MINUTES OF THE REGULAR COUNCIL MEETING OF THE
CITY COUNCIL OF THE CaTY OF DES PLAINES, ILL.
HED IN THE COUNCIL ROOM, CITY HALL, MARCH 1,
1965 at 8:00 P.M.
CALL TO ORDER: The meeting was. called to order by Mayor Herbert H. Behrel, with
Alderman Luellen, leer, Shillington, Figard, Czubakowski, Swanson, French,
Martin, Bonaguidi, Szabo, Prickett, and Wright responding.to roll call.
The meeting was opened with a prayer by the Mayor and a pledge of allegiance to
the flag. •
APPROVAL OF MINUTES: On motion by Alderman Prickett and second by Wright, the
Council approved the minutes of February 15, 1965.

OFFICIAL REPORTS: The Clerk submitted the report of the Health Officer,: Building
Commissioner and Director of Civil Defense for February. The Comptroller submitted
the annual report for 1964.
Alderman Leer presented a petition from people in the area of Oak Leaf Commons
regarding a variation for height of building granted May 14, 1964. This was over
six months past and on motion by Alderman Leer.and second by Czubakowski the
petition was referred to the Building Control and Inspection Committee and City
Attorney. ,
Alderman Rateike appeared at this time. -
CITY PLANNER CONTRACT: Alderman Martin presented the above contract and made the
following report: ,"Your Committee, on Municipal Development, has investigated the
above and, has found the City is in need of a plan for updating. We, your
Committee on Municipal Development therefore recommend Tec -Search, Inc. be
engaged as Planning Consultants. Copy of contract is here attached. We hereby
recommend that the Mayor and City Clerk be authorized to sign said contract."
The motion was made by Alderman Martin and seconded by Prickett to approve the
report. After considerable discussion the motion was made by Alderman Swanson
and seconded by Czubakowski to table the report for two weeks., The Mayor put
the question and the Clerk called the roll with the following results: Ayes:•
Alderman Rateike, Wright, Luellen, Leer, Czubakowski, French,, and Swanson. Nays:
Alderman Millington, Figard, Martin Bonaguidi, Szabo and Prickett. The Mayor
voted "no" and declared the motion lost.
The Mayor put the question on the previous motion, and the Clerk called the roll
with the following results: Ayes: Alderman Szabo, Wright, Prickett, Luellen,
Leer, Shillington, Figard, Carroll,, Czubakowski, French, Martin and Bonaguidi.
Nays: Alderman Swanson and Rateike. The Mayor declared the motion carried.

AWARD BID ON SQUAD CARS: The motion was made by Alderman Figard and seconded
by Prickett to award the /hove bid. to Jim Aikey Ford Inc. for -$282.00 without
gas and .03 per mile for excess mileage. The Mayor put the question and the
Clerk called the roll with the following results: Ayes: Alderman Rateike, Szabo,
Wright, Prickett, Luellen, leer, Figard, French, Swanson,.Martin and Bonaguidi.
Nays: Alderman Shillington and Czubakowski. The Mayor declared the motion carried.
On motion by Alderman Martin and second by Luellen, regarding granting car wash'
companies permits, this was referred to the Building Control and Inspection
Committee.
TO ADVERTISE BIDS FOR SEAL COATING STREETS:, On motion by Alderman French and
second by Leer, the Council approved to advertise above bid to be returned
April 5th.
PARKING ON WOODLAWN ANDICTEER STREETS: On motion by Alderman French and second
by Shillington, the above parking study was referred to the Traffic Commission.
APPROVE AUSTIN CO. DRIVEWAY: Alderman French made the following report: "Your
Caanmittee on Streets and Traffic has investigated the above and has found
request is for a 24! driveway. (flare .to 50') into Miner St. (U.S. 14) and a 221
(flare to 50') driveway into Rand Rd. (U.S. 12). We, your Committee on Streets
and Traffic, therefore recommend Supt. of Public Works issue permits for these
driveways if he finds that required State permits have been obtained." On
motion by Alderman French and second by Swanson the Council approved the above
report.
APPROVE DRIVEWAY OF FIIZiORE CONSTRUCTION CO.: On motion by
second by Martin the above driveway was approved.

APPROVE DRIVEWAY FOR D. J. VELA CO.: On motion by Alderman
by Martin the above driveways were approved.
Hooding of parking meters east side of lee St. to Thacker St. Friday nights and
Saturday mornings was referred to the Street Committee.
The motion was made by Alderman Figard-and seconded by Shillington to grant use
of water to a company purchasing the Benjamin Electric Building. After dis-
cussion,,the motion was withdrawn.

AWARD BID FOR CLEANING CATCH BASINS: Alderman Luellen made the following report:
"Your Joint Committees on Sewers and Finances has investigated the above and
has found Town and Country Services'of Harvey, Ill.submitted the low bid of
$4.90 per basin, however investigation shows his equipment does not meet our
specifications and furthermore Mr. Schou has asked the Superintendent of Public
Works to withdraw his bid. We, your Committee end Sewers and Finance therefore
recommend the second low bidder - City Sanitary Services of Wilmette, at $4.90
and who meets all specifications be awarded the contract for cleaning catch
basins - the checks of the unsuccessful bidders be returned." The motion was
made by Alderman Luellen and seconded by Prickett to approve the report. The
Mayor put the question and the Clerk called the roll with the following results:
Ayes: Alderman Rateike,liSzabo, Wright, Prickett, Luellen,'Leer, Shillington,
Figard,`Czubakowski, French, Swanson, Martin and Bonaguidi. Nays: None. The
Mayor declared the motion carried.
O. and N. 11. ZONING CASE: Alderman Bonaguidi made the following report: "Master
of Chancery Sidney 1Wolf ';has filed his Master's report recommending a decree
against the City in the Chicago and Northwestern Railway zoning case. The, City
has until March 17, 1965 to file objections and a hearing thereon has been set
for March 24. After reviewing the Master's report and conferring with both
Attorney John Burke,:whe has been handling this for the .City, and the City .
Attorney, the Judiciary Committee recommends :that Mr. Burke be authorized to
file objections to the Master's report and exceptions thereto, to argue same
and to prosecute the matter fully through the trial level. If an adverse decree
is entered, your Committee recommends that an appeal be filed to the Illinois
Appellate Court." After discussion the motion was made by Alderman Bonaguidi
and seconded by Luellen to approve the report.; The Mayor put the question and
the Clerk.called the roll with the following results: Ayes: Alderman Szabo

KUNTZE ZONING CASE: Alderman Bonaguidi made the following report: "Judge Walker
Butter has entered a decree in favor of Kuntze against the City in the Kuntze
. zoningcase, in accordance with the recommendations of the; Master in Chancery..
After reviewing the matter with the city Attorney, your Judiciary Committee re-
commends that an appeal be filed to the Appellate Court of Illinois by the City
Attorney." The motion was made by Alderman Bonaguidi and seconded by Shillington
:to approve the report. The Mayor put the question and the Clerk called the roll
with the following results: Ayes: Alderman Rateike, Szabo, Wright, Prickett,
Luellen, Icer, Shillington, Figard, Czubakowski, French, Swanson,. Martin and
Bonaguidi. Nays: None. The Mayor declared the motion carried,:
BOECKENKAUER ANNEXATION CASE: Alderman Bonaguidi made the following report:
"As previously announced by the City Attorney, Judge Dougherty has entered an
order firing that the annexation ordinance of the Boeckenhauer property was
invalid and after discussing the case with the City Attorney, your Judiciary
Committee recommends that an appeal be filed to the Appellate Court of Illinois
by the City Attorney." The motion was made by Alderman Bonaguidi and seconded
by Swanson to approve the report. The Mayor put the question and the Clerk
called the roll withthe following results: Ayes: Alderman Rateike, Szabo,
Wright, Prickett, Luellen, leer, S^hillington, Figard, Czubakowski, French, Swanson,
Martin and Bonaguidi. Nays: None. The Mayor declared the motion carried.

TRANSFER OF SALES TAX FUNDS: On motion by Alderman Prickett and secondly
Rateike, the Council approved to transfer the Sales Tax Furls to the following
departments. Corporate - $99,797.63: Street - $28,136.73: Street Lighting -
$14,423.09: Sanitation - $15,489.66: Fire - $9,763.11 and Enployees Retirement -
$10,727.51.
CASE 65 -5 -RV ZONING BOARD REPORT WIC,c: AVE. AND WEBSTER LANE: The Zoning Board
recommended that the rezoning from R-2 - R-4 with a variation from 2800 square.'
feet to 2250 feet, be denied. On motion by Alderman Luellen and second by
French, the Council concurred in the report.

LIQUOR REQUEST HOWARD JOHNSON'S RESTAURANT: The above request was referred to
the License and Inspection C ommittee.
O'HARE ZONING REGULATIONS: An ordinance on the above was referred to the'
Special Aeronautics Committee and City Attorney.
At request of Alderman French traffic on Maple St. from Howard to Touhy was re-
ferred to the Traffic Commission for study.
At Alderman Shillington's request stop signs for Kathleen end Marshall was re-
ferred to the Traffic Commission for study.
