J.(He ich, City Clerk REGULAR MEETING CF THE CITY COUNCIL DES PLAINES, ILLINOIS.HEID IN THE COUNCIL ROOM, CITY HALL, FEBRUARY 20, 1961 AT 8:00 P.M. The meeting was called.to order by Mayor Herbert H. Behrel with Alderman Neff, Moehling, Flauter, Figard, Prickett, Tistle, Massman, Bell, Jackson, Rateike, Blume, Tures and Wright responding to roll call. The Mayor introduced;Mrs. J. West and James Bauer of the Safety Council, who. have done excellent service on the Safety Council. APPROVAL OF MINUTES: The motion was made by°Alderman Figard and seconded by Rateike to approve the minutes of February 6, 1961. The motion was voted upon by acclamation.' OPEN BIDS FOR POLICE AUTOS RENTAL: On motion by Alderman Rateike and second- ed by Blume, the Clerk was -instructed to open the above bids. Three bids received: Maine Leasing Company per month $298.00 Kuhlman and Nabel per month 335.00 'Holmes Motor Co. per month 315.00 On motion by Alderman Tures and'seconded by Wright the bids were referred to the Police and Finance Committees. The Mayor declared a recess and after reconvening'the motion was made by Alderman Turfs and seconded by Blume to award the bid to the Maine Leasing Corporation. The Mayor put the question and the Clerk called the roll with the following results: Ayes: Alderman Rateike, Blume, Wright, Tures, Neff, Moehling, Flauter, Figard, Prickett, Tistle, Massman, Bell and Jackson. Nays: None.' The Mayor declared the motion carried. OFFICIAL REPORTS: The Clerk submitted the report of the City Treasurer and Comptroller for January. Also the annual report of the Safety Council. Engineer Fletcher gave a report on new sewers with a showing on a blackboard of the sewers. Thacker Street sewer is to be paid partly by the County and Motor Fuel Tax. The motion was made by Alderman Tures and seconded by - Jackson to give Fletcher $75.00 to attend meeting at Springfield. The Mayor,put the question and the Clerk called the roll with the following results: Ayes: Alderman Rateike, Blume, Wright, Tures, Neff, Moehling, Flauter, Figard, Prickett, Tistle, Massman, Bell and Jackson. Nays: None. The Mayor declared the. motion carried. DES PU.INES E UIPMENT COMPANY : Alderman Bell made the following report: "Your committee on Municipal Development has investigated the above and has found petitioner requests permission to remove 14 large trees, fill and grade the land and erect a sign in conformance with existing city ordinances. We'assume the petitioner owns the property in question in which case no permission is required to remove trees, fill and grade land and erect a sign as proposed. We, your Committee on Muhicipal Development therefore recommend petitioner be notified that the City is averse to the removal of trees from Public z operty, particularly for the erection of signs and should the property'in question belong to the city, the petition be denied. In the event the petitioner now owns the property, no.approval of his request is necessary." 141 -2- 2/20/61 On motion by Alderman Bell and seconded by Prickett the Council concurred in the report. KUNZE REQUEST TO VACATE PART OF MILLER ROAD: Alderman Bell made the following report: "Your Committee on.Mumicipal Development has investigated the above and has found Miller Road is presently used as a throughfare between Elmhurst Road and Marshall Street and a xtends both east and w est 'from the portion requested to be vacated. No reason was given for this request and t:he'Committee could determine only that inconvenience for users of this street would result from this vacation. We, your Committee on Municipal Development,- therefore _recommiend the request for vacation of Miller Road between Marshall Street and Elmhurst Road be denied." On motion by Alderman Bell and seconded by Blume the Council concurred in the'report. CHICAGO FAUCET COMPANY APPROVED: Alderman Bell made the following report: "Your Committee On Municipal Development has investigated the above and has' found property is properly zoned "I-2" At its present site on Pulaski Avenue near Diversey Avenue in Chicago, residents in the surrounding area have:had no complaints of nuisance created by this company. Chicago Faucet' Company would prove a valuable, addition to the Industrial Area west of the City. We, your Committee on Municipal Development,'therefore recommend approval of the construction of a plant for the Chidago Faucet Company at the above location." On motion by Alderman Bell and seconded by Prickett the Council approved the report. REZONING 661-741 S. EI HORST ROAD DENIED: Alderman Bell made the following report: "Your Committee on Municipal Development has investigated the above and has found Zoning Board recommends denial of this petition. At the time of annexation and. subdivision petitioner represented this property as single family and no mention was made of rezoning at that time. Evidence proving multi -family zoning is necessary or essential at this time and location was not proven. We, your Committee on Municipal l)evelopinent therefore recommend recommendation of the -Zoning Board to d eny rezoning be upheld." On.motion by Alderman Bell and seconded by Prickett the Council concurred in the report. REZONING N.E. CORNER THACKER AND EIMHURST ROAD DENIED: Alderman Bell made the following. report: "Your Committee.on Municipal Development has investigated the above and has found Zoning Board recommends denial of this petition,, Two objectors with petitions signed by 103 rfsidents of the area were present. The size of the area (100 X 150 ft.) precludes the use of the property for any use other than a gas station, although no use was proposed. While the Committee realizes this property will probably eventually be commercial, we prefer' to see some intended usage before rezoning this corner.. We, your Committee on Municipal Development, therefore recommend the recommendation of the Zoning Board be upheld and the petition to rezonethis property to C-3 be denied." On motion by Alderman Bell and seconded by Blume the Council approved the report. ANNEXATION OF U. S. GYPSUM COMPANY:,Alderman Bell made the following report: "Your Committee on Municipal Developent has investigated the above and has found the industry is one which will benefit the city of Des Plaines both from an esthetic and an economical viewpoint. There are no noisesor odors connected with this industry. We, your Committee on Municipal Development, therefore recommend the annexation petition of U. S. Gypsum Company be approved along with the annexation of the Public Service and Soo Line property." On motion by Alderman Bell and seconded by Blume the Council approved the report. FOREST MANOR PIAT APPROVED: The motion was made by Alderman -Bell and seconded by Prickett. The Council approved the Forest Manor Plat and the Mayor and City Clerk to be authorized to sign'plat. TOUHY-MANNHEIM INDUSTRIAL PLAT APPROVED: 'Alderman Bell'made the following report: "Your Committee on Municipal Development has investigated the above and has found subdivision is for north section of Premier Rose Garden property previously zoned industrial except for a portion along Howard Street 9 1 2W -3- 2/20/61 zoned multi -family. Plan Commission has approved the subdivision. J. Emil Anderson has presented a letter promising to pave their section of Howard Street upon applying for a building permit for the multi-family'development and this agreement will be part of any sales contract involving this property. We, your Committee on Municipal Development therefore recommend approval of the subdivision as shown. Mayor and City Clerk be authorized to sign the plat." On motion by Alderman Bell and seconded by Blume the Council approved the report. PARKWAYS DES PLAINES SUB. PLAT APPROVAL: Alderman Bell made the -following report: "Your Committee on Municipal Development has investigated the above and has found Plan Commission has approved -the subdivision. Subdivision consists of 17 lots in Orchard Place previously requested to be rezoned for multi -family but denied by the Council. Present Subdivision retains the single family status. We, your Committee on Municipal Development therefore recommend approval of 'subdivision as shown. Mayor and City Clerk be authoriz- ed to sigh plat upon receipt of bonds to cover improvements. Also that the City Clerk notify the petitioner that a Gregory Lane already a xists in the city and to present another name-for.this street." On motion by Alderman Bell and seconded by Massman the Council approved the report. REZONING S.M. CORNER ELMHURST AND THACKER: ''Alderman Bell made the following report. "Your Committee on Municipal Development has investigated the above and has found Zoning Board has recommended denial of this -rezoning. The pro- posed usage is either for a shopping center or an office building - both transactions still in abeyance pending the action of the Council. There were no objectors to this rezoning. It is unrealistic to insist on single family development on the corner of Route 83 and Thacker and extremely doubtful such a case could successfully be defended in court. We, your Committee on Municipal Development, therefore recommend rezoning of this property from. single family residential to C-3 be permitted." On motion by Alderman Bell and seconded by Blume'the rezoning was referred back to the Zoning Board.. TO ADVERTISE BIDS FOR STATION WAGON FIRE DEPARTMENT On motion by' Alderman Tistle and seconded by Rateike the Council approved to advertise bids for Fire Department station wagon with bids returned March 20th. REPAIR FURNACE - $730,00: Alderman Rateike made the following report: "Your Committee on Building and Grounds has investigated the request of Supt. Wernicke in regard to the furnace breakdown in the sewer and water department building. The furnace was beyond repair, this was 'acknowledged by inspection of two furnace men. Bids were requested 'from local heating firms and the committee received four. The request was for a gas fired furnace. Bids are in the file of our Supt. of Public Works for inspection if anyone 80 desires. We, your Comamittee'on Building and Grounds therefore recommend that the low bid of Toay Heating Company, Des Plaines, Illinois fora total of $730.00 be accepted and being an emergency the Council sanction the committee's action on authorizing the expenditure and installation of this work." The motion was made by Alderman Reteike and seconded by Moehling to approve the report. The Mayor put the question and 'the Clerk called the roll with the following results: Ayes: Alderman Rateike, Blume, Wright, Tures, Neff, Moehling, Flauter, Figard,-Prickett, Tistle, Massman, Bell, Jackson. TO ADVERTISE BIDS EIECTRIDAL WORK AT CITY GARAGE: On motion by Alderman Rateike and seconded by Bell, the Council approved to advertise bids for electrical work at northwest building at 'Garage. Supt. Wernicke is to draft specifications. TO ADVERTISE BIDS FOR :PUMP FOR WELL NO. 6: On motion by Alderman Tures and seconded by Wright the Council approved to advertise bids for pump for Well No. 6 to be returned March 6th. AWARD BID REPAIR WELL NO. 3 TO L. CLIFF NEEIEY - $5.147.25: The motion was made 43 -4-. 2/20/61 by Alderman Tures and seconded by Wright to award the L. Cliff Neeley the bid for repair of Well No. 3 and the other checks to.be.returned. The Mayor put the question and the Clerk called the roll with the following results: Ayes: Alddrman Rateike, Blume, Wright, Tures, Neff, Moehling, Flauter, Figard, Prickett,-Tistle, Massman, Bell, and Jackson. ATTORNEY DOWD RETAINED FOR CITIZENS BANK AND TRUST'CASE: The motion was made' by Alderman Neff and seconded by Moehling to retain Attorney Dowd for rezoning case of Citizens Bank and Trust Coipany. The Mayor put.the question and the Clerk called the roll with the following results:, Ayes: Alderman Rateikei Blume, Wright, Tures, Neff, Moehling, Flauter, Figard, Prickett, Tistle, Massman, Bell and Jackson. Nays: None. The Mayor declared the motion carried. TWO LIQUOR LICENSES - NO ACTION BE TAKEN: Alderman Jackson made the following report regarding liquor license for Cesarts Pizza Restaurant,l8$l Oakton and La Cantina, 1062 Lee Street: "Your Committee on License and Inspection has investigated the .above and has found these licenses would necessitate the drafting of. a new ordinance to provide a beer and wine classification. That these restaurants seem to be doing good business without them. That such .an ordinance would open the way to..such requests from numerous other restaurants,etc. We, your Committee on License and Inspection, therefore recommend that no action be taken on these applications." The motion was made by Alderman Jackson and seconded by Rateike to approve the report. On motion by Alderman Massman and seconded by Moehling, the request for license by La Cantina, 1062 Lee Street was referred back to the Committee. NO LIQUOR LICENSE FOR WALGREENS: Alderman Jackson made the following report: "Your Committee on license and Inspection has investigated the above and has found that Walgreen Company is willing to transfer their downtown license to the Lee and Cakton site, at a later date, but that they wish a license .for the Elmhurst road location now. We would like to see them transfer the exist- ing permit to Elmhurst at this time and'have the Oakton application considered on its own merits at a later date. We would be in favor of such a transfer. We, your Committee 0 License and Inspection, therefore recommend that the Council concur in -the above, and that no new C lass "B" license be issued at this time." On: motion by Alderman Jackson and seconded by Prickett the Council concurred in the report. APPROVAL OF BILLS: Alderman Prickett presented the following resolution: BE IT RESOLVED BY THS CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORiztD TO MASE PAYMENT FOR SAME. The motion was made by Alderman Prickett and seconded by Figard to adopt the' resolution. The Mayor declared the motion carried. RESOLUTION TO CONDEMN PROPERTY: The Clerk read the resolution to condemn part of Des Plaines Countryside Subdivision for park and playground purposes. The•motion was made by Alderman Massman and seconded by Tistle to adopt the resolution. DES PLAINES LUMBER AND COAL CO. IE21'JR REGARDING CAR WASH: The above letter was referred to the Water Committee. TO ADVERTISE BIDS FOR REPAIR OF SIDEWALKS: On motion by Alderman Wright and seconded by Jackson the Council approved to advertise bids for repairing videwalks. At Alderman Moehlingts request the Mayor referred to the Sewer Committee the report of Engineer Fletcher about Thacker Street and other Streets' sewers.
