REGULAR MEETING OF THE CITY COUNQILL
OF DES PLAINES, ILLINOIS HELD
IN COUNCIL ROOM CITY HALL
JULY 18, 1060 at 8x00 P.M.
CALL TO ORDER. The meeting was called to order by Mayor Herbert H. Behrel,'City Clerk
Henrich being absent the Deputy Clerk called the roll with the following results:
Alderman Jackson, Blume, Tures, Wright, Neff, Moehling, Flauter, Figard, Prickett,
Tistle, Massman and Bell. Alderman Callaghan and Rateike being absent.
APPROVAL OF MINUTES. The Motion was made by Alderman Prickett and seconded by
Bell to correct Alderman Moehling's bid to Aye on the Warning System and then to
approve the minutes of adjourned meeting of July 11, 1960. The motion was voted
upon by acclamation.
OPEN BIDS REPAIR WELL #2. On a motion by Alderman Prickett and seconded by Blume
the Deputy Clerk was authorized to open the following bids:

Boyd and Storm, Chicago, I11. 5,693.00
M.P.Schneller & Assoc, Montgomery, I11. 4,584.00'
On a motion by Alderman Tures and second by Prickett the Council approved referral
of above bids to Finance and Water Committees, Superintendent and Engineer for
study and report.
Attorney Dowd made progress report Park Ridge Case is awaiting decision of Judge
and Barry case continued on Monday.
APPROVE GOLF PARK TERRACE SUBDIVISION. Alderman Bellmmade the following report:
Property lies in the area between Niles, Park Ridge and Des Plaines, Niles and
Park Ridge are closer than Des Plaines and both have approved plat. Property
onsists of 16 residential lots meeting our minimum requirements. Plan Commission
as approved plat. The Motion was made by Alderman Bella:id seconded by Prickett
to approve plat as shown and to have Mayor and City Clerk authorized to sign plat.
The motion was voted upon by acclamation.
SOU1'hABST CORNER ALGONQ,UIN AND MT. PROSPECT ROADS. On a motion by Alderman Bell and
seconded by Figard the Council approved Attorney Dowd Preparing annexation ordinance
a#0 referring same to Municipal Development Committee.
Alderman Jackson announced a Committee meeting as a whole for July 25th at 8:00 P.M.
Alderman Tures announced a meeting of the Water and Finance Committees, Superintendent
and Engineer for July 21st at 5:00 P.M.
AWARD BID REPAIR PARKING LOT TO MILBURN BROTHERS. Alderman Massman made the following
report: The low bid of $2550. by the Milburn Bros. of Mount Prospect is acceptable
to the city engineer, the Supt. of Public Works, the Finance Committee and this
parking meter committee, The motion was made by Alderman Massman and Seconded by
Wright to accept the bid of Milburn Brothers, the Mayor and City Clerk be authorized
to sign the contracts, and the checks of the unsuccessful bidder to be returned.
The Mayor put the question and the Deputy Clerk called the roll with the following
results: Ayes: Alderman Jackson, Blume, Tures, Writht, Neff, Moehling, Rlauter,
Figard, Prickett, Tistle, Massman and Bell. Nays: None. The Mayor declared the
motion carried.
ADVERTISE BIDS REPAIRING NORTH SCHOOL PARKING LOT. Alderman Massman made the
ollowing report: The estimated cost of repairing North School lot including
leaning loose stone from the lot, giving a prime coat of asphalt and a seal coat of
MC 5 asphalt and coated chips to be approximately $3,100. The motion was made by
Alderman Massman and seconded by Tures to advertise bids for repairing Parking L$b #5,
North School lot returnable August 15, 1960, with Superintendent and Engineer pre-
paring specifications. The Mayor put the question and the Deputy Clerk called
the roll with the following results: Ayes: Alderman Jackson, Blume, Tures, Wright,
Neff, Moehling, Flauter, Figard and Massman. Nays: Alderman Prickett, Tistle and
Bell. The Mayor declared the motion carried.
Alderman Massman announced a meeting of Parking Meter and Street and Traffic
Committees for Wednesday July 20th at 8:00 P.M.

Alderman Moehling made a progress report on the airplanes.
APPROVAL OF BILLS. Alderman Prickett pr Bated the following resolution:

BILLS ARE DUE AND PAYABLE AND TRAT THE MAYOR
AND CITY CLERK BE AND HEREBY AUTHORIZED TO
MAKE PAYMENT FOR SAME.
Total: $25,383.64. (A copy of resolution placed before each Alderman and on
file with the City Clerk.) The motion was made by Alderman Prickett and seconded
by Tistle to adopt the resolution. The Mayor put the question and the Deputy
Clerk called the roll with the following results: Ayes: Alderman Jackson, Blume,
Tures, Wright, Neff, Moehling, Flauter, Figard, Prickett, Tistle, Massman and
Bell. Nays: None. The Mayor declared the motion carried. On a motion by
Alderman Prickett and second by Tistle the Council concurred in payment of Bremer
& Son bill of $1,277.20.
AWARD GAS BID TO DES PLAINES MOBIL SERVICE. The motion was made by Alderman
Prickett and second by Bell to award the gasoline bid to the Des Plaines Mobil
Service Station at Graceland and Miner Streets for .06 less purchase price for
regu.lAr and .052 less for ethel for one year from this date. The Mayor put'the
question and the Deputy Clerk called the roll with the follaing results: Ayes:
Alderman Jackson,.Blume, Tures, Wright, Neff, Moehling, Flauter_; Figard, Prickett,
Tistle, Massman and Bell. Nays: None. The Mayer declared the motion carried.
Zoning variation of 1997 Ash Street denied and rehearing for 967 First Avenue
were placed on file.
FIRST READING MULTI*FAMILY ZONING ALGONQUIN AND OAKTON STREET SUBDIVISION. The
beputy Clerk read for first reading the above ordinance.
FIRST READING INDUSTRIAL ZONING-ALGONQUIN AND OAKTON STREETS SUBDIVISION. The
Deputy Clerk read for first reading the alibve ordinance.

ZONING VARIATION 1180 SECOND AVENUE. On a motion by Alderman Moehling and second
by BeLlthe•:Codncil concurred referral of application to the Zoning Board of Appeal
sitting as a Commission to call a hearing.
ZONING VARIATION MARLAND OIL COMPANY. The Deputy Clerk presented the zoning
application for above. On a motion b Alderman Massman and second by Tistle the
Council concurred referral of application to Zoning Board of Apppals sitting as
a commission to call a hearing.
Alderman Callaghan arrived at this time.
Alderman Callaghan announced committee meeting for July 19 to discuss taxi -cab
license at 7:30 and carnivals at 8:00 P.M.
REZONING APPLICATION LOTS 2 AND 3 OAKTON STREET. The Deputy Clerk pres#nted'the
above application upon annexation for rezoning, which was referred to the Zoning
Board of Appeals sitting as a commission to call a hearing.
CHAPMAN AND CUTLER - CITIZENS WAYCINDEN COMPANY LETTER. Mayor Behrel read the
following letter:
We are writing you on behalf of Citizens Waycinden Company (formerly Waycinden
Sevier & Water Co.) which, as you know, owns and operates the water and sewerage
facilities in Wayoinden Park Subdivision and vicinity. As you have previously
been advised, the stock of this company is owned by Citizens Utilities Company
which has assets of approeimately $35,000,000, is blessed with outstanding
managerial talent and efficiently operates other water and sewer utilities in
the Chicago area.
At the meeting with the Water Committee, the City Engineer and the City
Attorney last evening, at which we were discussing the possibility of some
arrangement for common use of the outfall sewer serving Wayoinden Park Subdivision
and vincinity and the sewer

in Mount Prospect Rad installed r-ecently.for the -purpose _.of.. serving. .the ...Kuntze Sub-
division lying west of Mount Prospect Road .and .north ..of.Dempster Street, we were
advised that applications for annexation of the Deutsch and Miller.properties, lying
within the area bounded by Mount Prospect, Algonquin, Elmhurst and Wille Roads, to the
City of Des Plaines had been made and were presently pending before the City Council
and that apparently some arrangements for water and sewer services to this area by
the City of Des Plaines were contemplated. For reasons hereinafter discussed, this
information was rather surprising and disturbing to our client.
The Waycinden utility was acquired by Citizens at a time when it was quite
generally understood in the.northwest area of Cook County that the City of Des Plaines
did not intend to extend its boundaries west'of Mount Prospect Road, but shortly
thereafter the City annexed that aforesaid Kuntze Subdivision and, we understand,
that since has also annexed or considered annexation of other properties in the same
general area.
Early in the year 1959 Town Builders (the proposed developer of the Deutsch
property) and Baird & Warner, Inc. (whom we understood represented the parties
interested in developing the Miller property), and various other persons owning
property adjacent to the service area of Citizens W8ycinden Company,, requested this
company to furnish sewer and water services to the various properties owned or proposed
to be developed by the various applicants, and as a result thereof, the company filed
with the Illinois Commerce Commission applications for certificates of convenience and
necessity to construct, operate and maintain a water supply and distribution system
and a sewerage disposal system in the various areas for which services were requested,
including all the area bounded by Mount Prospect, Algonquin, Elmhurst and Wille Roads.
In the regular course of procedure in these matters, the City of Des Plaines was
notified of the filing of these applications and of'the.contemplated hearings thereon.
At the hearing on the application for water service, the City of Des Plaines appeared
by its City Attorney and ddd not register any objection to the granting of water
certificate for the requested area except with respect to a forty acre tract located
at the southwest corner of Dempster Street and Elmhurst Road which was, by agreement,
excluded from the scope of the application. So far as our files and records reveal,
and according to the writer's recollection, there was no objection to the granting
of a certificate for sewer service to the various areas involved in the application.
In due course certificates of convenience and necessity were issued by the Illinois
Commerce Commission to the company authorizing it to render water and sewer services
in these areas which are still in full force and effect.
Acting in reliance on these various requests of the property owners (including
the Deutsch and Miller people), Citizens Waycinden Company expended substantial
amounts of money for legal fees in connection with the filing of these applications
and for engineering fees in connection with its proposed development of these areas
for water and sewer services and will, of course, lose the benefit of all of these
substantial expenditures in the event that it is unable to render water and sewer
services in these areas.
Since the preparations have, been made for extending service to these areas
and Citizens Waycinden Copany is willing and able to render ,competent and efficient
service, we feel that in equity and in good conscience the City Council should give
consideration to the granting of a franchise to Citizens Waycinden Company so that
it will be enabled to furnish water and sewer services to the areas for which it has
obtained certificates of convenience and necessity from the Illinois Commerce
Commission. Suggested forms of franchises are enclosed.
The Mayor referred the letter to the Sewer and Water Committees, Superintendent,
Engineer and Attorney for study at the July 21st meeting and report at next Council
meeting.
The Mayor read rezoning hearing by Cook County for July 27th at 8:00 P.M. which was
placed on file.
The Mayor made a progress report of the Northwest Mayors Conference regarding Cook
County zoning ordinance.
ADOPT OFFICIAL FLAG. On a motion by Alderman Figard and second by Prickett the Council
adopted the official flag as drawn by Arthur Wetter.
COMMENDATION LETTER TO ARTHUR WETTER. On a motion by Alderman Figard and second by
Prickett the Council concurred a commendation letter be sent by Mayor Behrel to
Arthur Wetter for official flag drawing.
APPROVE $600. EXPENDITURE FOR FLOAT FOR CENTI-QUAD-DRAMA PARADE. The motion was made
by Alderman Figard and second by Prickett to appropriate expenditure of not more than
$600. for float for parade for 125th year anniversary of the City of Des Plaines, The

Engineer Fletcher made a report on Traffic lights at Mt. Prospect Road and
Northwest Highway.
CHICAGO DISTRICT PIPE LINE AGREEMENT APPROVED. After a report by engineer
Fletcher, on a motion by Alderman Figard and second by Tistle the Council approved
the agreement and authorized Mayor and City Clerk to sign permit.
Alderman Prickett announced a meeting July 20th at 7:30 to interview candidates
for City Comptroller.
DEVONSHIRE SUBDIVISION. The Mayor referred above subdivision to the Plan
Commission.
ZEMON'S'CAPITOL HILL SUBDIVISION. The Mayor referred above subdivision to the'
Plan Commission.
ADJOURNMENT. On a,motion by Alderman Prickett and second by Tures the Council
approved adjournment.

OFFICIAL REPORTS. The -Deputy Clerk presented the June report from City Treasurer,
and July report from Building Commissioner.
Engineer Fletcher reported the repairs of the two wells was completed with the
assistance of the City of Park Ridge.
Attorney Dowd made progress report on Barry case and informed Council judge
ruled against City in 'Park Ridge case. Mayor referred same to Judiciary
Committee for study and report.
GOLF -PARK TERRACE #2. On a motion by Alderman Bell and second by Callaghan
the Council concurred Mayor and Clerk signing plat, on Ilan Commission approval
letter and following report by Alderman Bell: Property is not within the city
limits of Des Plaines but in the area within *miles of our boundaries.
Property is actually closer to Park Ridge and Niles than to the City of Des
Plaines and both other cities have approved plat. Subdivision meeting all
requirements of multi -family ordinance and in, in fact, so zoned in the county.
