CALL TO ORDER. The meeting was called to order by Mayor Herbert H. Behrel,

APPROVAL OF MINUTES. After the following corrections were made, on a motion
by.Alderman Prickett and seconded by Wright, the Council approved the corrected
minutes: On page 3 • Library parking --deleteaafter legal holidays!' Rerouting
of Route 62 - change Mt. Prospect Road to Elmhurst Road, page 4, first paragraph
replacement. On a motion by Alderman McKay, seconded by Bell, Mayor referred

from Ohio Oil Company, -favoring the tank farm, on a motion by Alderman Bell
and seconded by Rateike to refer the matter to Municipal Development Committee
for report and study. '
OFFICIAL REPORTS. The Deputy Clerk presented the Building Cc®miissionera report
for February.
On the Dean Case, Attorney Dowd reported that the. Judge gave 20 more days to
demolish the building. On a motion by Alderman Rateike and seconded by
Masaman, the council approved to return the bids and checks submitted for
demolishing said building, with a letter of explanation.

"Report of Flood Control dta ittee •• Mayor and City Council:
A meeting was held in the Chicago offices of the Metropolitan Sanitary District
on February 18111959, at which was present in addition to representatives of the
MSD (including President Chesrow) the following - Mayor Behrel, Alderman Dunlap,
Tistle and McKay, SPW,Warnicke, CE Fletcher, CA Dowd and Mr. Richard Bliss.
On behalf of,"the City 'Of Des Plaines, a letter was presented to the attorney of
the MSD as formal notification that. that portion of Weller Creek within the City
had been disconnected -from the Weller Creek Drainage District on September 3,
1958, by order.,of Judge Otto Kerner. Our letter also requested the MSD to take
the necessary.steps to take over.
Request was made by the MSD that the City supplement its letter with a copy of
the court order covering the disannexation, which Mr. Dowd is to arrange to do.
Also SPW Wernicke is to submit a letter outlining what we have dorm in our efforts
to alleviate Creek conditions, such as construction of an additional flume under
Northwest Highway, dredging of the Creek between Wolf Road and Graceland Avenue,
etc. and the SPW will please include in his letter the cost figures on,the flume
and dredging.projects,.;which;,were considerable, and also if feasible an a stimate
of other costs.." After the section.of the Creek in the City has been taken over
by the MSD, we should *eke', an effort to r ecover some of this expense on the
theory that the -City was not responsible for the conditions it tried to improve;
that the expense, could; more fairly be assumed by the MSD because it has juris
diction and the power to tax not only the City of Des Plaines but also the Creek
area beyond the City limits and which latter area Was and is almost entirely re-
sponsible for. our Weller Creek Difficulties.
Getting back to our. meeting ;of the 18th, it might .be said that while the
representatives of.the`MSD Were not enthusiastic about it, the rather cautious •
consensus seemed:'to be that eventually the MSD would have to assume the problems
of Welldr Creek and try to solve them on -a long range basis. Perhaps the most .
encouraging feature of our meeting Was' the attitude of President Chesrow and Mr.
Bahia, one of the MSD'trustees, who seemed quite sympathetic to our dilemma and
our desire for action by the,MSD.
We frau Des Plaines tried to:impress the representatives ofthe District with
the specific problem we have on otr doorstep right now - that of extensive con-
struction of homes, in the Weller Creek drainage area and the contemplated over-
taxing with storm water of a ditch already sadly inadequate. We had with us
pictures of our 1954 flood, and also of the most disastrous of all, that of July,
1957. Several of -the MSD'folks were mildly` interested. However, none'of them
seemed very certain as to what could 'be done. Insofar as the- area within the
City is coneerned,•as long as it is under our control perhaps we can insiat'on
certain measures to safeguard the health, sefety,'convenience and general welfare

of our citizens. As to the Creek beyond the City limits, the MSD say theylave
no rights except certain easements for dredging, and they inferred they had not
taken over any section of the Creek and had no authority to approve or deny use
of the Creek for drainage. It was suggested that perhaps same action could be
taken by the County in the unincorporated area.
In connection with the inference by the MSD that they had not taken over any
section of Weller Creek, it is requested that Mr. Dowd contact Mr. Wildi attorney
for the Weller Creek Drainage District. That Mr. Wild be•asked the status of that
portion of the Creek in the Mt. Prospedt area which he had informed us had been
disannexed from the Weller Creek Drainage District - whether it has or has not
been taken over by the MSD."
Ori a motion by Alderman McKay and seconded by Dunlap, the Council concurred in
the report.
Alderman McKay made the following report:
"Mr. Mayor and'Aldermen: - with reference to the recommendation of the Flan
Commission on the proposed High Ridge Knolls development.
In addition to the rather ridiculous situation we are asked to approve whereby
the Mt. Prospect Park District would haveurisdiction over park area withib the
City Limits of Des'Plaines; the question of water supply and the limited
facilities of our water softening plant, there is the very important matter of
sanitary sewer service, and disposition of surface drainage and storm -water.
That portion of the Plan Commission recommendation wherein this subject is dealt
with, briefly and vaguely, states "'House drains will be connected to the
Sanitary district system and storm -water will be collected in a slow -run-off,
street sewer system for eventual outfall into Weller Creek.'
This item of sewers, sanitary and surface run-off is of vital concern to the
people of Northshire, Cumberland and Cumberland Terrace.
City Engineer has expressed confidence that there will be no difficulty in
connection with sanitary sewage, but there is same doubt the interceptor will
be able to cope with the ever-increasing flow. During periods of heavy and
prolonged rainfall the interceptor will undoubtedly become surcharged and
there will be back-up in sewers and basement drains., Due to the disinclin-
ation of those in authority to say NO to the eager land developers, hook -ons
to the sanitary sewer will probably be permitted until same major health hazard
threatens.
As far as surface drainage and storm -water run-off is concerned,with thf
cooperatio4 of developers, something could and should be done, perhaps impounding,
until such time as the Sanitary District can effect some genuine relief. The
Mayor himself has expressed apprehension at what might happen again in the
Cumberland Terrace section; also that he felt some consideration should be
given to the feasibility of impounding in connection with the project under
discussion.
Certainly the slow run-off Street sewer system mentioned by the Plan Commission
would not be satisfactory. The Council should know more about this system than
can be learned from the Plan Commission report. What comprises this system and
what is meant by "eventual" outfall into'Welier Creek?" Does "eventual" mean a
matter of minutes, hours or days? And the Council should wonder why the "system"
should involve a new storm -water sewer to the Creek, to cut in just below
WashihgtonStreet and where it would be five feet in diameter. The Council
should remember too that the subdivision plat must be approved -by the City
of Des Plaines whether it is within the City or in the unincorporated area,
and that if it should be in the unincorporated area the approval of Mt. Prospect
and Elk Grove, must be obtained as well as that of Des Plaines. '
The Plan Commission report states tit should be noted that any development in
this area will have the right to make use of its natural watershed into Weller
Creek." Agreed. The developer has the right to make proper use of the water-
shed. -But the people have rights also, rights which should transcend those

of any promoter. And no one has the right to threaten the health, safety and
general welfare of the people who already live in the area.
The Weller Creek drainage ditch was never intended to be used as an open sewer
for the benefit of subdivision developers. It was created prily for the drain-
age of farm land.
The Chicago Sunday Tribune of September 26, 1957, two months after our king-sized
flood of that year, carried a story on the Weller creek problem. Part of that
story -read: "Aribert F. Wild, Palatine Attorney for the drainage district ---
laid part of the blame for flooding of the Creek on subdividers in the area. 'The
district is now out to eradicate certain deficiencies and damage caused by sub-
dividers in the area,' he said. Urbanization of the general area served by Weller
Creek, which at the time the district wax created was mostly farm land, has
created new problems, Wild said. 'The Subdividers are not doing their job,' he
said. Wild explained that some subdividers in the Des Plaines area have not pro-
vided adequate drainage facilities within their subdivisions."
Mr. Mayor and Aldermen, the Sewer Committee and the Flood Control Committee,
with the assistance of the City Engineer and the Superintendent of Public Works,
and perhaps the cooperation of•the developers, may be able to agree on amore
definite and realistic handling of the surface drainage and storm -water problem
than that touched upon in.the report of the Plan Commission, and I therefore,
move that the plat and the Plan Commission report be referred to these Committees
for consideration and recommendation."
On a motion by Alderman McKay and seconded by Dunlap, the Cduncil concurred in
the report and plat of the High Ridge Knolls Subdivision , and the Plan Commission
report be referred to the Municipal Development, Flood Control and Sewer Committees.
ARTHUR HINTZ TO F.B,I, SCHOOL The motion was made by Alderman Tures'and seconded
. by Rateike to advance a check for $950.00 to Arthur Hintz for attending F.B.I.
School in Washington D. C. The Mayor put the question and the Deputy Clerk called
the roll with the following results: Ayes:.Alderman Rateike, Dunlap, Tures, -
Wright, Neff, Wexler, Figard, Prickett, Tistle, Massman, Bell and McKay. Nays:
None. The Mayor declared the motion was carried.
Due to an error in date' bids for remodeling the City Hall will be readvertised for,

SPRAYING BID TO CLARK OUTDOOR SPRAYING. The motion was made by Alderman Dunlap
and seconded by Neff toward the Tree Spraying bid to'Clark Outdoor Spraying for
$.87.per gallon. The Mayor put the quewtion and the Deputy Clerk called the
roll'with the following:results: Ayes: Alderman Rateike, Dunlap, Tures, Wright,
Neff, Wexler, Figard, Prickett, Tistle, Massman, Bell and McKay. Nays: None.

TRAFFIC JSURVEY CONTRACT ACCEPTED.', The motion was made by Alderman McKay and seconded
by Dunlap to accept G.W. Barton and Associated traffic survey contract be
accepted and for,the City Clerk and Mayor to sign same. The Mayor put the question
and the Deputy Clerk called the roll with the following results: Ayes: Alderman

TRAFFIC CONTROL MAINTENANCE TO H -H ELECTRIC FOR SIX MONTHS TRIAL,. The motion was
made by Alderman McKay and seconded by Dunlap to award the Traffic Control main-
tenance bid to the H -H Electric Company for $63.75 per month or $765.00 per year,
on a six month basis and if satisfactory to a xtend for another six months. The
Mayor put the question and the Deputy Clerk called the roll with the following results.

by Alderman McKay and seconded by Bell, the Council concurred in the resolution
to the State for pedestrian controlled traffic signal on Miner Street at Rand
Park, from Motor Fuel Tax money.

RESQLUTION C'Sa19 WIDENING WHITE STREET FROM OAKTON TO EVERETT STREETS. On a
motion'by Alderman McKay and seconded by Tistle, the Council approved resolution
to State for CS -39 widening White Street from Oakton to Everett Streets.
Alderman; McKay's complaint on bus service in Cumberland Terrace was referred
to License and.Inspection Committee, notify Alderman Bell and McKay for
meeting.
REPAIR TO WELL #4 The motion was made by Alderman tures and seconded by Wright,

GAIL TO ORDER The meeting was called to order by the Mayor Behrel who

APPROVAL OF MINUTES The motion was made by Alderman Prickett and seconded by
Callaghan to approve the minutes of March 2, 1959. The motion was voted upon
by acclamation.
OFFICIAL; REPORTS The Clerk submitted the reports of the Treasurer and Clerk for
February.
Attorney Dowd reported that the United Motor Coach fare increase will take effect
March 29th if no protest is filed with the Illinois Commerce Commission. The
