Police Chief Kennicott reported the capture of young man who robbed the North School and this was due to the training the police had on finger printing. . REZONING'DENIED SOUTH SIDE TOUHY CONTIGUOUS -TO TWO LOTS WEST OF MOTEL AT RIVER ROAD: .Alderman Bell made the following report: "Your Committee on Municipal Development has investigated the above and has found Zoning Board has recommended rezoning from single family to Commercial C-2. While the Committee realizes this property will eventually be commercial, the petitioner has no proposed usage in mind. It has been the policy of this 136 -2- 2/6/61 Committee to require some proposed usage'of property before rezoning, in order to exercise some control over the desirability of the.commerce'to be intro- duced. We, your Committee og Municipal Development, therefore recommend Zoning to C-2 be denied.Petitioner be advised that the Committee will be pleased to reconsider the matter when some intended usage is proposed." On motion by Alderman Bell and seconded by. Blume, the Council approved the report. Alderman Bell reported the followings "Resolution fof instigating con- demnation proceedings. to condemn the property for park and or playground. 3-1/2 acres west of Peterson bane and East of Junction'of Patton and Craig Drive. Tour Committee'on Municipal Development has investigated the above and has found property is contiguous to Peterson Lake and ideally suited for park property. HOSPITAL ZONING:, On motion by Alderman Bell and seconded by Figard, the Clerk is to write a letter to the Couhty Zoning Board that the City c ouncil protests the rezoning for addition• to the hospital west of the Des Plaines River south of Rand Road but do not oppose a variation. At Alderman'Tures' request, 'the Attorney is to redraft loitering ordinance. THE,YAR COMPANY DRi SWAY REQUEST:, 'Alderman Jackson reported the Yar Company had received State approval for driveway ezidorecoMmended approval for drive- ' way. On motion by Alderman Jackson and seconded by Bell the Council approved the driveway. MILL STREET PARKING:, Alderman Jackson made the following report: "Your Committee on Streets and Traffic has investigated the above and has found 1), that a 3 hour limit now exists along the entire length of Mill Street (1 block) 2) that the -restriction was imposed prior to the opening of the North School. 3) That the restriction was imposed because of a commuter parking nuisance. 4) That the residents feel that because of the parking lot that they can get along without the restriction. We, your Committee on Streets and Traffic, therefore recommend that the City Attorney be in- structed to draw the necessary ordinance adding Mill Street to the Alternate Year Parking Ordinance. On motion.* Alderman Jackson and seconded by Bell the Council approved the report. BESTMAN WATER -MAIN: Mr. Bestman had received permission to install a'6 inch water main to connect with the Potter -Meadow Mprovement Assn. main on the northwest corner of Potter and Ballard Road. This is approximately 285 feet. He requested permission from the City to install this main. On motion by Alderman Tures and seconded by Callaghan, the Council granted permission. TO ADVERTISE BIDS TO REPAIR WELL NO. 4 On motion bysAlderman Tures and seconded by Figard, the Council approved to advertise bids to be returned March 6th for repairing Well.No. 4. AGREEMENT ON s' IN MT. PROSPECT ROAD: Alderman Moehling made the follow- ing report: "Your Committee on Sewer has investigated the above and has found: The sewer is a 24 inch.main running down Mt. Prospect Road to Algonquin Road and down Algonquin west to Pennsylvania Avenue. Although this sewer has already been installed, the present contract will permit Algonquin Residential Corporation, owners of Capitol Hill development to recoup one-half of` the total cost of the sewer, that is, one-half of $152,452.02 or $76,225.51 from the users of the sewer who tie-in to the sewer main after December 31, 1960. The other half of the cost of the sewer has been paid by Algonquin Residential Corporation, for use by them for 212 acres of their development. Specifically exempted from payment of the tap -on fees is (1) Westfield"Gardens Subdivision (2) eleven acres at the Southwest corner of Mt. Prospect and Algonquin Roads, recently annexed to the City of Des Plaines, and (3) Universal 0i1.Products Company at 1, 37 -3- A lgonquin and Mt. Prospect Roads. All others tying into the sewer would pay a tie-in rate of $500.00 per acre, plus a 10% increase per year after 1960 to a maximum of five years. When the balance of $76,225.51 is paid by such tie-in fees or after twenty years, the City of Des Plaines would then acquire exclusive ownership of the sewer. The City would be required to maintain and repair the sewers in the interim. The contract further provides that upon payment of the connection fee, the corporation shall issue a receipt and a "releasee which can be taken to the City Clerk and if all of the City's ordinances have been complied with, the City, shall issue a permit for connection to the sewer, the corporation having the right to issue a release not only for sewers with respect to land lying within the corporate boundaries of Des Plaines. "We, your Committee on Sewer, therefore recommend='In view of the fact that the City acquires an extension to its sewer service by this equitable arrangement with the corporation which installs the sewer and the City there- by acquires a sewer of adequate size to permit further development of the City with a desirable sewer system and in view, further, of the fact that the contract enables the corporation who installs the sewer to be made whole for installing a sewer of a size greater than necessary to serve its own individual development, City thereby is benefited by entering into a mutual arrangement of this character and the corporation is reasonably compensated. "However, in order for the City to exercise a degree of control over the number and size of.the tieAins to these sewers. and. thereby prevent over- loading these facilities, -it. is recommended that an additional clause be inserted on page -7, line 10, after "with" as follows: and the City Engineer shall certify to the Building Commissioner prior to issuance of the permit that the sewer has sufficient capacity t� accommodate the additional load - - . With the further insertion of the above provision, it is recommended that the City'enter into•the contract with Algonquin Residential Corporation and that the City Clerk and Mayor be authorized to sign the contract." -The motion was made by Alderman Moehling and seconded by -Tistle to approve the report to enter in the contract. On motion by Alderman Neff and seconded by Jackson to amend thee =tract paragraph No. 1 of section'3 to add "or any subsidiaries" thereof back of Universal Oil Products Company was approved by Council. On motion by Alderman Neff and seconded by Callaghan, the Council approved to amend the contract by adding after connection "without tap -on fee" in paragraph, section 3. ZONING VARIATION: The Clerk reported of Zoning Board action on six zoning variations. TRAFFIC COMMISSION REPORT: The Clerk read the report on traffic hazards of North School." Recommendations: 1) Rand Road, between Hawthorne St. and Grove St: This crossing area is outside the Des Plaines city limits and therefore outside the jurisdiction of this commission. The Illinois State Department of Highways is presently considering this situation. , No recommendation. 2) River Road at Perry Streets Recommend signs limiting speed to "20 MPH on school days when childrel@; are present" on River Road approaching Perry Street. In addition, we recommend regular and frequent police radar speed checks to keep traffic within'posted limits during times crossing is being used by school Children. 3) Lee Street at Perry Street: Protection,for school children at this crossing consists of a crossing guard, school crossing signs and a 30 MPH speed limit on Lee Street. This appears to be adequate protection. However, We recommend that the "School Cross Walk" signs on Lee'Street be raised 18 to,24 inches to make them conspicious to motorists." //s/ Henry P. PARKING HOURS ON ELLINWOOD EAST OF PEARSON ST.: A letter from Sims Bowl regarding changing the parking to two hours was referred to the Street Committee. LETTER FROM DES PLAINES EQUIPMENT COMPANY, MANNHEIM ROAD regarding im- proving the neighborhood, was referred to the Municipal Development Committee. RESIGNATION'OF HARRY KINSER AS DIRECTOR OF CIVIL DEFENSE: The Mayor in- formed the Council he had received -the above letter and comanented on the fine service performed by Mr. Kinser on Civil Defense. DES PU.INES E UIPMENT COMPANY : Alderman Bell made the following report: "Your committee on Municipal Development has investigated the above and has found petitioner requests permission to remove 14 large trees, fill and grade the land and erect a sign in conformance with existing city ordinances. We'assume the petitioner owns the property in question in which case no permission is required to remove trees, fill and grade land and erect a sign as proposed. We, your Committee on Muhicipal Development therefore recommend petitioner be notified that the City is averse to the removal of trees from Public z operty, particularly for the erection of signs and should the property'in question belong to the city, the petition be denied. In the event the petitioner now owns the property, no.approval of his request is necessary."
