COUNCIL, DES PLAINES, ILLINOIS, HELD IN
THE'COUNCIL ROOM, CITY HALL, DEC. 21,
1959 at 8:00 P.M.
CALL TO ORDER: The meeting was called to order by Mayor Herbert H. Behrel,
who presided with Alderman Flauter, Figard, Massman, Bell, Callaghan, Rateike
Tures, Wright, Neff and Moehling responding to roll call.
APPROVAL OF MINUTES: The --motion was made by Alderman Massman and seconded by
Tures to adopt the minutes of December 7, 1959. The motion was voted upon by
acclamation.
OFFICIAL REPORTS: The Clerk submitted the report of the City Treasurer for
November.
ALDERMAN BELL reported there will be a meeting December 28th regarding Bellaire
Annexation. He requested the City Attorney and Attorney Levander be present.
Alderman Bell reported the following regarding driveway permit for southwest
corner Wolf and Central Roads. "Your Committee on Streets and Traffic has
investigated the above and has found - while the four, recommended driveways
seem to be in line with the use (gas station) -two of the driveways are in
excess of 35 feet when measured on a line'pardilel-to the center line of the road.
We, your Committee on Streets and Traffic, therefore recommend that a permit be
used for the construction of four driveways none of which shall exceed 35 feet
when measured on a line parallel to the center line of the street touched by
the driveways. Driveways to be located as indicated on the attached plat."
On motion by Alderman Bell and seconded by Massman the Council concurred in
the report.
On motion by Alderman Tures and seconded by Bell the Council approved to
advertise for bids to rehabilitate Cater Well. Bids to be returned January
4, 1960.
On motion by Alderman Tures and seconded by Rateike, the Council approved
to advertise for bids for lime. Bids to be returned January 18, 1960.
Alderman Moehling made the following report regarding Gypsum Company Storm
Sewer into Weller Creek. "Your Committee on Sewer has investigated the,
above and has found:The proposed construction of a concrete headwall
structure for an 18" storm sewer pipe on Weller Creek near the City of
Des Plaines by United States Gypsum Company is intended solely fpr the pur-
pose of carrying off surfacd accumulation of storm water on the parking lots,
buildings, etc. of U.S. Gypsum Co. Derived from these sources, therefore,
the water entering Weller Creek would carry no sewage or decomposable
matter that would lead to contamination of Weller Creek. Indeed, water from
these sources would increase the flow of water in Weller Creek, add badly
needed oxygen to the contaminated water that already flows in Weller Creek as
a consequence of upstream sewage contamination and in short, would provide a
welcome source of desirable influent into the Creek. We, your Committee on
Sewer, therefore recommend that the City Council of Des Plaines take no action
in opposition to the proposed construction by U.S. Gypsum Co." On motion by
Alderman Moehling and seconded by Neff, the Council concurred in the report.
Alderman Moehling made the following report: "A: letter from Mr. Victor G. Morris
residing at 2645 Craig Drive, Des Plaines, requesting action by the City of
Des Plaines to correct or alleviate a condition described in a letter to the
City Council as standing sewage water in the basement and crawl space of com-
plainant's house, further inhabited by reptiles, vermin and suspected disease
producing bacteria. Your Committee on Sewer has investigated the above and
has found that an investigation by City Engineer, Mr. Ed Fletcher, has shown
that a subsurface system of drainage tile which previously provided drainage
for the area has been damaged and made ineffective by construction of the toll
road, approximately 300 feet to the East of the subject area. That, as a
result, surface water stands in ,stagnant pools on the property between the
end of complainant's lot and the toll road, indicating a generally high water

table for the entire area, particularly during rainy periods. Thus, the
basement and crawl space of the subject property is below the existing water
table and much of the standing water in complainant's home is believed to be
seepage, a condition which is worsened by the generally low grade level
established by the builder of these homes (Pleasant Manor Estates) and the
lack of fill around the home, as well as water originating from downspouts
emptying roof drainage near the foundation. The builder has periodically
provided pumping facilities.to remove the standing water from complainant's
basement and crawl space, but does not choose to continue this service.
"We, your Committee on Sewer, therefore recommend: 1- That the complainant,
or through him, the builder should install a combination sump and overhead
sewer in order to provide immediate relief of the situation. Since -the
seepage condition is not the result of factors for which the City of Des
Plaines is at fault, the cost of such installation should be. borne by the
complainant, or more logically, by the builder. 2 That the area between
complainant's lot and the toll road which contains stagnant pools be drained
either by digging a ditch from this area to the drainage channel running
alongside the toll road, or by installing a drainage tile from the area of
stggnant water to a spur of the Touhy Avenue storm sewer connecting there—
with by a tile 300 feet in length. lathe opinion of Mr. Ed Fletcher and
Mr. Joe Schwab, the installation of the drainage tile would be the preferred
and recommended procedure. This Committeetherefore recommends that these
recommendations be adopted and that not more than $1,200.00 be approved to pay
for installation of a 12 inch sewer tile from the area ofstagnant water to
the Touhy Avenue storm sewer spur. Your Camnnittee on Sewer moves adoption
of this report." The motion was made by Alderman Moehling and seconded by
Neff to approve the report. The Mayor put the question and the Clerk called
the roll with the following results: Ayes: Alderman Rateike, Blume, Wright,
Tures, Neff, Moehling, Flauter, Figard, Massman, Bell, and Callaghan. Nays:
None. The Mayor declared the motion carried.
Alderman Blume made the following report on Johnny's Trailer. Sales sign:
'"Your Committee on Building Control and Inspection has investigated the above
and has found that there are no extenuating circumstances and that two other.
such businesses now exist in the same area with signs that comply with the
ordinances. We, your Committee on Building Control and Inspection there.
fore recommend that if the sign is not rOduced, to less than 120 square
feet in size and moved so as to be inside the lot lines, legal action be
started by the City of Des Plaines to force the Trailer Sales Company to
comply.++ On motion by Alderman Blume and seconded by Massman, the Council
concurred in the report.
Alderman Blume made the following report on Triangle Sign Company sign on
Mannheim and Higgins Road: "Your Committee on Building Control and Inspection
has investigated the above and has found after conference with attorney re—
presenting Triangle Signs, who pleaded ignorance on the extension of the City
limits to Higgins Road end after reviewing the sign and its location, and there—
fore recommend that t sign had been erected without a permit and its size
is approximately 220 gat that a permit be granted." The motion was made
by Alderman Blume and seconded by Massman to concur in the report. The Mayor
declared the motion lost on a voice vote.
On motion by Alderman Massman and seconded by Tures, the Council approved to ad—
vertise bids for salt. Bids to be returned January 18, 1960.
APPROVAL OF BILLS:. Alderman Bell presented the following resolution:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF IES PLAIDS THAT THE FOLLOWING BILIS ARE
DUE AND PAYABLE AND THAT THE MAYOR AND CITY
COUNCIL BE AND ARE HEREBY AUTHORIZED TO
MAKE PAYMENT FOR SAME:
TOTAL — $53,670.02. (A copy of resolution placed before each Alderman and
on file with the City Clerk). The motion was made by Alderman Bell and
seconded by Callaghan to adopt the resolution. The Mayor put the question and
the clerk called the roll with the following results:.Ayes:, Alderman Rateike,
Blume, fright, Tures, Neff, Moehling, Flauter, Massman, Bell, Callaghan. Nays:
None.

ADOPT REZONING ORDINANCE LOT 8 IN CRAIG MANOR SUB. TO COMMERCIAL. The Clerk read
for the second reading the above ordinance • The motion wasmade by Alderman,Bell
and seconded by Figard to adopt the ordinance. The Mayor put the question and.,
the Clerk called the roll with the following results: Ayes, Rateike,Blume.,
Wright, Tures, Neff, Moehling, Flauter, Figard, Massman, Bell, Callaghan. Nays:
None. The Mayor declared the motion carried.
ADOPT ZONING ORDINANCE AMENDING.GASOLINE SERVICE STATION ORDINANCE. The Clerk
read for the second reading the above ordinance. The motionwasmade by Alderman
Neff and seconded by Moehling to adopt the ordinance. The Mayor put the question
and the Clerk called the roll with the following results: Vis: Alderman Rateike,
Blume, Wright, Tures, Neff, Moehling, Flauter, Figard, Massman, Bell, Callaghan.
Nays: None. The Mayor declared the motion carried.
ADOPT ORDINANANCE AMENDING RESIDENTIAL ORDINANCE. The Clerk read for the second
reading the above. ordinance... Themotionwasmade by Alderman Neff and seconded
by Massman to adopt the ordinance. The Mayor put the question and the Clerk
called the roil with the following results. Ayes: Alderman Rateike, Blume, Wright,
Tures, Neff, Moehling, Flauter, Jackson, Callaghan. Nays: None. The Mayor
declared the motion carried.
ZONING VARIATION APPLICATION FOR POST OFFICE PARKING LOT. The Clerk presented
the above application. On.motion by Alderman Figard andseconded by Massman,
the application was referred to the Zoning Board,sitting as a Commission to call
a hearing.
Alderman Prickett appeared at this time.
LETTER FROM SCHOOL DISTRICT NO. 62. The Clerk read the above letter and the
Mayor referred same.to.the.Street Committee...
OAKTON STREET BUSINESSMEN'S TETTER ON STREET LIGHTING. The Clerk read the above
letter.regarding.nev.lights,.for.Oakton Street., The.letter was referred to the
Board of Local Improvements.
OAKTON STREET BUSINESSMEN'S TETTER ON PARKING LOTS. The Clerk read the above
letter and the Mayor referred sameto the Parking Meter Camunittee.
TETTER FROM A. MOETJER ALLEY BACK OF 1261 BROWN ST. The Clerk read the above
letter and the Mayor referred same to the Street Committee and City Engineer Fletcher.
REZONING APPLICATION - GOLF RD. EAST OF HOSPITAL. The Clerk presented the __
above application. On motion by Alderman Prickett and seconded by Figard, the
application was referred to the Zoning Board sitting as a commission to call a
hearing.
PLAT OF CRAIG MANOR UNIT TWO. The Clerk submitted the above plat. The Mayor
referred the plat to the Plan Commission.
Letter from Postmaster Wesley that 12 Government vehicles are desibnated units of
Civil Defense was referred to Alderman Figard and Director Kinser.
On motion by Alderman Callaghan and seconded by Tures, that the Attorney allow -
to January 15, 1960 for Decks, Inc. to removii building material on Broadway
was approved by Council.
At Alderman Neffts request, Chief Kennicott is to contact contractor to remove
material from property east side of Warrington and south of Ashland and report
back next meeting.
The Clerk reported of death of Former Alderman John Lemke, who was Alderman from
1935 to..1945.

ADJOURNMENT: The motion was made by Alderman Tures and seconded by Callaghan

roll call.
APPROVAL OF MINUTES: The motion was made by Alderman Prickett andiseonded
by Blume to approve.the minutes of December 19, 1959._..The motion was vot.d
upon and approved by acclamation.
OFFICIAL IEPORTS:" The Clerk submitted the reports of the City Clerk, Building
Commissioner and Health Officer for December. Chief Kennicott reported the
contractor for building on Warrington Road was notified to remove material
from lot.

There being only bid for rehabilitating Cater Well, the motion was made by
Alderman Tures and seconded by Figard to return the bid'and readvertiss for-
bids for the January 18th meeting.
BIDS ON PRINTING ZONING COWS: On motion by Alderman Neff and seconded
by Tistie, .the Council instructed the Clerk to open the above bids. There=
were six bids received. On motion by Alderman Neff and seconded by Moehling,
the.:bids were opened and referred to the City Code and Finance Committee
and City Attorney.
REZONING APPROVED NORTHWEST'CORNER GOLF AND MT. PROSPECT ROADS:
Alderman Bell made the following report."Your Committee on Municipal Development
has investigated the. above and has found. residential zoning is unrealistic on
the corner of two thorfares such as Golf and Mt. Prospect Road. Revision• of
existing C-2 ordinance gives protection'to our 'proximity ordinance' and
therefore no gas station could be placed on this corner. We, your Committee
on Municipal Development, therefore recommend Commercial Zoning C-2 be approved
for this area."" On motion by Alderman Bell and seconded by. Prickett, the
Council approved the report.
ANNEXATION FAIRE AREA:, Alderman Bell made the following report. 'Your Committee
on Municipal Development has investigated the above and has found no practical
means can be devised to place money in escrow, to assure improvements being
installed after annexation. Size of area is one mile long and between 1/4 to
3/8 miles in width, being only about 2/5ths developed and problems would
therefore be much less than in similar previous annexations . Annexation of
this area would allow city to control future development to meet existing
standards. We, your Committee on Municipal Development, therefore feel the
people of this area are sincere in their efforts to improve this area. Any
escrow agreement would only work a hardship on those who are sincere and would
not be binding on the others. We, therefore feel the advantage of super-
vising the future development of this area out weighs the possible problems
