05/04/1959-4- - Apri171, 1959 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES, COOK COUNTY, ILLINOIS. Section 1. That Robert 0. Blume, Raymond N. Tures, Donald E. Moehling, Peter R.Flauter, Walter J. Tistle, George Massman, and Ralph J. Jackson having re- ceived the highest number of votes cast for the office of Alderman of they first, sedond, third, fourth, fifth, sixth and seventh Wards respectively, shall be and are declared elected to the office' of Aldermen of the City of Des Plaines, Illinois, for a full term of four (4) years as provided by law. Adopted by the City of Des Plaines, Illinois on the day of 1959." On motion by Alderman Figard and seconded by Wexler, the Council adopted the resolution. Resignation of Arthur Rieck. Building Commissioner. The report was read that Mr. Bieck notified of his resignation as of May 1,.1959. On motion by Alderman Figard and seconded by Wright,. the Council accepted his resignation. On motion by Alderman Neff and seconded by Wexler, the Council adopted a resolution of appreciation for the many years of service he has given the City. Merritt L. Wiedeman appointed Building Commissioner. The Council, by motion - of Alderman Figard.and seconded by Rateike, approved the appointment of Merritt L. Wiedeman as Building Commissioner. Supt. Wernicke to enter Sanitarium. The Mayor informed the Council that Supt. Wernicke will enter the sanitarium for two or three months for treatment of T.B. Joe Schwab and Mrs. Hartman to act_as assistants during his absence. Alderman Rateike has called a meeting for Wednesday, April 29th at 7130 P.M, the City -Clerk to notify the new Aldermen elect. Alderman Bell reported that the Toll Road construction removed a sidwalk on River Road from Chase to Touhy._ The Supt..of Public Works is to contact the Toll Commission. Adjournment. CALL TO ORDER The meeting was called to order by Mayor Herbert H. Behrel, with . Alderman Rateike, Dunlap, Tures, Wright, Neff, Wexler, Figard, Prickett, Tistle, Massman, Bell, McKay and Callaghan responding to roll call. APPROVAL OF MINUTES The motion was made by Alderman Prickett and seconded by.Bell_to approve.the minutes of April 20th and adjourned meeting April 27, 1959. The motion was voted upon by acclamation. OFFICIAL REPORTS The Clerk submitted the reports of the Building Commissioner ana City Clerk. Mrs. Hartman reported the following for Supt. Wernicke. The guard rail along the sidewalk on Miner St. east of the river has been completed by the State Highway Department as of April 21, 1959. Route 62 signs have not been changed as yet, but Mr. Tuthiel reported they would be changed as soon as possible. Sidewalk work at ToBhy and River Road to be finished by 'the end of the week, weather permitting. -2- 5/4/59 TO ADVERTISE BIDS FOR PAVING WHITE STREET. At.request of Engineer Fletcher, the Council approved to advertise for bids for paving White Street on motion by Alderman McKay and seconded by Bell. Bids to be returned by June 1, 1959. TO ADVERTISE BIDS FOR FUEL OIL. On motion by Alderman Rateike and seconded by Bell, the Council approved to advertise bids for fuel oil, with bids to be re- turned by June 1, 1959. 0 JOHN BURKE REPORT ON VAN SLOW CASE . Alderman Wexler submitted the following report. "Van Selow v City of Des Plaines - On the 4th day of May, 1959, a Consent Decree was entered, a copy of which is hereby attached, relating to a ,suit of Mr. & Mrs. Van Selow against the City of Des Plaines. The pertinent provisions of th$ Decree are as follows: 1. That the West 7.50 acres are hereby declared and decreed to be and .constitute a non -conforming use under the Zoning Ordinance of the City of Des Plaines, a municipal corporation, and the plaintiffs are hereby authorized to continue the use_of said West 7.60 acres as and for a Trailer Park, pursuant to the decree heretofore entered by the Circuit Court of Cook County, Illinois, in Case Number 51C7379; and the defendant, City of Des Plaines, a municipal corporation, be and it hereby is permanently restrained and enjoined from interfering with the use by plaintiffs of said West 7.50 acres as and for a Trailer Park. 2. The East 7.50 acres (except that portion thereof which is specifically described below) are hereby declared and decreed to be and constitute a non -conforming use under the Zoning Ordinance ,of the City of • : ,. L Des Plaines, a municipal corporation, and the plaintiffs are hereby authorized to use the said East 730 acres (subject to the exception stated b elow) as and for a Trailer Park. The following portion, however, of said East 7.50 acres is hereby declared and decreed to be permanently reserved solely for single family dwelling unit residential use pursuant to the Zoning Ordinance, of the City of Des Plaines, a municipal Ordinance of the City of Des Plaines, a municipal corporation: Starting at a point in the center of Scott Street at the northern boundary of said East 7.50 acres and from thence in a westerly direction one hundred seventy-five (176) feet and thence four hundred ninety (490) feet in a southerly direction to the southern boundary of said East 7.50 acres and thence in an easterly direction one hundred seventy-five(175) feet to the center of Scott Street and along the center of Scott Street to the. _point of beginning. Until said'area hereinabove specifically reserved for use for said residential purposes is wholly used for=such purposes the portion there- of not so used shall be maintained by plaintiffs solely as a park at plaintifftst expense; and neither trailers Sor automobiles owned or maintained by plaintiffs or by occupants of the Trailer Park, or by guests of plaintiffs or such occupants, shall be parked thereon, nor shall machinery equipment or other chattels of any kind or nature be stored, kept or maintained in said area. 3. The service road presently extending in an easterly and westerly direction from the West 7.50 acres through the center of the East 7.50 acres shall, at the option of plaintiffs, extend through the area reserved for re- sidential purposes in Paragraph 2 hereof, so as to give the plaintiffs ingress to and egress from all the property herein d esignated as constituting a non- conforming use, but said road_shall not be greaten than forty (40) feet in width. 4. The plaintiffs shall, not later than ten (10) years from the date hereof, dedicate an area of forty (401 feet west of the present westerly edge of Scott Street along the entire east boundary of said East 7.50 acres, as and for a public stfeet to constitute a part of Scott Street. 5. That the plaintiffst,property along the_north boundary of the plain- tiff's fifteen (15) acre tract .herein described as a non -conforming use, to -wit: the entire fifteen (15) acre tract except the_ said one hundred seventy-five(175) fdot setback along the east boundary of said property fronting on Scott Street, shall not be subject to any setback requirements of the City of Des Plaines except for the dedication of an area by the plaintiffs for a public street to constitute a part of Nimitz Drive. 5/4/59 -3- 6. This decree shall be binding upon and inure to the benefit of the heirs, executors, administrators and assigns of the plaintiffs and each of them; and the provisions of this decree shall be construed to be and con- stitute covenants on the part of plaintiffs which run with the land. 7. This Court hereby expressly reserves jurisdiction of this cause and of the parties hereto for the purpose of endorsing the, provisions of this decree. n The Mayor ordered the report to be placed in the minutes. BLUETTS RAIRVIEW GARDENS PLANT. The Clerk submitted the above plat -approved by the Plan Commission. The Mayor referred the plat to the Municipal Development Commission. ADOPT ORDINANCE PROHIBITING BACKING INTO METERED PARKING PLACE. The Clerk read for the second reading the above ordinance. The motion was made by Alderman McKay and seconded by Dunlap to adopt'the ordinance. The Mayor. put the question and the clerk called the roll with the following results: Ayes: Alderman Rateike, Dunlap, Tright, Tures, Neff, Wexler, Figard, Prickett, Tistle, Massman, Bell, McKay and Callaghan. Nays: None. The Mayor declared the motion carried. ADJOURN SINE DIE. On motion by Alderman Rateike and seconded by Callaghan, the Council adjourned sine die. POLICE MAGISTRATE A. L. SENGSTOK INSTALLS NEW ALDERMEN. The Mayor informed the Council Mr.. Sengstock would install the new Aldermen.After the installation Mr. Sengstock gave a short speech. Each new Alderman was`then allowed to talk after which the three retiring Aldermen made their final speeches. Alderman McKay was presented with a framed resolution and plague from the Cumberland Civic Club. THE MAYOR CALLED THE MEETING TO ORDER WITH THE NEW MEMBERS HAVING BEEN SWORN INTO OFFICE. Alderman Rateike, Blume, Tures, Wright, Neff, Moehling, Flauter, Figard, Prickett, Tistle, Massman, Bell, Jackson and Callaghan responded to rolh call. THE MAYOR ANNOUNCED THE FOLLOWING NEW COMMITTEES. and requested the approval of the Council. On motion by Alderman Prickett and seconded by Bell, the -Council approved the committees. On motion by Alderman -Tures and seconded by Tistle, the Council referred the rezoning application - from Residential to Commercial at 2070 Miner Street to the Zoning Board of Appeals sitting as a commission to call a hearing. ORDINANCE FOR DUMPING RUBBISH IN STREAMS AND LAKES. The Clerk read for the first reading the above ordinance. SIGN APPLICATION Sign application referred to. Building Control Committee. DRIVEWAY REQUEST, - LAUREL AND HARDING. The above driveway]equest was re. ferred to the Street Committee. AT REQUEST OF ALDERMAN RATEfl the permanent parking on even side of street at 1400 block Willow Street was referred to Street Committee. AT REQUEST OF ALDERMAN BELL the metering of all or part of North Side'Parking Lot was referred to Parking Lot Committee. The parking and marking of Clinic Lot at Center and Thacker was referred to AMr. Schwab to investigate on request of Aldermanliright. Also to check on one-way signs at that corner. ADJOURNMENT.
