MINUTES OF TIE REGULAR MEETING OF THE CITY COUNCIL, DES PLAINES, ILLINOIS, HELD IN THE COUNCIL ROOM, CITY HALL, MARCH 16, 1959 AT 8:00 P.M. GAIL TO ORDER The meeting was called to order by the Mayor Behrel who presided' with Alderman Rateike, Dunlap, Tures-, Wright, Neff, Wexler, Prickett, Tistle, Massman, Bell, McKay and Callaghan responding to roll call. APPROVAL OF MINUTES The motion was made by Alderman Prickett and seconded by Callaghan to approve the minutes of March 2, 1959. The motion was voted upon by acclamation. OFFICIAL; REPORTS The Clerk submitted the reports of the Treasurer and Clerk for February. Attorney Dowd reported that the United Motor Coach fare increase will take effect March 29th if no protest is filed with the Illinois Commerce Commission. The motion was made by Alderman Bell and seconded by Prickett to file a protest 3/16/59 -2- to see about getting better service. The motion and second were withdrawn after Attorney Dowd said they could only file a protest on the Tarrif but could file a protest to the Commission any time about service. The motion was made by Alderman Bell and seconded by Massman that a protest be filed on the poor service. The Mayor put the question and the clerk called the roll with the following results: Ayes: Alderman Rateike, Dunlap, Neff, Tistle, Bell and McKay. Nays: Alderman Tures, Wright, Wexler, Prickett , Massman and Callaghan. The Mayor declared the motion carried. The motion was made by Alderman Rateike and seconded by Massman to approve the appointment of James J. Dowd as attorney to file the protest. Nays: None. - Attorney Dowd reported that an appeal has been filed in the Dean. Case. Alderman Wexler said he would report later in meeting. Attorney Dowd informed the Council that they must pass a salary ordinance when they have a compensation and classification ordinance. Attorney Dowd read a letter from the Sisters of Nazareth regarding their desire to annex their land to the City. The letter was referred to the Mayor, Attorney Dowd and the Building Commissioner. APPROVE KUNZE'S HIGH RIDGE SUBDIVISION Alderman Bell_reported the Municipal Development Committee'had investigated the above and found annexation approved on attached report. Plan Commission has approved and studied plat dedications to Park and School districts acceptable and previously approved. Subdivider has agreed to reroute sanitary sewer to run down Dempster (Thacker) to Mt. Prospect Road.to relieve Westfield Gardens. The Committee has recommended approval of subdivision as shown on plat, Mayor and City Clerk to be authorized to sign plat upon receipt of bond covering improvements and revised plat showing rerouting of sewer. Alderman Bell also presented an agreement from Des Plaines Dempster Developments, Inc, that they agree to pay the City $3,000.00 a year for five . years beginning December 31, 1959 to be used as the City sees fit for spraying and removal of underbrush in Weller Creek or for any other purpose calculated to expedite the free flow of sewage and storm water. Alderman McKay read the following report: "In joint meeting with Municipal Development Committee on March llth a spokesman for the Kuntze interests stated itt effect they would not give any consideration at all to the impounding of storm -water, or to any change in their plans for the run-off of drainage and storm -water. He stated they would make no concession in addition to those they had already made 14 connection with the development. "Present plans include a new drainage and storm -water sewer to enter Weller Creek just below Washington Street, and at which point it would be five feet in diameter. This we consider a threat to the health, safety and general welfare of the residents of Cumberland Terrace; and wise and considerate advance planning is our just due, and in no wise a 'concession.( We feel that at times of heavy rainfall this proposed new sewer line will bring to the Creek such an additional flow in the matter of minutds that the effect of the dredging and other relief measures taken along the Creek since 1957 would quite likely be offset. Unless some real effort is made to control, such as by impounding the storm -water flow into Weller Creek until such time as additional and major changes are made, along the route of the Creek between Wolf Road and the River, the approval of the plat by the Council may be considered by the residents of Cumberland Terrace as due notice they may expect flooding in times of heavy and prolonged rainfall. r "Mr.'Fletcher submitted certain interesting information in our meeting of the. llth, which'would seem to indicate that under present conditions the Creek might not flood the Terrace at the next sustained precipitation. Please note we say 'under present conditions' which would not include new large subdivisions. During the meeting, in answer to a question, Mr. Fletcher admitted that in his early negotiations with the developers he had suggested that some consideration be given to the advisability of impounding. Obviously, the suggestion was vetoed, and Mr. Fletcher has had to conform more closely to the interests of the developers. 3/16/59 -3- "Mr. Mayor and Aldermen we urge that approval of the plat or any portion thereof be withheld, until the developers agree to improve their plans for storm -water run-off." After considerable discussion, the motion was made by Alderman Bell and seconded by Dunlap to concur in'the Municipal Development Committee's report to,approve the plat. The Mayor put the question and the clerk called the roll with the following results: Ayes: Alderman Rateike, Dunlap, Wright, Tures, Neff,, Wex]er, Prickett, Tistle, Massman, and Bell. Nays: Alderman McKay and Callaghan. The Mayor declared the motion carried. ADOPT HIGH RIDE SUBDIVISION ANNEXATION ORDINANCE. The motion was made by Alderman Bell and seconded by Massman to adopt the above ordinance. Alderman McKay read the following report. "in a 'meeting of the Committee of the Whole on February 26th, we considered the question 'of annexations generally and during the discussion it vas pointed out by .AldermatvWexler that the prime function of government is to serve the people. That is true of course, and when we consider CITY,government, perhaps we should be a bit more specific and emphasize that the present citizens of any city, should have first call on the services of that city. The present citizens have the right tooexpect their government to protect their health , safety and general welfare, even though it might interfere with the plans of developers and sub- dividers,for their own welfare and that of prospective citizens. • "We should give consideration to ANY request for annexation but with due regard to advantages and disadvantages. We should cooperate fairly with the developers and insist that they reciprocate, for the benefit of all concerned. "Northshire, Cumberland, and Cumberland Terrace are directly concerned with the proposed High Ridge Knolls development, and being parts of Des Plaines the whole city should be concerned, because of the problem of storm -water and Weller Creek. There is a vast difference between d raining a hugh section of farm -land and draining the same section built-up .with roofs, asphalt streets and curbs and gutters. "Some, plan should be adopted for holding the water back, especially when the Creek is ever -burdened and a flood is threatened. "An impounding basin has been suggested. It could be of a temporary. nature and subject to reclamation if and when the Metropolitan Sanitary District effects some Permanent relief along the route of the Creek. During the meeting referred to, a representative of the developers, Mr. Hoover from Arlington Heights, told us his clients would not consider an impounding basin. One of his objections was it would not look nicel "Now, Mr. Mayor, and also those aldermen who journeyed out to Cumberland Terrace that week -end of the July 1957 flood: When you stood on Oxford Road and gazed down on Columbia Avenue, and Wolf Road, and Harvey, and the hares surrounded -with contaminated water, much of which, by,the way, came down from Mt. Prospect and Arlington Heights - we ask you, did that look nice? Wouldn't you rather look•at an impounding basin, properly designed, landscaped and well.kept? "Such a device would not prevent a flood, if the rains are too heavy and too pro- longed, but to the extent of the capacity of the basin it could hold back that much fram the streets of the subdivision_itseId and from Cumberland Terrace. "We ask that all of you reflect carefully before you cast your vote and that until the developers decide to cooperate in the matter of flood control, approval of annexation be withheld." The Mayor put the question and the clerk called the roll with the following results: Ayes:. Rateike, 'Dunlap, Wright, Tures, Neff, Wexler, Prickett, Tistle, Massman and Bell. Nays: Alderman McKay and Callaghan. The Mayor voted Aye and declared the motion carried. APPROVE SUPERIOR HOVES S SUBDIVISION. Alderman Bell reported the above subdivision meets requirements of multi -family zoning on which it is located. Donation of lot and improvements for Park District acceptable. The Committee recommends the Mayor and 3/16/59 -4- and the City Clerk be authorized to sign the plat upon receipt of bond covering improvements. On motion by Alderman Bell and seconded by Dunlap, the Council concurred in the report. APPROVE SCHWARTZ SUBDIVISION. On motion by Alderman Bell and seconded by Dunlap, the Council approved Schwartz Subdivision Plat and the Mayor and Clerk authorized to sign same. PROTEST OHIO OIL TANK FARM AT OAKTON AND EIMHURST.RD. Alderman Bell reported that residential property directly across street with no buffer zone between tank farm and Elmhurst Road, area would•appear better with a commercial buffer between residential and industrial, area. The Municipal -Development Committee recommends that the City of Des Plaines continue to lodge protest on the proposal of re- zoning. In line with our present policy, we rdcommend a commercial buffer zone between residential and industrial zoning whenever possible. On motion by Alderman Bell and seconded by Dunlap, the City Clerk was instructed to write a letter of protest stating the Council's protest, to the County Zoning Board: APPROVE DEY AND SPROAT SUBDIVISION. On motion by Alderman Bell and seconded by Dunlap, the Council approved the above plat and authorized the Mayor and City Clerk to sign same. APPROVE APPLE CREEK LANE SUBDIVISION. The motion was made by Alderman Bell and seconded by Rateike .and the Council approved the above plat and authorized the Mayor and City Clerk to sign same. TO ADVERTISE FOR BIDS FOR FIRE LADDER TRUCK. On motion by Alderman Tistle and seconded by Rateike, the Council approved to advertise for bids for a Fire Truck to be returned April 20th. AWARD TREE TRIMMING BID TO BISHOPS TREE SERVICE. The motion was made by Alderman Dunlap and seconded by Tures to award the tree trimming to Bishop. The motion was made by Alderman McKay and seconded by Bell to award the bid for paving Scott St:_ to the Skokie Valley Asphalt Company for $17,298.17 and return all other bidders' checks. ALL NO. 5 BID TO L. CLIFF NEELY. The motion was made by Alderman Tures and seconded by Wright to award the bid on Well No. 5 to L. Cliff Neely for $39,094.00. The Mayor referred the ordinance to the Municipal Develop- ment Cannnittee. CRAIG MANOR SUBDIVISION PLAT. The Craig Manor Plat was approved by the Plan Commission and the Mayor referred the Plat to the Municipal Development Committee. HOWARD HIGHLANDS PLAT NO. 2 The above was approved by the Plan Commission and the Mayor referred same to the Municipal Development Committee. FOREST PRESERVE'DISTRICT ANNEXATION., The Clerk read for the first reading the, above ordinance. RESOLUTION DESIGNATING POLLING PLACES; ETC. The Clerk presented the following resolution: Resolution designating Polling Places, Appointing Judges of Election and Directing the City Clerk to Publish Notice of Municipal Election to be held April 21, 1959. On motion by Alderman McKay and seconded by Tistle, the Council adopted the resolution. RAND PARK PONY LEAGUE letter for _Tag Day. The Clerk fead the above letter. The Payor said we do not allow Tag Days but thought it was a good cause and would reply to the letter. At Alderman Neff's request, the Mayor referred to Attorney Dowd to investigate zoning at 925 Thacker Street; regarding a barber shop. ADVERTISE BIDS OH SIDEWALK REPAIR. On a motion by Alderman Wright and seconded by Rateike, the Council approved to advertise for bids for.repair of sidewalks to be returned April 6, 1959. Alderman*xler inquired about City Finances due to report of threemonth delay in'taxes. The City Clerk informed the Council that he estimated by July lst, the City would not have any funds in the bank. ADJOURNMENT.
