MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY
OF DES PLAINES, ILLINOIS, HELD IN
THE COUNCIL CHAMBERS, CITY HALL,
TUESDAY, SEPTEMBER 8, 1970
CALL TO ORDER: The regular meeting of the City Council of the City of
Des Plaines was called to order by mayor Herbert H. Behrel
at 8:00 P.M. The meeting opened with prayer by Rev. Kenneth
Wobbe, Pastor of Christ Evangelical and Reformed Church,
followed by the Pledge of Allegiance to the flag.
111 ROLL CALL: Roll Call indicated the following aldermen present:
Koplos, Szabo, Prickett, Bolek, Leer, O'Brien, Hinde,
Czubakowski, Wagner, Swanson, Thomas, Bonaauidi, Seitz,
Shillington, Michaels, Absent was Alderman Sherwood
Also present were: Police Chief Hintz, Fire Chief Haag, City Comptroller
Blietz, Commissioner of Public Works Schwab, Building Commissioner
Schwab, and Cit::y.ttorney DiLeonardi.
There being a quorum present, the meeting was in order.
MINUTES:
Moved by Prickett, seconded by Thomas, that the Minutes of
the regular meeting of August 17, 1970, be approved as
published. Motion declared Carried.
REPORTS OF Placed on file.�.were the following reports: Building Commissioner
CITY OFFICIALS for month of August; Public Works Department, August;
City Comptroller's Statement of Cash Receipts to August 31,
1970;
POLICE CHIEF Police Chief Hintz reported there were 20 motor vehicle
accidents over Labor Day weekend with' 4 injuries which
is below normal for three day weekend.
111 FIRE CHIEF
Fire Chief Haag reported on the International rite Chief's
Conference stating that the se,=:sions on collective bargain-
ing were most informative.
AIR POLLUTION: Building Commissioner reported that the equipment for
measuring air pollution has been erected on the Maine West
High School :gym roof and work, including testing,should
be completed within a week.
RIO RAND
MOTEL
Building Commissioner Schuepfer reported that the court
ruled in favor of the property owners in the City's case
against them for certain building violations, stating that
the property owner has denied permission for entry to inspect.
Following considerable discussion, it was moved by Szabo,
seconded by Wagner, to authorize the necessary legal steps
in order that City Officials may gain entry to make
inspections of Rio Rand Motel Building. Motion declared
Carried.
LEGAL SUIT City Attorney DiLeonardi reported that on August 20th
A..F.C.O. the Metropolitan Sanitary District appeared before the
MET. SAN. court in suit filed against the City and A.F.C.O. Products
DISTRICT and case was dismissed against the City.
ILEGAL SUIT City Attorney DiLeonardi reported thatJudge Epstein entered
ZONING decree in favor of the City in Zoning Suit - Edward T.
SZELIGA Szeliga VS City of. Des Plaines - property located on Third
Avenue and subject of Zoning variation.
SCIENTIFIC City Attorney reported that owners of Scientific Machinery
MACHINERY Movers, Inc. have requested the court to modify Consent
MOVERS,INC. Decree filed September 17, 1969 by removing the provision
that the entire operation of. Defendant's business cease
completely not later than September 3, 1970. He reported
that he appeared before Judge Kelly and that said Judge
granted petitioner leave to file amended petition to
be argued September 10th. '

Moved by Swanson, seconded by Prickett, to concur with
Municipal Development Committee's recommendation to deny
permission to Mobil Oil Corporation to rebuild service
station located on the southeast corner of Golf and Mt.
Prosect Roads as property does not meet minimum land
requirements for a gasoline service station and Zoning
Administrator has determined that property has been
abandoned. Motion declared Carried.
Moved by Swanson, seconded by Prickett, to concur with
Municipal Development Committee's recommendation to accept
Plat of Dedication of 33' to extend Pleasant Lane and
authorize execution of same. Motion declared Carried.
Moved by Swanson, seconded by Prickett, to concur with
Municipal Development Committee's recommendation to concur
with report of Zoning Board in Case 70-15-R, 1509 River Road,
and authorize City Attorney to prepare the map amendment
to the Zoning Ordinance for further consideration by the
Council, rezoning property to C-1 and restricting usage
to office buildings only. Motion declared Carried.
Moved by Swanson, seconded by Prickett, to concur with
Municipal Development Committee's recommendation that Mayor
and City Attorney meet with property owners in attempt
to resolve matters set forth in agreement entered into
by the City of Des Plaines and Elmer C. Rypkema on April
5, 1954. Motion declared Carried.
Moved by Swanson, seconded by Wagner, to concur with Municipal
Development Committee's recommendation to approve Plat of
Subdivision - Academy of. St. Patrick located on north side
of Touhy Avenue, east of Lee Street, and authorize execution
of same - deposit for improvements having been received.
Motion declared. Carried.
Moved by Thomas, seconded by Wagner, to concur with Police
Committee's recommendation to authorize the purchase of four
ban radio from Motorola Communications, Inc. in the amount of
$966.00 for installation in authmobile of Reserve Police
Captain. Upon roll call, the vote was:

O'Brien, Hinde, Czubakowski, Wagner, Swanson,

Moved by Thomas, seconded by Prickett, to concur with Police
Committee's recommendation to authorize the funding in the
amount of $7,250, representing 50%, to allow Lt. A. Schweisow
to attend the Fall Session of Northwestern University
Traffic Institute - 50% to be borne by the National Highway
Safety Bureau. Upon roll call, the vote was:

Moved by Hinde, seconded by Shillington, to concur with Fire
Committee's recommendation to adopt a resolution to authorize
Mayor and City Clerk to execute Articles of Agreement between
Elk Grove Rural Fire Protection District - to cover a two
year period ending December 31, 1972, payments to the City
to be made in accordance with schedule contained therein
for the sum of $9,000.00 per year for services rendered. /9

Chief Haag to renew request before Illinois Fire Inspection
and Rating Bureau to lower City's present Class 5 rating,
based on watermain improvements, increased water supply,
additional personnel and equipment. Motion declared Carried.
The letter from Tobin Stahr Company, Inc. containing results
of. Des Plaines second refuse sack test questionnaire was
referred to the Sanitation Committee for study and report.
Moved by Leer, seconded by Seitz, to concur with Streets and
Traffic Committee's recommendation to prohibit parking
from 8 a.m. to 6 p.m. except Saturdays, Sundays, and Holidays
on the west side of. Eighth Avenue between Golf and Stone
Streets - City Attorney to draft ordinance. motion
declared Carried.
Moved by Leer, seconded by Seitz, to concur with Streets and
Traffic Committee's recommendation to post 20 m.p.h. speed
limit signs on Eighth Avenue, when school children are
present, from Golf Road to Stone Street - City Attorney to
draft ordinance. Motion declared Carried.
Moved by Szabo, seconded by Koplos, for 3 -hr parking, 10 a.m.
to 6 p.m. except Saturdays, Sundays and holidays on the
south side of Brown Street from Alles Street east to the
alley - City Attorney to draft ordinance. Motion declared
Carried.
Moved by Wagner, seconded by Shillington, to concur with
Building Control and Inspection Committee's recommendation
to deny sign request of Kings Host at 819 Elmhurst Road
for sign 29' in height. Motion declared Carried.
Moved by Wagner, seconded by Thomas, to concur with Building
Control and Inspection Committee's recommendation to deny
signs request of Ridge Motors on River Road - 47' high and
37' high. Motion declared Carried.
Moved by Szabo, seconded by Koplos, to terminate resolution
adopted at meeting held August 17, 1970, regarding conduct
of business by Jeco Industries in vacated Sears Farm Store
on Pearson Street for a period of ninety rays, inasmuch as
new location has been secured. Motion declared Carried.
Moved by Leer, seconded by Koplos, to concur with Forestry
Committee's recommendation to purchase 1200 1 3/4 to 2"
Marshalls Ash trees from Matt Tures Sons, Huntley, Illinois
at a cost of $12.75 per tree. Upon roll call, the vote was:

West line of Lee Street. Upon roll call, the vote was:

Moved by Prickett, seconded by Wagner, to authorize City Clerk
to open only bid received for proposed sidewalk on Nimitz
North Shore and Eisenhower. Total Bid, $16,552.34 quoted
at $1.37 per square foot by Capitol Cement Co., Inc.
Moved by Wagner, seconded by Koplos, to reject the bid
aforementioned and return bid check. Motion declared Carried.
Moved by Wagner, seconded by Hinde, to authorize City Engineer,
City Attorney, City Comptroller, and Mayor to negotiate
contract for proposed sidewalk aforementioned. Motion
declared Carried.
Mayor Behrel reviewed with Council results of research
conducted regarding recent 1970 Census figure - copies to
be submitted to Council.
APPOINTMENT` Moved by Prickett, seconded by Thomas, to concur with Mayor
Behrel's appointment of Alderman Morgan O'Brien to the
following Committees, filling vacancy caused by recent death
of Alderman Figard: Building and Grounds, Sanitation,
Water, Judiciary, Special Historical Society, and naming
Alderman Thomas as Chairman of the Water Committee. Motion
declared Carried.

Alderman Shillington's request for investigation of the
recent flooding in the eighth ward - 500 block of Kathleen,
200 block of Westmere, Corner of Beau and Kathleen and
portions of Sandy Lane was referred to the City Engineer
and Commissioner of Public Works.
Alderman Czubakowski's request to prohibit parking on the
south side of Everett between Ash and Mannheim and limit
parking on the north side only was referred:to the Traffic
Comm:kssion for study and report.
Alderman Czubakowski's request for investigation of parking
of boats on a public street to determine its legality was
referred to the Police Chief for further study and investigation.
Moved by Shillington, seconded by Swanson, that the regular
meeting of the City Counci adjourn. Motion decl d Carried.
