09/21/19708 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, CITY HALL, MONDAY; SEPTEMBER 21, 1970 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines was called to order by Mayor Pro -Tem Alfred Prickett at 8:08 P.M. The meeting opened with prayer read by City Clerk Rohrbach, followed by the Pledge of Allegiance to the flag. II ROLL CALL: Roll Call indicated the following aldermen present: Koplos, Szabo, Prickett, Bolek, Leer, O'Brien, Hinde, Swanson, Thomas, Seitz, Shillington, Michaels. Absent were Aldermen Sherwood, Czubakowski, Wagner, Bonaguidi. Present alsotwere Police Chief Hintz, Fire Chief Haag, City Comptroller Blietz, Commissioner of Public Works Schwab, Assistant Commissioner of Public Works Schaeffer, Building Commissioner Schuepfer, and City Attorney DiLeonardi. 1 There being a quorum present, the meeting was in order. MINUTES: Moved by Shillington, seconded by Thomas, that the Minutes of the regular meeting of September 8, 1970, be approved as published. Motion declared Carried. REPORTS OF The following reports were ordered placed on file: CITY OFFICIALS: Appropriation Expenditures January thru August 31, 1970, Health Department, August, 1970; Engineering Department, August, 1970 City City Comptroller Blietz reported that $79,088.01 had been Comptroller received from the Department of Revenue, representing estimate of back payments, in addition to regular payment for the month of May, totaling $233,589.77. He further reported that he is meeting with various employee organizations and upon completion of these meetings will request an executive session to discuss requests. City Engineer City Engineer Bowen reported that inspections of improvements in 192, 193, 194 were conducted by his office and finds that watermain in Anderson Subvision nearly complete and water and sewer work in 193 and 194 about 20% completed. Complaint City Attorney reviewed with City Council the decision William Fox made by the Board of Police and Fire Commission regarding William Fox, and stated that William Fox has filed complaint in court for review of Board's decision. Moved by Hinde, seconded by Thomas, that City Attorney DiLeonardi be retained to defend the City and Board of Police and Fire Commis±ion in said complaint. Upon questioning by Alderman Michaels, Attorney DiLeonardi advised that Alderman Michaels not vote on any of these matters regarding William Fox. Upon roll call, the vote was: AYES: - 11 - Koplos, Szabo, Prickett, Bolek, Leer, O'Brien, Hinde, Swanson, Thomas, Seitz, Shillington. NAYS: 0 - None ABSTAIN: 1 - Alderman Michaels ABSENT: 4 - Sherwood, Czubakowski:,Bonaguidi, Wagner There being eleven affirmative votes, Motion declared Carried. Redevelopment City Attorney DiLeonardi reported that during the last Prairie & Lee two years efforts have been made by the Des Plaines Redeveoprent Corporation and Des Plaines Tomorrow Corporation to acquire certain lands for redevelopment at the northeast corner of Prairie and Lee Streets. Referred to the Municipal Development Committee was the request of property owners to rezone property located 4 9/21/70 Page two at Miner Street and River Road from C-2 Commercial District to C-4 Commercial District and obtain Special Use permit for gasoline service station, in exchange for real estate located at the Northeast corner of Prairie and Lee Streets which presently occupy the Gnoit service station. Soliciting Alderman Shillington questioned City Attorney regarding present legislation governing soliciting in the City of Des Plaines. Subject discussed for some time and City Clerk requested to submit copies of City Attorney's draft of ordinance re solicitors to Council. Condemnation City Attorney DiLeonardi reported that pre-trial Egan Property discovery is scheduled for October 5th and trial date is November 5th in the condemnation of Egan property on Campground Road. Military Commerative Committee COMMITTEE REPORTS: Zoning 70-12-R 1799 thru 2001 Busse 9 At this time Mr. Don Vance, past Commander of Des Plaines Post 36, American Legion, addressed City Council regarding the progress of the Monument as a suitable memorial for members of the military service who gave their lives and the proposed model was placed on display. Moved by Swanson, seconded by Koplos, to concur with Municipal Development Committee's recommendation to deny petition to rezone property located at 1799 thru 2001 Busse Highway - Case 70-12-R. Motion declared Carried. ZONING 70-28-R 1796 Rand Rd. ZONING 70-27-R 1776 Rand Rd. RIVER -RAND AREA ZONING EQUIPMENT Fire Department Truck Moved by Swanson, seconded by Koplos, to concur with Municipal Development Committee's recommendation to deny petition to rezone property located at 1796 Rand Road to C-1 Commercial District - Case 70-28-R. Motion declared Carried. Moved by Swanson, seconded by Koplos, to concur with Municipal Development Committee's recommendation to deny petition to rezone to C-1 Commercial District property located at 1776 Rand Road - Case 70-27-R. Motion declared Carried. Moved by Swanson, seconded by Hinde, to concur with Municipal Development Committee's recommendation to request the Plan Commission to study the land uses along Rand Road, River Road and Lee Street in the neighborhood of the five -corner area in accordance with Paragraph 6 of letters from Des Plaines Zoning Board of Appeals in cases 70-27-R and 70-28-R and report findings to City Council. Motion declared Carried. Moved by Hinde, seconded by Thomas, to concur with Fire Committee's recommendation to ratify action of Mayor Behrel and Committee members in authorizing the repair by rebuilding engine of Fire Department Truck by FWD, Clintonville, Wisconsin, at a cost not to exceed $6,155. Upon roll call, the vote was: AYES: - 12 - Koplos, Szabo, Prickett, Bolek, Leer, O'Brien, Hinde, Swanson, Thomas, Seitz, Shillington, Michaels NAYS: 0 - None ABSENT: 4 - Sherwood, Czubakowski, Wagner, Bonaguidi There being twelve affirmative votes, Motion declared Carried. FIRE PROTECTION In a progress report submitted by Alderman Hinde, Park Ridge Chairman of the Fire Committee, he stated that a meeting Manor had been held with Trustees of the Park Ridge Manor Fire Protection District to discuss their contract and the possibilities of their being served by either Park Ridge or North Maine Fire Protection District. A meeting will be again scheduled within the next three weeks. 9/21/70 10 Page three APPRAISAL Moved by Szabo, seconded by Koplos, to concur with Building City Bldg. and Grounds Committee's recommendation to authorize an Expansion appraisal of certain properties in connection with expansion of city buildings at a cost not to exceed $5,000. PETITION re Alderman Bolek read and presented Petition signed by 66 THACKER ST. Thacker Street residents regarding proposed improvement TRAFFIC of Thacker Street and proposed improvements to railroad crossings. Said petition was referred to the Streets and Traffic Committee, Traffic Commission and City Engineer for study and report. PARKING OF Moved by Michaels, seconded by Thomas, to concur with VEHICLES ' Judiciary and Building Control and Inspection Committees SERVICE Committees recommendation as follows: STATIONS City Attorney prepare an ordinance that will permit the following uses be prohibited at gasoline service station locations: 1. Prohibit junk or Abandoned cars or other vehicles 2. Prohibit transfer of goods not incidental to service station use. 3. Prohibit warehouse use not incidental to service station use. 4. Prohibit occupied trailers and recreational'vehicles 5. Prohibit unhitched trailers from tractor -trailer rigs (parking thereof) This ordinance shall not apply to and should expressly exclude vehicles owned or leased by service station and used for service station uses and further shall exclude recreational vehicles, e. g. campers, boat trailers parked on service station grounds. Motion declared Carried. FLOWERING Moved by Szabo, seconded by Seitz, to concur with TREES - Wolf Beautification Committee's recommendation to authorize Rd. Broadway the expenditure of up to $1500 for flowering trees to State Street be placed on the center parkways of Wolf Road, Broadway, and State Street, and authorize Commissioner of. Public Works to secure quotes from various landscapers prior to issuance of Purchase Order. After considerable discussion, it was moved by Bolek, seconded by Prickett to defer.action. BILLS PAYABLE: Moved by Swanson, seconded by Hinde, to adopt the following resolution: BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF TMEt:CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE:1DUE AND PAYABLE AND THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME: Total $204,319.03. The request to name a street within the City Limits in Alderman Figard's membry was referred to the Streets and Traffic Committee for study and report. Ordinance T-39-70 amending Section 10-6-16 of the City Code havrimg to do with 20 m.ph speed limit on Eighth Avenue from Golf Road to Stone Street, when children are present was placed on First Reading. Amended to read: "During School Hours When Children are Present". Placed on First Reading was Ordinance T-40-70 prohibiting Parking on the west side of Eighth Avenue between Golf Road and Stone Street between the hours of 8 a.m. and 6 p.m. except Saturdays, Sundays and Holidays. Placed on Fli:ist Reading was Ordinance T-41-70 providing for three hour parking, 10 a.m. to 6 p.m. except Saturdays, Sundays and holidays on the south side of Brown Street from Alles Street east to the alley. Oakton Street 79-26-R - 1738 Rand Road 70-29-R - 1200 Golf Road 70-30-R - 611 East Golf Road. Cook.County Zoning Dockets #1855 and 1856 re text amendments to Cook County Zoning Ordinance were read to Council. No action. MASS Alderman Hinde reported on meeting of Northwest Municipal TRANSPORTATION Conference stating that more than 2/3 of the member communities are participating in formation of Mass Transportation Study oto be conducted by Harper College and Chicago Circle College at a cost of approximately $27,500 which represents funds submitted. FIRE Referred to the Fire Committee was the possible Maintenance EQUIPMENT Contract for a periodic check at least every three months MAINTENANCE of equipment, including moving vehicles, within the Fire Department. LIBRARY TAX RATE The letter from Des Plaines Public Library Board regarding increase in library tax rate without referendum was referred to the Library Committee and Finance Committee for study and report.
