12/05/19771 1 236 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, CIVIC CENTER, MONDAY, December 5, 1977 CALL TO ORDER: The regular meeting of the City Council. of the City of Des Plaines was called to order by Mayor Herbert H. Volberding at 8:10 P.M. in the Council Chambers, Des Plaines Civic Center. ROLL CALL: Roll Call indicated the following aldermen present: Koplos, Sullivan, Kehe, Ensign, Leer, Brannigan, Kisslinger, Birchfield, Erbach, Kraves, Sarlo, Meyer, Seitz, Abrams, Ward. Alderman Szabo arrived during the Prayer. Also present were: City Treasurer Swanson, City Comptroller Blietz, Commissioner of Public Works Schwab, City Engineer Bowen, Director of Zoning and Planning Richardson, Acting Building Commissioner Trost, Deputy Fire Chief Clark, Police Chief Hintz, Health Director Branding, Environmental Officer Lindahl, and City Attorney Hug. PRAYER AND PLEDGE MINUTES: BILLS PAYABLE REVENUE SHARING Des Plaines Park District POLICE DEPT. RULES AND REGULATIONS ZONING CASE 77 -57 -SU 795 W. Golf ZONING CASE 77-62-V 368 Hawthorne The meeting opened with prayer by Deaconess Betty Havey of Immanuel Lutheran Church, followed by the Pledge of Allegiance to the flag. Moved by Kraves, seconded by Sarlo, that the Minutes of the regular meeting held November 21, 1977, be approved as published. Motion declared carried. Moved by Ward, seconded by Seitz, to adopt the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. Total, $196,609.37. Moved by Ward, seconded by Seitz, to adopt the recommendation of Finance and Insurance Committee to re -affirm the City's committment to Des Plaines Park District to share $8,000 of Revenue Sharing Funds for partial payment of lighting at Rand Park. Moved by Kehe, seconded by Sarlo, to adopt the recommendation of Police Committee to approve the amendments and additions to Des Plaines Police Department Rules having to do with providing an official form for the purpose of filing charges under the disciplinary section and provide a rule regarding impartiality. Motion declared carried. Moved by Szabo, seconded by Meyer, to adopt the recommendation of Municipal Development Committee to concur with Zoning Board of Appeals in Case 77 -57 -SU, property located at 795 W. Golf to grant special use, City Attorney to draft ordinance for further consideration. Motion declared carried. Moved by Szabo, seconded by Koplos, to adopt the recommendation of Municipal Development Committee to concur with Zoning Board of Appeals in Case 77-62-V, granting variation at 368 Hawthorne City Attorney to draft ordinance for further consideration. Motion declared carried. Mayor Volberding abstained from voting as his relationship to the property owner in the sale of property was previous to his holding the Office of Mayor. Moved by Sarlo, seconded by Brannigan, to adopt the recom- mendation of Streets and Traffic Committee to not install three-way stop signs at the intersection of Illinois and Prospect, as requested by Alderman Kraves. Moved by Szabo, seconded by Koplos, to adopt Ordinance Z-29-77, AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF DES PLAINES, ILLINOIS, CASE NO. 77-49-R, rezoning property located at 1442-1444 Rand Road to C-2 Commercial District. Upon roll call, the vote was: AYES: - 17 - Koplos, Szabo, Sullivan, Kehe, Ensign, Leer, Brannigan, Kisslinger, Birchfield, Erbach, Kraves, Sarlo, Meyer, Seitz, Abrams, Ward, Mayor Volberding NAYS: 0 - None ABSENT: 0 - None Motion declared carried. Moved by Koplos, seconded by Seitz, to adopt Ordinance Z-30-77 AN ORDINANCE AMENDING SECTION 4.1.2 OF THE DES PLAINES ZONING ORDINANCE HAVING TO DO WITH USE REGULATIONS IN THE C-1 NEIGHBORHOOD SHOPPING DISTRICT BY ADDING THERETO SECTION 4.1.2.28 AUTHORIZING SCHOOLS OF DANCING. Moved by Meyer, seconded by Koplos, that the matter of allegations made by officers of the CCPA and its handling by the Mayor and Police Chief be assigned to the Police and City Code and Judiciary Committee for public hearing, at which time all persons concerned be ordered to appear. Moved by Meyer, seconded by Seitz, to waive First Reading and place on passage Ordinance T-21-77, AN ORDINANCE AMENDING SECTION 10-5-5 (E) OF THE CITY CODE HAVING TO DO WITH RESTRICTED PARKING BY PROHIBITING PARKING ON EITHER SIDE OF ARDMORE ROAD FROM DRAKE LANE TO STONE STREET BETWEEN THE HOURS OF 8:00 A M. to 10:00 A. HINTZ AND LIEUTENANT JAMES ROEL. Motion declared carried. The letter from Director of Zoning and Planning Richardson re the city's participation in Community Development Block Grant funds was referred to Health and Welfare Committee. The liquor license applications of Colonial Coffee Shop, 638 Algonquin Road and Pesche's Inc., 170 River Road, were referred to License and Inspection Committee. The letter from City Attorney regarding the city's Business Regulation ordinance as it relates to insurance companies was referred to License and Inspection Committee PARKING TICKET Letter from City Attorney Hug regarding present City Code FINES concerning parking ticket fines and the collection thereof was referred to License and Inspection Committee. Beautification Letter from Missy Boho regarding suggestion for the HHB Plaza beautification of the Herbert H. The lease of Congressman Mikva for office space, expiring January 3, 1978, was referred to Public Buildings, Grounds and Parking Lots Committee Mayor Volberding's recommendation to provide ten or twelve parking spaces in Lot 4 for the Cook County Circuit Court employees as a temporary measure was referred to Public Buildings, Grounds and Parking Lots Committee. The objection to Sandras Resubdivision, at 970 North filed by Homer Mattingly was referred to the Municipal Development Committee.
