adopt resolution'
requesting that Speed Limit on Wolf Road from Touhy Avenue
to Golf Road be 30 m.p.h. upon completion of improvements.
Motion declared Carried.
Moved by Sherwood, seconded by Shillington, to concur
with Youth Activity Committee's recommendation that the
City participate in Youth Appreciation Week activities
with the local Optimist Club, at a cost not to exceed
$800 as appropriated. Upon roll call, the vote was:
AYES: - 13 - Szabo, Prickett, Sherwood, Bolek, Hinde,
Wagner,. Swanson, Thomas, Bonaguidi, Seitz,
Shillington, Michaels, Mayor.
NAYS: 0 - None
ABSENT: 4 - Koplos, Leer, O'Brien, Czubakowski

Moved by Szabo, seconded by Bonaguidi, to concur with
Beautification Committee's recommendation to authorize
Commissioner of Public Works Schwab to investigate and
report to City Council estimate of cost for planting
of certain flowering trees on boulevard parkways on'
Broadway, State Street, and Wolf Road, north of Northwest
Highway. Motion declared Carried.

Mayor Behrel read the letter from Department of Housing
and Urban Development - Federal Housing Administration,
regarding Des Plaines's application for low -rent public
housing for the elderly - said letter placed on file.

T-39-70 having to do with 20 m.p.h. speed limit on Eighth
Avenue from Golf Road to Stone Street during school hours
when children are present. Upon roll call, the vote was:

T-40-70 prohibiting parking on the west side of Eighth

T-41-70 providing for three hour parking, 10 A.M. to 6 P.M.
except Saturdays, Sundays and Holidays on the south side
of Brown Street from Alles Street east to the alley.
Upon roll'call, the vote was:
AYES: - 12 - Prickett, Sherwood, Bolek, Hinde, Wagner,
Swanson, Thomas, Bonaguidi, Seitz, Shillington,

The letters from Des Plaines Zoning Board of Appeals and
Plan Commission regarding Zoning Case 70 -32 -PUD were
referred to the Municipal Development Committee for study
and report.
Cook County Zoning Docket #1861 was brought to attention
of Council - No Action.
Moved by Shillington, seconded by Sherwood, to concur with
Board of Local Improvements recommendation to authorize
City Engineer to prepare plans and specifications for the
improvement of the entire area lying north of Dempster and
west of Potter Road, within the City Limits, and abandon
the improvement of Lyman Avenue with bridge construction
by Special Assessment at this time - Plans prepared by
E. N. Fletcher Engineering Co. to be submitted to City
Engineer with statement for services rendered. Upon roll
call, the vote was:
AYES: - 12 - Prickett, Sherwood, Bolek, Hinde, Wagner,

RESIGNATION Moved by Prickett, seconded by Bonaguidi, to accept the
Youth resignation of Mrs. Carl Swanson from the Youth Commission
Commission and authorize Mayor Behrel to write letter of appreciation.
Motion declared Carried.
APPOINTMENT Moved by Shillington, seconded by Prickett, to concur with
Youth Mayor Behrel's appointment of Mrs. Gregory Morgan, 1744
Commission East Oakton Street, to fill vacancy on the Youth Commission,
term to expire April 30, 1972. Motion declared Carried.
STOP SIGN Alderman Hinde's request for stop signs at the intersection
Walnut & of Walnut and Warrington was referred to the Streets and
Warrington Traffic Committee for study and report.
LOAD LIMIT Alderman Hinde's request for Load Limit signs on Second
Second Ave. Avenue between North and Thacker Streets was referred to
the Streets and Traffic Committee for study and report.
Also a study of traffic pattern for traffic at West
School during school hours.
ADJOURNMENT: Moved by Prickett, seconded by Shillington, that the
regular meeting of the City Council adjourn.
