09/19/1960-4- 9/6/60 and Inspection Committee. The Mayor made a progress report regarding the City's taking legal action on the Cook County Zoning Amendment. PETITION REGARDING USE CF HARDING AVENUE: The Mayor received a petition from five companies regarding use of Harding. Avenue, for traffic. The Mayor referred the petition to the Streets and Traffic Committee. PETITION FOR SIDEWALKS ON HOWARD STREET: On motion by Alderman Tistle and seconded by Wright, the petition for sidewalks to be installed as requested, was granted. Alderman Neff did not vote. SEWER ON WHITE ST.: At the request of Alderman Bell, sewer condition on White Street south of Everett was referred to the Sewer Committee. THE' MINU'T'ES OF THE ADJOURNED MEETING OF THE CITY COUNCIL HELD IN THE COUNCIL ROOM CTTY HALL,'SEPT. 19, 1960 at 8:00 P.M. CALL TO ORDER: The meeting was called to order by the City Clerk due to. the absenceof the Mayor with Alderman Rateike, Blume, Tures, Wright, Moehling, Flauter, Prickett, Tistle, Massman,. Bell and Jackson responding to roll call. On motion by Alderman Tures and seconded by Tistle the Council approved the appointment of Alderman Prickett as Mayor pro tem. Alderman Neff appeared at this time. APPROVAL OF MINUTES: On motion by Alderman Blume and seconded by Massman, the Council approved the minutes of September 12th meeting after one correction of including a no vote made by Alderman Neff on adoption of temporary sign ordinance. OFFIC IAL REPORTS: The Clerk submitted the report'of Treasurer D. Eichner for - A ugust. Alderman Rateike reported oh seven items totalling 058.00 as extras on the remodeling. The motion was made by Alderman Rateike and seconded by Bell to -approve the items for payment. The Mayor pro tem put the question.and the Clerk called the roll with the following results: Ayes: Alderman Rateike, Blume Wright, Tures, Neff, Moehling, Flauter,lPrickett, Tistle, Massman, Bell and Jackson. Nays: None. The Mayor pro tem declared the motion carried. SUBURBAN OIL COMPANY AWARDED FUEL OIL CONTRACT: The motion was made by Alderman Rateike' and seconded by Bell to award the Suburban Oil Company the fuel oil contract at 3.4 cents less. The Mayor pro tem put the question and the Clerk called the roll with the following results: Ayes: Alderman Rateike, Blume, Wright, Tures, Neff, Moehling, Flauter, Prickett, Tistle, Massman, Bell, and Jackson. Nays: None. The Mayor pro tem declared. the motion carried. Alderman Rateike reported the Police Station open house would be on October 23rd, 1960. AIR CONDITIONING: Alderman Rateike reported that the Architect's fee for air conditioning the. City Hall would, be about $2,500.00. The item was•re- ferred to the Building and Grounds and Finance Committee. -2 9/19/60 NRW WELL: On motion by Alderman' Tures and seconded by Massman, the Council approved that Engineer Fletcher prepare specifications for a new yell, was approved by the Council. The Finance and Water Committees are to meet regard- ing financing. TO ADVERTISE FOR BIDS FOR SEWER ON WHI'L'E ST.: On motion by Alderman Moehling and seconded by Tistle, the'Council approved that Engineer Fletcher draft plans and specifications for storm sewer oft White Street from Everett.to Prospect and advertise for bids to be returned October 17th. CONVALESCENT HOMES: Alderman Neff made the following report: ""Should the business of operating rest homes, convalescent homes, and old age homes as a commercial enterprise be permitted in R-4 multi -family districts, your Committee on City Code has investigated the above and has found in the last few years the City Council'has received in three different instances, complaints from neighbors of rest homes or convalescent homes which were operating in multi -family or R-4 areas. Lawsuits between the city and the operator of the home resulted in two cases; the police stopped the operation in the third case. No complaint has been r eceived in any instance where a convalescent or old age home was operated in a commercial district. In the present matter, no public organization appeared and requested this zoning change. No individual appeared except the part owner of anexisting home, who said this change in the zoning ordinance would help her get a new mortgage. She wanted the new mortgage to pay up the existing debt on her building since she had been offered more favorable terms in such event. She stated the mortgage lender refused to give her a loan unless she would obtain this change in the Des Plaines zoning ordinance. The committee found that the rest home operated by this individual has the; legal right to operate at its present location and -has not been dis- turbed in its operation by the city in anyway.. The committee did not feel that on these facts this type of business should be permitted to go into any apart- ments area anywhere in the city. The Committee therefore recommends that no change be made in the zoning ordinance at this time to permit this type of business in an R-4 residential district." On motion by Alderman Neff, and seconded by Jackson, the Council approved the report. APPROVAL OF BTTLS:' Alderman Bell presented the following resolution& BE IT RESOLVED BY THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CIERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME: Total: $17,830.68. (A copy. of resolution presented to each Alderman and on file with the City Clerk.) The motion was made by Alderman Bell and seconded by Massman to adopt the resolution. DISCONNECTION GOLF AND POTTER: Attorney Dowd requested the disconnection ordinance for the above be referred to the Municipal Development Committee. SAFETY COUNCIL LETTER: A letter from the Safety Council regarding hazardous condition of sidewalks at. Des Plaines River near Rand and Miner Street was referred:te the Street Committee. UNITED MOTOR COACH BUS STOP: A letter from the Safety Council regarding changing bus stop from the N. E. corner Miner and Des Plaines Avenue to, the N.W. corner was referred to the Street Committee. ADOPT RESOLUTION ON SIDEWALKS,: On motion by Alderman Massman and seconded by Jackson, the Council .adopted the State Highway resolution regarding sidewalks installation at Golf and Wolf Roads, south of C. and N.W. Railway. REZONING APPLICATION ESTES AVENUE AND E. RAILROAD AVENUE: On motion by Alderman T istle and seconded by Blume the application has been referred to the --3- 9/19/60 Zoning -Board of Appeals sitting as a Commission to call a hearing. REZONING APPLICATION• 1700 TOUHY AVE.: The above application was referred to the Zoning Board of Appeals, sitting as a Commission.to call a hearing on motion by Alderman Tistle and seconded by Bell. ZONING VARIATION ON TOUHY AVENUE: On motion by Alderman Tistle and seconded by Massman the above application was referred to the Zoning Board of Appeals sitting as a Commission to call a hearing. ZONING VARIATION N.E. CORNER PEARSON AND THACKER ST.: On motion by Alderman Bell and seconded by Massman the above application was referred to the Zoning Board of Appeals, sitting as a Commission to call a hearing. MEYER ON 1 PROVING•MAPIE ST. The above letter was referred to the Street Committee. PETITION AND -LETTER ON TWO HOUSES: A letter from V Riverview Civic Club and petition from property owners about two homes uncompleted were referred to . Attorney Dowd. At Alderman Bell's request the Pratt Avenue sewer was referred to the Sewer Committee. At Alderman Bell's request a driveway condition at River Raid and Touhy was referred to Supt. Warnicke. At Alderman Bell's request Supt. Warnicke is to check the garbage dump west side of River Road, south of Toll Road. At Alderman Rateike1s request a license for trampolines was referred to the Code Committee and City Attorney.
